  2. Dear Members I am new to RTI . My visa case was in German Embassy in 1997 and visa refused and I did not collect the passport from Embassy I email to Embassy about my passport in 2008 but they reply my email that embassy has send my passport to Ministry of external affairs india.I have only email about that and have not any official letter from embassy.I have contacted ministry but no reply from their side.... My Question is that Can I get information about my passport from German Embassy in delhi (India) through RTI ? Please reply your views ... I will be thankful to you... Gagan Punjab India

In a reply to a RTI application, the Ministry of External Affairs (MEA) has confirmed that the following two methods can be used for filing RTIs with Indian Embassies, High Commissions and Consulate Generals located abroad: 1. File RTI directly with the Embassy by email and pay the application fee by e-IPO 2. Send the RTI application to the MEA in Delhi, with the application fee by IPO and they will forward the same to the overseas Embassy. The reply is attached to this post. RTI to Embassies overseas.pdf

    The RTI battle of the NRIs

    As reported in thehindu.com on 03 April 2009: The Hindu News Update Service NRIs face difficulty in availing of RTI facility New Delhi (PTI): Non-resident Indians are finding it diffcult to take advantage of the Right to Information Act with complaints of a cumbersome process of fee-payment for information seekers living outside India. An RTI applicant Lokesh Batra raised the issue with Indian mission in Washington citing problems faced by NRIs in filing RTI applications. "There is no definite procedure to deposit the fee of Rs 10 from there (USA) to the public authority anywhere in India which is a big difficulty for accessing the information," Commodore Batra said. According to the Indian Embassy website, people can submit applications along with documentary proof of Indian citizenship (like copy of personal particulars pages of passport) and send prescribed fee in dollars, equivalent to Indian Rs 10 in cheque or demand draft. However, "they need to send the fee directly to public authority here in India for which the process is quiet vague," Commodore Batra said. "From abroad, payment in India in Rupees for RTI Fee is a cumbersome process, especially when different modes of payment and amount being prescribed and accepted by Center, State Governments and other Public Authorities like Courts "For instance in Uttar Pradesh, one has to apply and paste treasury stamp for getting copy of State Information Commission's order. How can a person will travel all the way from America to paste stamp and get the information?", he asked.
  5. Hi, I need an important piece of information from the Canadian High Commission. I've written several emails and letters to them, but all of those communications have fallen on deaf ears. I have the following urgent questions: Do embassies and high commissions fall under the purview of the RTI act? If not, are there any similar Canadian acts under which I can seek the required information? Please do note that I'm a female citizen of India.
  6. Hello, I am doing some research work in Hamburg, Germany. I need data on judicial system in India like the number of courts (including district courts), number of cases filed, disposed and pending in courts of India state wise. Also, if possible the number of computers in each court. Such information is not available on the internet. So I thought I might ask for them using RTI. Kindly tell me who should I ask for this information. Do I need to write to the Union Law ministry or to every state government? Also, is it possible to get this information in Hamburg? There is an Indian consulate here. This is the first time I am using RTI, so do not know how to proceed with it. Thank You.
  7. Hi All, I've applied for my passport renewal at High Commission of India, London more than 2 months back. I have not received any communication from them. Last time when I went to enquire in person they told me that the status of my passport Renewal/Re issue is ADVERSE however they couldn't provide more details. I've done all the homework and now ready to send RTI. I've few questions 1) How much fee to pay in £ Well there is only one question. Rest I’ve already sorted out. I was browsing through the HCI London website but couldn't find the fee details. Any help?
  8. 1. I received a email from a member of this forum asking if a PIO (Person of Indian Origin) card holder can make a application under the Right to Information Act. The MHA website states that a PIO card holder shall have: (iv) Parity with NRIs in respect of all facilities available to the later in the economic, financial and educational fields except in maters relating to the acquisition of agricultural/ plantation properties. No parity shall be allowed in the sphere of political rights. (The spelling mistake is not mine, I just copied and pasted) (http://www.mha.nic.in/oci/chart.pdf'>http://www.mha.nic.in/oci/chart.pdf) As per my understanding, RTI is not Economic, Financial or Educational. Neither is it Political right. So can a PIO card holder use RTI ? 2. While we are on the subject, can members also clarify, if a OCI (Overseas Citizen of India) or a Dual Citizenship holder, can use RTI ? The MHA website says about OCI: (iii) Parity with Non resident Indians (NRIs) in respect of economic, financial and educational fields except in relation to acquisition of agricultural or plantation properties. No parity shall be allowed in the sphere of political rights. Any other benefits to OCIs will be notified by the Ministry of Overseas Indian Affairs (MOIA) under Section 7B(1) of the Citizenship Act, 1955. As reported on thaindian.com on 04 November 2008: NRIs demand access to information back home under RTI NRIs demand access to information back home under RTI New Delhi, Nov 4 (IANS) Non resident Indians in the US have demanded that they be allowed access to information related to public authorities back home under the Right to Information Act (RTI). NRIs have appealed to the Central Information Commission (CIC) to direct Indian missions abroad to provide information related to public authorities back home under the act. The request from NRIs comes at a time when the country is taking stock of the problems in implementing the RTI Act in the last three years. “The biggest problem we are facing is that the Indian embassy in the US accepts applications related to the embassy but returns RTI applications related to public authorities in India,” said Arun Gopalan, an RTI activist in the US and member of Association of India’s Development, at the CIC’s annual convention here. “I have filed several RTI applications to public authorities in India through the Indian embassy in Washington in the last one year and am still awaiting a reply,” added Gopalan, a software programmer in Maryland. The RTI Act, 2005, does not provide NRIs access to any information related to public authorities in India and they can only seek information related to Indian embassies in their respective countries. The CIC had issued an order in 2007 bringing the Indian embassies abroad under the purview of the RTI Act. Vishal Kudchadkar, a software engineer from Los Angeles, who had filed an RTI application requesting information regarding the decision of the embassy not to forward RTI applications, said: “I hope the CIC will instruct the Indian embassy to forward RTI applications to other public authorities.” According to NRIs, they are unable to participate in the transparency and accountability movement that promises to improve governance in India. “The issue is debatable, as under the RTI Act embassies abroad are only authorised to provide information related to them,” a CIC official said.

