Dear EsteemedMembers of this August Forum, In a series of decisions received today, the Hon’ble SIC Maj Gen Kundu , State InformationCommissioner, Haryana, has issued show cause notices in the undersigned appealnumber 1048 of 2015 titled Harinder Dhingra vs Joint Excise Taxation Commissioner , Gurgaon &others to DETC (PGT), Gurgaon asking besides providing information, as to whyRs 25000/-penalty be not be imposed on each of them for not providing theinformation and also directed the JETC, Gurgaon to investigate the non-receiptof undersigned RTI application duly transferred by their other office on05.08.2014 by the SPIO cum DETC (West) and take appropriate action against erring officials. 2) In another case heard on 19th March 2015, the Hon’ble SIC Maj Gen Kundu, State Information Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1024 of 2015 titled Harinder Dhingra vs Joint Excise TaxationCommissioner , Gurgaon & others to Mr. Dilbagh Singh then DETC (west), Gurgaon , Ms Gitanjali Mor &Ms.Sunila Singh the then DETC (PGT), Gurgaon asking as to why Rs 25000/-penaltybe not be imposed on each of them for not providing the information and also directedto provide the information within three weeks of receipt of this order. All thethree officers have been asked to be present personally before StateInformation Commission on 25.05.2015. 3) In another case heard on 19th March 2015, the Hon’ble SIC Maj Gen Kundu , StateInformation Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1046 of 2015 titled Harinder Dhingra vs Joint Excise TaxationCommissioner , Gurgaon & others to, Mr. Kuldip Malik the then DETC (East),Gurgaon, Mr. Dilbagh Singh then DETC (West), Gurgaon , Mr. Sunil Kumar,the DETC (West), Gurgaon and the DETC (PGT), Gurgaon asking as to why Rs25000/-penalty be not be imposed on each of them for not providing theinformation and also directed to provide the information within three weeks ofreceipt of this order. All the three officers have been asked to be presentpersonally before State Information Commission on 25.05.2015. 4) In another case heard on 13th March 2015, the Hon’ble SIC Maj Gen Kundu , StateInformation Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1043 of 2015 titled Harinder Dhingra Vs Directorate of Town & Country Planning(Haryana) & others to DTP (Enf),Gurgaon Cum SPIO & Mr. Sanjay Kumarthe then DTP posted at DTCP, Chandigarh asking as to why Rs 25000/-penalty benot be imposed on each of them for not providing the information and alsodirected to provide the information within two weeks of receipt of this order.All the above two officers have been asked to be present personally beforeState Information Commission on 21.05.2015. 5) In another case heard on 13th March 2015, the Hon’ble SIC Maj Gen Kundu , StateInformation Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1028 of 2015 titled Harinder Dhingra Vs Directorate of Town & Country Planning(Haryana) & others to SPIO cum STP,Gurgaon asking as to why Rs 25000/-penalty be not be imposed on him for notproviding the information and also directed to provide the information withintwo weeks of receipt of this order. He is directed to be present personallybefore State Information Commission on 30.04.2015. 6) In another case heard on 13th March 2015, the Hon’ble SIC Maj Gen Kundu , StateInformation Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1023 of 2015 titled Harinder Dhingra Vs Directorate of Town & Country Planning(Haryana) directing the DTCP to updateits data duly catalogued and also put on its web-site the relevant data asenvisaged in Section 4 of RTI Act 2005. 7) In another case heard on 13th March 2015, the Hon’ble SIC Maj Gen Kundu , StateInformation Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1045 of 2015 titled Harinder Dhingra Vs Directorate of Town & Country Planning(Haryana) & others to then SPIO cumDTCP, Chandigarh asking as to why Rs 25000/-penalty be not be imposed on himfor not providing the information and also directed to provide the informationwithin 15 days of receipt of this order. He is directed to be presentpersonally before State Information Commission on 25.05.2015. 8) Inanother case heard on 13th March 2015, the Hon’ble SIC Maj Gen Kundu , StateInformation Commissioner, Haryana, has issued show cause notices in theundersigned appeal number 1028 of 2015 titled Harinder Dhingra Vs Joint Commissioner, Municipal Corporation, Gurgaon& others, to SPIO cum STP, Gurgaon & SPIO cum Executive Engineer, M CGurgaon, asking as to why Rs 25000/-penalty be not be imposed on him for notproviding the information and also directed to provide the information withintwo weeks of receipt of this order. He is directed to be present personallybefore State Information Commission on 21.05.2015. 