Hello, PIO denied under Sections 8(1)(h) and 8(1)(j) of a copy of letter (and notings on it) written by my boss to Chairman of a Govt of India Department, where in my boss has clearly agreed that he did the assessment of my previous APARs/ACRs under strong influence of his seniors and I was badly undergraded; and he also wrote that such a practice is common to favour or disfavour the employees. I have already filed a case in CAT pertaining to irregularities in assessment of my ACRs, and because of filing the case they malafidely transferred me to a faraway location, hence I had to file another case against the transfer. Recently I had got a copy of my bosses said letter which is written more than six months back, and I have already informed CAT about the said letter by an affidavit. I made the RTI query for the said letter after I filed the affidavit. I WISH TO MAKE FIRST APPEAL TO GET A COPY OF THE SAID LETTER. I shall be grateful for your advice. Best Regards.
  2. Appellant had sought copy of service record of his late father. CPIO denied stating no information is available. The Commission observed that: Denial of information to appellant who is a young boy of 20 years of age study in BSc means denial of employment that again means breach of his right to life under Article 21 of Constitution of India.     I asked information from police regarding certified copies of all complaints received in a police station on a particular area and between particular dates. The pio informed that complaint record is maintained by the name , parentage and complete address of complainant hence denied information. According to section 4(1)a the records here are not properly indexed and computerised. Kindly help me with some citations and your view on this.

I had sought following information from my previous employer who is a nationalized bank I had complained to Ministry of Finance that bank was absorbing shortages and fake notes detected by RBI in Bank's revenue accounts instaed of recovering it from concerned Currency Chest Officer.Bank's CVO replied to Ministry of Finance that amount involved is recovered from concerned officer.As per my knowledge it is false report.Hence,I had sought following information REPLIES OF CPIO ON SEEKING INFORMATION ON Rs.71600 recoveries made from currency chest in charge of Belgaum Main branch as per CVO letter no. 2343/2011-12 dated 15.06.2012 addressed to Central Vigilance Commission/ Ministry of Finance INFORMATION REQUIRED 1. Kindly provide me the certified copy of report submitted by Mr.Setty, the then DGM as referred by CVO in letter no.2343/2011-12 dated 15.06.2012 addressed to CVC CPIO REPLY -The report s contain sensitive information of public money and related dealings held by the bank in fiduciary capacity and cannot be given for inspection 2. Kindly inform me the name of Currency Chest in charge during the period from 2003-2009 CPIO REPLY - Since the sought information is more than five years, you are requested to furnish Rs.300/- as further fee in terms of section7(3) of the Right to Information Act,2005 and as per the Bank’s rules on service charges for disclosing various classes of documents and records. MADURAI: A petition has been filed in the Madurai bench of the Madras high court seeking its intervention to get information under the RTI Act on the appointment of 23 district judges in Tamil Nadu. In his petition, Madurai-based K Kathiresan said he submitted an application to the Madras high court registrar (administration), who is the public information officer (PIO), on November 25 last year seeking the copies of application forms and police verification reports of the 23 district judges (entry level) who were appointed in 2013.     PIOs denial

    If a PIO denied or didnot provide information within time, can it be recorded in his service book?

