  1. Transgenders can now mention themselves as "third gender" while seeking information on governance related matters through online RTI application through the website. The Department of Personnel and Training (DoPT) has introduced a field -- third gender -- other than male and female on the RTI portal. "The field 'third gender' has been introduced on the website allowing transgenders to give detail of their identity while filing RTI applications online. Though it is not a mandatory field but it will help the government in collecting data on different categories of people filing queries under the transparency law," a DoPT official said.   5. Hello, Hon. Experts, It is my experience that RTI queries are neither satiafactorily replied to by the PIOs nor properly attended to by FAAs. under such circumstances what is advisable? To file a complaint under section 18 or to file second appeal under 19(3), however I have noticed that it takes prohibitively long for a second appeal to bear fruit that is to be called for a hearing. Most of the times this inordinate delay renders the original complaint infructuous, and leaves the complainant exasperated. Please, therefore, advise the pros & cons of complaints under section 18 of RTI, does it give one a chance of getting a quicker solution to one's complaints/applications? Thanking you all in anticipation, Senior Citizen.
  6. Hello, This is Deepti, a final year student of Uttar Pradesh Technical University. My University is renowned for irregularities in answer sheet evaluation. Your marks completely depends on your luck i.e. who has checked your copy in what mood. I have tolerated this for past three years, but the results of 7th semester are so discrepant that I applied under RTI requesting photocopies of my answer sheet. (I have applied today, results were out two days before, on 13.4.2015) But I want to know, how I am going to match my copy with the copies of students who have scored more? (The college examination results are quite contrary to University results, which strengthen my belief of discrepancy ) Is there no apex Institution to check the state universities?

NEW DELHI: Lok Sabha and Rajya Sabha secretariats and Delhi High Court are among some prominent offices which have not filed mandatory annual reports of compliance of RTI Act even once since the transparency law was enacted nine years ago, according to an advocacy group.   9. Hello, My wife filed false dowry cases on me and my parents. The case is in court and we are all participating in the trial. We filed RTI to get information about my in-laws income tax returns, various welfare schemes of Depart of Rural Development in which my in-laws are taking advantage of. We wanted to use this information to show the financial status of my in-laws family in the court when appropriate. The concerned PIOs replied to our RTIs in time with information requested. My wife filed a complaint in police station saying that by filing RTIs to income tax department and Department of Rural development we are harassing her and her family. The police opened FIR. RTI is a fundamental right and we used it to protect ourselves in the court. My wife who is looking for opportunities to file more false cases on us has been very persistent and successful in getting a FIR opened. Please advice whom should I write to help in this regard.
  10. zee News, 21.3.2015 Chennai: Holding that mere confession in the absence of evidence cannot be the basis for filing chargesheet, Madras High Court has quashed a murder case against a man, charged with killing his wife, and six others, accused of abetting it. The accused need not be made to go through the rigour of trial, as the entire case had been built on mere confessions made by key suspects to police, Justice R S Ramanathan said allowing a petition by the accused seeking quashing of the case in a magistrate court. "Charge sheet cannot be filed against the accused solely on the basis of confession, which does not lead to recovery (of evidence). In this case, except the confession, there is no recovery. Therefore, the confession cannot be the basis for conviction, even accepting it as true," the Judge ruled. Quoting Supreme Court verdicts, he said "When the confession does not lead to recovery, the confession is inadmissible in law, and the chargesheet based on such confession has no legal basis, and is liable to be quashed."

  12. Hyderabad: The opaque manner in which officials are functioning appears to kill the very spirit of empowering people. Here is an instance where an official took nearly a month to reply to an RTI applicant. The reply reflects the prevailing “babu culture” in government administration. Instead of providing the information, the officer concerned directed the applicant to seek it from another source. What beats all is why the officer took 30 days to “provide this information”. A Dalit, who sought details, through an RTI, of the land tax and property tax paid by a private college that came under the jurisdiction of the local panchayat, was attacked by an unidentified gang on Friday.   14. Dear Team,I have a court fee stamp of Rs 5 dated 5th February 2012 with me can I file a RTI application using this stamp. Also let me know about the validity of an court fee stamp in Maharastra (Mumbai). I have tried finding validity of a court fee stamp under Bombay Court-Fees Act,1959 but was not able to find any such section or amendment mentioning the validity. Thanks Yogesh
  15. Hello,Wish to ask that whether filing a 1st appeal also carry any nominal charge similar to the case of an Original RTI? Secondly, do one has to especially approach in person to meet the First Appellate Authority & thus file 1st Appeal? Lastly, can a First appeal be simply mailed through Speed Post for the designated Authority?Thanks. A Prompt Reply will be sincerely appreciated!

