    I had filed RTI with a public authority in Haryana seeking details and copies of budget and expenditure. The PIO asked me to deposit ₹900/- plus another ₹125/- for postal charges and did not give any information regarding the reasoning 10 points for which no additional fees was required. The FAA and the SIC upheld the ground of not allowing the disclosure of any information till the fees was deposited. Please guide and suggest if the decision of SIC can be reviewed or any similar provide on to allow the information as now someone told me that section 4 of RTI Act states that the budget and expenditure details are to be disclosure voluntarily on the website of department . PLEASE HELP ME Organisation- Haryana Co-operative sugar mills Ltd , Rohtak Drafted an RTI on 12 April 2017 to the concerned SPIO and received no reply As I know the internal organisation structure of the mills I know that the entire administration is corrupt and they are intentionally ignoring my RTI (Truly I have been in that office and seen it myself as I have a relative employee in the mills ) As the First Appellate Authority is the Managing director of the mills , I donot expect any reply from him too. But being a law abiding citizen I am ready to follow the procedures by RTI Law/ But again i do not expect reply from MD as well. Recently I have heard in case of no reply a citizen can directly approach CIC So I request the esteemed forum members to help me in this case. Please Guide me in this further matter i) If i should approach the first appeleate authority kindly provide me with what to write and how| ii) If i should approach CIC , then how to approach CIC haryana and what to write and how to follow up with it, if you can provide me the details , address it would be very very helpful... I thank in advance to people addressiong my query and providing me a SOLUTION...

[h=1]Former IAS officer gets three-year jail[/h] Former Haryana State Information Commissioner and retired IAS officer Asha Sharma was today sentenced to three-year rigorous imprisonment by a local court for forgery of records in a property dispute case with her mother. The court also imposed a fine of Rs 2,000 on her. Read More: Former IAS officer gets three-year jail ================= If she could forge records of her mothers property by summoning the file to her residence, just imagine the damage she would have done as a IC, when she had powers to summon any file of the State Government ! No wonder the SC in one of its judgments commented: "Information is Currency"

RTI का बड़ा खुलासा, लाखों के कर्जदार हैं केंद्रीय मंत्री वीरेंद्र चंडीगढ़: महंगे जूते पहनने और 9 लाख की घड़ी बांधने वाले केंद्रीय ग्रामीण विकास मंत्री चौधरी वीरेंद्र सिंह विधानसभा के सबसे बड़े डिफालतरो की श्रेणी में आते हैं। उन्होंने विधानसभा से लाखों रुपए का हाऊस लोन और कार लोन लिया हुआ वह भी महज चार प्रतिशत की ब्याज दर पर हैरानी की बात तो ये ह की वे लोन लेने के बाद भूल ही गए लेकिन एक RTI उन्हें ये सब वापिस याद दिलवा रही है। वीरेंद्र सिंह जो उचाना से विधायक भी हैं और केंद्र मंत्री भी ने घर बनाने के लिए करीबन 12 लाख 50 हजार रुपए का लोन लिया था जिसके बाद उन पर बैंक का अबतक 15 लाख 33065 रुपए बकाया बाकि है यही नहीं उन्होंने कार पर भी करीबन 10 लाख का लोन लिया था और इसमें भी उनपर आठ लाख 90 हजार रुपए का बकाया है ये खुलासा RTI के जरिये हुआ। Read more at: RTI का बड़ा खुलासा, लाखों के कर्जदार हैं केंद्रीय मंत्री वीरेंद्र

