    how to file rti in ibps

    Hello, I have appeared in ibps clerk 4 written exam held in December 2014. I have secured 120 marks out of 200. I belongs to SC category. Hence i called for interview in February in Lucknow. They have asked me 6 question out of those I have answered them 5 correctly. My interview was really good. But when I see result they have failed me in interview and I don't know the reason for failing me. That's why I want to know the reason for failing me. Pls help me out.
  3. Team, Please guide me: 1. I have filed an RTI application under life or liberty clause with Public Health & Engineering department, Rewari. 2. PIO had provided me partial / incomplete information, but they had manually changes the inspection reports. 3. I have received the information from two PIOs, both had given me different information. 4. One PIO had given the information, while second one is saying that the required information is not available with the department. 5. It was a clear cut case of cheating. 4. I filed a complaint with SIC and ask to take legal action against these PIOs. 5. The compliant was heard by Sh. Hemant Atri Ji, I show him all the proofs of cheating in front of PIOs. He allowed a compensation of Rs. 2000/- and instruct the FAA to enquire the same and submit a report to the Commission. 6. I also requested him to order for remaining information, but he told that there is no provision to order for information under complaint. --> My complaint was already heard on the said RTI application, Can I filed Second appeal now, to get the required information.   4. hello, i need a suggestion on the below for someone that approached me but not able to answer with my knowledge..whether if is it is advisable to file a RTI for this with police.. details - a complaint was filed by the person at the police station in a city in tamilnadu in regards to a theft at home and this is while people are there in home ..and this clearly seems to be the work of masonary that was present on that day called in for some domestic work.it is for a theft of gold worth close to 3 lakhs. after speaking to the suspect, it is all clear that he did it in the way he responds and by his reactions..but not able prove it. a complaint was filed with the police 3 days later after checking thoroughly again ...and the police performs a enquiry with both parties ( the other party being the suspect) ..a special police visits the location after that ( just looked more like a eye wash) and no finger prints were taken after that..but police also feels the same what the complainant felt after talking to the suspect...but asked the complainant to wait for sometime to monitor the activities of suspect and just let the suspect go after giving a strict warning..police says this case seems a sensitive issue that they cannot rush up with..dont know what that means..i always thought police always has a way to get the truth from suspect. and it has been 2 months since this happened...no CSR or FIR was given ..this is in the state of tamil nadu and the complaint is currently abroad with his only old mom living in the city. now, do you advise is it OK to file a RTI with police on this.. basically the RTI applicant wants to know - by filing a RTI with police.... 1. will this make the case and investigation more serious from police side 2. will this RTI backfire in anyway by calling the old mom for any unnecessary interrogation or enquiry or is this RTI is really needed in this case... 3. should the applicant really need to wait for police to get back.. 4. will a FIR be filed on these kind of cases? 5..worst case..would there be any chance where the police would have colluded with the suspect and got any deal striken.. kindly advise on how to proceed here.

Angry over missing Govt file, Bombay High Court directs FIR against officers MUMBAI: Observing that information under Right to Information Act (RTI) cannot be denied to a citizen, the Bombay High Court has directed Deputy Secretary of Urban Development Department in Maharashtra to register an FIR against officers responsible for a 'missing' file. A division bench of the HC further directed that after filing the FIR, the investigation must be completed within six months and it should be headed by an officer not below the rank of Deputy Commissioner of Police. Justices Abhay Oka and A S Gadkari imposed costs of Rs 15,000 on the State Government for the lapse on part of officers which led to a UDD file going 'missing' as a result information under RTI Act couldn't be provided to an advocate. "The case in hand is a classic example as to how the Government officers protecting their fellow officers tend to frustrate the basic intention of the legislature behind the enactment of the Right to Information Act, 2005," said the Judges in their order on Friday. The HC was hearing a petition filed by Sangli-based advocate Vivek Vishnupant Kulkarni, who is also an office- bearer of Swatantraya Veer Savarkar Pratishthan, a voluntary group which runs two schools having 1,600 students on rolls. The 58-year-old