An RTI activist probing the funds spent on Republic Day parade has received a letter from the Central Public Works Department (CPWD) saying that due to a typing error, the expenditure the agency had earlier claimed, was, in fact, wrong.   8. The Imphal Free Press IMPHAL, Aug 22: A dead man was found drawing salary in the electricity department as assistant lineman sixteen years after his death. This faux pass came to light when L Tombi and L Rishikanta, wife and son of late L Ningthemjao of Kiyam Siphai, filed a complaint with the state chief information commissioner for service-related documents of Ningthemjao from the electricity department under the Right to Information Act on July 7, 2007. As told by Rishikanta at a press conference held today at the office of Human Rights Law Network, his father was serving as an assistant lineman with the electricity department from January 21, 1971. Later, on August 18, 1984, he joined as work charge. However, Rishikanta said, his father died on June 21, 1985 due to illness. He said that the representatives from the office employee union came for his shradha and provided monetary help. Rishikanta said that since he was very young and his mother was also illiterate, they did not have any idea about pension and other benefits procedures. He said, “It was only in 2004 that we sent an application to the electricity department to find out about my father’s pension when one of his friends enquired about it. Then we started to investigate and could not make much headway.” M Rakesh, state coordinator HRLN, said that after Rishikanta approached for help, he sent a legal notice to the chief engineer of the electricity department on January 17, 2007 on behalf of Tombi inquiring about the pension benefits of late Ningthemjao. Not being able to make much progress, two applications were sent by Tombi and Rishikanta under RTI to the electricity department. After 30 days lapsed with no action forthcoming, on July 7, 2007, the state information commission was approached. Thereafter, the state information commission directed the chief engineer of the electricity department to furnish the relevant service documents of Ningthemjao. In the service documents provided by the electricity department, it was found that Ningthemjao was promoted as lineman on January 16, 1998, thirteen years after his death, by the then chief engineer. Thereafter he retired on superannuation on August 31, 2001, more than 16 years after his death. Apart from having somebody withdrawing Ningthemjao’s salary for the past 16 years, Rakesh said that there were various false documentations. As per the family’s version, at the time of his death Ningthemjao was serving with the Thoubal electricity division whereas the official document mentioned that he was last serving with the Imphal Electrical Division No. 3, Lamphelpat. Rakesh said that a criminal case will be taken up at the earliest against the electricity department and the High Court will be approached to provide relief to the aggrieved family. NEW DELHI, APR 13: In a verdict which may have a far-reaching consequence in the future, the Central Information Commission (CIC) on Friday directed the department of bio-technology (DBT) to make public the data generated from the tests carried out on transgenic crops by agro-biotech companies. Chief commissioner Wajahat Habibullah delivered this right to information (RTI) power-punch, in response to an petition filed by Greenpeace India, after the review committee on genetic modification (RCGM) under DBT consistently refused to part with this closely guarded secret for over a year. Striking down the DBT's contention that the data falls under Section 8.1.(d), Habibullah pointed out that the request of the applicant for toxicity and allergenicity tests on genetically modified (GM) rice, mustard, okra and brinjal cannot be refused under the RTI Act. Any further grounds for non-disclosure are invalid even if the data in reference are in the process of development. The information was also directed to be disclosed under section 4. (1). (d) of the RTI Act, which states " provide reasons for its administrative or quasi judicial decisions to affected persons.” Supreme Court advocate Prashant Bhushan who appeared pleaded before the CIC on behalf of Greenpeace India said,” The Commission's order is significant as past experience shows that RCGM has not used the right kind of protocols for bio-safety testing". In February, last year, Greenpeace India had requested the RCGM to make public the toxicity and allergenicity data for four GM crops alongwith the minutes of the meeting. "Our victory today is in keeping with the spirit of the RTI, and has only strengthened the RTI as a tool to building a participatory democracy, " Divya Raghunandan of Greenpeace India. Ahmedabad, August 16: Justice D N Patel of Gujarat High Court has quashed an order passed by the Chief Information Commissioner (CIC) of the State directing the PIO of labour department to provide information to one Rasiklal Maradia. Maradia had sought information about Reliance Refinery in Jamnagar under RTI from the labour department. After Maradia was denied the information by the labour department, he had moved the CIC. Having accepted his contentions, the CIC passed an order directing the labour department PIO to furnish the information to the applicant. Subsequently, Maradia was provided with the information. Meanwhile, the Reliance Industry moved an application before all PIOs and the CIC contending that the information sought under RTI about the company should not be disclosed before hearing the company. After the order of the CIC, the company approached the High Court, challenging the order of the CIC. Senior counsel Mihir Thakor and advocate Dhaval Dave submitted that the information pertains to the private company (third party) and therefore it should not have been parted with before hearing the company. They also submitted that the information should be provided only if public interest warrants it. Secondly, they submitted that applicant Maradia wanted to settle his commercial rivalry with Reliance and therefore he had sought information regarding the company. Another submission made by the company was that the applicant was likely to misuse the information obtained under RTI and he was facing several criminal cases filed by the Union of India. Having heard the submissions, the court held that the information pertains to the third party and therefore the company should have been heard before the information was given away. The court has quashed the order of CIC and ruled in favour of the Reliance Industries. Moreover, the court has held that the applicant had tried to drag the company into controversy earlier also.     I-T dept seeks exemption of RTI Act

