CHANDIGARH: More than a decade old struggle demanding abolition of contract labour system at PGI, which started in 1996, came to an end after the central government issued gazette notification prohibiting engagement of contract labour."There has been unreasonable delay in issuing gazette notification. Therefore, on October last year, the PGI Contract Workers Union filed a RTI application to know its status.   2. Delhi High Court adjourns PIL for appointment of CIC and 3 Information Commissioners for ASG to seek instructions 1. The PIL,(W.P.© No.3386/2015) filed by Shri R.K. Jain, Shri Lokesh Batra and Shri Subhash Agrawal came up for hearing on 8-4-2015 before the bench of Hon’ble Chief Justice and Hon'ble Mr Justice Rajiv Sahai Endlaw of Delhi High Court. 2. Shri Prashant Bhushan, Advocate appeared for the petitioners and Shri Sanjay Jain, ASG, appeared for the respondents. 3. Initially, the Court wanted to know from the ASG as to what steps has been taken for the appointment of the Chief Information Commissioner and 3 Information Commissioners since August, 2014 as in April, 2015, it is a long time. Court indicated that appointments be made within 4 weeks. However on the submissions of ASG, the matter was adjourned for tomorrow i.e. 9-4-2015, so that he may seek instructions and make further submissions in the matter. 4.   4. Who will be India’s next Central Chief Information Commissioner under RTI ? After nearly six months of keeping the post of Central CIC’s post vacant and with 203 applicants responding to DoPT’s advertisement for this post, the screening committee is finally meeting on 16th January to decide a name So, who will be India’s next Central Chief Information Commissioner? The Department of Personnel & Training (DoPT) has invited the search committee members comprising cabinet secretary, Rashtrapati Bhavan (chairman); Additional Principal Secretary to PM; Secretary, DoPT; Secretary, Ministry of Home Affairs; Secretary, Dept of Expenditure and Professor Ram Chand, National Centre for Agricultural Economics & Policy. They are scheduled to meet at the cabinet secretariat of Rahtrapati Bhavan on 16th January. On the same day, another meeting to draw a panel for information commissioners will also take place. The Agenda note for the meeting states that the 203 applications received for the CIC post have been divided into seven categories to facilitate shortlisting of candidate. The Agenda note procured by Moneylife states: “(the) Prime Minister’s Office (PMO) has directed that for the sake of consistency and uniformity in approach, the procedure for selection of information commissioner, which includes amongst other things, advertising the post and short listing by a search committee may be adopted for appointment to the post of Chief Information Commissioner as well. Such short listed panel may then be placed before the selection committee for its consideration.” “Accordingly, a circular was posted on the website of DoPT inviting applications to the post of Chief Information Commissioner on 24.10.2014. The post was also advertised in three leading newspapers (two in English and one in Hindi) as was done for appointment to the posts of information commissioners. The last date of receipt of applications is 24.11.2014. A total number of 203 applications for the post of Chief Information Commissioner in CIC were received. Applications received after the cut-off date of 24.11.2014 are not being considered.” “As per Section 12 (5) of the RTI Act 2005, the Chief Information Commissioner and Information Commissioner shall be persons of eminence in public life with wide knowledge and experience in `law, science and technology, social service, management, journalism, mass media or administration and governance.” “Accordingly, all these 203 applications have been broadly categorized into seven categories of knowledge and experience as mentioned above. Few applications which do not fall within these seven categories have been mentioned as ‘other’ categories. However, for the sake of categorization, only the main field of knowledge and experience, if any, have not been indicated. So, finally it seems the crucial vacancy that had earned ire from activists from across the country is well on its way to be filled up. However, India needs to thank Delhi-based RTI activist Commodore Lokesh Batra (retd) who has been pursuing this issue through RTI applications. In its note of 17 October 2014, PMO stated that : Quote : "Prime Minister has desired that for the sake of consistency and uniformity in approach, the procedure for selection of Information Commissioners which includes, among other things, advertising the post and short listing by a Search Committee, may be adopted for appointment to the post of Central Information Commissioner as well. Such short-listed panel may then be placed before the Selection Committee for its consideration."Unquote[/TD] [/TR] [TR] [TD] [/TD] [/TR] [TR] [TD]12 June 2014 : DoPT sought clarification from Lok Sabha Secretariat : "xxx whether any leader of opposition in the Lok Sabha has been recognised. If the leader of opposition in the Lok Sabha has not been recognised as such, it is requested to kindly intimate the name of the leader of the single largest group in opposition of Government in the Lok Sabha, for the purpose of selection of Information Commissioners as per the RTI Act."