Sir, After having not received the reply from PIO of New Delhi Municipal Council New Delhi, with in stipulated period of 35 days I filled a First Appeal with Director Fiananc as per attached first Appeal. On receipt of my 1st appeal Director Fiananc called me for hearing and accordingly I attended the same. During the proceedings PIO told the FAA that they have not received the application. I submitted before FAA that my RTI was duly received. Accordingly FAA told PIO that you put up details and I was told by FAA that reply shall be sent to you. No proceedings note was prepared by FAA and got signed by PIO/Myself. Now a reply has been received by me from PIO and No ID reference is given, further the information contained in reply as asked by me not in order. Therefore should I filled 2nd Appeal with CIC and some suitable drafting for the appeal may be suggested as per my First Appeal and reply received. Thanks
  2. I am 69 years old. My only younger brother Mr. Jayaraman was working in the Registraation Dept.of Tamil Nadu Govt in CHENNAI.He retired on 31-1-2012. In 1981 he married Mrs. Malarkodi on his own accord without the knowledge of myself,my mother and sisters all living at Ariyalur. On knowing the fact that Jayaraman was already living with one Tmt. Sampathkumari, a co worker of his office Malarkodi ran away to her parents. Jayaraman never cared for his first wife and his blood relations(me and my relatives) and living with Sampathkumari illegally, we had neglected him for his misconduct and immoral turpitude. He never visited to our family at Ariyalur from 1980 till to his death in April, 2017 at Ariyalur. ON his death only it was known to us that he had left Sampathkumari and was living with another lady Ramadevi from 2003. As Ramadevi had failed to take care of his health and left to her mother, Jayaraman came to Ariyalur, native place and surrendered to my sister for treatment on 25-3-2017 in a critical condition.He died at the hospital on 10-4-2017 without informing anything to us.At the time of his death I was living at Coimbatore and unable to get any information about his service. As he had no child through all the said three ladies, being an available brother I had performed his obituaries etc and put fire on the body.As Ramadevi claimed rights over the properties left over by him at Chennai, pensionery benefits etc. I had submitted a petition to the Dt. Registrar, Chennai South requesting information under RTI Act. He is the appointing authority and maintaining his Service Register and pension sanctioning authority. The petition dt 07-09-2017 is attached herewith as per the additional option. It may kindly be perused. Out of the 10 items relating to information sought, the PIO Dt.Registrar, Chennai south has refused to furnish information on items No.1, 2,3,6 and 8. as no records are available in his office.and rejected my request for items No.4,5,7,9 and 10 as they related to Private individual. As regards the information about his service etc they should have been entered in the Service Register of a Govt. Servant prescribed by the Tamil Nadu Govt as per Service Rules.The transfer from Chennai South District to far away district Tuticorin and reposting to Chennai South should have been entered in the Service Register of the individual which is a basic statutory record for claiming pay and allowances by the respective pay drawing officers, pension sanctioning authority.Based on the entries alone, the qualifying service of a person for pension, Dcrg, Family pension, GPF accumulations,withdrawals etc may be calculated and ordered to be paid to a retired Govt.Servant. Nominations filed for all the above claims should have been obtained by the respective officers and filed in the Service Register of a Govt.Servant. Acquisition of immovable and movables and its disposals and permission to construct a building on the plot owned by the govt.Servant should have been entered in that register. Without the Service register, the appointing authority viz the Dt. registrar should not have been counter signed the Pension proposals signed by the retired Govt.Servant. Jayaraman. In 1986.Jayaraman had purchased a plot No. 24 at Vandalur in S.No.113/1 now valued to Rs.2 crores and constructed a house building in 2010.All of them should have been entered in the SB. The marriage details of Malarkodi, Sampathkumari and Ramadevi should have been entered by the Officers maintaining authority. In the absence of valid nominations supported by records, the Dt.Registrar should not have forwarded the proposals to the Accountant General for Pension, Family pension, Withdrawal of GPF amount etc. How the Dt. Registrar had ordered for such things. As regards the enquiry conducted by the Dept, the records might be available with the Head of the Dept for which, the PIO should have forwarded the relevant portion of my petition to the Inspector General of Registration, Chennai under Sec 6(3) of the RTI Act. The PIO has utterly failed in his duties. As regards the reply of the PIO that relates to a private individual is not acceptable. All the details are available in Public Records. More over Jayaraman had died on 10-4-2017 and I am his elder brother becoming a II class legal heir provided under the Hind Succession Act 1956. the Tasildar, Chengalpattu who is the competent authority to issue a legal heir certificate under Law has rejected the request of Ramadevi for legal heir ship and directed her to approach the Civil Court. Therefore there is no privacy for a dead person and the particulars available in the Service Register of a Govt.Servant is not a private matter and cannot be rejected to his own brother so as to enable him to seek remedies in a court of Law against the Wrong claimants posing themselves as heirs.   