9) In a major development, a case heard on 05th March 2015, the Hon’ble Mr. P R Meena(IPS), State Information Commissioner, Haryana, has directed the office of SDM(Civil), Gurgaon to computerize the complete record in respect of all RTIapplications and subsequent action taken by SPIO, FAA including orders and complianceof orders of State Information Commission, Haryana. It is a welcome decisionwhich would enable common citizen to make use of already filed RTI with theoffice of SDM, Gurgaon. 10) In another case heard on 16th Feb 2015, the Hon’ble Mr. Shiv Raman Gaur (IAS), State InformationCommissioner, Haryana, has issued show cause notices in the undersigned appealnumber 7004 of 2014 titled HarinderDhingra Vs Deputy Commissioner, Gurgaon & others, to SPIO cum City Magistrate, Gurgaon, Mr. Om Parkash thethen City Magistrate, Gurgaon & Sh. Satinder Dulhan, the then CityMagistrate, Gurgaon, asking as to why Rs 25000/-penalty be not be imposed oneach of them for not providing the information within thirty days as mandatedunder Section 7(1) of RTI Act 2005. All the above three officers have beenasked to be present personally before State Information Commission on01.05.2015. 11) In another case heard on 5th March 2015 by the Hon’ble Madam UrvashiGulati (IAS) State Information Commissioner, Haryana, in case of HarinderDhingra Vs Food & drugs Administration in case number 8690 of 2014 hasdirected the office of Drug Controller (FDA, Govt. of Haryana), Gurgaon toupload the citizen Charter on its web-site. 12) In another case heard on 10th March 2015 bythe Hon’ble Madam Urvashi Gulati (IAS) State Information Commissioner, Haryana,in case number 27 of 2015 titled Harinder Dhingra Vs DCP(HQ) & other,directed the public authority to complete the enquiry of undersigned complaintalleging antedating the reply in the said case by the Gurgaon Police. harinder dhingra

Hello sir/mdm I've applied for mci registration for additional qualification in October last year.till now it is pending.ive mailed to mci many a times,but there's no reply.when ive called & asked about ,mci has sent a query to my college regarding whether my PG seat is a recognized/permitted seat & only when the college replies to it ,my application will be processed. Sir I want to ask how long will it take to reply it back.its the responsibility of both the state & mci to address the issues of recognized /permitted pg seats.its more than 6months & don't know how long further it may take.but there should be some time frame within which the government offices should work. If I don't pay my electricity /water bills..im I allowed to use them soon...similarly there should be a limited time frame within which the common man should get his work done or else the concerned govt official should be penalised
  3. #Lucknow #Uttar Pradesh The Uttar Pradesh State Information Commission (UPSIC) slapped fine on 10 public officials of several state government departments for delaying information under the Right to Information Act (RTI). The commission- the RTI watchdog body of the state- has also recommended departmental action against nine other government officials found guilty for violating the norms laid down in the transparency act.     Municipality Delay

    Hi Expert, I have applied for the Building Plan approval to the Pallavaram Municipality, Chennai, Taminadu. WE have applied this on June , 2008 and still we didnt get any approval. When asked for the reasons, they jus telling that the signing authority is not there and again after 1 week they are asking for the another application for the another internal process. 1. Can we apply RTI for asking them about the delay in the approval process? 