As reported by Manoj Mitta of TNN in timesofindia.indiatimes.com on 12 July 2008: Seeking information under RTI a tough task for NRIs-Indians Abroad-The Times of India Seeking information under RTI a tough task for NRIs NEW DELHI: It had first claimed that Indian missions abroad did not come at all under the purview of RTI. And now, making access more difficult for NRIs, the Indian embassy in US has been refusing to entertain RTI applications that did not pertain to information held by it. This is despite an express provision, section 6(3) of the RTI Act, stating that if the subject matter of an application addressed to one public authority actually relates to another, then the former has to transfer it to the latter within five days. The mission in Washington admitted under RTI about a month ago that in 31 of the 45 queries received till then, the NRIs had been "advised to send their applications directly" to the public authorities based in India. The queries sought information on diverse public interest issues such as Narmada project, Nandigram, Dow Chemicals and Bhopal gas tragedy. Though section 6(3) contains no such condition, the embassy announced on its website that NRIs could send their applications to it "only when the subject matter can reasonably be presumed to pertain to the embassy." Disclaiming its statutory obligation to transfer such queries, the embassy said it would not entertain applications where "the information required obviously does not pertain to the embassy." When one of the NRIs asked it under RTI to disclose the file notings that led to the website statement, all that the embassy said was, "The information contained in the website was created by the public information officer (PIO) with the approval of the government of India." On the application filed by NRI Vishal Kudchadkar, the embassy also declined to provide the list of cases in which the applicants had been told to send their application directly to the public authorities in India. It said the disclosure of the list would violate the applicant's "privacy." The ground cited by the embassy for withholding information on the applicants flies in the face of the transparency maintained by the independent appellate body in New Delhi, Central Information Commission (CIC), which lists all its decisions on its website along with the names and addresses of the applicants. But NRIs are aggrieved with the conduct of CIC too. For, despite repeated reminders, the complaints sent by them to CIC all the way from US have not even been acknowledged, let alone being listed for hearing. Though Preeti Sampat, for instance, filed her complaint against the embassy way back on February 17, CIC has so far not sent any acknowledgement of it. Sampat's complaint is gathering dust although it brings out more evidence of the embassy's cavalier approach to RTI. On an application related to the Narmada project, the embassy's PIO first replied that the information was not available with it. When the applicant raised the section 6(3) argument in his first appeal, it was again the PIO who responded (instead of the designated appellate authority in the embassy) and he said that the transfer provision was not applicable since "an explicit request to do so" had not been made in the RTI application.
  11. Recently, GoI decided to accept RTI applications at Indian missions abroad. Could we send applications destined for State and Local government agencies to the Embassy? I have sent an email to Indian Embassy in Washington DC but my experience is that they never respond to any emails.... ANyone have any idea?

Who can do it? - Any Indian citizen with valid Indian passport can file a RTI application in Indian Embassy. Can I file an application? Ofcourse, all of us can file application. In fact, every one should file because: Filing RTI application is easier than your primary school "As I am suffering from..." leave letter. Simple & straightforward procedure empowers you to file as many applications Indian Embassy will automatically transfer your application to concerned department if the information you are asking is not pertaining to them. You will get your response with in 35 days or you can file an appeal to Appellate Authority[AA] and later to Chief Information Commissioner [CIC]. How to file an application? Here are the steps: 1. Make the application: All you need is one plain sheet of paper. You can type or hand-write your application with all the questions you want to ask, Address it to the PIO and sign underneath [yeah, that is all]. You can ask multiple question in same application. Please look at some sample application Few things to note: - Mention that you are exercising your right under RTI 2005 - Attach your passport first page copy - Frame the questions to best of your understanding as "precise" answers depend on precise questions questions. 2. Attach personal check for 24 Cents [equivalent to Rs. 10] and mention in your application that you have attached it. Checks should be made to favoring " Embassy of India, Washington DC".
