    PIO Sends a staff to my house

    The person in the article below is me. I had a corporation official visit my house with the RTI and asking for my whereabouts. However the PIO has sent a reply on 8/5/19 stating that AE Div 170 is the person responsible for inspecting the banners on the particular stretch. It is after finalising this reply that I had got a call from AE Div 170 on 8/5/19 evening and a person visited my house on 9/5/19. The reply sent by PIO dated 8/5/19 was received on 11/5/19. Further The AE has stated that he has inspected the stretch and removed illegal banners immediately. However I have material evidence that the banners remained in the same place from afternoon till late night. Only the persons who kept the banner had removed them. So can I penalise the PIO for providing false and incorrect information.

    Harassment and bribe case

    Respected Sir, My Self Neetu Singh ,Travelled on dated 02-05-2015 from Mumbai (BCT) to New Delhi (NDLS).I want to draw your attention regarding my exit from New Delhi railways station that Rajesh Kumar (TC) has asked for the ticket and I have shown .But he asking for my kid ticket ,she is just 4.5 years old .I told him that she is not eligible for the ticket.He start asking for fine and threatening us for jail.I am alone with my mother and keep requesting but all went unheard to him.I have suffered mentally harassment for 1/2 hours.After the co-passengers intervention and continuous request he left us .This is the mentally harassment for bribe and request railway authority to take some stictt action for his railways employee (Rajesh Kumar-TC). If required i will forward this case to Woman Human right commission for harassment of Woman. Neetu singh

    Harassment by pio

    The pio always gives misleading statements eg. He directs complaints regarding encroachment sometimes to health department, sometimes to meat inspector and openly taunts me when I file rti. However two of his replies were contradictory. Can he be charged under IPC or what strict action can be taken against him.

Hello, I would like to know whether any legal action can be taken against a some persons who are filing RTI against an individual by asking about his/her personal information and constantly by giving wrong address wherein all the replies related to queries and first appeal is returned by the postal authorities as unclaimed and the appellant does not turn up for the hearing. Kindly reply immediately as it has led to an harassment of the staff as well as defamation against the third party on whom information is sought. As there is no cost per month three to four RTI queries are posted on the same matter but the appellant's address is always wrong. Can we take action against such people.

    I purchase 2 flats from Vibgyor Allied Infrastructure Ltd in their Belurmath projects since 2 year back at the confirmation that the building & lift will be ready in the 6 months but till date nothing is happen and now they are not responding my calls or when I go to their office they dont want to talk with me further when I send a mail for registration of the same they denied verbally over phone. I want to lodge FIR in the name of Mr. Swapnadip Sarkar GM & Mr. Gourab Khan Sales Person. Please help me.

    Encroachment upon public space by Hawker

    Sub: Illegal selling of Custom Goods at dirt cheap price(Hawker) in front of Vinayak Apt, Deendayal Nagar, Vasai (W) by paying "Hafta" to Municipality Dear Sir/Madam, I am writing this on behalf of my father (Mohsin Matiwala). My father is an electrician and owns a shop in Vinayak Apt in Vasai (W), since he’s in his 70’s and is physically handicapped he has to give the shop on rent. The person whom we had last rented our shop to (Mohammed Younus Lakha), he was just not ready to vacate our shop, he ‘s like a local goon, and after lots of hardship (filing a complaint against him in police station and also greasing the hands of the police)we were able to vacate him. My father now no longer has the strength to run down your offices nor his spine has the tolerance to bow down at your feet and beg for you to do what is to be your work “Nagar Seva”. He has already greased the hands of the police for vacating this same man from his shop. The amount he paid is the amount that his wife has been using to feed the mouth of her household from the time she came to his house irrespective of inflation be high or low. This shop means a lot to him and is his only source of livelihood. But now because this local goon sells his illegal goods on the road right in front of the shop. Due to this our shop gets covered and no one is ready to take it on rent due to his fear. The entire Vinayak Apt Society too fears him. And past 4 months there is not a single tenant. Even after filing a complaint against him in Vasai Municipal Corporation and in Police Station no action has been taken. We also went to our area corporator, but he too simply dismissed the case. And now this goon threatened him saying "we know where all you went to file complaint against us, even if you go to Thane Municipality no one will help, since I give "Hafta". Please Help Us. FAA has rejected my appeal by citing the reason that only information "related to" private body can be provided and information "held by" private body cannot be provided. 2. This decision is dated and has been sent well past the 45 days deadline. If this is upheld by CIC then it seems it will be another death knell to RTI act 2005.     delhi police harassment