Dear All, Continuing the efforts of providing the bare minimum facilities to our sisters /daughters in Haryana Police Stations & check their human rights violations, the undersigned filed application under RTI Act 2005 before Director General of Police, Haryana to know the actual status of separate bathrooms/toilets/washrooms in Police Stations/Posts in Haryana. It was startling to find that even in 2015, 20% Police Stations/Posts are not having separate toilets for ladies. Filed the following Complaint before Hon'ble Human Rights Commission of Haryana praying for directions to CS/DGP to do the needful. It is pertinent to mention here that undersigned complaint about 9 Police Stations out of 33 Police Stations situated in Gurgaon Commissioner-ate has already taken cognizance by Hon'ble Commission and notices have been issued. Yours harinder dhingra To Dated 16th June 2015 The Chairman, State Human Rights Information, Haryana Chandigarh Sub: Human Rights violations: Prayer for directions to Chief Secretary/Home Secretary/ Director General of Police Haryana for implementing Hon’ble Punjab & Haryana High Court directions to have ladies toilets in following Police Stations/Posts Sir, Respectfully submits that human rights of Citizens are violated in following Police Stations situated at following locations by not having ladies toilets namely; 1) Rampura (District Rewari) Police Station 2) Sector-6 Mirpur (District Rewari) Police Post; 3) Sadar (Rewari) District Rewari Police Station; 4) Assandh (District Karnal) Police Station; 5) Jathlana (District Yamuna Nagar) Police Station; 6) Khizrabad (District Yamuna Nagar) Police Station; 7) Chachrauli (District Yamuna Nagar) Police Station; 8) 13 numbers of Police Post situated in District Fatehabad have NO LADIES TOILETS The above information has been provided by learned SPIO cum DSP/ACP(HQ) of Haryana Police under RTI Act 2005 (Copies Enclosed) That above Police Stations situated in the state of Haryana in the State of Haryana are not having separate toilets for ladies, the basic human right and privacy of the female police personnel and others female visiting police stations are being deprived. I draw your kind attention to Hon’ble Punjab & Haryana High Court order in CWP No. CWP-10756-2014 dated 28th May 2014 (H.C. Arora Vs. State of Punjab and other) (Copy of the order enclosed) the Hon’ble Court directed, QUOTE “ The petitioner, appearing in person, seeks to advance the cause of lady constables in the police stations as it is alleged that there is absence of lady toilets in police stations and police posts, the details of which he has obtained after serving notice on the respondents. There is no doubt that adequate facilities in respect of the aforesaid are required. We would expect the Government to look into this issue expeditiously and the Director General of Police with the Department of Home Affairs to take necessary action for provision of toilets for lady constables in different police stations. We would also expect the action to be taken within a maximum period of four months from today. The petition accordingly stands disposed of.” UNQUOTE PRAYER AND RELIEF SOUGHT This is a fundamental right of our girl children/sisters. Thus, the Police Department must also be directed to construct separate toilets for ladies in Police Stations in the state of Haryana. The above reasons contribute to human rights violations in above named Police Stations situated in the State of Haryana and as such pray to Hon’ble Commission to pass appropriate orders under relevant section of the said Human Rights Act as deem fit by Hon’ble Commission.   6. Hello, I had filed a couple of RTIs with haryana police through their portal www.haryanapoliceonline.gov.in. RTIs were accepted after payment of Rs. 50 was made. After some time reply was also attached but before i could see the reply i was asked to make a payment of Rs. 2. I tried paying the amount through debit card but the transaction did not go through. Not only was i not able to see the reply but RTIs itself were removed from the database. Has anyone faced this problem before? I believe asking for payment of Rs 2 is intentional because they know that it is not possible to do the same online. Does anyone have a solution to this? Thanks!!

