  1. Dear Sir,Madam, We have got our house registered in the month of May 2017. Within a weeks time we have seen that the -"Encumbrance certificate" has our apartment name misspelled. We have approached the SRO Gandipet(Telangana) for rectification and have given a rectification request in writing and the Sub Registrar has suggested she will get it corrected in next 15 days. It has been more than 45 days, but it has not yet been done- even after multiple followups. Requesting your suggestion and guidance on 1. Can I raise RTI to get this correction done? 2. If yes, can you please guide be through the category under which it has to be raised and where can I raise it. Thank you
  2. Delhi Government 38 Departments are allowing Ping Pong with RTI Applications, claims the RTI Applicant. A senior Citizen RTI Application asking for handicapped pension for his wife was transferred to 29 Public Information Officers (PIOs). Among those authorities, some of them transferred the application to each other. The issue is in fact, multiple transfers of the RTI application from CM office to a number of PIOs, spending huge amount of money on the correspondence and yielding nothing. Can Govt spend public money on such purposeless transfers? There appears to be a serious governance crisis as the appellant and the citizens similarly placed, are not getting any information under the RTI Act from Delhi Government, noted CIC. Applicant stated that "When the question was nonpayment of pension, it is supposed to be decided by the office of the CM, and it cannot simply shirk its responsibility by transferring the RTI application to the MCD". Ping Pong with RTI Application The Commission finds larger public interest in the RTI request filed by the appellant. It is a major human rights problem for lakhs of pensioners who are found eligible to receive pension according to the Govt schemes and are not getting the pension. The appellant in this case questioned how the government could permit its 38 departments to spend money in transferring his RTI application and build up a huge file of papers. Is there no financial crunch for such activity? He also questioned that the Govt representatives attending the hearings in 1st/2nd appeals, are using the govt vehicles or private taxies paid by office, for which funds are available. When the government does not release the funds for payment of pension, how can the civic bodies and the departments can give any information on nonpayment of pension? The CMO should have replied the appellant that they are not in a position to release the funds and that they cannot pay pension. Instead they have transferred to various departments without leading to disclosure of any information. The Commission, therefore, directed the CMO to furnish a white paper on the status of all kinds of pensions in Delhi Government, reasons for nonpayment, time of resumption of payment of pension, time of payment of arrears, etc within 20 days from the date of receipt of this order. If the information asked under RTI is available after the reply to RTI, the PIO should not wait for the second appeal to happen to give those documents, instead it should be provided to the RTI applicant immediately. The PIO has earlier furnished incomplete reply due to unavailability of the documents. However, subsequently he had the documents, but did not give to the RTI applicant for approximately a year. Instead it waited for the second appeal hearing at CIC for more than a year and then produced the documents in front of the CIC. If you have any question regarding RTI, please post at our forum here! Central Information Commission directed the PIO that he should not wait until he receives the hearing notice from the commission. The commission directed the PIO to stick to this principle that as and when he is able to collect the information sought by the applicant, it should be provided to the applicant immediately. Don't wait for the hearing Notice from CIC Earlier the applicant has filed RTI asking for copies of various orders issued by the respondent authority in 1997 and 1998 regarding recruitment of TGTs along with copies of panel of selected TGTs in 1997­98 and related details, etc. Claiming that the respondent authority i.e Directorate of Education Old Secretariat, GNCTD has not furnished complete information, the appellant filed 2nd appeal before the Commission. The respondent authority submitted that the information sought by the appellant was not available at the time of his RTI application. Now that the complete information is available, the respondent authority has presented a full set of information to the appellant during hearing, who has acknowledged the same.     aadhaar card delay

    I have enrolled on 10/04/2015 along with my wife, now aadhar number is generated for her but my status in portal is still under process.   8. Hello, I m a student of M.Sc Final Year Examination , Generally the exam was held in the month of " June " every year , but the results are published around " March or April " Of Next Year. And this excessive delay of " 7 to 8 "months for publishing results is very harmful for student. Because they Neither able to join in any higher course on the same consecutive year , nor able to apply for a job of post graduate level . So in broad way, we can say , there is complete waste of one year , due to the delay of publishing result. So therefore , what may be key points to discuss & write in RTI application ?