3. I had filed RTI to Virar municipality asking for document submitted for building permission, but pio had refused stating third party information. I had filed first appeal on June 24 giving ground for appeal as per Prasadsirs format. Now there is no response till date n would like to file second appeal, please can I be guided for ground for appeal. Do I have to write the same ground for appeal.   4. Dear Esteemed Members, I put one RTI to PIO of one Public Authority. As there was no response from concerned PIO, I escalated to First Appellate Authority (FAA) after 45 days of my filing RTI. Getting no response from FAA after almost 45 days of waiting, I preferred to file complaint as deemed refusal of information and infringement of my fundamental right. I got the response from State Information Commission that ' Certificate stating that matters under appeal or Complaint have not been previously filed or pending or decided by any of the State Information Commission'. As I am into the process of going to civil court regarding some other issues, the formation of this RTI can be helpful in civil case. Now I have one queries Should I give the certificate that till this moment nothing related to this appeal or complaint is filed considering I will be approach civil court after 15 days Please respond as I think, RTI community is doing wonders in making a transparent society. At Vadodara municipal corporation we had filed RTI application seeking information regarding illegal construction activity and in response to that we received a reply which asked us to visit the office and check the relevant file. We didn't get any information from file. Hence, we had filed first appeal. First appeal officer called us for meeting and there he denied for further information in the matter. He asked to again check the file. In this case what should we do apart from second appeal. What should we write in second appeal that strict action to ne initiated against such official by commission. We had filed 3-4 RTIs differently for the same matter and same response received in all RTI. Pls help in the matter.
  6. Sir, I had filed various RTIs with Delhi Developmental Authority. I have also filed First appeal for them but No satisfactory response received from CPIO/FAA. All the RTIs are on the same issue but are different from each other with different set of questions. But CPIO has denied information on different grounds for each RTI. I would like to know whether I can file second appeals for all the RTI's I have written? All the RTI's are against DDA and revolve around the similar issue. Should I go ahead with filing second appeals for all RTI's?
  7. Respected Senior Members, I had file a RTI with the university for seeking the Plagiarism certificate for the thesis which is submitted in year 2015 . The PIO had Rejected to provide me the information under Section 8(1) (d & j) and i filed the first appeal . The FAA had also rejected to provide me the details stating the same section of RTI act mention by PIO. Stating " information regarding percentage of Plagiarism Checked for the PhD thesis of Women PhD scholar, is of Confidential nature and has no relation ship to any public activity or interest, there information cannot be provided under section 8(1) (d & j) of RTI act" please guide me with the latest judgments to counter this in SIC. and need a format for the SECOND APPEAL too . and need help regarding any judgment related to Plagiarism in which SIC or CIC ordered to provide the copy of same to the applicant.   8. The reply from CPIO states that the requisite information in the said form is not kept in this office. This reply from CPIO does correlate to the requisite information. Then I filed first appeal but the FAA replied stating: Decision:– 1. The Original Application, the First Appeal and the reply of the CPIO have been perused vis-à-vis the input provided by the deemed PIOs in this matter. On perusal of the concerned file, it has been observed that the CPIO has decided the matter based on the input of the concerned deemed PIOs. Therefore, the decision of the CPIO is upheld in this matter. 2. The appeal is decided accordingly Please suggest how to write for Second Appeal. Thank you

I filed RTI with UGC with the following points: Point 1: Does CSIR RESEARCH ASSOCIATESHIP (RA) will be consider as past service if one person joins the post of Assistant Professor in any reputed institute after spending some time in CSIR RESEARCH ASSOCIATESHIP (RA) (One persons resigns from CSIR RESEARCH ASSOCIATESHIP (RA) on Feb 10 and joins post of Assistant Professor on Feb 11). Point 2: Does Research Associateship (RA) (mostly offered by research labs) and Post Doctoral Fellowship (such as NBHM postdoctoral fellowship and National Post Doctoral Fellowship) are equivalent in terms of “COUNTING OF PAST SERVICES FOR DIRECT RECRUITMENT AND PROMOTION UNDER CAS”? If there is any difference please specify. Reply of PIO: Such issues are required to be governed and decided in term of Clause 10.0 of UGC Regulations....2010 as referred to in your queries. I filed first appeal with UGC and after 6 months I got the reply of FAA as following: Reply of FAA: [/b]I have considered the submissions made by the appellant and the PIO. In this regard, it is to state that the PIO is not supposed to assess the queries of the applicant and then provide a conclusion so deduced thereon. The RTI Act, 2005 requires the PIO to provide only information/material which is in his custody or as held by the Public Authority. I find that available information has already been provided by the PIO which was found to be as per records. How can UGC let the universities to draw their own conclusions from the regulations. Why UGC cannot categorically tells the meaning of their own regulations. The point is that, under UGC regulations Research Associateship (RA) is considered as past service but Post Doctorate is not considered as past service. Although, both RA and post doc are same positions. I wanted to file second appeal for the same. Please help in drafting the second appeal so that I can get the relevant information.

