[h=1]Law panel to Modi Govt: Bribery for 'good intention' should not be considered a crime[/h] New Delhi, Feb 17: Prime Minister Narendra Modi, throughout his electioneering, sought votes to curb widespread corruption and bribery in the government offices, but if reports are to be believed then Law Commission has come up with a recommendation that might promote bribery. Bribery to be legalised in India? As per reports, suggesting amendments in the Prevention of Corruption Amendment Bill, 2013, the Law Commission wants to decriminalisation of bribery 'if taken for a right cause'. That means, the law panel has suggested the government to not to penalise a government employee if he is caught seeking bribe for a good cause. For this, the panel has come up with a justification that Indian employees do not seek bribe only for their personal interests, infact bribe here is taken to get some of the work done on time. If this recommendation is accepted then only those public servants would be punished who misused their office by taking bribe. It must be noted that taking money or favours to get the work done is legal in several countries, there it is termed as 'facilitation fee'. A person is free to pay some extra money to get his/her work done quickly. With India bidding big ticket investments, the Law Commission, last week, recommended mandatory norms by government for commercial organisations to prevent bribery. Recommending amendments to the bill, the law panel proposed introducing a "statutory obligation" on the government to publish guidance about the procedures that commercial organisations can take to put in place "adequate systems" to prevent bribery to public servants. It said in Section 9, a new sub-clause can be added to make it clear that "the central government shall prescribe and publish guidelines about the adequate procedures, which can be put in place by commercial organisations to prevent persons associated with them from bribing any person, being or expecting to be, a public servant". It said the guidelines shall be prescribed and published by the Centre "after following a consultation process in which the views of all the interested stakeholders are obtained". Section 10 of the bill pending in the Rajya Sabha extends the liability of the commercial organisation to every person who is in charge of and is responsible to the organisation for the conduct of its business through a deeming provision. The panel in its latest report submitted to the Law Ministry has also recommended amending Section 10. The revised Section 10 now states that if an offence by a commercial organisation is proved to have been committed with the consent or connivance of any director, manager, secretary or other officer of the commercial organisation, then such person shall be guilty of the offence and will be liable to be proceeded against and punishable with imprisonment which shall not be less than three years but which may extend to seven years. [h=1]HC directs DVAC to upload its crime manual on its website[/h] The Madras High Court bench here has directed the Directorate of Vigilance and Anti-Corruption to upload its crime manual on its website within six weeks, rejecing DVAC's contention that it was a privileged document and could not be made public. The manual should contain details about Government instructions and guidelines to investigating officers relating to corruption cases, Justice M Sathyanarayanan said in his order said yesterday on a batch of petitions filed by some public servants who wanted to prove that the investigating officer in the corruption case against them had not followed procedures prescribed under the manual. The DVAC had refused to issue a copy of the manual to them, following which they moved the High Court. The counsel for the petitioners submitted that the DVAC could not insist on keeping the manual secret much to the disadvantage of the accused, who required it desperately to establish their innocence during the course of trial. The judge said the DVAC was not entitled to claim that it was a privileged document and could not be made public. "We are in the era of Right to Information Act and especially when the Central Bureau of Investigation itself had hosted its crime manual on its website, why can't the DVAC do the same", he asked. The State Information Commission had directed the DVAC on November 28,2011 to furnish a copy of the manual to an RTI applicant. Justice D Hariparanthaman had then dismissed the petition against the Commission's order in December 2012 and upheld the Information Commission's order. The judge pointed out that G Rajagopalan, counsel for Tamil Nadu Information Commission, had also submitted that the manual was not exempted from disclosure.     Reported by Amit Choudhary in Timesofindia.indiatimes.com on Jan 22, 2015 Online babu-bashing no crime, SC says - The Times of India The Supreme Court has yet again come to the rescue of common people who give vent to their anguish against official apathy on social networking sites as it said such adverse comments were not a crime under the law. Saving a Bengaluru-based couple from criminal prosecution for posting adverse comments against the police on the Bangalore Police Facebook page, the court ruled that it was a public forum and a commoner had every right to give vent to his feelings. The court quashed criminal proceedings against the couple which had accused a police officer of misbehaviour. Upset at the Facebook comment, the police officer lodged an FIR against the couple for offences of criminal intimidation and assault aimed at preventing him from discharging his duty. Unimpressed by the police's argument justifying filing of the case, a bench of Justices V Gopala Gowda and R Banumathi said mere expression of any word without any intention to cause alarm would not be sufficient to slap charges of criminal intimidation. It said there was also no intention on the part of the couple to obstruct the officer from discharging his duty. "As far as the comments posted on Facebook are concerned, it appears that it is a public forum meant for helping the public and the act of appellants posting a comment on Facebook may not attract ingredients of criminal intimidation in Section 503 IPC," the court said. The couple contended that the Facebook page of Bengaluru traffic police was a public forum meant for citizens to discuss and post their grievances and it could not be prosecuted for posting comments against the officer for his misbehavior. "As noted earlier, the page created by the traffic police on Facebook was a forum for the public to put forth their grievances. In our considered view, the appellants might have posted the comment online under the bona fide belief that it was within the permissible limits. As discussed earlier, even going by the uncontroverted allegations in the FIR, in our view, none of the ingredients of the alleged offences are satisfied," it said. Accepting the couple's submission, the bench quashed the FIR filed against them. "We are of the view that in the facts and circumstances of the case, it would be unjust to allow the process of the court to be continued against the appellants and consequently the order of the high court is liable to be set aside," the court said. The couple, Manik Taneja and wife Sakshi Jawa, met with an accident in June last year when their car collided with an auto. They were taken to police station where an officer allegedly misbehaved and threatened them. Aggrieved at the manner in which they were treated, the couple posted comments on the Bangalore traffic police's Facebook page, accusing the officer of misbehaviour. The officer lodged a complaint. The couple then approached the Karnataka High Court which refused to quash the FIR.