This letter was in response to my mail to Secretary DoPT in trail. I have so far filed 74 RTIs through e-Mail by attaching signed and scanned copy of my RTI Application and e-IPO (pdf) (Electronic Indian Postal Order) in PDF format. The list include RTIs in DOPT, PMO, MEA, MOIA and 67 Indian Missions/Posts Abroad. Signed and scanned copies of Responses have also been received by emails as per request included in my RTI application.e-IPO can be directly download in PDF format.   17. Can a housing society expel its member for filing too many RTI Applications ? Recently, a housing society in Bandra, Mumbai has soughtexpulsion of one of its members. The complaint against him was that he used to harass the society by filing Right To Information (RTI) applications. The Co-operative Societies Act, which also governs housing societies, allows this. But the process is not easy. A co-operative housing society can expel members under Section 35 of the Maharashtra Co-operative Societies Act, 1960. According to the Act, a member can be expelled if he/she willfully deceives the society, provides false information to the society, acts against the society’s by-laws, does not pay the society’s dues persistently or is involved in illegal or immoral activities. The co-operative societies rules are similar for other states and include similar provisions for expelling members. However, the conditions are subjective and the society has to prove it to the Registrar of Co-operative Housing Societies. The member can challenge the order in court. Filing RTI applications to become simpler NEW DELHI, JUNE 19: The Central Information Commission (CIC) has come up with a ‘codified set of regulations’, to simplify the process for filing RTI applications. These regulations will help in countering the longstanding problem of dealing with frivolous complaints. The regulations, which will be uploaded on the Commission website tomorrow, will inform applicants, among other things, about how to properly document, scrutinise and complete the forms in order to be admitted for appeal before the CIC. The CIC will henceforth bring out a cause list of the cases coming up for hearing. It will also have a Registry to scrutinise, format and properly document applications. It will also see whether the application is time barred and thus help in early disposal of cases. According to the new regulations, a full bench hearing a case will now comprise three members instead of the existing practice of the full commission sitting for a hearing. Applicants will also be informed whether the matter is to be put up before a single bench, a division bench or the full bench. Chief Information Commissioner Wajahat Habibullah said, “This will make the whole process more systematic. At the same time, it will help the public to know how the CIC functions and how their cases are dealt with.” The CIC had in the past tried coming up with a cause list but it didn’t work. “Till now, cases without proper documentation were also listed for hearing just because they were marked to the Commissioner.   20. Is there any general convenient way of filing RTI applications for Delhi state govt offices? I found that most of the websites of Delhi govt offices demand the applicants to visit to the premises of that particular office. Delhi govt has opened multiple kiosks across the state that accepts a lot of applications/bill-payments on behalf of Delhi govt; but these kiosks seems not authorized to take RTI applications. In contrast, central govt offices accept RTI applications via speed post and courier. Also, in one of the media reports, it was said the Bihar has Call-center based common RTI-point for all the Bihar state offices -- this is probably the best way of letting people use RTI. Has CIC left making of these procedures to the discretion of state-govts? Or CIC's role is limited to center only? I'm not able to understand why the RTI application/reply processes are not made uniform across the country (be it state of govt business).

Practise Filing One Application in Month under RTI Mangalore, Nov 5: �For the betterment of your own, make a practice of filing at least one application in a month under the Right To Information (RTI) Act,� said renowned RTI activist Shailesh Gandhi. He was addressing the Citizens at Lions Seva Mandir here on Saturday November 3. He further said that by filing the application one can shake the government. The entire administrative machinery can be reformed in three years, if 25 to 30 lac people, out of 100 crore population, file the application seeking information under the RTI Act, he informed. In order to make effective use of the most powerful weapon, it is necessary that all should have a strong will in the form of the RTI Act, he added. After a long, continued struggle the Act came into existence, said Gandhi. It was also an ideal democratic tool to realize the dream of Sampurna Swaraj, he added. All these year the biggest democracy remained a participatory democracy and not functional democracy. So today with the RTI act in hand, we can make it function for the betterment of the country, he added.     "Who is responsible for providing the the information under RTI Act, in the case of Meghalaya, where in each and every District there is District Information Officer and District Information & Public Relation Officer, if the information is filed, was meant in the Office of the District Institute of Educational Training and to whom shall I file the Application."
  23. The thought of filing an RTI application in a typical sarkari office may have deterred you from using your right. Soon, there will be an alternative that is close to your home and less bureaucratic. Your neighbourhood post office. The Central Information Commission has asked the government to tell all ministries to notify post masters as Assistant Public Information Officers (APIOs), assigned with the duty to receive the application and forwarding it to its destination. "We have asked Department of Personnel and Training (DoPT) to ensure that the ministries notify post offices as centres to receive applications," Chief Information Commission of India, Wahajahat Habibullah told the HT. The arrangement to make post offices as nodal offices to receive RTI applications was already there but most of the central government ministries were reluctant to notify them as APIOs. It was primarily because of two reasons. First, that it would increase the workload of handling RTI applications. Second, there was a dispute over how much money post offices should charge to provide the service. The post offices are charging Rs 10, which is given as RTI application fee as charges for accepting and mailing the application whereas the CIC says it has no claim over RTI application fee. To find a solution to the problem, Habibullah has suggested that post offices can charge a nominal amount of Rs 10 over and above the RTI application fee per application. In addition to this, he has asked DoPT to issue instructions to all central government ministries to notify post offices for receiving applications. So far, Goa is the state that has notified 433 post offices as RTI offices. There, the duty of the APIOs is to send the application to the Central Principal Information Officer of the concerned ministry. Some states have also notified a few post offices but most of the ministries are yet to conduct the exercise. The CIC has itself gone a step ahead.   24. Is is possible to submit complaints u/s 18 to the CIC through the Designated CAPIOs of Department of Post? Many Designated CAPIOs are refusing to accept Complaint Applications U/s 18 saying that they are not entitled to do so. Is there any circulars available online on this issue? Sidmis
