  1. we had made our society in july 2010 ,and since from october 2010 onwards society had not taken proper action for my complaints, i have taken flat at ground floor on back side of building. my complaints: 1. infront of my gallery of my house there is a small garden of society which should be maitained neat and clean., but from last october 2010 month no one bothered to make it clean.. all junglees small plant had grown and this had result in generation of lot of mosquitoes, other bacteria...etc and ALSO lot of dust, paper, other garbage is thrown from upstairs of the building. Plus there is no security wire rolled on society border wall , this results in people casually comes jumping from the wall. and society is not bothered for same. we are complaining to society from october 2010 onwards and said them that its a new society and as we dont have sufficient funds that i understand but for security reason wire rolled on wall-it is important - so today or tomorrow we have to do it, when ever there is a fund in society we have to do it.... BUT this neatness and clean work maitainaince of garden and my gallery premises which comes back side of building can be done clean. Regularly i attends all the society meeting every week of sunday, and every month we inform society of this complain. Plus there is less light on back of bulding by evening near to our gallery and on back of building premises so we had also said to society to add one more society Light . we had found till december 2010 no action had been taken properly still problem of garden cleanliness, no light at back of building premises is pending.. so i had decided that from january 2011 onwards i will not pay our society maintainence charges- which is Rs 500/- per month. And every week's meeting , monthly meeting i am attending and every month i am reminding about this and they said "" ho jayega and bla bla."" Also i had informed them in meeting by march 2011 that i had not paid maintainence becuase of above reasons still no action had taken. then by April 2011 i had given a letter to society stating about the problem and why i am not paying maintainece bill and from now onwards will not pay. So they had not given answer and said that Treasure is not here as he went to village and will be back after one month. so april, may 2011 month over. Now in june 2011 when i found this matter will continue and i decided to pay the maintainence bill... so now here society is asking me for late payments... and lot of disputes happen. i said society made the mistake for not doing the work and also i said i didnt paid charges... i had stoped the charges as society had not done the work of above complaint. so please tell me whether i should make the payment with late payment. Also they are charging 21 percent for late fee per month wise. Is there any law of charging 21 percent on monthly maintainence bill per month. our monthly maintainaince amount is Rs 500/-. plz help. regards, Mr. shah (thane-nalasopara.)
  2. Background Information: My Grandfather had procured the a land in Nanganallur – Chennai – Tamilnadu long back around 1980’s Since he died long back, the land is now owned by my father. We have all the required documents like land registration document, patta & plan approval. Four years back, we noticed that our neighbor has encroached our land with the fences. At that time, we went to his home and had a lengthy discussion and got a confirmation letter from him in written and signed by him and his family members to demolish his fence. We didn’t start demolishing his fence since we were not having enough money to start demolishing his fence. During when we approached our neighbor he is not allowing us to demolish his fence. We launched an application to the land surveyor with the Thasildhar office four months ago. Nobody from the Thasildhar office had visited our house to measure the boundary yet. Query: Please help us with the information to measure the boundaries and to solve this issue. It will be so helpful for my beloved old parents. Thanks a lot in advance

    Forest dept disputes RTI information