[/TD] [/TR] [TR] [TD] [/TD] [/TR] [TR] [TD]19 June 2014 : Lok Sabha Secretariat responded to DoPT's above clarification and stated : Quote "As on date, there is no Leader of Opposition in Lok Sabha. Indian National Congress with a strength of 44 members is, however, the single largest party in opposition to the Government in Lok Sabha. As per information received from the party, Mallikaarjun Kharge is the Leader of Indian National Congress in Lok Sabha" Unquote[/TD] [/TR] [TR] [TD] [/TD] [/TR] [TR] [TD]08 July 2014: DoPT sought the advice of Department of Legal Affairs (DOLA) as to whether the Leader of single largest party in opposition can be considered as Leader of the single largest group in opposition, in Lok Sabha, for the sake of section 12(3) of RTI Act.[/TD] [/TR] [TR] [TD] [/TD] [/TR] [TR] [TD]15 July 2014: Pending Clarification from DOLA..... DoPT submitted file with brief to PMO for kind consideration of Hon'ble Prime Minister on 'Appointment of Chief Information Commissioner' in Central Information Commission for :- (i) Nomination of a Union Cabinet Minister for the Selection Committee u/s of the RTI act. Sheshadri, Director, PMO in its note to Secretary, DoPT conveyed that the Prime Minister has nominated Arun Jaitley, Union Minister of Finance, Corporate Affairs and Defence, as the Member of the Selection Committee under of Section 12(3) of the RTI Act. The PMO note goes on to say "The undersigned is directed to convey that the matter shall be resubmitted for a decision on date of meeting of Selection Committee, after the issue raised in para 6 of the aforesaid note is decided."[/TD] [/TR] [TR] [TD] [/TD] [/TR] [TR] [TD]17 July 2014: DOPT received clarification from DOLA.   5. Dear friends I have been asked to give my comments on whether Indian Farmers Fertilizers Cooperative Ltd [iFFCO] is covered under RTI Act or not? I sent a reply which I am reproducing below for your comments and observation. Waiting for your comments. Thanks and Regards. Divya Jyoti Jaipuriar Advocate [***Email Link Deleted***] _______________________________________________________________ Dear Mr Roy Thanks for your mail. In response to the question, whether IFFCO is covered under RTI Act or not, I have to make following observations: 1. If you see the definition of the "Public Authority" in the Right to Information Act, the intent of this definition is that every authority which us discharging its duties as an instrumentality of "State" is a "Public Authority". The scope of this term is very wide. In fact, the term includes not only authorities covered under Article 12 of the Constitution, but other agencies like and NGO etc. are also covered under the Act. If I re-frame this statement, it can be said that the term "Public Authority" includes all instrumentality of Article 12 and other agencies which are substantially funded by the Government Agencies. 2. This provision of RTI Act provides that the any organisation which receives substantial funding from Central or State Government is also covered under the definition of the "Public Authority" But the RTI Act does not define the term "substantial funding". This term, however is defined in CAG Act which states that if any organisation received funding from the Central or State Government to the extent that 75% of its total budgetary requirement is satisfied, then only it can be said that the organisation has been "Substantially funded". In such a case, to apply RTI Act on IFFCO, we have to know how much money does it get from the Central Government and/or State Government either in form of subsidy in production or otherwise. The annual report and financial statement of IFFCO will help us in getting this information. 4. Further, while deciding whether a Co-operative Society is an instrumentality of Article 12 or not, in U.P. State Co-Operative Land Development Bank Limited vs. Chandra Bhan Dubey and Ors.stated that the Co-operative Societies which act as an extended arm of the State, and is also controlled by the State, is also covered under article 12. To quote the Supreme Court Judgment: "... It is not necessary for us to quote various other sections and rules by all these provisions unmistakably show that the affairs of the appellant [u.P. State Co-operative Land Development Bank Limited] are controlled by the State Government though it functions as a cooperative society and it is certainly an extended arm of the State and thus an instrumentality of the State or authority as mentioned under Article 12 of the Constitution." IFFCO is also an extension arm of the Central Government. Police on Saturday arrested an assistant administrative officer (AAO) of the Post-Graduate Institute of Medical Education and Research (PGIMER) for allegedly producing fake documents to get a job at the PGIMER in 2009. The matter came to the fore after the employees’ union of the institute filed an RTI, which reads that an employee cannot submit the NOC. After receiving the complaint, the forensic lab team of Chandigarh Police found the signatures on the NOC fake, and that it didn’t belong to any official of the Punjab State Warehousing Corporation.     Help me to frame RTI questions