Hello, I have sent two RTI Applications under sec 6(1) seeking 9 information pertains to Annamalai University Annamalai Nagar to the PIO Higher Education Dept, Govt of Tamil Nadu, chennai-9 and Annamlai University , Annamalai Nagar on 03-03-2015. But, the PIO Higher Education Dept, Govt of Tamil Nadu has sent reply only on 07-04-2015 stating that the petition has been forwarded to PIO Annamalai University for furnishing the information to me. Further, I have not received any response from the PIO Annamalai University. As per rules in force Sec 6(3) , the PIO has to forward the application to the concerned PIO atleast before 12-03-2015( within 5 days). But, it was not followed by the PIO. I may kindly be clarified the followings:- 1. Can I apply for First appeal to FAA, Annamalai University based on my RTI application dt 3-3-15 since no reply has been received. 2. Can I send complaint letter to FAA, Higher Education Dept, Govt of Tamil Nadu Chennai-9 to take action against P I O for delay in simply forwarding the application to concerned PIO.   11. I had filed an application at RPO Ahmedabad on 1st Jan (Been 3 months now). Constant visits with no results have now forced me to resort to stricter means than just following up with the department. Kindly advise how can RTI help me.
  12. I want compensation for the delay in Possession of my Plot in EMAAR MGF : sector ____ as per the Buyers Agreement. According to the Company, they have made the possession as per the terms and conditions of the Buyer's Agreement, as the Company is required to offer possession of a unit subsequent to laying of services on the same which includes water and sewer lines, electrification and road work. Since these services were laid on your unit, possession of same was offered to me in 2010 which was within the timeframe stipulated in the Buyer's Agreement. Hence, the compensation clause does not stand applicable Contention : I have been regularly visiting the site and bringing all the shortcomings to your notice and also provided photographic evidence of the same. Even when I visited the site in mid Aug 2013, I found that all the basic amenities had not been completed and the same along-with photographic evidence was brought to your teams notice. Thereafter vide Emaar MGF e-mail dated 22nd August 2013 (copy of mail reproduced below for your ready reference) they have clearly admitted that Emaar MGF had just initiated the process of installation of Sewage Treatment Plant (STP) and transformers in the sector. Also necessary works on the water tanks and rain water harvesting system has already been completed. The Company is expediting the completion of overall development across all sectors to make the place habitable and we shall keep you updated on the status at regular intervals. Even during my last visit in the 31st March, 2014 around 10:45 AM - pics shared to them the road to my plot was not ready and was not ready and made of pebbles. A mail to this effect was also sent and post that the road was made. In view of the foregoing it is very clear that the plot and other basic amenities were only ready by end of 2014 and the offer letter for taking possession of the plot was made. Thus I am clearly entitled to claim penalty for late possession as per the Builder-Buyer Agreement. Kindly advise

  14. Anger and frustration is on the rise over inordinate delays by the Central Information Commission in responding to or inquiring into complaints from RTI appellants. Revathi Siva Kumar looks at what ails the institution. Even as the Right to Information (RTI) Act turns nine, charges of tardy, ‘half’ or ‘zero’ decisions taken by its authorities are kicking high. R K Jain, an activist and Convenor of Legal Aid, a private group that helps people with problems over RTI, points out that ironically, even petitions against delays are delayed! According to advocates in the group, about 25,000 decisions have been held back by the Central Information Commission (CIC). This body was set up under the RTI Act in 2005, and is required to inquire into complaints from anyone who is unable to submit requests to Central or State Public Information Officers, or has been refused access to information under the Act. The CIC must also receive and inquire into complaints from anyone who has not been given a response to a request for information or access to information within the time limit specified under the RTI Act. Yet, many decisions have been delayed by the CIC itself after receipt of such complaints. Some appeals have still not been examined! A study of some of the applications made by Jain to the CIC reveals some interesting details pertaining to the “malfunctioning” of the RTI. In one of his appeals, he alleges that the concerned official “has deliberately and malafidely provided incomplete, incorrect and misleading information.” In another application, he writes that “there seems to be an arrangement to scuttle complaints and representations in CIC.” According to him, the appeals do not even seem to have been forwarded to the relevant people.

But the Act has allegedly become an eyewash only as information sought under the Act is denied to the seeker for months together. A certain journalist had sought some information on the National Highway (four-lane construction at Naduar) by submitting an application to the Sonitpur DC on September 12, 2014. [h=1]A Rs. 58-crore terminal delay[/h] The delay in the construction of new domestic and international terminals of the Chennai airport had resulted in a cost escalation of over Rs. 58 crores, according to a reply from Airports Authority of India to (AAI) an RTI query. AAI has admitted to the delay and said it had paid this sum to the contractors — Herve Pomerleau International (HPI) and Consolidated Construction Consortium Limited (CCCL) — who executed this project as a joint venture. To the query, AAI responded: “Escalation cost as per agreement clause was paid to M/s. HPI-CCCL (JV) for the work of construction of both terminals for an amount of Rs. 58.50 crore. Since the delay is not because of the contractor no penalty to be imposed.” “It took us time to acquire land for the international terminal from the defence department. This was one of the primary reasons for the delay in the construction and commissioning of the terminals,” an official said. In 2013, a government audit noted there was a loss of interest of Rs. 48 crore due to the delay in the commissioning of the new international terminal. Also, there was a loss of revenue of Rs. 37 crore due to the delay in the construction of both terminals. The Rs. 2,300-crore Chennai airport expansion project started in October 2008 with a deadline of January 2011. But it was only two years after the deadline, in January 2013, that both terminals were inaugurated. The terminals have run into several construction-related problems over the past two years, including breaking of glass panels and collapse of parts of the false ceiling. More recently, the state of maintenance of the airport also came under fire, after Union Aviation Minister Ashok Gajapathi Raju’s team came for a surprise inspection, and found the state of toilets deplorable. My father got retired in May 2013 and still he is being delayed for the pension. At first the staff told that his record book was incomplete.     Delay in PF Claim Amount.

Delhi Metro Rail Corporation are under legal obligation to provide complete list of incidences when Delhi Metro trains services are halted due to technical snag or due to other reasons on all routs/ lines, along with duration of halt and service, free of cost rules CIC.