Dear Moderators, Please find below details and help in drafting second Appeal RTI Application Date : 29-08-2016 Information sought in RTI application and also attached CIC, Maharashtra Order: Kindly provide a copy of orders/judgments passed and note sheets consist of notings/remarks/comments dictated or directed by all the officials on all the cases/matters (includes appeals and applications both) which were taken-up or looked upon in front of this particular hearing board/bench conducted by XXXXX on 06th-Feb-2016 (i.e. on first Saturday of Febuary-2016). PIO Decision Date: 21-09-2016 PIO replied: उपरोकत संदर्भाधिन अर्जामधये मागणी केलेल्या माहितीसाठी आपणास कळविणेत येते की, आपणास आवश्यक असलेल्या माहितीसाठी आपण या विभागामधील उपलब्ध असल्याने नस्तीचे पाहणी / निरिक्षण खालीलप्रमाणे शुल्क भरून सोमवार ते शुक्रवार(बुधवार व शनिवार वगळून) या दिवशी कार्यालयीन वेळेत दुपारी 3:00 ते 5:00 या कालावधीत पूर्व निशिचत केलेल्या वेळी करता येईल. पहिला तास निशुल्क यानंतरच्या प्रत्येक अतिरिक्त 15 मिनिटाला रु.5/- आपणास आवश्यक असलेल्या माहितीचा खुलासा करून आपण सुचित केलेली व उपरोकत अधिनियमानुसार देय असलेली माहिती आपण विहित शुल्क भरुन प्राप्त करु शकता. तपासणीअंती आपणास आवश्यक असलेली माहिती आपणास उपलब्ध करून देणेत येईल. First Appeal Date: 03-10-2016 First Appeal Grounds: With reference to the PIO’s above quoted response, I would hereby like to draw your kind attention towards the provision of section 2(j)(i) & section 7 (3)(a) as follows: As per the provision of section 2(j)(i) of the RTI Act, inspection of information pertaining to Public Authority has been defined as one of the rights to information of a citizen, but then, this provision of the Act, can be invoked as a right only by a citizen seeking information from a Public Authority, and not by a PIO of a Public Authority. And as such, the provision of section 2 (j)(i) cannot be construed as a pre-condition to obtaining any information under the provision of section 6(1) of the RTI Act. Moreover, please note that I had requested for specific information, and as such, I as an applicant had not invoked the provision of section of section 2(j)(i) of the RTI Act for seeking an overall generic inspection of information. Thus, I had neither asked for, nor do I wish to exercise the opportunity of seeking an inspection of the requested information, before the information requested against point no. 1 and 2 of “Description of the Information Required” column is provided to me under the provision of section 6(1) of the RTI Act. Also, I had like to draw your Honourable Appellate Authority’s kind attention towards the following circular issued by General Administration Department of Government of Maharashtra with respect to the calling a citizen for inspection of information in response to his RTI application (photocopy enclosed herewith for your perusal): महाराष्ट्र शासन, सामान्य प्रशासन विभाग, शासन परिपत्रक क्र. संकिर्ण २०१५/प्र. क्र. (२२१/१५) सहा. दिनांक २६-१०-२०१५. पहा- मा. राज्य मुख्य माहिती आयुक्त यांचे दिनांक २.७. २०१५ चे आदेश Futhermore, as per the provision of section 7(3)(a) of the RTI Act, wherever a decision is taken by PIO to provide the information on payment of any further fee representing the cost of providing the information, he shall send an intimation to the person making the request, giving the details of further fees representing the cost of providing the information as determined by him, together with the calculations made to arrive at the amount in accordance with fee prescribed under section (1) of section 7, requesting him to deposit that fees. Thus, the PIO has responded to the request for information vide the point no. 1 and 2 of “Description of the Information Required” column of said RTI application in contravention of section 7(3)(a) read with 2(j)(i) and further read with section 7(1) of the RTI Act. First Appeal Prayers / Relief sought: 1. In keeping with the letter & spirit of section 7 (6) of the RTI Act, kindly direct the PIO to provide all the requested informations free of cost within a period of 05 working days from the decision of this appeal. 2. Kindly direct the PIO to provide a specific & separate response against each of the points of request for information in the RTI Application (i.e. a point-wise response) and supply the information as sought by the appellant. 3.