An electricity consumer complained that somebody has taken power connection in his name and wants to know the documents filed by him in support of application so that he could take action against the responsible people. Based on this power connection, he is claiming a share in the property. First, his wife filed an RTI application but died before getting information. Her husband asked whether any application has been made for new electricity connection on his address, if yes, then the name, address and other details of the applicant and a copy of the application made by the applicant.   8. In my recent RTI application the PIO asked me to deposit Rs. 699/- as photocopy charges which I paid through a bank draft. The PIO then send me the reply of all the questions that I have asked in RTI application. He also mentioned in the letter that he has received the photocopy charges and that the department concerned is being informed to send the photocopies directly to me. When I did not received the photocopies even after one month, I filed my first appeal to FAA. Today when I appeared before the FAA he asked me the proof of my payment for the photocopies. When I told him that I have send a Bank Draft by speed post along with the covering letter (I produced the covering letter) he asked me to prove if that bank draft was actually enclosed with the letter. When I replied that this information can be obtained only from the bank concerned he asked me the counter foil of the Bank Draft !! I was surprised at his question and informed him that a bank draft do not have any counter foil, he told me that I should have deposited the amount at treasury and get a receipt or should prove that the bank draft was actually received by his department. At this point I flashed him the acknowedgement receipt from his own department and he has to agree that his department has received the bank draft. In this case I was fortunate that I had an acknowlegement from the department, but what would have happened had there been no such receipt with me ? How you can prove that you actually sent a bank draft along with your application ? Bank can only prove only if the bank draft has been encashed by the department. What to do if it is not encashed ? A discuss on this matter will help all the mebers.

PATNA: The irony could not have been more pronounced: When this newspaper asked Bihar State Milk Cooperative Federation Ltd (Comfed) MD Harjot Kaur why milk was being sold @ Rs 33 to 43/litre in Bihar and Rs 25/litre to a private dairy at Joya in Moradabad, she banged the phone. When the report got into print on May 29, the MD of Vaishal-Pataliputra Milk Union (VPMU) - one of the milk unions under the cooperative - presumably took it upon himself to deny the report, of which VPMU is only a small part. 'Presumably' because the denial is on plain paper, not on letter head, and the signature is also illegible. It does not have even a letter number. The gist of the three-page denial, which has used terms like 'baseless', 'misleading' and their synonyms at least 36 times, is that the TOI report is bunkum. Kaur, on her part, held a press conference to trash the TOI story. This newspaper was not invited to the presser. We exercised our RTI (right to information) to know who is misleading whom. And according to documents procured under the RTI Act, the state animal husbandry and fisheries department received complaints earlier this year, alleging milk unions under Comfed were sending lakhs of litres of milk to private dairies in Delhi and Moradabad for processing the same as powder. Thus, the milk powder plants, opened by the Bihar government investing crores from the state exchequer, are not being utilized. This causes losses worth crores to the state every month, the complaints alleged and added one private party was selected in violation of tender rules. Friends, Andhra Pradesh Pollution Control Board is diluting the implementation of RTI act by giving incomplete and irrelevant information to applicants and also denying information under 8 d frequently. They are protecting the violators rather than the people who are subjected to pollution from industries. This is my own experience and that of others I know. Hexavalent chromium is a highly toxic poison and strictly regulated all over the world. Here in Andhra Pradesh, industries producing chromium chemicals by outdated technology are generating about 10000 tonnes per annum of waste containing hexavalent chromium that is detrimental to all forms of life. It is being stocked in the plant premises in violation of environmental regulations without proper protections. One plant has stocked about 30000 tonnes in an open area. Hema Chemicals in Ahmedabad, Golden Chemicals in Dahisar, and Tamilnadu chromates in Ranipet have severly polluted the land and groundwater all around their plant. Several workers have died of lung cancer and many had nasal perforations, amputations etc. Exposure of workers to chromium dust is neither monitored nor controlled with industrial hygiene measures. Permissions for operation are issued without proper assessment of the dangers. Recent permission was issued after complaint from several citizens was pending. I have raised a number of questions and sought information and they have not given proper information. I had to continue asking further specific questions that expose the failure of APPCB as a regulatory authority. Now I get a letter saying that the companies have replied requesting the board not to reveal the information/ records to the third party under section 8 (d) of the Right to Information Act, 2005. Now I am giving first appeal. Any specific orders from any state information commission dealing with pollution cases may be brought to my notice for strengthening my appeal. Regards, Babu Rao
  11. There have been several posts on this forum, in the past, about whether the PA/PIO is bound to give information which has to be "created" or "collected". Some decisions of the CIC and SIC's have added confusion to this issue: - information to be given in the form that it is available - diversion of PA's resources to provide the information etc etc etc In a recent decision, due to persuasive arguments of the appellants representative, the CIC ordered that even information that has to be "created" or "collected" must be given to the applicant: http://cic.gov.in/CIC-Orders/Decision_18022008_02.pdf We agree with learned Counsel assisting appellant Ms. Lakshmi Jayashankar’s rejoinder quoted above that none of the grounds decided upon for denying information is valid. Under Rule 4 (a) of the RTI Act (Regulation of Fee & Cost Rules) 2005 which came into force on September 16, 2005 a fee is expected to be charged for each page “created or copied”, which indicates that all information held by or under the control of any public authority is accessible to the public as is covered by the ‘right to information’ defined in sec. 2(j), even when it needs to ‘collected’. This is, of course, subject to the exceptions laid down in sec. 7(1). None of these exemptions includes the kind of exemption the MoEF seeks to foist through its decision of 27.9.06. Therefore, the information sought will now be provided to appellant Shri Karthik Jayashankar within 30 working days from the date of receipt of this Decision Notice. In response to my RTI query, the Public Information Officer has written that "the copy of the report cannot be provided at this stage since the matter is still under process and is treated as subjudice". I am quite sure that the matter is not pending in any court of law. Please see the ambiguous language used by the Public Information Officer. Is this a valid excuse or the Public Information Officer is simply avoiding to provide the copy of the report? It has agreed that the report has been received from the committee. I have also written to the First Appellate Authority (registered post) but the reply came the same day (after 40 days). Do I need to do anything or let the First Appellate Authority decide again and I wait for another 6 weeks before I can write to the CIC?