petitioner filed an application on September 5, 2008, with the Section and Information Officer of UDD seeking information under RTI in respect of a Government Resolution (GR) dated August 21, 1996. The resolution pertained to release of various lands in and around Sangli city in western Maharashtra which were acquired by the Government under the Urban Land (Ceiling and Regulation) Act, 1976. He sought information about the Government notings and other documents on the basis of which the GR was issued. By a communication dated September 22, 2008, the UDD Information Officer told Kulkarni the required information sought by him regarding file ULC/1089/2123//ULC-2 is not available on the Department's record and therefore, the said details cannot be furnished. In the same letter, the petitioner was also informed that some details sought by him is connected with the office of Deputy Collector and his application to that extent had been transferred to the said authority for further action. Being aggrieved by inaction of the Information Officer, the petitioner filed an appeal on November 27, 2008, before the Deputy Secretary of UDD. The Deputy Secretary asked the Information Officer to search the missing file and give the details sought by Kulkarni immediately.   8. CPIM veteran and former minister Ashok Bhattacharya has decided to file an RTI to bring to light the facts behindthe alleged scams of Siliguri Jalpaiguri Development Authority (SJDA). Speaking to the media persons at Anil Biswas Bhawan in Siliguri Bhattacharya alleged that the funds had been misused for the construction of the 11.5 kilometres of road from Fulbari to Ghoshpukur.   9. CIC has ordered the disclosure of file notings related to the appointment of the chairperson of SBI, since the appointment process is now over. Earlier, CPIO and FAA denied it citing Sec 8(1)(i). The appellant, Shri G Nageswara Reddy, submitted RTI application dated 17 October 2013 before the Central Public Information Officer (CPIO), Department of Financial services, New Delhi; seeking information regarding the relevant File Notings of the appointment of Smt. Arundhati Bhattacharya as chairman, SBI on 7.10.2013 vide notification F.No:2/5/2013BOI. 2. Vide reply dated 18 November 2013, the CPIO denied the information u/s 8(1)(i) of the RTI Act, 2005 as the information sought for was part of ‘cabinet paper’. Not satisfied with the CPIO’s reply, the appellant preferred an appeal dated 26 November 2013 to the first appellate authority (FAA) stating that as the Appointment Committee of the Cabinet (ACC) had already decided the matter and the aforesaid decision has already been implemented on 7.10.2013, the cabinet papers could no longer be held back in accordance with the provisions of Section 8(1)(i) of the RTI Act, 2005. Vide order dated 31 December 2013, the FAA, however, upheld CPIO’s decision. 3. Dissatisfied with the response of the public authority, the appellant preferred appeal before the Commission. 4. The matter was heard by the Commission. The appellant was not present during the hearing. The respondent submitted that the appellant vide his RTI application dated 17.10.2013 had sought copy of file notings of the appointment of Smt. Arundhati Bhattacharya as chairman, SBI which was part of the proposal to be placed before the Appointments Committee of the Cabinet which they had denied under the exemption given u/s 8(1)(i) of the RTI Act, 2005. The FAA had also upheld the decision of the CPIO. 5. During the hearing, the respondents stated that the selection process had been concluded and therefore, they will be able to provide the information sought by the appellant. 6. In view of the above, the Commission directs the respondent to furnish the information sought for to the appellant by 31st December 2014 keeping in view the provisions of the RTI Act, 2005 & RTI Rules, 2012.   11. Hi RTI Activists, I want to file an RTI in Himachal Pradesh state department (HPPSC), but being an NRI I can only file RTI with Union of India online. I have drafted the RTI application here ... (please attach the document instead of link) Can anyone file the RTI on my behalf and post the results back here?   12. Sir, In my locality one of my neighbour is given contract to some mobile company to erect mobile tower. The area is highly populated by nearby houses and a hospital within 200 mtr distance. Even the person is not disclosing the details in this regards and he did not get permission from any of the neighbors.Hence, i would like to file and RTI for the information, its approval, etc..One draft of the RTI framed by me by browsing the site is attached hereRTI mobile tower thrissur.docwith.   13. Under RTI to the PIO , whether can I ask about a Govt. Servant Past criminal history, any pending criminal cases, or disciplinary action is pending ,has he appeared with respect to any criminal court case as a witness or has he attending a criminal court case as a witness. After asking this under RTI, If any case if it is not there , whether will he file a defamation case against RTI applicant.