    NEW DELHI: The income-tax department has asked the department of personnel and training to amend the Right to Information (RTI) Act to shield itself from unsolicited queries on its investigations. The RTI Act has exempted the department of revenue intelligence, Intelligence Bureau, Central Excise Intelligence Bureau and the Enforcement Directorate, which are in the Schedule-II of the Act. The Central Board of Direct Taxes has written to the department of personnel and training that its investigation wing should also be exempted as its nature of work was similar to these agencies, a government source said. “Most of these agencies exchange information with the income-tax department, which could be very sensitive in nature. Since these agencies have been exempted from the purview of the RTI Act, it is logical the income-tax department’s investigation wing should also be exempted,” he said. The investigation mainly involves search operations to nab tax evaders. These searches, and any other investigation activity, usually involves department’s trusted network of informers, whose information is crucial to cases. These informers could get into trouble if exposed under the RTI Act and could be harassed by the affected parties, the source said. Recently, the Central Information Commission had turned down an appeal by First Global’s Shankar Sharma seeking details of investigations carried out by the income-tax department. The department had raided the stock broker’s premises in 2001 after the Tehelka sting. Though the department draws comfort from the decision, it wants to prevent anyone filing an application under the RTI Act to find out details about its investigations. Well within a month of filing my first RTI to in Income tax department via a post office i got some 10 letter and a few phone calls telling me that Income tax dept was ommitted from the RTI Purview... Now this is ****ing embrassing? I was looking for the list of departments that have been omitted from RTI Power and one more thing I got a letter from the income tax deptment of patna which gave methe details of the raids carried out by them from 2000 - 2008 and the total amount seized by them and toalt amoutn imposed as fine.. I am having a change of heart about patna Pardon my language please.....all this tension in mumbai and ...hope you understand. RTI india.org rocks!!!!!!!!!!!!!

RTI: Education dept seeks refuge in ‘secret’ clause Chandigarh, December 17 In What can be called a mockery of the Right to Information Act, the UT Administration’s Education department has denied routine information to a local resident citing its secret nature. While the Education department has denied information to the applicant, it has allowed him to inspect the “secret” documents on any working day. Jagdish, a resident of Sector 22, Chandigarh, asked for information about the criterion adopted by the Education department to select yoga instructors. The UT Administration had recently advertised the post. Jagdish’s daughter had applied for this post. Though she had the highest marks in graduation and other requisite courses for the post, she could not get through. Her father, Jagdish, filed an application under the RTI Act. These were the questions he put to the Education department 1. What was the selection criterion for the post of yoga instructor? 2. Supply the details of marks obtained by me under different heads of the criterion 3. Kindly supply the marks obtained by the following candidates under different sub-heads of the criterion 4. Please supply me the marks obtained by other candidates in graduation and yoga instructor 5. Kindly supply how many candidates applied in OBC category and how many candidates have been selected in that category In its reply, the Education department submitted, “As the information sought by you is of a secret nature, the copies of the same cannot be supplied. However, you can inspect the documents on any working day”. The reply does not even mention the section and sub-section of the RTI Act under which the information is denied. The reply gives no legal explanation as to how the information regarding selection criterion is termed secret. “The selection criterion has to be given in advance even before the posts are advertised. They have denied me the information yet allowed me to inspect it so that I can use their documents in any court. Such misconduct certainly smells foul. I-T dept puts RTI tasks in juniors' hands MUMBAI: The Right to Information (RTI) Act—perhaps one of the best tools in the hands of the common man—has become a pain to senior officers in the government. If they fail to respond to requests for information under the Act, they are compelled to pay a fine of Rs 25,000. To get around the problem, the income-tax (I-T) department has started re-designating junior officers to perform the role. Until now, only the chief public information officer (CPIO) could respond to any request for information. In a recent circular, however, the Central Board of Direct Taxes (CBDT), has said that junior officers at the level of assessing officers be assigned additional responsibilities as CPIOs. In the earlier dispensation, CPIOs had to be at least at the level of a commissioner, if not a chief commissioner. "It's clearly a retrograde move. Senior officials should stay in-charge of passing information under an important Act like the RTI," said Narayan Varma, a leading chartered accountant and an active member of the RTI cell run by the Bombay Chartered Accountants Society. Shailesh Gandhi, an RTI activist, agrees. "By re-designating juniors as CPIOs, the tax department is just passing the buck which in the long run will prove very expensive."     