sidmis posted a topic in RTI in MediaHC rejects ex-RAW official’s plea for info under RTI As reported in Indian Express, Fri Jul 02 2010 The Delhi High Court today turned down the plea of a retired Director of Research and Analysis Wing (RAW) seeking direction to the agency to disclose information under the RTI Act. Justice S Muralidhar dismissed the plea of Brig (Retd) Ujjal Dasgupta, a former official of the intelligence agency, who was arrested for allegedly leaking sensitive information to a CIA agent. The court passed the order on a petition of Dasgupta filed against the Centre for not disclosing information about the software ‘Anveshak’ which was crucial to his defence in the espionage case filed against him. Dasgupta, former Director (Computers), RAW, was arrested in 2006 for allegedly violating the Official Secrets Act by passing on sensitive information to an American diplomat Rosanna Minchew. Under the RTI Act, Dasgupta had sought details about the development of ‘Anveshak’, the way it was transferred to RAW -- by floppy disk, CD or pen drive, the agency responsible for installation at the premises of RAW and other such details but the plea was refused by the government agencies. Atul Patankar posted a topic in RTI in MediaAs reported at indopia.in on August 25, 2009 New Delhi, Aug 25 (PTI) The Election Commission today told the Delhi High Court that information pertaining to voting in election cannot be revealed under the RTI Act. The Commission's submission came while challenging the Central Information Commission's order directing it to reveal timing of each poll cast in an election to an information seeker under the transparency law. "Confidentiality of voters have to be protected at any cost. It would be very easy to find out voting pattern if such informations are revealed,"advocate Meenakshi Arora, appearing for the Commission, submitted before Justice Sanjiv Khanna. She said EC has no control over the information stored in the Electronic Voting Machines as it itself cannot access to information without the Court's order."We are under law precluded from having access to the information. We have custody of the machines but we don't have custody of the information containing in the machine,"she said adding the Commission can break the seal of the machines only if an appropriate court directs it.Challenging CIC's order, the Commission contended that it cannot provide the information to information seekers as it did not have control over it. Atul Patankar posted a topic in RTI in MediaAs reported at Indopia.in on July 6, 2009 New Delhi, Jul 6 (PTI) The Delhi High Court today sought an explanation from the CIC over the contradictory orders passed by its Commissioners over revealing information of a confidential report of a government employee under RTI Act. "You have passed contradictory orders on the issue. You have earlier admitted some application and directed to reveal notes of ACR of an employee while some were rejected,"Justice Sanjiv Khanna said while asking the CIC to file its response. The Court passed the order on a petition filed by State Bank of India challenging CIC order asking it to disclose marks alloted to one of its employee in connection with his promotion. The Bank alleged the procedure followed by it for the promotion of an employee is confidential and it cannot be revealed under the transparency law. It pointed out that the order passed by CIC is contrary to its earlier order in which it was held that notes of Annual Confidential Report of an employee can't be disclosed.
