I appealed for help with the Director of Health, Chief Secretary, the Chief District Medical Officer, Pension Secretary and others. Yet there was no change in the scene and hence I filed an RTI to know all details." He adds, "With the help of RTI he came to know that the provisional pension drawn in his name was also faulty. While the department withdrew a sum of Rs 1,200 as provisional pension on my head I only received Rs 735. Information cannot be denied under Sec 7(9) but only provided in another form

The CIC has ruled (like many times in the past - also by courts) that Sec 7(9) cannot be used to deny information. 13. The Commission observes that the CPIO cannot take protection of section 7(9) without any basis thereof. Under Section 7(9) of the RTI Act, the Public Authority can deny information in a particular form but it cannot refuse totally. The said subsection does not provide additional ground for denial of information. If section 7(9) applies to the tontext, the respondent authority has to give information in the same form as available. The Commission, therefore, issues Show Cause Notice to the CPIO for wrongly denying the information by citing Section 7(9) of the RTI Act. His explanation should reach the Commission within 3 weeks from the date of receipt of this order. The FAA is also advised to give speaking order and there should be no ambiguity in the order. 14. The Commission further directs the Public Authority to implement the guidelines issued by the DOPT and upload the RTI questions and responses, first appeals, FAA orders and further information given by the CPIO, if any, after the FAA order, Second appeals, CIC orders and compliance etc on the official website. It should be petitioner/appellant wise, so that when clicked on that name, all this information should be displayed in the website. 15. The PIO denies information with calculatingly incorrect, incomplete, or misleading information or obstructed in any manner in furnishing the true information. information sought (1) pl. provide the copy of registration renewal application of m/s 'x' with all remarks. PIO replied - the information sought is of third party. The TP gives consent not to disclose his information". ( yes, the TP give consent , does it means PIO himself wants so and TP gave consent) hence information not provided mentioning sec.11(1). I have explain in detail that PIO can deny under sec.8 or 9 only. Sec 11(1) is for procedural reference only. At work place it is right of all workmate to know how & on which merit the co worker get appointment, registration, perks, sp. Allowances, promotion, higher grade etc. Now here the registration renewal application is treated as confidential. It simply strengthen doubts that there is something wrong. Any how this isn't confidential information. (2) disciplinary action initiated if any, in proven cases' Earlier through RTI many irregularities & malpractice were uncovered .in those cases if any departmental actions initiated by chief engineer I have sough for that information. The PIO replies - the information sought is not clear' Hear it's conflict of interest. (3) how work order no. ' xxx' placed before paying security deposits. This is violation of guiding principle of GoG. In said work order. The deposit was made after 03 months from work order date. This information was collected through RTI. Even though PIO replies - work order placed only after paying Security deposits. There are 20 points in which false, incorrect, incomplete answer given by PIO. Almost all the issues are of irregularities & misuse of public money. i have sought the information under RTI act 2005. I don't have superscripted clause 24. Is it excuse, for deny ? Hi All, I have a query and would require your guidance for the same. Is RTI Act applicable on all the states and Goverment offices in the same manner. Ex:- I have asked certain information from Mumbai Municipal corporation , kolkata municipal corporation and Delhi municipal corporation. Mumbai municipal corporation provided me the desired information after paying the fees asked by them however the same information was denied by the other two. Now first query is that are they allowed to deny me information when one municipal corporation has already furnished the desired information. Secondly does it make my case stronger during first appeal as I have recieved information from one municipal corporation but denied by other two. -