An applicant who filed a request with Assistant Public Information Officer (APIO) V V Sagade of State Department of Prisons for information on Sanjay Dutt's period of stay in Yerawada Central Prison under the Right to Information Act has been asked to approach the jail. According to Section 6 (3) of the RTI Act, the request should have been transferred to the PIO of the jail and the applicant informed about such a transfer. The application seeking information on Dutt's stay in the jail was submitted to the State Department of Prisons on August 29. However, APIO Sagade, in his reply on September 11, asked the applicant to file a separate RTI query with PIO Yerawada Central Jail. He said information on every prisoner was unavailable with the department and hence the information sought could not be provided. Sagade added that the RTI Act 2005 states that when a citizen submits an RTI application to a wrong public information officer, he should be directed to the information officer concerned of the department. "You are requested to file a personal RTI application to PIO of Yerawada Central Jail and obtain the information concerned," said the letter. Veteran RTI activist Shahid Raza Burney said: "It is a totally wrong method adopted by the department. It is a clear-cut violation of the RTI Act.   16. MUMBAI: The Right to Information (RTI) Act—perhaps one of the best tools in the hands of the common man—has become a pain to senior officers in the government. If they fail to respond to requests for information under the Act, they are compelled to pay a fine of Rs 25,000. To get around the problem, the income-tax (I-T) department has started re-designating junior officers to perform the role. Until now, only the chief public information officer (CPIO) could respond to any request for information. In a recent circular, however, the Central Board of Direct Taxes (CBDT), has said that junior officers at the level of assessing officers be assigned additional responsibilities as CPIOs. In the earlier dispensation, CPIOs had to be at least at the level of a commissioner, if not a chief commissioner. "It's clearly a retrograde move. Senior officials should stay in-charge of passing information under an important Act like the RTI," said Narayan Varma, a leading chartered accountant and an active member of the RTI cell run by the Bombay Chartered Accountants Society. Shailesh Gandhi, an RTI activist, agrees. "By re-designating juniors as CPIOs, the tax department is just passing the buck which in the long run will prove very expensive."     Forest dept disputes RTI information

    NAGPUR: A piece of prime 0.1 hectare (10,763 sq ft) zudpi jungle land worth over Rs 3 crore near Laxmi Nagar Square is not available to the forest department, thanks to the indifference of its own officials. Information sought recently by Abdul Karim Patel, working president, Democratic Secular Party (DSP), under the Right to Information Act, shows that the land is under the control of deputy conservator of forests, Civil Lines, Nagpur, range forest officer, Seminary Hills, and two other officials. "Strangely, the land is managed by Shree Ram Seva Mandal, Bajaj Nagar, which is looking after a small garden and a temple constructed under the MLA's fund. A small passage of the land is also being used by the residents as entry point,'' claims Patel. When contacted, west Nagpur MLA Devendra Fadnavis, who had funded the project, said: "There were encroachments on the land causing nuisance to the residents. Assuming it to be corporation land, we utilised it for a temple and a garden. When we learnt that the land belongs to the forest department, we informed the officials concerned and informally got their nod.'' "Otherwise also, zudpi land, which is less than one hectare, can be treated as revenue land. Hence, there shouldn't be any problem. Some vested interests are working to grab the land,'' he said. Talking to TOI on Wednesday, Patel said, "It's shocking that the department doesn't have a single document showing when the land was encroached upon. The information officer says that as a POR (primary offence report) was not filed against any person, they don't have any details.'' "We took up the issue with forest minister Babanrao Pachpute during his recent visit to the city. But no action has been taken so far. The Laxmi Nagar plot is not the only case. We have sought details of all forest land in Nagpur that has been encroached upon,'' the DSP leader said. Department officials, however, said, the land was in their possession and is only used by nearby residents. There's no pucca construction on it and hence cannot be called as encroachment, they said, adding that a small patch of land is being used by the builder for the past 25 years but he has been issued notices. The officials further said the builder has sought some time to construct a new entry point. "In 15 days, we would build a wall closing entry through the forest land,'' they said. The officials said, "Not an inch of land has been encroached upon. The wall constructed under the MLA fund is protection to zudpi land. We have also sent proposals for constructing quarters, hostel for department employees' wards or an information centre at the said