    this is the case so far. my friend was visiting a friend here, in sukhdev vihar. she had classes the other day and decided she wanted to go home and get to classes from there, so she decided to leave for home, which is a p.g. accomodation in gk1. since it was 4 in the morning, i decided to accompany her till her destination, which knowing how safe delhi is, is nothing unexpected. i did so, dropped her off, and headed back in the same auto. i stopped the auto to have some water since i was very thirsty at the time. a pcr van pulled up in front of us and asked why the auto was standing and not moving. imagine, that is their concern. had the auto been moving they would have had no problem. so i got off and explained the situation. they asked me where i lived and where i was coming from. i answered, jamia. they asked me my name, i answered. they asked me what address i had come to, and i told them. my friend's name they asked and i told them. they asked my for my phone number and i gave it to them. the sho who had asked me, called the number to verify if it was indeed mine, and my phone rang. then he told me i could leave. now, they have been going to the pg and harassing my friend, her landlady, who in turn harasses her thus for being harassed by the police, and have basically made my friend's stay in delhi miserable. if they really have a problem, which they do not state clearly at all, and all they do is imply that '' there might be something wrong going on with boys from jamia coming to this area at odd hours '', they have my number. they haven't intimated me once. not once. yet they go to the pg and create problems for my friend and the owner of the house several times a day. what do i do. it is always so hard to act under such circumstances because despite the fact that you know you have done nothing wrong, and are free to do everything that you have been given a right to being a citizen, the undue power the delhi police excercise is really intimidating. i know of my right to freedom of movement. i've known since i was a little boy in school. and why wouldn't i drop a girl off, do they think delhi is the safest place in the world for women. even in the day it is not, so i'm sure not leaving her safety to chance in the night. what should i do. kindly help.
  12. 'Harassment' drives RTI activist to suicide: Right to information and right to life, both seem to have been casualties of corruption and abuse of power in Nanded district last week. The police are investigating the possible role of a health department official in pushing a young right-to-information activist from Mukhed, some 75 km from Nanded, to suicide. Jaipal Chavan, a government hospital superintendent, was named in the suicide note of Shivam Jankuatar (24) for having brought the activist “social shame by lodging a false criminal complaint against me”. On Wednesday morning Jankuatar handed the note to people at the local taluka office and consumed poison on the premises. "The note maintains that Chavan had lodged a false case because Jankutuar was attempting to expose corruption by asking the official for copies of expenditure bills under the Right to Information Act,” district Superintendent of Police (SP) Vijay Singhal said. "On September 22 the local police had booked Jankutuar for extortion after receiving a complaint from Chavan.” State Information Commissioner Suresh Joshi said a report had been sought on the incident from authorities in Nanded, which is about 650 km from the city. "I don’t have any details on the case yet, but the commission has asked for a report from the district administration," Joshi said. “If there is evidence of any violation under the Right to Information Act by local officials, or of the person being harassed because of using the act, then we will take up the matter with the government,” he added. The district civil surgeon was unavailable for comment. SP Singhal said the extreme step of suicide was mysterious, and the police were also inquiring into the kind of information Jankutuar had sought. “If he had suspected corruption, he could have approached the local police, and they would have lodged a case under the law. It is still not clear why he went to the extent of taking his life," Singhal said. The state leads the country in putting to use the two-year-old sunshine law, with over 400 right to information applications each day probing hitherto opaque government processes. But a senior district official, speaking on condition of anonymity for protocol reasons, maintained that attempts to extort officials on the basis of incriminating information extricated under the RTI law were not uncommon, especially in rural offices. "As an appellate authority in Nanded, I have heard cases where the appellant using the law has arrived at a settlement with the official, and withdrawn his request for information at the hearing," he said.   14. Sir, I am working as UDC in Income-tax Appellate tribunal (ministry of law and justice) till 27.05.2011 at Visakhapatnam. Since, I made 3 applications under RTI Act 2005, to our department requesting them to inform about the status of my representations made for Cadre review, copies of recruitment rules, rosters, etc., then all of a sudden, they transferred me to Pune by making me a victim (they picked me out of entire 100+ UDCs of ITAT), by relieving me from the duties at Visakhpatnam on 27.05.2011 (date of transfer order). Sir, is there any thing I can do, to make a compliant against this injustice and attitude of our Head Office. Kindly, suggest me the correct procedure and oblige. Yours sincerely, Madhu Kumar

