The Madhya Pradesh State Information Commission (MPSIC) fined with Rs5000 the then Public Information Officer (PIO) and Joint Collector HS Bhadoriya for violating of Right To Information (RTI) Act.     THIRUVANANTHAPURAM:Coming down heavily for not divulging information sought in an RTI, the State Information Commission has imposed a fine on Pangode grama panchayat secretary. Jasi K C, the panchayat official, had not replied to the majority of the questions sought by Human Rights Protection Forum convenor Thembamoodu Sahadevan on March 8, 2013 through an RTI query. BAREILLY: Six years since a national ban was imposed on smoking in public places, in Bareilly city, which has a population of over 12 lakh, only 138 people have been challaned for the offence so far and a fine of Rs 23,625 added to the government treasury. "The dismal number suggests that the anti-tobacco drive run by health and district authorities has only been a formality and no officer is serious about it. Not less than 100 residents can be seen smoking in public on a single day. Slapping penalty on only a few will have no impact," said Pradeep Kumar, a social activist. He further said, "To ensure that minors do not fall prey to tobacco products, there is a need to make them aware about its harmful effects from a very young age." The challans were issued between December 2014 and March 2015. Urvashi Sharma, an RTI activist, had filed a plea before authorities seeking the number of people fined between July 10, 2009 and November 11, 2014. TOI had reported how the directorate of local bodies in Uttar Pradesh was unable to give her a concrete answer. MANGALURU: The Mundur panchayat development officer, who is already in the dock for allowing a village panchayat member discharge multiple functions, has now been fined by the Karnataka Information Commission (KIC) for not giving information to a Right to Information (RTI) query. The Karnataka Information Commission has issued a show-cause notice to Bengaluru South Tahsildar Dr Dayanand for not providing information sought by an applicant under the Right to Information (RTI) Act. Information Commissioner T Rama Naik slapped the show-cause notice on the tahsildar, asking him why disciplinary action should not be taken against him for denying information to an RTI applicant, P Kalidas Reddy.   12. The Taj Mahal Palace and Tower hotel will have to pay Rs 63 lakh to the Brihanmumbai Municipal Corporation (BMC) for occupying a Colaba road. The road, approximately 1,350 square meters in area, is in front and around the hotel premises. A Right To Information (RTI) application filed by activist Sanjay Gurav revealed that despite several reminders to the hotel management, sent from August 2011 till date, the authorities did nothing regarding the matter.     RTI fallout: Collector fined as reported by Faizan Ahmad,TNN 12 Oct 2008, Times of India Cartoonist R K Laxman’s common man is no longer a hapless commoner. Armed with a constitutional weapon provided by the Right To Information (RTI) Act, he is now empowered enough to expose the powers-that-be and ensure the erring ones among them are taken to task. This is exactly what Ram Pravesh Rai has been doing for sometime now. This 48-year-old farmer from Buxar has almost dedicated his life to dig out the truth buried in official files and expose the erring babus. Thanks to his relentless efforts, a district magistrate (DM), who once sent him to jail, has been fined by the State Information Commission (SIC). The former Buxar DM, Vishnudeo Prasad, was fined Rs 25,000 by name and the money has since been deducted from his salary. His successor in Buxar was also slapped a fine of an equal amount. But at a later meeting of the full bench of SIC, the recovery of fine from the present DM has been stayed. Rai, an activist of Soochna Ka Adhikar Manch, is often seen carrying a heavy bundle of photocopies of official documents he has procured through RTI, and even a cursory look at these documents provides enough evidence of corruption, embezzlement of government funds and evasion of taxes worth several crores of rupees in Buxar district alone. The information he has secured concerns implementation of three government-sponsored schemes - Million Shallow Tubeless Yojana, Pradhan Mantri Rojgar Yojana and the scheme for loan to purchase tractor - during the last six to seven years. "What is surprising is that such corrupt practices continued not only during the RJD regime but also under the ‘sushasan’," rued Rai, showing the documents. Chief minister Nitish Kumar too knows most officials do not want to supply information to public. "Justice can be provided to people through RTI but the problem is that some officials with old mindset are hesitant to make official information public," he once said at a function of SIC. Noted social activist Parveen Amanullah, the founder head of `Soochna Ka Adhikar Manch’, said since the information dissemination mechanism is still in a very early stage, it is not functioning satisfactorily. "The officials are supposed to keep details readily available but they are not doing it," she said. SIC spokesman Rambadan Baruah admitted that certain officials are still hesitant to share information with people.     Info panel slaps fine on two tahsildars

    As reported by Jayaraj Sivan, TNN at timesofindia.indiatimes.com on 30 March 2009 CHENNAI: Acting on an RTI petition seeking to expose the forgery of revenue records by a person who had encroached upon a lake at Pallavaram, the state information commission has imposed a fine of Rs 25,000 each on two ex-tahsildars of Tambaram who not only failed to remove the encroachment but also provided false information to the petitioner. The issue dates back to 2006 when RTI activist T Retna Pandian brought to the notice of the Kancheepuram district collector that a new encroachment had come up on the Ramasamy lake near Pallavaram railway station. He pointed out that A Jameela, who had earlier constructed a shop on the lake land and been evicted by the revenue officials once, had returned to the same spot and put up another construction and also applied for a power connection from the Tamil Nadu Electricity Board using a forged NOC from the village administrative officer. The forgery came to light when revenue officials, responding to a query from Pandian, dismissed the NOC. Pandian also found that the seal on the document produced by Jameela did not match the official seal of the VAO. Also, the fake NOC was signed in green ink; VAOs are not authorized to use green ink since they are non-gazetted officials. Pandian, in his complaint, said he was forced to approach the collector because the jurisdictional tahsildar had excused himself from removing the encroachment saying he was busy with the assembly elections. Independent of Pandian's petition, another activist, K R Ramasamy (Traffic Ramasamy), also sent a fax to the collector informing him about the encroachment. With the petition evoking