  1. Hello, Firstly, this is a wonderful platform. Secondly, I want to RTI NMIMS University. However: 1. NMIMS website and byelaws and resource brochures do not disclose RTI details required by law under Section 4 and other sections. Where do I complain and how? 2. I'm filing RTI for certified copy of answer sheet. Do I have to enclose Rs.2 per page of answer sheet photocopy along with Rs.10 of application fee? What do I do if I don't remember how many pages the answer sheet had? 3. I want to pay by Demand Draft. What name do I write on Payee? Thank you!

DISCLOSURE OF EVALUATED ANSWER SHEETS OF UNIVERSITIES The Central Information Commission has constituted a seven member bench to decide whether evaluated answer sheets of university examinations be disclosed under the Right to Information Act, 2005. In the past, a five member Bench of CIC decided not to disclose evaluated answer sheet. The Bench is constituted on the background of an appeal preferred by a Delhi University Student, who was CBSE XII topper and nominee of HRD Ministry’s Commonwealth Scholarship 2009, who appeared for BA (Hons) Economics Final year exams held in Apr-May 2009 by Delhi University. Not only that she was shown absent in one of the papers, but her score as evaluated by Delhi University was an average 50%. There is no check point over the system of evaluation of answer sheets by Universities or Education Boards. There is neither any effective administrative norm nor any legal remedy to this nefarious problem, which completely distroy the future of millions of bright students across the country. Providing answer sheets may multiply the workload of University / Board is not a reasonable justification to deny information under the Act since the workload that may accrue shall be flowing out of the University’s own mistakes. One cannot claim advantage of his own mistakes. An evaluated answer sheet is in public domain and not exempted from disclosure. As the object and purpose of the Act itself is transparency in public functioning, there is no plausible reason why the evaluated answer sheets should not be disclosed. Section-4(1)© of Right to Information Act, 2005 casts an obligation on every public authority to provide reasons for its administrative or quasi-judicial decisions to affected persons. A student who scored unreasonably low marks or failed even after properly answering questions, is an affected party and has a right to know the reasons of his failure. Conspicuous by its absence of such a provision, the evaluators or moderators are at free will to condemn even the best student. The victims of such unethical act lose faith in the system of education and the constitutional numbness that clip his future. The future of students are bestowed on the system of education. There is reasonable expectation of correct evaluation of answer sheets by evaluators and moderators. Presently, the evaluation done by University is final and a student has no right to know whether evaluation was proper and marks obtained are commensurate with answers written. There is lack of transparency and objectivity in this method. The evaluators are not answerable to anybody. They can evaluate paper at their whims and fancy. There should be a method to check the evaluation system to make evaluators answerable and accountable. Dissemination of evaluated answer sheets under the Act is indispensable to overcome the menace of slack and irresponsible evaluation system of Universities & Boards.

BANGALORE: In a landmark decision, the Karnataka Information Commission (KIC) has ruled that evaluated answer scripts should be made available to anybody who wishes to see them and cannot be kept confidential for the benefit of the examiners. The commission has ordered the Karnataka Public Service Commission (KPSC) to make available the answerscripts free of cost to applicant E Ramamurthy, who sought copies of four answer scripts of the Gazetted Probationers Examinations, 1998. State chief information commissioner K K Misra and state information officer K A Thippeswamy have rejected the KPSC's plea, which said that answer scripts cannot be made public as they are exempted under Sec 8 (i) (e) and 8 (i) (j) of the RTI Act, 2005. KIC observed. More importantly, it has rejected the Central Information Commission's decision under Section 8 (i) (j) saying that seeking evaluated answer papers either his/her own or others is purely personal and has no relationship to any public interest or activity. "This view does not appear correct to this commission. Although the applicant is not to be asked the purpose for seeking information, in the present case, providing the information would ensure the impartiality, objectivity, and fairness of the evaluation by examiners appointed by public services commissions whose purpose incidentally is of utmost concern to the people," it stated. the KIC has held.     Want to see my answer sheets

    Hi, I'm a CA student and have just passed my CA inter exams in May 2011. I wanted to see my answer sheets of the exams. As per the Supreme court ruling dated 09-08-2011, The Institute Of Chartered Accountants of India are liable to Show the answer sheets. I wanted to know about the procedure to undergo so that i could see my answer sheets beginning from filling An RTI Application To Submitting it !!