Dear friends, Since quite some time we are observing CONFLICTING OPINIONS BEING EXPRESSED BY MEMBERS on the issue of applicability of RTI Act,2005 in respect of NON PUBLIC AUTHORITIES(PRIVATE ORGANISATIONS). Several members put querries that some private but recognised school is NOT GIVING ME SOME INFORMATION RELATED to student education/certificates and another member asks ask about PRIVATE UNIVERSITIES RECOGNISED BY UGC and Some members ask what action I can take against a kirana shop which is charging more than MARKED PRICE ON THE PRODUCTa and this list will go on but the MAIN ISSUE HERE is whether the RTI Act ,2005 will apply in these cases so that the members can file RTI Application and if so to whom it is to be addressed(PIO).Promptly some senior members reply to these NEW MEMBERS that these are PRIVATE INSTITUTIONS AND ARE NOT PUBLIC AUTHORITIES AS DEFINED IN Sec2(h) of RTI Act and therefore, you can not file RTI with these institutions/organisations.While this was so the very next moment some other senior member POST HIS COMMENTS STATING THAT THE school is recognised you file RTI with DEO who is a public Authority.Here both the FIRST MEMBER AND THE 2nd Member are THUS DIFFERED AND THE NEW MEMBER WILL SCRATCH HIS HEAD AS TO WHAT EXACTLY HE SHOULD DO. The issue here is the DEO who is the public authority and who will oversee functioning of the schools or labour inspoector who oversee the labour aspect of the general/kirana store or the Legal Meteriology department who deal with less weighing/less packings or charging more money then packing rate printed though public authorities MAY NOT BE IN A POSITION TO TAKE ANY ACTION AGAINST THE SCHOOL/SHOP BASING UPON YOUR RTI APPLICATION.He cannot also give any INFORMATION TO YOUR QUERRY AS THE INFORMATION is NOT AVAILABLE WITH HIM IN A HARD COPY FORMAT OR SOFT COPY FORMAT and thus he cannot give any information as asked for by the applicant and if it is FORMAL COMPLAINT AGAINST THE SCHOOL OR SHOP HE CAN TAKE ACTION AS DEEMED FIT AFTER CHECKING THE GENUINESS OF THE COMPLAINT which he cannot do on the RTI Application basis as it is only AN APPLICATION SEEKINHG INFORMATION AND NOT A COMPLAINT.In one case of COOLING CHARGES THE THREAD WENT ON FOR SO MANY POSTING ONE MEMBER AFTER THE OTHER for days together and we are not CLEAR AS TO WHERE IT ENDED .SO ALSO REGARDING EDUCATIONAL INSTITUTIONS AND UNIVERSITIES WHICH ARE private.The TOP MODERATORS AND VERY SENIOR MEMBERS SHOULD EVOLVE SOME SCIENTIFIC WAY OUT AND THERE SHOULD BE A LINK FOR THIS PURPOSE AND INSTEAD OF WASTING ONE COMMENT AFTER THE OTHER THAT TOO WHICH ARE contradictory with each each other the NEW MEMBER WANTING CLARIFICATION CAN BE DIRECTED TO SEE THE LINK WHICH WILL BE GOOD FOR THE MEMBERS AND ORGANISATION WHICH IS very very repute(RTI.INDI.ORG).i REQUEST THAT THIS MAY BE EXAMINED TO FORMULATE CLEAR POLICY ON THIS TYPE OF SUBJECTS.