Mumbai : In a landmark order, the Central Information Commission has ruled that CCTV footage of a public place is in the public domain and cannot be denied to a citizen. The case pertains to Mumbai-based RTI activist Chetan Kothari, who wanted the CCTV footage of the incident when a UCO bank cashier at Bhulabhai Desai Road misbehaved him. “The man ahead of me in the queue got Rs 1,000 in the denomination of Rs ten but when I asked for it, the cashier, Ganpat Dongera, was rude to me,’’ said Kothari. The incident happened on November 3, 2012. Unsatisfied with the action taken by the bank — merely instructing the employee concerned to be polite — Kothari asked for the service record of Dongera as well as the CCTV record of the incident. There have been several posts on this forum, in the past, about whether the PA/PIO is bound to give information which has to be "created" or "collected". Some decisions of the CIC and SIC's have added confusion to this issue: - information to be given in the form that it is available - diversion of PA's resources to provide the information etc etc etc In a recent decision, due to persuasive arguments of the appellants representative, the CIC ordered that even information that has to be "created" or "collected" must be given to the applicant: http://cic.gov.in/CIC-Orders/Decision_18022008_02.pdf We agree with learned Counsel assisting appellant Ms. Lakshmi Jayashankar’s rejoinder quoted above that none of the grounds decided upon for denying information is valid. Under Rule 4 (a) of the RTI Act (Regulation of Fee & Cost Rules) 2005 which came into force on September 16, 2005 a fee is expected to be charged for each page “created or copiedâ€, which indicates that all information held by or under the control of any public authority is accessible to the public as is covered by the ‘right to information’ defined in sec. 2(j), even when it needs to ‘collected’. This is, of course, subject to the exceptions laid down in sec. 7(1). None of these exemptions includes the kind of exemption the MoEF seeks to foist through its decision of 27.9.06. Therefore, the information sought will now be provided to appellant Shri Karthik Jayashankar within 30 working days from the date of receipt of this Decision Notice. Hello, I am doing some research work in Hamburg, Germany. I need data on judicial system in India like the number of courts (including district courts), number of cases filed, disposed and pending in courts of India state wise. Also, if possible the number of computers in each court. Such information is not available on the internet. So I thought I might ask for them using RTI. Kindly tell me who should I ask for this information. Do I need to write to the Union Law ministry or to every state government? Also, is it possible to get this information in Hamburg? There is an Indian consulate here. This is the first time I am using RTI, so do not know how to proceed with it. Thank You.- 24 replies

I asked for following question 1. what is status of PF transfer ? 2, with whom my PF transfer application pending and for how much time 3. what is stipulated time for processing PF transfer application 4. what is penalty for not adhering to time limit specified in question 3 5. what action PF office has taken against officer who found guilty in answer to question no 2. BY Hindustan Times FOR ALMOST a year now, Ravi Dutt, who has 75 per cent disability in his upper limbs, has been running from pillar to post, hoping against hope to get his rightful berth in the government services. Armed with a diploma in Elementary Teacher Education and a certificate in Computer Application, this commerce graduate had first appeared for the Staff Selection Commission (SSC) examination on August 28, 2006. Soon after, he sat for the Employee State Insurance Corporation (ESIC) on October 25, 2006. He hoped to make it to one of the two reserved seats in the Physically Handicapped category. But he was never considered for the post. When he had approached SSC and ESIC to find out the reasons for his rejection, he never received a satisfactory answer. He then filed a petition under the Right to Information (RTI) Act. "I approached all possible people in the recruitment office. When I failed to get an answer, I was left with one option - to extract information rightfully through RTI," said Dutt. ESIC refused to divulge any information, stating results and other qualifying details were highly confidential. The only information they could provide was that no candidate was absorbed under the Physically Handicapped category. SSC said since most positions were open for the Scheduled Caste/Scheduled Tribe category, its minimum cut-off was 103. SSC's response also revealed that Dutt had secured 114, much higher that the required cut-off. SSC wrote, "Typing abilities were a minimum requirement for the job. While the candidate applied for exemption, permitted under the Physically Handicapped category, he failed to submit documents." Reacting to this, Dutt said, "This job is extremely important for me. Being a disabled and conscious of my weakness, there is no reason why I should have faltered on this account." In a later communication, SSC said while he had applied for an exemption under medical grounds, he may have forged the certificate. Documents show that the Vocational Rehabilitation Certificate he had submitted were authenticated by the board of Ram Manohar Lohia Hospital, dated a month before he had applied for the job. "In government services, very few doors are open to us, and if they don't recruit us even for clerical jobs, where do we go?" asked Dutt. "I have also approached the Commissioner of Disabilities, but no one has responded." Deputy Chief Commissioner of Disabilities T.D. Dhariyal said, "We are yet to look into the facts and get the version of both the parties concerned. There are several factors that have to be looked into in the case of reserved categories. Dear Sir, I am glad to become a member of RTI movement. I have several successes to my credit. I shall post the details in the next few days. Meanwhile I have a query relating to denial of information by the Appellate Authority, LIC of India, Zonal Office, I asked the Information Office, LIC, New Delhi for details on insurance training programs conducted by certain agencies for its agents on the criteria of their selection, their standing infrastructure available with them, if any of these institutions were involved in disciplinary action by the LIC or IRDA, cost per candidate and details of the faculty, the resources available at command of the institution. The Information Officer denied the same for all the 10 points under Section 8 (i)(d) thereby showing a bias in favor of certain institution. The Appellate Authority supplied some information but denied the same on most of the points. At the end, he stated that if the applicant did not feel satisfied with his order, he may appeal within 30 days to him again. My question is: 01. Whether Section 8(i)(d) can allow non-disclosure of information on the points above? 02. Whether the Appellate Authority can seek another appeal in respect to its own order on the first appeal?