As reported by the Legal Reporter in telegraphindia.com on 6 March 2008: The Telegraph - Calcutta (Kolkata) | Metro | Answer script suit in high court Answer script suit in high court Several students turned up at the high court on Wednesday to attend the hearing of a case filed by a Presidency College student, asking to see his answer script under the Right to Information Act. Pritam Rooz, the third-year mathematics honours student, had requested the Calcutta University authorities to show him his honours paper V answer script. He had appeared for the paper last year during B.Sc Part II. The university authorities had turned down the request. Rooz then moved the high court, stating that the university had violated the Right to Information Act by not allowing him to see his answer script. On Wednesday, Justice Indira Banerjee fixed the matter for hearing on March 7. Rooz had obtained 28 marks out of 100 in his honours paper V. He applied to the university authorities for review of his answer script. Four marks were added following the process. Not satisfied with the increase, Rooz had asked to see his answer script. The university authorities informed him that the norms did not permit handing over of the answer scripts to the examinees. Rooz then wrote to the university authorities that the Right to Information Act empowered him to see his answer script. But the authorities again turned down the request, stating that the university rules did not come under the purview of the act. “I want to know from the court whether students have the right to see their answer scripts. A student should have the right to know whether his answer script was properly evaluated or not,” said Pritam, who filed the case in the high court in January. Viewing of answer scripts is a long-standing demand of students. In 2003, at least 300 Higher Secondary examinees had moved a PIL in the high court, calling for photocopies of answer scripts to be supplied with results. “The court had turned down the plea but said the agencies that conduct examinations should make the result publication process more transparent. The students are now relying on the Right to Information Act,” said advocate Supradip Roy, who had appeared for the examinees.
  8. Hi, I am working as an Assistant Project Manager in a private company in Anna Nagar, Chennai. I am pursuing MBA 2nd year in University of Madras through Correspondence education. I suspect that the Exam results are not put in a correct legal way. Even though I wrote the exams very well I was failed in 3 subjects. Since the school was late in replying to the RTI plea, a penalty was also imposed. Information commissioner .P. Kejrewal said: “We instructed the school to show the boy his answer sheets and also show him the answer sheets of his classmates. If he wanted photocopies of his answer sheets, then the needful has to be done. We did this to maintain transparency.” Mohsin, a student of Government Boys Senior Secondary School in Dilshad Garden in east Delhi, failed in three of six subjects in his annual examinations. “It was unbelievable that he failed in his class promotion examinations. My nephew had said he had done well. He was not even given his report card,” said Arif, the boy’s uncle. On April 1, Mohsin filed an RTI application requesting the school to disclose to him the marks obtained in all six subjects. “I also wanted to know that even if I failed, why was I denied a report card,” said Mohsin. He also sought information on the pass percentage of Class IX and the rules for granting grace marks along with details of students who were given the same. The school did not respond but, after one month and eight days, it finally agreed to provide the information on the order of the commission. ================================ The full CIC decision has not yet been uploaded on the CIC website.