  17. Hi My name is Sai Ghatpande, a resident of Mumbai. My passport was expiring this June and hence on 23 Jan 2009 i submitted my papers to the Passport office. It took 2 1/2 weeks and my papers hadn't reached my local area police station. When i made inquries, i was told that my papers were misplaced and i had to go to the CID office to get duplicate papers. The papers were then re-submitted to the Oshiwara police station and on 21 feb 2009 i went and signed for my verification. Since then i have been waiting for my passport to be delievered. Today when i checked on their website, it said that on 15.04.2009 my passport will be dispatched. Which means the whole proceedure will take over 2 months and i dont even know when i am getting my passport. I was told that filing a complain with RTI will help. I mailed my complaint to the address that was given on the mumbai passport website. I am hoping that you guys help me and tell me what i can do, can i gfile a complain? if yes, then where...     Repetition to PIO

    I have filed a RTI two weeks earlier and now i have come across some information pertaining to the my submitted RTI question from reliable source and Iam satisfied with the source information. Now is it possible for me to drop those(two) question befor 30 days of period? I believe if i continue with the question as i already have information(not for every question just two information out of eight question)it would be waste of money to pay for known information.   19. 12 April 2007 Refusing Mission Netaji's plea to review its decision in Netaji-R&AW case, the Central Information Commission (CIC) has stated that it has "no jurisdiction to pass any orders/decisions" to India's external intelligence agency Research and Analysis Wing (R&AW).   21. Hello, I have a query, I want to file an RTI through my lawyer who is in India. (In other words, the lawyer files the RTI on my behalf) Is that at all possible.??? I can give him a no objection certificate. (NOC) I read through the RTI act and there seems to be no mention of this. Can you help me out on this please.!! Yes both me and the lawyer are citizens of India. I just moved out of India a couple of years back for study purpose. I also looked up this forum and there seems to have been conflicting answers. (some say yes, some say no, some say NOC is required) If this is possible can you point me towards the direction of this. (my personal thoughts, it should not be a problem, why should it, both of us are citizens of India, I want to use him and his skills as a lawyer to take appropriate response and take the matter to court , that should not be a problem. CENTRAL INFORMATION COMMISSION Appeal No.ICPB/A-1/CIC/2006 Right to Information Act – Sections 6/18 Name of Appellant : Satyapal Name of Public Authority : CPIO, TCIL DECISION Decisions appealed against : The CPIO, TCIL has declined to supply a copy of a document on the ground that the same forms part of “file Noting” which, according to CPIO is exempt under the RTI Act. Appellate authority also has confirmed the decision of the CPIO. The appellant contents that he has the right to seek information contained in the “File Notings”. Facts Shri Satyapal – appellant, a resident of Delhi, applied to the CPIO, TCIL seeking for copies of certain documents by a letter dated 17th October, 2005. By a letter dated 14th November, 2005, CPIO, TCIL furnished copies of certain documents, however, stating that a particular document sought for was a file noting in the Department of Telecom and as such it was exempt from disclosure. By a letter dated 17th Nov. 2005, Shri Satyapal again wrote to the CPIO, TCIL pointing out that the information sought for by him did not fall within the ambit of Section 8 of the RTI Act and as such the same should be supplied. He also brought to the notice of CPIO, TCIL that in respect of information already furnished, a copy of a bill in respect of advertisement relating to independence day 1996 had not been supplied. By a letter dated 28th Nov. 2005, the CPIO, TCIL while furnishing a copy of the bill, once again reiterated that file notings are exempt from disclosure in terms of the clarification given by the Department of Personnel in their website. Aggrieved by this decision, Shri Satyapaul preferred an appeal to the appellate authority by a letter dated 14th Dec. 2005 stating that file notings are not exempt from disclosure in terms of Section 8 of the RTI Act. He followed up the same by letters dated 14th Dec., 31st Dec. 2005 and 5th January, 2006. The appellate authority by a letter dated 5.1.2006 rejected the appeal stating “The information sought by you pertains to the file notings of the Department of Telecommunication as also that of TCIL. I am of the view that TCIL is exempted from disclosing the information sought by you under Section 8(1)(d)&(e) of the RTI Act. UO No.7-17/95-PP dated 4.10.1995 is a part of file notings. You have mentioned in your appeal that the information has been denied misconstruing it as “file notings” by CPIO, TCIL. I confirm that these are notings in the file”. Aggrieved with the decision of the appellate authority, Shri Satyapal has filed this appeal before this Commission. According to Shri Satyapal, there is no specific exemption from disclosure as far as file notings are concerned in Section 8 of RTI Act. Commission’s Decision : It is seen that while the CPIO declined to furnish the information sought for on the ground that file notings are exempt from disclosure, the appellate authority, without confirming or rejecting the stand of CPIO that file notings are exempt from disclosure, has relied on Section 8(1)(d) and (e) of the RTI Act to deny the information. As is evident from the Preamble to the RTI Act, the Act has been enacted to vest with the citizens, the right of access to information under the control of public authorities in order to promote transparency and accountability in the working of any public authority. Conscious of the fact that access to certain information may not be in the public interest, the Act also provides certain exemptions from disclosure. Whether file notings fall within the exempted class is the issue for consideration. Section 2(f) defines information as “Any material in any form, including records, documents, memos, e-mails, opinion, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law