    Hi all, I am new here and need to know how to frame questions for RTI. This RTI is for VTU. VTU in an answer to RTI regarding recognition of PhD, specified that “universities recognized by UGC AND the members of association of indian universities are only recognized by VTU. I read this in RTI forum and got upset regarding this foolish decision. How come mearly a membership of AIU will form as a criteria for deciding recognition of a university? Hence I am planning to file an RTI. Please help me to frame questions. What I want to ask is as follows: Please state the reason for which vtu doesn’t recognize the phD degree awarded by JJTU. Since UGC Is the supreme authority to recognize PhD awarded by any university, is it mandatory to ask permission from VTU regarding the recognition of degree awarded by a particular university? If yes please state the reason as such why any student need to ask for two authorities? Why there are two authority to state the recognition of one university? Is vtu is following ALL the rules and regulations for PhD course laid by UGC? when did VTU has started to submit a soft copy of the PhD thesis to the ugc ? So far none of the PhD thesis awarded by VTU are available on Shodhganga@INFLIBNET Centre..please state the reason for the same. As per the RTI reply provided by VTU, VTU recognizes PhD degrees from “universities recognized by UGC AND the members of association of Indian universities(AIU) only”… in this case what is the reason behind considereing mearly the MEMBERSHIP of “Association of Indian universities” as one of the mandatory thing in recognizing any universities Phd? By mearly a member of Association of Indian universities how does vtu think that the PhD degree awarded by any University is of high standards? Please give the evidence of the meeting held and decision taken by the committee mambers as “universities recognized by UGC AND the members of association of Indian universities(AIU) only” are recognized by vtu. Provide the name of the members who taken such decisions. If such a meeting is not held on what basis and under who’s presence, who’s has been the chief chair in taking such decision? Provide me the minutes of such meeting along with all details. If VTU itself not following the rules laid by the UGC (none of the thesis is uploaded to shodganga till date) how come it is expecting others to follow the UGC rules? May be you understood what I want to ask. Please, experts, frame the questions and help me. Suggest me can all these questions can be asked once?   13. Hello every one, I have done PhD in computer science from CMJ UNIVERSITY, Meghalaya. I am in Karnataka where most of the colleges are under Visvesvaraya Technological University (VTU), Belgaum. VTU in my case says that "The degrees awarded by member universities of Association of Indian Universities (AIU), new delhi are recognized on reciprocal basis, If the universities and their degrees are recognized by competent authorities". Although CMJ UNIVERSITY, Meghalaya is recognized by UGC but since it is not a member of AIU it is not recognized by VTU !!!. Now my friends I am really confused. 1) Who should recognize our degree (PhD or other) ?? Is it UGC or AIU. ? 2) If both, then why there are two bodies. (both are making money from this?) 3) Who has given right for AIU to make universities as its members...and by merely getting membership of AIU will a university is recognized ?? To clarify my doubts I am filing an RTI to AIU and also to IISC, bangalore (to see what is its openion in this regard) The RTI need to have good questions which will resolve this issue and give me correct information. In this regard I NEED YOUR VALUABLE SUGGESTIONS. I have framed the questions. But not so happy with it. Before filing the RTI, I would like to seek your VALUABLE openions and CORRECTIONS.   15. Hi, I have completed M.Sc.(Chemistry) with first rank from Gujarat University in July, 2012. I will be awarded with INSPIRE fellowship from DST, Govt. of India perhaps in January, 2013. In many institutions like Indian Institute of Sciences, IITs, JNCASR, CSIR-Laboratories, & Universities from other states provide Direct Admission to PhD if student is awarded such fellowships. But, in Gujarat University this facilities are not provided. so I want to file an RTI to University to get the proper information regarding PhD admission schemes for INSPIRE-fellows. But I don't know where to apply & how. Someone please help me..