Exam results confidential, SIC tells driver as reported by Jeeva,TNN, 8 Oct 2008 In an order that could trigger a controversy, the Tamil Nadu State Information Commission has upheld the State Transport Corporation's rejection of an RTI application which had sought the markslist of candidates selected in an examination for drivers last year. The Commission rejected the application filed by S S Gunasekaran from Vellore, saying "the markslist is confidential and an exempted document under the RTI Act." Gunasekaran appeared for the bus drivers' examination conducted by Tamil Nadu State Transport Corporation (TNSTC) in May 2007 but did not get the job. Stating that he had the required education qualification and experience, he filed an application under the RTI Act seeking the disclosure of the criteria on which the selection was made, the list of selected candidates and the marks awarded to them, reasons for his non-selection and the details of drivers who did not join duty after selection. The TNSTC refused to disclose this information. Pointing out that selections were made based on the candidates' age, educational qualification, driving experience and seniority of their registration in employment exchanges, it said the marks awarded by panel experts to each candidate under different parameters were confidential and could not be disclosed considering the "public interest" involved. Gunasekaran filed his first appeal with the appellate authority in the transport corporation which also refused the furnish the information. He then filed his second appeal with the State Information Commission in January 2008 stating that most of the public sector undertakings were releasing the markslist of candidates and that such documents were not exempted under the RTI Act. In May this year, he filed another RTI application with the TNSTC seeking the names of the members of the selection committee and got a favourable reply. However, the corporation still refused to provide him with the markslist. Meanwhile, the Commission held an inquiry in August. Justifying the TNSTC's refusal to disclose the markslist, the Commission said: "We consider that the markslist is an exempted document under the RTI Act and hence cannot order in favour of Gunasekaran. Had he not asked for the names of the selection members, we would have ordered the corporation to disclose the markslist. It is not fair to ask for the names of the members on the one side and for the markslist on the other. It cannot be accepted as per law.'' Ahmedabad, May 11: THE Mahiti Adhikar Gujarat Pahel, an initiative of Janpath, will set up guidance centres in different parts of Gujarat on Saturday to help students studying in Class XII view their answer sheets under the Right to Information (RTI) Act. The results of Class XII (Science) will be declared on Saturday. Guidance centres will be started in Ahmedabad, Naroda, Dholka, Surat, Vadodara, Jamnagar, Bharuch, Surendranagar and Mehasana. Students can file RTI applications to get a copy of their answer sheets in 48 hours with the help of these guidance centres. The guidance centres will function for three days. Apart from guidance centres, a citizens’ orientation camp will also be organised in Ahmedabad. Talking to the media about these guidance centres, Harinesh Pandya of Janpath said, “A lot of procedure needs to be followed to get one’s answer sheet but if a student applies under Section 7 (1) of the RTI Act which says that the information needs to be provided within 48 hours if it concerns the life and liberty of the person, then the burden of the proof is on the PIO if he chooses to reject the application.” The Mahiti Adhikar Gujarat Pahel also revealed its data for the whole year which included the number and the kind of calls made on its helpline. While 12, 427 calls were made last year on the helpline, a majority of calls were made by people seeking information from the State Revenue Department.     Answer Sheet Xerox

    Dear All, One of my friend is doing her Part Time Correspondence Course in one of leading University in India and when the Results was declared everyone was surprised:o. The reason is, one person who has taken exams only for 1 hour in statistics paper, has cleared the exam, and moreover he is not good in Mathematics, even he has informed on several occassion. Plz let me know, whether is it possible to get the Xerox copy of his Answer Sheet. Plz confirm me. Regards, Chandrasekar
  17. Getting to see their corrected answer sheets on demand looks possible for Calcutta University (CU) students, thanks to Right to Information (RTI). The state information commission on Tuesday directed the university to show a former student his evaluated answer script. The student was unhappy with his marks in the B.Com Part II Accountancy (Honours) examination of 2006. The commission, however, added that the university should protect the identity of the examiner and scrutinizer who marked the answer script. The university syndicate on Wednesday decided unanimously to accept the commission’s directive. Suranjan Das, pro vice-chancellor (academic affairs), said that the university was ready to show the student his script. Utsav Dutta, the petitioner, now an MBA student in New Delhi, said: “When the results came out in July 2006, I found I had fared badly in some papers.” He contacted the university, which okayed a scrutiny, but turned down his request to show him the answer script. “I moved high court, which directed the university to show me the script. But the university cited internal problems.” In September, Dutta filed a petition using the RTI clause. “But I still failed to get it and then moved the commission.” The commissioner summoned the CU registrar, who acts as the university’s principal information officer (PIO), and directed him to provide Dutta with the data. Initially, the university officials said such disclosures were exempted under the RTI. The commission held another hearing in early December. “After that, we directed the PIO to disclose the information, as it does not come under the exempted category,” said Arun Bhattacharyya, information commissioner. Dutta, who lost a semester in MBA because he was not issued a marksheet, is yet to receive any communication from the university. The directive may have far-reaching implications. “Since this will set a precedent, more students may approach us. We are considering guidelines for showing scripts to undergraduates and steps are being taken to preserve the scripts,” said pro vice-chancellor Das. About 20 lakh undergraduate answer scripts are examined every year. “The CU authorities and examiners will now be alert, as they can at last be made answerable,” said M.