As reported by Kshitiz Gaur in Times of India, Jaipur, 05 Mar 2011 Query proves costly for couple, set to leave Raj Query proves costly for couple, set to leave Raj Kshitiz Gaur | TNN Ajmer: Seeking information under the RTI Act from the organisation where she was working on the reason for non-renewal of her job contract had proved costly for Piyusha Tiwari. Her husband Rishu Garg, who is also working with the same organisation, has been demoted after her query. Now, the couple has decided to leave the state and start their careers anew. Tiwari, 26, said she filed an RTI query with the Association for Rural Advancement through Voluntary Action and Local Involvement (ARAVALI), a state government organisation aided by the Unicef, after her two-months salary was blocked after a new management took over the association and it did not renew her contract without assigning any reason. She had also accused her seniors of harassing her. “I was working with an associate NGO of ARAVALI in the health sector since 2008. In 2009, the management of the organisation changed and I started facing harassment from my seniors. When I protested, they blocked two months’ payment without assigning any reason,” she said. Later, the NGO did not renew her job contract, this time too without assigning any reason, she said. “I filed an application under the RTI to seek the reason behind the non-renewal of my contract and also the reason for holding back two months’ pay,” she said. A month after she filed her query, not only her application was rejected but also Garg, her husband was demoted. “A month after her application, I was demoted from the post of regional co-ordinator to project officer without giving any reason. I had been the regional coordinator for four years,” Garg said. ARAVALI turned down the application saying the organisation is an NGO and did not fall under the preview of the RTI Act. Information commissioner M D Korani has, however, directed ARAVALI to give a reply to Tiwari’s query, while hearing her petition before the state information commission. “We have not got the information despite the order by the commission. I have filed another application informing about the commission about it,” Tiwari said. When contacted, executive director of the organisation Sanjeev Kumar said, “The matter is pending with the state information commission. Therefore, it is not right to comment on it.” He, however, added that the organisation has a reason for demoting Garg without going into details. During the last two years, the couple has filed several complaints with many government entities, including rural development minister Bharat Singh who is also chairman of ARAVALI, to seek justice. “We went from door to door but all in vain. We are tired and just want to live peacefully,” cried Tiwari, adding that they have now decided to leave the state.

No right to probe cops: RTI activist harassed by police? as reported by NDTV Correspondent, NDTV, May 30, 2010, Bikaner Thirty-two year old Goverdhan Singh has paid a heavy price for running a campaign against corruption in his native district of Bikaner. A 100 Right to Information (RTI) applications filed by him exposed corruption in banks and government departments, but things got uncomfortable for Goverdhan when he asked questions about the properties and assets of police personnel. Overnight there were nine FIRs lodged against him. "As soon as I filed an RTI application against the police, they started putting cases against me, so that I stop my activism," said Goverdhan. The police also raided his house, seized his car and locked his office. Goverdhan's family members say they are being constantly harassed. "The police threaten us. They say they will kill my son in an encounter," says Goverdhan's wife. The People's Union for Civil Liberties investigated the matter and came back with a report of extreme police high-handedness, forcing the government to transfer the Bikaner SP. But surprisingly, even now the role of the police is being investigated by the police themselves. "Initially the local police station was probing the case, now it will be probed by a Deputy SP," said Bikaner SP, Habib Khan Goran. Goverdhan is now on the run. He is absconding because he's not sure if he will ever get out of jail if the police catch him. He has also approached the Human Rights Commission.   17. It is observed that so called national institutes are deliberately violating prescribed law & procedures for their own benefits. When some RTI queries are raised they resist to hide their misdeeds & start harassing RTI applicants, delaying replies & using all sort of menas to defeat RTI spirit. It is high time that, the forum should raise collectively in support of such RTI activists, as to a mighty institute fund is not a problem, they use public funds to do such mis-deeds, while for an individual it is big task to spend even thousands.     PF Withdrawal