They told me to make an application to Equivalence committee and pay Rs 10,000 as fees. Just to know whether a universities PhD is valid or not a citizen need to pay Rs 10,000?. I had submitted the RTI application by hand in the format available from PGIMER RTI office and paid the RTI fee of Rs 10 and obtained cash reciept. The required information is detailed as follows. 1 In the recently conducted interviews for selection of faculty members at PGI Chandigarh, were there any structured objective criteria for selection. 2 How much weightage is given to post graduate education and patient care done by individual faculty members when deciding upon selection by the selection committee. Kindly provide documents proving this. 3 Have any faculty members including the Professors been selected at PGI Chandigarh without appearing for the interview physically. On how many occasions has this happened before. Was any faculty member at PGI Chandigarh selected at recently held interviews during December 2010 to April 2011 at PGI without haven appeared for the interview. Kindly provide documents proving the same. 4 What was the basis for such selection where the faculty member was not present for the interview. Kindly provide documents for this. 5 In the previously held interviews for selection to the post of faculty members, is there a provision for getting the selection process reviewed or reevaluated. 6 Has such selection process reevaluation or review happened after the declaration of results of such interview ever before. What were the basis and outcome of the review or reevaluation process if they were done. Kindly provide document proving this. The RTI office assigned RTI number 3381 to this application. I did not recieve any reply from CPIO PGIMER even after 30 days. I submitted first appeal to the FAA at PGIMER Chandigarh on 28 July 2011 stating the above facts. I appeared in all exam(of two different specialization Finance as main and HR as second) and scored passing marks, however I did not score pass marks in one of the subject. Due to which I was not able to complete my course and attain a diploma from the university. University did not give me opportunity to appear for the exam and refuse to provide diploma. I need help. Can I file a RTI in this case
  23. MUMBAI: When Mumbai-based lawyer VT Gokhale filed a request with the Industrial Finance Corporation of India (IFCI) under the Right to Information (RTI) Act, a response wasn't forthcoming. Industrial Finance Corporation of India produced a certificate from the government that said it wasn't a ‘public body'. Therefore, the company argued, it was outside the purview of the RTI and did not have to respond to the request. But Gokhale persisted and went to Sebi, the stock exchange regulator. Because Sebi is a public body that comes under the RTI's canvas, it could be approached for information on another company controlled by it. Having done that, he also went to the Central Information Commission (CIC) challenging the validity of the certificate issued by the government. In a recent ruling, the CIC favoured Gokhale, pulled by IFCI, declared the certificate it held ‘invalid' and urged government departments and ministries to refrain from issuing such certificates. "Whether an entity is a public authority or not is to be determined only under the RTI Act," it ruled. In July 1996, IFCI had made a public issue of five types of bonds. It collected about Rs 1,237 crore, including a green-shoe option from the bond issue. In 2003, IFCI decided to exercise its call option and asked bond holders to submit the bonds by a specified date. Gokhale's grievance was that IFCI did not pay the redemption money by the promised date and hence, it should pay interest on the delayed period. In his case, Gokhale was paid Rs 99 by IFCI as the penalty, but the company did not divulge full details about similar payments made to others. With the CIC order, Gokhale now hopes to get his answers in a months time. Says RTI activist Shailesh Gandhi, "Many companies try to dodge queries under the RTI by producing such certificates." This is because, the Act is applicable only to entities either run, controlled or substantially financed by the government.