or the time being in force”. Section 2(j) reads : “Right to information means the right to information accessible under this Act which is held by or under the control of any public authority and includes the right to (i) inspection of work, documents, records; (ii) taking notes, extracts or certified copies of document or records; (iii) …… (iv) …. “. In terms of Section 2(i) “Record” includes (a) any documents, manuscript and file; In the system of functioning of public authorities, a file is opened for every subject/matter dealt with by the public authority. While the main file would contain all the materials connected with the subject/matter, generally, each file also has what is known as note sheets, separate from but attached with the main file. Most of the discussions on the subject/matter are recorded in the note sheets and decisions are mostly based on the recording in the note sheets and even the decisions are recorded on the note sheets. These recordings are generally known as “file notings”. Therefore, no file would be complete without note sheets having “file notings”. In other words, note sheets containing “file notings” are an integral part of a file. Some times, notings are made on the main file also, which obviously would be a part of the file itself. In terms of Section 2(i), a record includes a file and in terms of Section 2(j) right to information extends to accessibility to a record. Thus, a combined reading of Sections 2(f), (i)&(j) would indicate that a citizen has the right of access to a file of which the file notings are an integral part. If the legislature had intended that “file notings” are to be exempted from disclosure, while defining a “record” or “file” it could have specifically provided so. Therefore, we are of the firm view, that, in terms of the existing provisions of the RTI Act, a citizen has the right to seek information contained in “file notings” unless the same relates to matters covered under Section 8 of the Act. Thus, the reliance of the CPIO, TCILO on the web site clarification of the Department of Personnel to deny the information on the basis that ‘file notings’ are exempted, is misplaced. However, it is seen from the decision of the appellate authority that he was of the view that TCIL was exempted from disclosing the information sought, under Section 8(1)(d)&(e) of RTI Act. In terms of Section 8, there shall be no obligation to give any citizen information relating to matters covered under subsections (a) to (j) of that Section. Section 8(d) exempts information including commercial confidence, trade secrets or intellectual property and Sub section (e) exempts information available to a person in his fiduciary relationship. Even then, at the discretion of the competent authority even these information could be disclosed if he is of the opinion that public interest so warrants. From the decision of the appellate authority of TCIL, which is not a speaking one, it is not clear whether the file notings, a copy of which was denied to the appellant, relate to commercial confidence or trade secret or intellectual property or is available to TCIL in its fiduciary relationship. Direction : Since we have held that file notings are not, as a matter of law, exempt from disclosure, the CPIO, TCIL is directed to furnish the information contained in the file notings, on or before 15.2.2006 to the appellant. However, if the CPIO, TCIL is still of the opinion that the said file notings are exempt under Section 8(d) & (e), he is at liberty to place the file notings before the Commission on 13.2.2006 at 11 AM to determine whether the same is exempt under these sections and even if so, whether disclosure of the same would be in the public interest or not.   23. The proposed amendments to this Act were or are: All file notings to be exempted except for social and development projects. No cabinet paper to be disclosed even after a decision has been taken. Aren't these both amendments fatal to the spirit of the main Right to Information Act of 2005? The government's intent in confining it only to social and development projects is a very worrisome limitation. Any file note may end up being considered as not pertaining to social or development project, just to deny access.

File notings under RTI after debate with section of society: Wajahat Habibullah Chief Information Commissioner Wajahat Habibullah said if the government decides to bring the bill to keep file notings outside the purview of the Right To Information (RTI) Act in the winter session, it will only be after debate with all sections of the society. "The civil society and the government are the decision makers on the Act. The Central Information Commission job is only to implement the Act, ' Habibullah said speaking at an interactive session on Right to Information Amendment Bill, 2006 organised by the NGO CUTS International. He said that all government departments have been directed to make a comprehensive compliance report of Section 4 of the Act dealing with maintaining data and information catalogue of information related to the department and submit it to CIC. The report will be submitted to the Parliament in the forthcoming winter session. Arvind Kejriwal, CEO of Parivartan and 2006 Magsaysay Award winner, said that the amendments do not pertain to file notings only as has been projected in the media. "If the amendments come through, the government will be able to keep the entire country out of the decision-making process. This is because the amendments provide that the departments will not give information on any issue till such time the matter is completed," Kejriwal said. Another important lacuna, he said, was that even after the decision was made, the entire information would not be provided and only file notings related to social and development work will be available. "So, if a citizen wants to know the status of his ration card or passport he would not get any information because this did not pertain to any social or developmental work," Kejriwal said. Also, all matters related to personnel will be out of the purview of RTI. Any information related to examinations process will also not be shown, he said. Pradeep S Mehta, secretary general of CUTS International, urged CIC to take up the role of advocacy given the extremely low public awareness on the usage of the act.