place.'' Ahmedabad, August 16: Justice D N Patel of Gujarat High Court has quashed an order passed by the Chief Information Commissioner (CIC) of the State directing the PIO of labour department to provide information to one Rasiklal Maradia. Maradia had sought information about Reliance Refinery in Jamnagar under RTI from the labour department. After Maradia was denied the information by the labour department, he had moved the CIC. Having accepted his contentions, the CIC passed an order directing the labour department PIO to furnish the information to the applicant. Subsequently, Maradia was provided with the information. Meanwhile, the Reliance Industry moved an application before all PIOs and the CIC contending that the information sought under RTI about the company should not be disclosed before hearing the company. After the order of the CIC, the company approached the High Court, challenging the order of the CIC. Senior counsel Mihir Thakor and advocate Dhaval Dave submitted that the information pertains to the private company (third party) and therefore it should not have been parted with before hearing the company. They also submitted that the information should be provided only if public interest warrants it. Secondly, they submitted that applicant Maradia wanted to settle his commercial rivalry with Reliance and therefore he had sought information regarding the company. Another submission made by the company was that the applicant was likely to misuse the information obtained under RTI and he was facing several criminal cases filed by the Union of India. Having heard the submissions, the court held that the information pertains to the third party and therefore the company should have been heard before the information was given away. The court has quashed the order of CIC and ruled in favour of the Reliance Industries. Moreover, the court has held that the applicant had tried to drag the company into controversy earlier also. School teacher denied information on retirement, not paid compensation either JULY 30: The Zilla Parishad education department, which was slapped a fine of Rs 5,000 on May 29 by State Information Commissioner (SIC) for Pune Region Vijay Kuvalekar for denying information to school teacher Haribhau Jagannath Bagade under the Right To Information Act, has been sitting on the orders for the past two months. In a letter to Kuvalekar, Bagade has said neither has the ED provided any information nor paid him the compensation. Kuvalekar had pulled up Public Information Officer (PIO) cum deputy education officer (secondary division) Dnyanoba Bhujbal and other officials over the issue. Bagade, who worked as a secondary teacher in Swami Vivekanand Shikshan Sanstha’s Chhatrapati Vidyalaya in Wadgaon Rasai in Shirur, nearly 50 km from Pune, was forced to retire on December 31, 1995 after his date of birth was assumed as December 12, 1937. Bagade was born on December 12, 1938. Bagade approached Lokayukta, Mumbai and Judicial Magistrate Court, Koregaon, Satara where the court, in a verdict on August 29, 2000, upheld Bagade’s date of birth as December 12, 1938. The verdict was validated by Lokayukta, Mumbai. The State government passed the order to ED, Zilla Parishad and Deputy Education Directorate to immediately arrange for the payment of a year’s salary to Bagade. The order was addressed to the deputy directorate (education), Pune which forwarded it to ED which took no action. The delay forced Bagade to file an RTI requisition on September 30, 2006 seeking information on the action taken by the department on the State government’s and Education Directorate, Pune’s orders. When no information was forthcoming, Bagade filed the first appeal on November 13, 2006 before Education Officer (secondary section). When he was denied information yet again, Bagade reappealed to the first appealing authority who passed an order saying, “PIO should explore whatever information could be provided.” A second appeal was lodged with state information commissioner on April 9, the hearing of which was scheduled on May 8 by Kuvalekar. The SIC in its ruling ordered the PIO to give information to Bagade by June 10 and a receipt of the same should be submitted to the Appellate officer cum education officer (Secondary), Zilla Parishad Prakash Parab. Kuvalekar asked the ED and deputy education directorate to send a completion report before June 15. The SIC ordered Parab to ensure that Rs 5,000 was paid to Bagade under RTI 2005 Section 19 (8) by June 20 as compensation. This amount was to be deducted from the salaries of Bhujbal and other officers. Parab was told to submit a completion report to the SIC. Kuvalekar’s order stated that Bhujbal should have followed the RTI rules strictly and asked for his conduct to be recorded in his confidential report . Bagade has alleged that his records have been tampered with. “There have been two appeals and the SIC has ruled in my favour.The ED had prepared bogus documents of my service records and is afraid to part with the information,’’ Bagade said. This is the literal translation of a news item that appeared in a local daily "Pudhari" dtd the 04th of July'06 Pune Municipal corporation "PMC" has used Right to Information act to obtain information from sales tax dept. PMC's efforts to obtain information about turnover of some merchants failed. The Octroi dept of PMC knew that many merchants smuggle their goods into Pune without paying octroi. So the PMC wanted to ask about the sales tax paid by these merchants, but all their efforts failed, sales tax dept was not cooperating, so finally they used RTI to obtain such information. Initially they filed a requisition asking information of sales tax paid by cloth merchants, and they got the information within 30 days and then they filed requisitions about plywood, hardware ,electrical merchants etc. And due to this information income of octroi dept has increased.