    I resigned from prev employer in 2005 september.As i was travelling immediately after that, I applied for trf of PF balance to new employer Feb 2006.My prev employer harassed my by replying in May2006 "that the PF cheque is ready but some dues amounting to appx Rs. 95000 are recoverable from me":(.When I asked the PF deptt of prev employer they said they have recd a letter from HR deptt on March 31st 2006 wrt some claims outstanding in my name hence they would deduct 95000 and pay only the balance which i refused. Anyways now I want to withdraw my acc balance. My question is : Can prev employer hold back my PF balance on such pretext When I resigned in sep2005,why was prev employer silent on this claim and is raising the issue only in May 2006. I sense something fishy .Please guide how to withdraw my balance from the prev employer.Also do I need to send THEM the form 19 or can it be sent directly to Employer?
  19. Here are details of the case, Please let me know how RTI can be helpful to me. One of my known person has went for driving license in Bangalore. Just check incidences - When he was in front of licensing authority, officer denied to speak in English and asked to speak him in Kannada only. When he said about not knowing Kannada and ask to speak in Hindi, officer shown him bitter face. Officer asked him to show PUC certificate for new car - new car doesn't require PUC certificate. During driving test, officer asked him where he belongs to, is he a software guy and for how much time he is in Bangalore - to probably inquire about his background. He was declared failed in driving test reason He did not wear helmet for 2 wheeler test - he has asked officer whether he should wear or not before test and officer said, its ok not to wear He did not put L sign board on bike as it was on his car. He asked officer whether he should transfer it from his car as it was on his car. He has not shown sign of stop while taking turn on bike - how many Indian knows sign of stop ? [*]At the end when he asked officer not to be unfair to him, officer replied to him only in Kannada ? Clearly it looks that License was rejected because of prejudice. I think RTI can't become useful here. Alternatively, this can go to the head of department i.e. Commissioner of Police as a complaint but I suggested my friend not to go there as I fear going to police for any case.

Chandigarh, February 20: A former teacher of Sanawar School, DR Rajinder Singla, today alleged that he was sacked after he demanded some information from the school under the Right To Information Act (RTI). Addressing a press conference at Press Club, Sector 27, Singla alleged that the school has a number of irregularities and the school authorities were not ready to confront it. Singla said, “When the school authorities were not ready to answer my queries I went through the RTI and submitted a 13 page application to the regional officer of CBSE at Panchkula. A few weeks later I received a letter from the headmaster of the school stating that my services had been terminated with immediate effect.” He further said, “ While I was denied the information the first time I had asked for it under the RTI act, the regional officer at the CBSE office in Panchkula, Kushal Singh later directed the headmaster of the school to provide me with the required information.” Singla also alleged that the school authorities direct the teachers to act and function as per their wishes, failing which they are harassed. He added, “ those who have been harassing the teachers include R P Aggarwal, Chairman of board of governors and education secretary to the Government of India, Jai Singh Gill, former chief secretary, Government of Punjab, Omar Abdullah, MP from Jammu and Kashmir and Lt General A N Aul, chief of staff, HQ Western Command, Chandimandir. Many teachers have been sacked by the school without serving any notice or explaining the reason of doing the same.” Meanwhile, refuting the allegation, Praveen Vasisht, Headmaster Sanawar School, said, “Singla had a poor record. He has been sacked as per the decision taken by the board of directors and not because he requested for information. He is making false allegations about the school because he himself is at fault.” Singla also said that he would be filing a case against the school authorities in the District Courts soon.