Except for Section 8 (1)(j) which puts the responsibility on the CPIO/SPIO to decide on disclosure of personal information for public good, for other reasons of denial of information it does not mention at what level can the decision be taken. Are there any guidelines on that? Thanks and Regards
  14. I had send specific questions to the Information officer. I recieved reply stating that "it would take enormously long time to complile for onward transmission". Further, the reply states that I contact a particular person in the related department "who will be able to provide you with the data. He will also be able to give you the necessary staistics ...." I wish to clarify the following 1. whether, this can be considered as DENIAL BY DELAY tactics; 2. whether, the person who is the appointed as Information Officer is supposed to collect and relay the information requested or direct the applicant to another person to seek all the info requested. 3. in this particular case, when I approached the person whom I was refered to, and asked whether he has any instruction regarding giving me the relevant info, he catagorically denied any such communication from the Information Officer. I furnished him, a copy of the reply recd from the Info Officer. HE still insists that he has to get written instructions from the appropriate authorities. CAN YOU HELP ME - is there any section of the RTI which states or prescribes the format of the reply to all the queries raised by the applicant?
  15. In one of the case, the applicant got the reply: The information asked by you is confidential and cannot be supplied. This is with the authority of the competent authority. When I asked weather the one who replied was CPIO, he said no! I want to ask weather the information asked to CPIO be signed by subordinate? And there was no mention as to why the information denied, I believe there there is no confidentiallity except for those coming under secnd schedule? A word of reply would be appreciated, as the person approached me for advice.

    Denial of Promotion

    I am working in an autonomous Institute under MHRD. In 1982, some of my juniors were given promotion based on certain rules. As a result of this they had superseded me. When we made a representation saying that according to the fundamental rules, when a junior person is given higher scale of pay, he cannot supersede his senior. And if this happens, the senior too will have to be given the higher scale. Accordigly, I had got a jump in my paysacle. Later on the management said that what had been given to me (higher scale) is trated as a promotion. They could do this by making a new order saying that any change in scale will be treated as promotion. My doubt is that since the higher scale was given in accordance with the Fundamental Rules, can the management or MHRD make additions to Fundamental Rules ? Can I take-up this matter through RTI ?
