  3. When RTI activist Mohit Goel had firstchecked, in case of several schools, DoE reported it didn't have records. The 2010 circular tells schools to place the proposal of an increase before the parent-teacher association (PTA) first, along with "detailed financial statement." The proposal goes to the managing committee only after the PTA clears it. Goel says he wanted to "understand if this system is working" and discovered it is not. "I had first filed an RTI seeking information for all northwest schools (there are 13 school districts in Delhi)," explains Goel. "But I got vague replies."   4. Haryana Paid Rs. 5.5 Crore as Legal Fees For a Single Case NEW DELHI: To fight high-profile cases, state and Central governments often hire senior lawyers. But the previous Haryana government under chief minister Bhupinder Singh Hooda of the Congress was billed an unusually high amount - a whopping Rs. 5.5 crore - to prosecute workers accused of violence at Maruti's plant in Manesar, in the western part of the state. More than 150 workers were arrested - almost all are still in jail - in an outbreak of violence at the Manesar plant of the carmaker in 2012, in A Right to Information (RTI) application accessed by NDTV has revealed that senior counsel and now Congress Rajya Sabha MP KTS Tulsi was appointed by the state as a Special Public Prosecutor (SPP) in the Maruti case. Mr Tulsi charged Rs. 11 lakh for a single appearance in the Gurgaon Additional District and Sessions Court. The RTI reply also details other fees, including that of Mr Tulsi's three assistants - Rs. 66,000 for each appearance - and "clerkage" of over Rs. 1 lakh for his expenses - a total of over Rs. 5 crore in just two years. Mr Tulsi, who has been a Congress Rajya Sabha MP since February 2014, said the violence had caused great alarm in Manesar, the state's industrial hub, and that he was approached by the Haryana government to represent it. But even for a high-profile case, that is a large sum for any government to pay as legal fees to its special prosecutors, especially for a trial in a lower court. In contrast to Mr Tulsi's fees, the special prosecutor in the coal scam case is paid approximately Rs. 33,000 for each hearing. When NDTV persisted with its questions about his fees, Mr Tulsi lost his temper. "I don't want to discuss my fees," he snapped and added: "I will not let you discuss it. It was an agreement between the Haryana government and me. I don't have to justify it." Vrinda Grover, who represents the Maruti workers in the Supreme Court, said it was hard to see how such a major expense was in public interest. "It's the choice of the state who it appoints as SPP, but to use public money for a sum such as this, we can look around to see if that is appropriate," she said. The Haryana Congress couldn't be reached for comment. The new BJP government in Haryana says hiring Mr Tulsi is an example of the old regime's excesses. "The government has its own battery of 85 law officers," said Bhupeshwar Dayal, Officer on Special Duty to Chief Minister Manohar Lal Khattar. "Yet, a questionable amount of money was paid to KTS Tulsi by the Hooda government. We're looking into it." In December last year, Mr Tulsi was dropped from the case. Even as the previous administration is asked to justify spending such an unprecedented amount of public funds on trying its own workers, the BJP must decide on whether Mr Tulsi will get the remainder of his dues - Rs. 65 lakh - still owed for his services.     RTI to MCI

    I need help in forming the question for RTI application to MCI. The information i need is: I request you to provide me with information whether in taking a transfer in 2nd year MBBS after passing 1st year of MBBS, from private to government medical college, both affiliated to MUHS,Nashik, the whole course fees of MBBS is to be paid to the private medical college, even though a person studies only 1st year of MBBS in private college. Please provide me with a certified photocopy of the rule stating whether a person has to pay the whole course fees of MBBS of private medical college before taking a transfer in 2nd year MBBS in another government medical college.

I have written an application letter but I don't know where to pay the fees. Also, I don't know where to send the application to and through what mode. Can someone please help me ?   9. I had made a RTI application to to the Office of Rent controller, Kolkata enclosing Rs. 10 IPO as fees. I have received a letter from the Public Information Officer that the "The requisite fee in form of Indian Postal Order of Rs. 10 as you submitted with the application referred to above is not according to RTI Rules." I have been further asked to submit the fees with court fee stamp of Rs. 10. I understand that there is a notification of the Govt. of India which stipulates that fees can be paid by IPO. I would request some feed back on this. Gautam Roy
  10. I need help from someone having experience in filing RTI by post. I am living in different state than my hometown and I want to file RTI for bad road conditions by Speed post. Apart from Rs 10 IPO, do I need to attach additional fee in order to let them reply my RTI by post or they will bear postal charges to reply my RTI? If yes then do I have to mention about the same in the application?

  13. Pl help. I have paid fees for MBA in a Coimbtore based university which had started new MBA course for CAs providing them exemption in certain subjects. Exam was goin to be held twice in a year. I had paid Rs 30000/- fees for May 2010 exams. Due to certain reasons i could not attend exam & same was communicated to the university & hence exam fees were not paid be me (this is apart from course fees of Rs 30000 above). There was no exam conducted thereafter in 2010. Now i wish to refrain from this exam & hence want to claim back my fees (after deduction of course material & administration charges) and same was conveyed to them. However I was then informed that there is no refund policy made by university. I checked up all my documents and there too there was no mention of refund procedure. My query is that if there is no express denial of refund in any of document can it claim that it is at university discretion? Pl note that this is not mentioned anywhere, nor on docs neither on its website. I have not given any exams so is it justified on their part to deny refund? Whether RTI application should be of any help? In case you require further details pl let me know. Awaiting your guidance. Vishal Shah