little response, Pandian filed an RTI application to the collector seeking details of the action taken against the encroacher. The issue was referred to the Tambaram tahsildar for inquiry as well as for replying to Pandian. But neither the tahsildar nor the appellate authority, PA (general) to the collector, gave replies to his queries. Pandian then moved the information commission on appeal. The commission ordered tahsildar to provide replies to the queries immediately. As the reply skirted the main issue of removal of the encroachment, Pandian once again approached the information commission. Passing orders on his petition, on August 6, 2007, the commission asked the collector to carry out a "special investigation by a senior officer and keep a personal watch on the investigation to check what went wrong." The Collector was asked to also probe how false information that Ramasamy's fax had not reached the collectorate could be provided to the commission by the PIO. As the commission's order made little impact on the officials, Pandian moved the information commission once again pointing out the laxity of revenue officials. The petitioner pointed out that Jameela had put up a pucca structure and obtained power connection too as no official had taken pains to evict her. The commission, which passed orders recently, imposed a fine of Rs 25,000 each on the two tahsildars who had been in that post at Tambaram during the course of the case for disobeying its directive. As reported by Times of India, Pune on 18 February, 2009 PUNE: In a major setback to the Pune Mahanagar Parivahan Mahamandal Limited, state information commissioner (Pune bench) Vijay Kuvalekar on Monday ordered the company administration to pay a fine of Rs 25,000 to the government treasury for failing to provide information under the Right to Information Act to an activist. As per the order, the fine is to be recovered from the officers responsible for failing to provide the information about a bill issued for 60 propeller shafts on a work order, issued by the PMPML in May 2006, for getting 30 propeller shafts. The order states that responsibility for not providing a photocopy of the bill is to be fixed on all the concerned officers, including traffic manager (vigilance department chief) S G Gavli, chief accounts and finance officer D V Unavane, chief internal accounts examiner Z A Sayyed and the then manager (traffic and administration) Shivraj Rane. The order adds that the fine should be recovered from the salaries to be paid in February and March, and this should be noted in the confidential report and service book of the concerned persons. The order asked the PMPML's executive director to get a copy of the bill from the concerned company and give it to activist Maj Gen S C N Jathar (retd) before February 25. The information commissioner has also asked the PMPML administration to initiate action against the concerned people for their failure to preserve the necessary documents as per the rules, and has ordered the executive director to submit a report to the information commissionerate. When contacted, PMPML joint managing director A Y Karche, said that he had not yet seen the order. In his application submitted to the PMPML on May 3, 2007, Jathar had asked for information on 11 issues, including that of the work order for getting 30 propeller shafts, and about the report by the Central Institute of Road Transport that remoulding of tyres has not been done as per quality standards. When the administration failed to provide the information, Jathar filed an appeal on June 5, 2007. Although the appeal came up for hearing, the PMPML could not provide the copy of the bill (issued for 60 shafts). Subsequently, show-cause notices were issued to chief engineer A G Shelar, Sayyad, Unavane and Gavli and also departmental enquiries were initiated, the administration informed the state information commissioner. After going through the explanations given by the administration, the information commissioner observed that the vigilance and the accounts departments were trying to pass on the blame to each other. The information commissioner also observed that there were no visible efforts from the PMPML to settle the issue.     Panchayat secretary fined under RTI Act

    As reported at Times of India, Patne on 18 February, 2009 PATNA: State Information Commissioner (SIC) P N Narayanan slapped a penalty of Rs 25,000 on panchayat secretary Raj Hakam (Gopalganj) under Right to Information Act (RTI). The SIC found the panchayat secretary guilty of refusing to supply the information sought by one Bharat Ram and of not replying to an explanation sought by the SIC in this regard. The panchayat secretary has been directed to deposit the penalty amount in five equal instalments in the government treasury. The SIC has also directed panchayat secretary to supply required information to Ram and to apprise the SIC of the compliance of the order by April 22. In yet another complaint under the RTI Act, Narayanan has slapped a fine of Rs 25,000 on PIO-cum-assistant registrar, co-operatives, Hajipur (Vaishali). The SIC has found him guilty of denying information sought by one Kamaldeo Prasad Singh under RTI Act and his not replying to an explanation sought by the SIC in this regard. As per SIC directive, the fine is to be deposited in the state treasury in five equal instalments. The PIO has been directed to supply information sought by the applicant by April 20. Government agency penalised for excluding couple from voters' list as reported in NewKerala.Com --- IANS Chandigarh, Nov 7: The Haryana State Electronics Development Corporation (Hartron), an agency of the state government, has been penalised Rs.100,000 for excluding the names of a man and his wife from the voters' list after an application was filed under the Right to Information Act. Satpal Singh, who runs an NGO "Anti Corruption Society" here, found that his name and that of his wife were excluded from the voters' list in the Chandigarh electoral roll issued Nov 22, 2007. Singh filed an RTI application with the Chief Electoral Officer, Chandigarh, seeking the reason for the exclusion of their names. "After an inquiry, Hartron, the company responsible for preparation, revision or any other correction in the electoral roll, was found guilty of unnecessarily omitting the two names without giving any reasonable reasons," he told IANS. "The company was penalised and the amount was deducted by chief electoral officer from their bills. Our names were again registered on the electoral roll and I got a letter from the electoral officer in this regard a few weeks back," Satpal Singh added. "I have specific proof showing that there are thousands of other voters in Chandigarh whose names have been removed without giving any reason. This is an offence according to Representation of People Act, 1950. "I am again filing an application under the RTI Act seeking the reasons for the exclusion of the other names."