Dear members of this August Forum, I filed a Complaint with Haryana Human Rights Commission, Chandigarh seeking directions to DGP Haryana /CP Gurgaon for constructing ladies washrooms in nine Police Station of Gurgaon Commissioner-ate of Police. The absence of this facility is violation of Human Rights of our girl child/sisters. The information about non-availability of wash rooms was received from ACP Gurgaon under RTI Act 2005. Following chief minister Manohar Lal Khattar's green signal, chief secretary, vigilance, has decided to seek explanations from Chandigarh deputy commissioner Mohammad Shayin and three other senior bureaucrats for their alleged roles in the misappropriation of funds under the Mahatma Gandhi National Employee Guarantee Scheme (MNREGS) in Ambala district.   9. हरियाणा सूचना आयोग ने सूचना का अधिकार (आरटीआई) अधिनियम के तहत जानकारी नहीं देने वाले अधिकारियों के खिलाफ कड़ा रुख कर लिया है। आयोग ने वर्ष 2014-15 में सूचना न देने पर 35 लाख 15 हजार रुपये का जुर्माना लगाया है। साथ ही, अधिकारी के रूप में अपने कर्तव्यों का ठीक से निर्वहन न करने और आरटीआई एक्ट का उल्लंघन करने के 59 मामलों में अफसरों के खिलाफ जांच की सिफारिश की है। सभी मामलों में आयोग ने जांच के आधार पर की गई कार्रवाई की रपट भी संबंधित अधिकारियों से तलब की है।अपीलों के निपटान में भी आयोग एक बार फिर देशभर में अव्वल रहा है। वर्ष 2014-15 के दौरान आई कुल 10 हजार 165 अपील में से 98 प्रतिशत यानी 9966 का निपटारा किया है। इस अवधि में सर्वाधिक 1330 मामले राज्य सूचना आयुक्त हेमंत अत्री ने निपटाए हैं। पूर्व मुख्य सचिव एवं राज्य सूचना आयुक्त उर्वशी गुलाटी ने इस अवधि में दूसरे नंबर पर 1320 मामलों का निपटारा किया। मुख्य सूचना आयुक्त नरेश गुलाटी ने 1303 मामलों का निपटारा किया है।Read at: ????? ????????? » News » ?? ??? ??? 35 ??? ?? ???? ?? ???????? ????

  11. More than a third of police stations in the city do not have separate lavatories for women, forcing them — be it staff, visitors or suspects — to use common toilets. A reply to a right to information revealed nine of the city's 24 police stations do not have a separate toilet for women. RTI activist Harinder Dhingra, who filed the query, said this amounts to a human rights violation and that women police personnel and other women are deprived of privacy. "The Punjab and Haryana high court had ordered last May that such facilities are required. The Haryana DGP and home ministry should take necessary actions to provide toilets to lady constables," said Dhingra. The project to set up airports in Hisar and Karnal seems to be not a priority as an RTI information reveals that there has been no concrete move from the state or the Centre about setting up the airports. In reply to a query filed by state convener of the Haryana Soochna Adhikar Manch Subhash, the Haryana Civil Aviation Department said a team of the Airport Authority of India (AAI) has inspected the sites for the airports in Hisar and Karnal on October 29-30, 2012, on the request of the Haryana Government.   14. According to the RTI reply, the six vends along NH-8, which were closed down after the HC order, would have deposited Rs 14.68 crore in fee for this financial year. The 17 shops that were shifted from the highway would deposit Rs 29.25 crore in licence fee, an increase of Rs 3 crore from the Rs 26.25 crore collected last year. So the total licence fee collection from these 23 vends for 2015-16 would stand at Rs 29 crore, which is a loss of Rs 11 crore from last year. On SEZ land, a global smart city NEW DELHI: About 800 acres of the total land the Haryana government got back from Reliance Haryana SEZ Limited (RHSL) in February last year will be developed as a global city having all the attributes of a smart city as the Narendra Modi government has envisioned. "The city shall be one of its kind in India. It will be designed by integrating smart community concepts ranging from water supply and power to integration of IT services in managing various utilities of the area. The project components would include festive and leisure (components), including an exhibition and convention centre, high value innovation and knowledge industries, central business district and township etc," says the concept note on the global city. The project will be developed by a special entity through a 50:50 partnership between the Haryana State Industrial & Infrastructure Development Corporation (HSIIDC) and Delhi Mumbai Industrial Corridor Development Corporation (DMICDC). While the state finance minister said on Tuesday his government would investigate how the previous Bhupinder Singh Hooda government did not invite bids for the scrapped SEZ project, the new government seems to be keen on the global city project in the outskirts of Gurgaon. In response to an RTI application filed by a Gurgaon-based activist, Aseem Takyar, the HSIIDC said DMICDC has appointed a consultant for preparing the master plan for the global city project. Sources in DMICDC said the state agency is working on the site boundary. According to the RTI reply, the board of directors of HSIIDC had approved the setting up of a joint venture in its meeting on March 14, 2014. "Work is going on and the project may be rolled out by the end of this year," a