2. Can i ask directly regarding my CASE giving them the FILE Number? My parents are afraid that if we ask particularly regarding our case, then they may delay our case further, and we have to go back to them for the future facilities such as water supply and contruction completion certificate etc... so then that time also..... 3. How to pay the money for the application? i am planning to send the application thru registered post with ack. Can i send it thru... DD of 100/-(Since i want the information in CD) or thru. Online Postal Order or thru., Money order which is Better? whether i shoudd accompany the money with application ? Punjab official fined Rs.20250 for delaying info under RTI GURPREET SINGH MEHAK Wednesday, 10 October 2007 FATEHGARH SAHIB: The Punjab State Information Commission has fined an Executive Officer of Rs 20,250 for not providing information under Right to Information Act. Information commissioners R.K. Gupta and P.P.S. Gill imposed fine on Sukhdev Singh, Executive Officer, Municipal Council, Rampura Phul in Bathinda district. Bathinda Deputy Commissioner has been asked to recover the amount from the EO’s salary in four equal monthly equal installments and report compliance on Monday of third week of February, 2008. The case relates to information sought by a lawyer Amandeep Goyal, a resident of Rampura Phul. It was observed by the information commissioners that the complainant has asked for a photocopy of the gazette notification issued by the Punjab Government. It has taken four months for the department in supplying of such a simple information. This does not speak well of the respondent-department. It is also seen that the present incumbent Sukhdev Singh, EO, Municipal Council, Rampura Phul who joined the department on July 3, 2007 has not bothered to appear in person or to deputy any body before the Commission on July 13, August 6 and September 3. The EO finally appeared before the Information Commission on October 1. The Commission took serious view of such negligence on his part and he is, accordingly, fined at the rate of Rs.250 per day from July 13, 2007 to October 1, 2007 subject to a maximum of Rs.25,000 . The commission observed that as far as supply of information is concerned, the case stands disposed of. Now the EO will have to deposit Rs 20,250 as fine for 81 days at the rate of Rs 250 per day. MUMBAI: The Maharashtra Information Commission has imposed a penalty of Rs 25,000 on an official of the Maharashtra Housing and Area Development Board (MHADA) for causing inordinate delay in providing information sought by an RTI applicant. This is the highest fine imposed by the Commission in the state since the RTI Act came into effect last year. Kandivli resident S K Nangia had filed a RTI query with joint chief officer, MHADA in March 2006 asking for details on proposed plans to develop gardens, playgrounds and hawking zones in the Charkop locality of Kandivili (west). Over the last few years, Charkop residents have been fighting for civic amenities that will improve their quality of life. "When the MHADA initiated the Charkop project with the assistance of World Bank in the eighties we were promised amenities like playgrounds, gardens and hawking zones. But today Charkop has become a congested residential suburb," says Nangia who filed the RTI query in March 2005. Instead of implementing the proposed plan, the vacant spaces are now used for dumping garbage and construction debris. Since there are no specified hawkers zones here, the hawkers squat on the road and bylanes and sell vegetables and fruits. "If you go around Charkop you will find open spaces which are today a breeding ground for mosquitoes. In fact, in last year's floods, the entire area was under water because open spaces are being gradually encroached or filled up. For the last 15 years, except for new buildings nothing else has come up here to improve quality of life," he said. MHADA did not respond to Nangia's application forcing him to approach the state Information Commission. Btu even then, the MHADA failed to take note. The housing body's public information officer did not turn up for the hearing on September 26 last year. The Commission then set a second hearing for September 30. "The PIO finally turned up, but he came without relevant papers. The Information Commissioner then gave MHADA seven days to file a reply," Nangia said. MHADA then wrote to Nangia asking for a copy of his RTI application saying it was missing from their records. "When I finally got the reply from MHADA, I sent a complaint to Commission stating that the agency had delayed my query without any reason and they should be penalised. The Information Commission then passed an order in December 27 stating that the seven-month delay "was a mockery of the RTI act." The commission also directed the vice-president and CEO of MHADA to deduct Rs 25,000 from the salary of the Public Information Officer.