NAGPUR: A piece of prime 0.1 hectare (10,763 sq ft) zudpi jungle land worth over Rs 3 crore near Laxmi Nagar Square is not available to the forest department, thanks to the indifference of its own officials. Information sought recently by Abdul Karim Patel, working president, Democratic Secular Party (DSP), under the Right to Information Act, shows that the land is under the control of deputy conservator of forests, Civil Lines, Nagpur, range forest officer, Seminary Hills, and two other officials. "Strangely, the land is managed by Shree Ram Seva Mandal, Bajaj Nagar, which is looking after a small garden and a temple constructed under the MLA's fund. A small passage of the land is also being used by the residents as entry point,'' claims Patel. When contacted, west Nagpur MLA Devendra Fadnavis, who had funded the project, said: "There were encroachments on the land causing nuisance to the residents. Assuming it to be corporation land, we utilised it for a temple and a garden. When we learnt that the land belongs to the forest department, we informed the officials concerned and informally got their nod.'' "Otherwise also, zudpi land, which is less than one hectare, can be treated as revenue land. Hence, there shouldn't be any problem. Some vested interests are working to grab the land,'' he said. Talking to TOI on Wednesday, Patel said, "It's shocking that the department doesn't have a single document showing when the land was encroached upon. The information officer says that as a POR (primary offence report) was not filed against any person, they don't have any details.'' "We took up the issue with forest minister Babanrao Pachpute during his recent visit to the city. But no action has been taken so far. The Laxmi Nagar plot is not the only case. We have sought details of all forest land in Nagpur that has been encroached upon,'' the DSP leader said. Department officials, however, said, the land was in their possession and is only used by nearby residents. There's no pucca construction on it and hence cannot be called as encroachment, they said, adding that a small patch of land is being used by the builder for the past 25 years but he has been issued notices. The officials further said the builder has sought some time to construct a new entry point. "In 15 days, we would build a wall closing entry through the forest land,'' they said. The officials said, "Not an inch of land has been encroached upon. The wall constructed under the MLA fund is protection to zudpi land. We have also sent proposals for constructing quarters, hostel for department employees' wards or an information centre at the said place.'' 6. New Delhi, May 16: There are nearly a dozen inter-state disputes over borders within India alone, a government statement has said while replying to a petition under the Right to Information (RTI) Act. Karnataka, Kerala and Maharashtra's borders were specified in the State Reorganisation Act of 1956. But Karnataka and Maharashtra disagree, with the latter wanting Marathi-speaking border areas. Karnataka and Kerala have a dispute over Kasargod district in Kerala. Efforts by the one-man Mahajan Commission of Justice Meher Chand Mahajan in 1967 were inconclusive, with Maharashtra not accepting its recommendations. In a reply made under the RTI Act to Harikumar P of Kasargod, the ministry of home affairs has acknowledged that a number of other disputes existed. The inter-state boundary between Bihar and Uttar Pradesh continued to fluctuate due to the frequent change in the course of rivers, 'giving rise to problems in the field of revenue administration and law and order', the government said. Despite an arbitrator looking into this issue in the 1960s and a law, disputes between private parties have continued. Likewise, Haryana and Uttar Pradesh's fluctuating boundary was sought to be solved in the 1970s. But some private parties have been approaching the courts over cases pertaining to tenancy disputes. Between Orissa and Andhra Pradesh, the boundary dispute relates to 63 villages falling presently in Orissa. But neither government has asked for Central intervention. Similarly, Orissa and Jharkhand have a boundary dispute relating to seven villages of Mayurbhang and Keonjhar districts. Orissa has claimed territories in the former princely states of Seraikela and Kharsuan, now in Jharkhand. Orissa is locked with Chhattisgarh over three villages of Naupada district. Orissa and West Bengal are also stalemated over five villages of Balasore and Mayurbhanj districts of Orissa. In the northwest, Punjab and Haryana are locked over the transfer of Chandigarh to Punjab, and part of Fazilka sub-district of Punjab to Haryana. Three commissions have been named so far to decide which specific Hindi-speaking areas of Punjab should go to Haryana in lieu of Chandigarh. Himachal Pradesh is contesting Uttarakhand over six places of Dehradun district, adjoining its Shimla district. Arunachal Pradesh claims territory in Assam on the basis of history. In September 2006, the Supreme Court appointed a local commission headed by retired judge S.N. Variava to identify the boundary there. Assam and Meghalaya don't have a major boundary dispute, the reply said. But Nagaland claims 5,000 sq miles of territory in Assam 'on historical grounds'. Assam filed a case in the Supreme Court and Justice Variava was named to decide on the issue. Zee News - Nearly a dozen border disputes within India alone!=