government source said. The concept note also mentioned that any excess land would be reserved for an exclusive township of HSIIDC and its "monetization to compensate for the opportunity cost of the land". Cosmos City project sale illegal, says DTCP GURGAON: After TOI reported that around 400 investors were allegedly duped by a developer in a multi-crore housing scam in Sector 103, a government probe has revealed that Adel Landmarks violated norms by selling off the Cosmos City project on Dwarka Expressway to another developer after taking 25% of the cost for each flat. The report by the department of town and country planning (DTCP) has recommended strict action, including filing of FIRs, against Adel Landmarks for selling off its subsidiary company, Identity Buildtech Limited, which was developing the Cosmos City project, to another builder - Ansal Housing and Construction Limited - without the department's knowledge and allegedly cheating 432 investors. The report, prepared by the then senior town planner Kamal Kumar has come to the fore, thanks to a response to an RTI query by one of the investors, K K Khurana. According to the probe report, Adel Landmarks Limited sold off Identity Buildtech Limited, along with all its assets, by entering into a share purchase agreement with Ansal Housing and Construction Limited. The whole process - which amounts to transfer of license - had taken place without the knowledge of DTCP, the licensing authority. In fact, the probe was ordered by the then principal secretary of town and country planning, TC Gupta, after TOI had exposed the scam in July last year and reported that a project by the second builder was coming up on that land. The then senior town planner, Kamal Kumar, carried out the inquiry. Kumar has recommended action against the developer for breach of terms and conditions of license. "DTP (enforcement), Gurgaon, has sent a complaint to the commissioner of police, Gurgaon, for lodging an FIR against the offenders," he said in the reports. When contacted, the additional chief secretary to DTCP, P Raghvendra Rao, told TOI, "After the case came to light, the department had even initiated action against the developer and a show-cause notice as to why the builder's licence should not be cancelled was issued to the builder." He added, "During a hearing, Adel's representatives had said that the claims of all investors would be settled by refund of their money along with interest. Another notice was issued on January 22 this year. The report is being compiled and further action will be taken after the compilation of the report." A spokesperson for Adel Landmarks said, "We have already replied to the notice issued by the DTCP on February 6 and apprised him of the progress of the refunds to investors. CWP No.11284 of 2014 (O&M) A bare combined reading of above said information sought by the petitioner vide Annexure P-1, Section 24(1) as well as Section 24(4) of the RTI Act would show that the information sought by the petitioner was not exempted and the Intelligence Wing of the respondent-State was duty bound to supply the information sought by the petitioner. Since, respondent No.1 has misdirected itself while completely ignoring the true import of provisions of Section 24 of RTI Act, therefore, the impugned order dated 22.05.2014 (Annexure P-8) is patently illegal and the same cannot be sustained In view of the above said provisions of the RTI Act, in case respondent No.2 was of the view that the information sought by the petitioner was pertaining to theIntelligence Wing, the Public Information Officer of respondent No.2 was dutybound to transfer the application of the petitioner to the concerned departmentunder intimation to the petitioner. Even this much was not done in the presentcase. Further, the respondents have been taking different stands at differentpoints of time as per their suitability. The only stand taken in Annexure P-3 dated 27.06.2013 was that the Intelligence Wing was exempted from the provisions of RTI Act under Section24(1) thereof. However, in the short reply filed by respondents No. 2 to 4, the stand taken was that information sought by the petitioner was not available on record of the Intelligence Wing. When a pointed question was put up to the State counsel in this regard, he had no answer and rightly so, because it was a matter of record. The respondents have taken contradictory stands at different points of time. No other argument was raised. Considering the peculiar facts and circumstances of the case noted above, coupled with the reasons aforementioned, this Court is of the considered view that since the impugned order (Annexure P-8) dated 22.05.2014 passed by respondent No.1 has been found to be patently illegal, the same is hereby set aside. The matter is remitted back to respondent No.1 to pass a fresh order in accordance with law. Let an appropriate order be passed within a period of three months from the date of receipt of a certified copy of this order. Resultantly,with the above said observations made and directions issued, the instantpetition stands allowed, however, with no order as to costs..