  8. Under RTI to the PIO , whether can I ask about a Govt. Servant Past criminal history, any pending criminal cases, or disciplinary action is pending ,has he appeared with respect to any criminal court case as a witness or has he attending a criminal court case as a witness. After asking this under RTI, If any case if it is not there , whether will he file a defamation case against RTI applicant.

The CIC has directed CBI to disclose photos taken at the crime scene and stated that just disclosing photos cannot hamper the process of investigation - specially since PIO/FAA have not given any reasons as to how such information can hamper the process of investigation or prosecution. Full order is attached to this post. We have carefully considered the facts of the case. The only information which remains to be disclosed in this case is the set of photographs taken by the team when they visited the site for reconstruction of the crime scene. Neither the CPIO nor the Appellate Authority has given any conclusive or convincing reasons why he thinks that the disclosure of the photographs would impede the process prosecution. We find it very difficult to imagine how the disclosure of the photographs taken at the site by the team can have any adverse effect on any prosecution. After all, the photographs would only reveal what had happened at the time these were taken by the team. Therefore, we cannot agree with the findings of the Appellate Authority that the photographs should not be disclosed. Photos taken at crime scene can be disclosed.pdf

Madurai district and city police differ on RTI plea Reported by Mohamed Imranullah S. in thehindu.com on Jan 6,2013 The Hindu : Cities / Madurai : Madurai district and city police differ on RTI plea While the Madurai district police provided the information sought , the city police refused to comply, claiming that such information was exempted from public disclosure Here is a classical case of the left hand not knowing what the right hand is doing. The Madurai District Police contradicted the Madurai City Police while responding to an identical query made by an applicant under the Right to Information Act, 2005. T. Wins, a lawyer practising in the Madras High Court Bench here, had filed the two RTI applications to the Public Information Officers (PIO) at the office of the Madurai Superintendent of Police as well as the office of the Commissioner of Police, Madurai city. The applicant wanted to know the number of accused identified so far in criminal cases registered since 2009, the number of those who had been arrested, whether any of them had been detained under the Goondas Act, and the number of charge sheets filed in the last four years. While the Madurai district police provided the information sought , the city police refused to comply, claiming that such information was exempted from public disclosure under Section 8 of the RTI Act. R. Gandhi, an advocate, remarked that PIOs often give ingenious reasons for denying information. Therefore, it becomes necessary for the applicants tooutsmart the information providers. He pointed out that Section 8 of the Act lists out various grounds under which information could be denied. As per Section 8(1)(a), information could be denied if it prejudicially affected the sovereignty or integrity or security of the nation.. Similarly, Section 8(1)(b) prevents the disclosure of information prohibited by a court of law. But the PIO of the Madurai City police had conveniently failed to mention under which sub-clause of the section the information sought by Mr. Wins fits in. "The only inference that we could make is that the figures could have been denied under Section 8(1)(h) which prohibits disclosure of information that would impede the process of investigation or apprehension or prosecution of offenders. "Even if we assume that the information was denied under Section 8(1)(h), I do not understand how the disclosure of the number of accused arrested so far and the number of them detained under Goondas Act would hamper the investigation in their cases," the advocate pointed out. S. Sampath, an RTI activist, felt that it was necessary to ensure that PIOs disclosed information at the first instance without making the applicants undergo the hardship of filing appeals before the higher authorities and then to the information commissions.