  15. In terms of modes of payment, one of the modes of payment is "cash". Is a Money Order as good as "cash" ? Karnataka SIC says so: 3. On issue of summons, the Respondent has filed a written submission dated 30.8.2007. Complainant’s representative states that the further fee sent though the money order is nothing but cash as the postal authority delivery the cash only. Respondent states that there is no provision in Karnataka Right to Information Rules, 2005 to pay the further fee through money order. However, the Commission noted that the money order sent by the applicant is as good as cash. Therefore, the Respondent should have accepted the money order and should have provided the relevant information. Therefore, Respondent wrongly rejected the request. Based on application by Shri Anil Agarwal, CIC has recommended to DoPT to consider bringing the practice of receipt of applications and fees in conformity with Section 6(1) of the RTI Act through the fullest use of electronic means. Therefore, there is no further information accessible under the RTI Act, 2005 and therefore held by the DoPT or under its control, which has not been provided thus far, which renders the appeal unsustainable. Nevertheless, under the authority vested in us in section 25(5) of the RTI Act this Commission recommends for the consideration of the DoPT, means of bringing the practice of receipt of application into greater conformity with section 6(1) of the RTI Act, through the fullest use of electronic means. Thus, the request of applicant Shri Agrawal in 1st appeal cited above may be examined seriously, with all aspects being considered including reliability of systems at present in place for payment by credit cards, before taking a decision on this subject.   17. Vide its order referred to below, CIC has asked Secretary DoPT to ensure that DoPT's instructions are complied to by all organs of the Government. The matter related to a complaint by an applicant that various organs were not accepting fees for RTI Applications payable to "Accounts Officer". The CIC felt that it was not within the jurisdiction of the Commission to issue instructions that DoPT instructions should be followed. http://cic.gov.in/CIC-Orders/WB-01102008-03.pdf "In this case the issue is quite clearly the enforcement of DoPT instructions on recovery of fees. As readily agreed to by respondent Shri S. Twickly in the hearing these instructions will be fully complied with. It is not within the province of this Information Commission to issue circulars to Government on the subject of observing DoPT instructions. This is clearly the responsibility of the concerned department. A copy of this decision may, therefore, be sent to Shri Rahul Sareen, Secretary, DoPT who will take such steps as to ensure that the instructions of DOPT in this matter are complied with by all organs of the Government of India."

    sir/madam, is there need to pay Rs. 10 fees again to appelate authority if the PIO has given incomplete information? if yes, whom should it be paid?

I had asked for the information from an department, however, the department asked me to deposit 3000/- which included Rs.300/- for the print out/photocopy and additional charges as the information is not readily available and they have to hire some people to compile the information. I am not sure if that is allowed and should I pay only 300/-?

DoPT has issued a Office Memorandum (OM) Nr. 12/9/2009-IR dated 24 May 2010 wherein it has clarifed that "additional" fees have to be only as per prescribed rules and no additional fee can be charged for postal expenses or additional manpower, etc. The copy of the OM is attached to this post. Members should note that this will be applicable only to PA's under the centre, unless the nodal departments in each state also issue similar circulars, if there is no provision of such types of additional fees in those States.     deposit of fees

    i have a querry on RTI the information asked for was refused by CPIO, the appellate committe also upheld the decision of CPIO thereafter the CIC has asked the Public Authority to supply the information. My question is whether it is justified and legallly correct that the public authority is asking the applicant to deposit the fees for photocopy of the documents

In a significant order, CIC has ruled that Delhi High Court has the powers under Sec 28(2)(iv) to prescribe a fee for First Appeals: On the issue raised by Shri Sharma regarding the fees charged in appeal, we have examined the Delhi High Court (RTI) Rules. Under Rule 10 the fees of Rs. 50/- is indeed charged for this purpose, in addition to the fee charged at the level of PIO. Under sub sec. (2) of Sec. 28 the authority to prescribe fees is described as below: 28(2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:— (i) the cost of the medium or print cost price of the material to be disseminated under sub-section (4) of section 4; (ii) the fee payable under sub-section (1) of section 6; (iii) the fee payable under sub-section (1) of section 7; and (iv) any other matter which is required to be, or may be, prescribed Sub sec. (1) of Sec. 6 speaks of fees to be prescribed to accompany the request made by a person who desires to obtain information to a CPIO or CAPIO. Similarly u/s 7(1) an application made u/s 6 is to be responded on payment of the fee prescribed. There is indeed no fee mandated in the law for appeal u/s 19 (1) or (3). However u/s 28(2) (iv) the Competent Authority has the discretion to provide for any other matter which is not only required to be, but may be prescribed, as underlined by us in the quote above. In this case, therefore, the High Court of Delhi is well within its authority to prescribe such a fee, keeping in mind only the requirement of proviso to Sub-Section (5) of Sec 7 .that the fee is reasonable inasmuch as it may be in reference to Sec 6 (1) or sub-sections (1) and (5) of Sec 7.     Hi alll! I sent out an RTI application from and there was no reply from the PIO of the branch. what should I do now?! Any action will be taken against this person?! If so, where should I apply and fees (for the same may be included in the reply)?! will I get any compensation for the same(unavailability of data resulting in losses )?! love all

    Hi, 1. What is the amount to be paid for getting info under RTI when sent thru registered post 2. How is it to be paid? 3.   25. Hi, I am currently residing in Pune, Maharashtra. I want to ask to Hyderabad PIO of passport office under RTI act. I've gone through the information in this website for sending it and it was self-explainatory . But I have a question - Whose name should be in payee column of fees i.e. Indian postal order of Rs.10 or DD. As per AP passport website Shri B.Bala Bhaskar is the CPIO (I hope website shows the correct name), should I write his name on the DD or on postal order? And There is an amount require to get the answer of query like Rs.2 per page etc.. so should I also include that amount in DD, as 90% chances are that he will reply;), so why to increase the turn around time. Thanks in advance.