No list of cops with criminal background Reported by thehindu.com on Jan 2,2013 The Hindu : Today's Paper News : No list of cops with criminal background The State Police Headquarters (PHQ) has not prepared or maintained a list of police officers with a criminal background, according to a reply from the State Public Information Officer to a Right To Information (RTI) plea submitted by S. Sreejith, Deputy Inspector General of Police (Training). Mr. Sreejith had submitted the application in August last, citing media reports that said his name was included in a list of officers with criminal background and sought to know under the RTI Act whether such a list was being maintained by the PHQ. The reply from the State PIO came early last month, stating that there was no such list being prepared or maintained at the PHQ. In another response to his letter, Mr. Sreejith was informed by the Chief Secretary that his name was not included in the list of officers with criminal antecedents but was included only in a list of officers against whom vigilance cases had been registered. The said case was registered against him before the Court of Enquiry Commissioner and Special Judge, Thrissur on the basis of a complaint filed by one Ramesh Nambiar.

Is the PIO Lok Sabha and Rajya Sabha bound to give this information ? Should the application be made to Election Commision ? Can I know if some one of our members has already sought this type of information and succeded or failed ?
  15. Dear sir My father bought 50 nos. of SBI equity shares @ Rs.100 on 25.02.94, in the following names : 1. S.R.Ghosh 2. Pratima Ghosh 3. Subhashis Ghosh Now, at December,2009, we applied for transfer this to S.R. Ghosh's demat a/c. But, the form was filled up by the share broker named Amit Vyas and signed by my father S.R.Ghosh. So we were not aware in which name he transferred the shares. Till date we have not got those shares in our account. We need the detail updated information about the folio no. SB 1258537 to launch FIR and legal action against that share broker named Amit Vyas.     Criminal Charges

    Dear sir/madam, My uncle has been under police interrogation (crime branch) since 24 hours asking for a theft case, which he is not part of it. He is running a finance in a small town near Trichy. A thief has informed crime branch that he gave a stolen jewel to my uncle. (which is not true). Now we are clueless what to do, as crime branch told that we can launch a case against them but this is possible only after we give the jewel or equivalent money to police. My questions/help/queries are, Can a crime branch police held any innocents without making any official records or without having any potential evidence other than a statement from a thief. Do we need to pay the amount for which we have been held, before we ask for bail or ask them to free my uncle. We are totally clueless and confused. We never came across a situation like this. Please help us to understand the process. If any of the statements are not proper, please forgive me. I need help from you experts, please. Regards Sinna

As reported in indianexpress.com on 19 July 2010: Delhi Police, MCD top list of most corrupt depts Delhi Police, MCD top list of most corrupt depts The two departments which have the maximum interface with the public, are also the most corrupt, according to the number of corruption cases filed by Delhi's Anti Corruption Branch (ACB) in the last three years. Delhi Police tops the list of government departments against whom the ACB has filed corruption cases, followed by the Municipal Corporation of Delhi(MCD). As many as 59 cases were filed against Delhi Police personnel followed by 27 against MCD employees. In all, as many as 300 Delhi government officials have been charged with involvement in corrupt activities between 2007 and 2010, the ACB said in reply to a Right to Information query by Ashwini Shrivastava. While officer at the level of inspector is the senior-most police officer charged with corruption, the other officers, including those from the MCD include commissioners, executive engineers, junior engineers, and senior clerks among others. According to the ACB, 57 cases were registered against 80 employees in 2007, 45 each in 2008 and 2009 against 122 and 64 officers respectively. Out of the 22 cases registered till May this year, ten were against Delhi Police officials, three against MCD employees and six against employees of other departments of the Delhi Government. Asked to comment on alleged instances of corruption detected by the ACB, the Delhi Police's Joint Commissioner (Vigilance) N Dilip Kumar said "We regularly organise vigilance checks in the department and act strictly on any complaints regarding involvement of any officials in corrupt practices. "Recently, we had carried out sting operations to nail corrupt police officials," he added. Asked about corruption in the MCD, its spokesman Deep Mathur remarked: "We have introduced e-governance in our departments to discourage corruption."

  23. A false hit and run case has been registered against me under IPC 279. The complainant is interested for compromise in criminal case. I would like to know the consequences of the compromise. Would a compromise mean that I have committed the crime? Would the records of Police reflect me as a criminal? If a compromise is made, what would be its effect on the ongoing civil case against me which is on the verge of conclusion (only three or four dates remaining). I was and I am having a valid driving license and insurance policy since the date of accident reported by complainant. I would specifically like to know that whether I would be having any difficulties in getting the VISA (after making compromise) in case it is required in future? Can I apply for this kind of information under RTI act? If yes could anyone confirm the complete procedure for the same?
