  1. I am working as a Branch Manager in a registered Co-op Society and had asked for some information citing my designation in the applicants name column. My application under RTI was rejected citing Section 3 "that information is given only to citizens of India" and there is no provision for giving information to any legal entities like Company, Bank Corporations etc. Can I file a first appeal

Army housing organisation not subject to RTI, says CIC as reported in Zee News, October 15, 2008 New Delhi, Oct 14: The Army Welfare Housing Organisation is not a "public authority" hence it does not come under the purview of the RTI Act, the Central Information Commission has held while hearing a petition of an ex-RAW official. Chief Information Commissioner, Wajahat Habibullah in his order on Monday said that since there was no enabling provision authorising the Army Headquarters or its CPIO to access information concerning AWHO, any direction by the Commission would not be legally tenable. The Commissioner was hearing the petition of Major General V K Singh, an ex-RAW who wanted information about a housing complex called Devinder Vihar in Gurgaon, Haryana, built by organisation. Singh asserted that since officials of the organisation were serving officers of Army, it should be in the purview of RTI and he should be provided the details sought by him. "The contention of the appellant that the application for registration under the societies registration Act, 1860 was made by the Army Headquarters before the Registrar of Societies, is not substantiated by the facts or record," Habibullah observed. The Commission also said that the self-financing basis of the AWHO is also not disputed. It held that regulations of the organisation do not depict any 'say' or 'control' of either the government or of the Army Headquarters. It ruled that if there is some information available with the CPIO or the Army Headquarters, it should be made available to Singh. The Commission asked Singh to seek information concerning AWHO through Registrar of Societies by filing fresh petition. Bureau Report Zee News - Army housing organisation RTI

Dear sir, we have registred a society in 1993 in 2005 Registrar of Co Operative societies sold. changed the name of Society and handed over to some oher person who is not having any concern with us not even we know him. members of new changed name society are diffrent, society registration number is same. i asked information one month ago under RTI, no response yet received. second time I sent RTI application, yet no response. I also sent a complaint to Registrar regarding reason & procedure done for changing the name of our society. No response received yet. tell me any suggestion, our money is in bank and registrar trying to take over the society due to some complaints of misgruntled elements

Hi, I need help and guidance from all the esteemed RTI activists as I am not certain that should I file 2nd appeal to CIC after going through the reply of my first appeal(See the attachment) There are also some points which I would like to bring to your kind notice: First when asstt.registrar was made well aware of the fact that documents are missing from the file during the meeting of first appeal ,he has still mentioned "Copies can be taken by depositing necessary fees." Also he try to hide information saying" no information has been sought" specially under number 5.He had knowingly cut short the original question. No straight reply has been given even though I have asked for it like"if there is no rule then say no rule. Also information related to rules ,I was asked to visit their domain,which doesn't have any such information and also can he is authorised to give such reply. I am not sure whether I asked wrong information under question 9. Also I have been asked "this information pertains to the society and as par Hon'ble CIC society is not public authority (under10) then how can I get information,society has already refused to give me any information. for 11 and 12 I was also told that information is not legible to ask, as well as I was asked to pay for free copy of citizen charter Registrar has also asked society to submit reply in 15 days but after 30 days neither society has given any reply nor I have received any further correspondence from registrar cooperative society. 1.pdf

I am confused as on one hand under section 139 of The Delhi Co-operative Societies Act ,2003 there is a provision for a member to exercise Right to information but on the other hand Registrar Cooperative societies and Group Housing society refuse to provide information saying that Cooperative society is not a public body and hence it is not bound to oblige with any information under RTI ACT. Kindly help me out here what section 139 means in relation to RTI act. Is there any other way I can access information using section 139

    Is it a Valid Reply?

    I have asked for some information from the Registrar Cooperative Societies about some rules under which cooperative society has been charging 18% interest from me.The reply that I have received boggles my mind and I wanted to know if it is an acceptable reply from PIO.Here is their reply [/b]"The management has to act as per DCS Act and rules which is available on departments website." So now as their reply didn't mentioned exact rule or any answer that there is no such rule exists. I wanted to know Is the above reply from PIO is a valid reply or I can appeal against this sort of reply. There is another reply in which I have asked for certified copy of bye laws of the society and they instead of providing me with one ceritified copy have asked me to inspect the file and get the photocopy of the desired document". So don't you think in a way they are concealing the information ? Please guide me as soon as possible so that I can file first appeal if their reply is not a valid reply.

    Housing society and RTI

    Recently I filed a RTI to my cooperative housing society regarding some information.I received a reply that Housing cooperative society doesn't come under the purview of RTI and hence my RTI is dismissed. Similarly I filed a RTI to Registrar COOPERATIVE society delhi regarding the information from the society but he also refused to provide me information giving me the same reason. Can anyone suggest me how I can get information from my housing society under what section or rule of the Law of RTI or housing ACT

    Co-op housing society rules

    Dear citizens, I'm from Thane and there are a few complaints regarding the procedures and working conditions of my housing society. As a resident of the society what are my rights and how do I go about bringing some normalcy to the situation. the nature of complaints are regarding the various employees (cleaning lady, watchman employment) of the society and the maintenance of the society (condition of the lift and painting etc).   10. Hi, I am a part of Mystique Homes Housing Socity and I have a query regarding an issue that the society is fighting with the builder. The builder as per sanction plan was supposed to make play area and other amenties in common area but he has built two flats and now not keen to vacate the same. Also, he has using the two flats for commercial purposes for some time and now is keen to sell the flats. We are following up with him for almost 3-4 years but he is not handing over the original documents to us and also not ready to vacate. My understanding is that a builder can not make flats on a common area and then sell off the same without seeking any permission from the society. [we are a registered society] Please suggest a redressal or an approach for this query

Hi, I have three important querries regarding the co-operative hosuing society: 1) I would like to know whether after two joint holders of a flat in Co-Operative Housing Society there can be a third person who wants to become an Associate Member to them or will he/she have to be a Nominal Member, because everytime the flat owner are are giving excuses that they cannot attend meetings and they are sending the third person from the family without any memebership to sit for meetings.The flat owner have kept tenants and want to be active memebers in the managing committe without staying in the premises. 2) Can a person with a power of attorney / caretaker of flat sit for general body meetings or special general body meetings. Can he influence any kind of decisions from the owners end with out the owner not being aware.What kind of membership he requires. 3) Can a member claim for arrears of the Repair Fund from 20 years because they was mistake take in the calculation.Now the member is awakening that he there is a mistake, but 20 years ago he agreed to it. but now he wants arrears for it. So the society is in a fix as to what to do. Please help with these questions
  13. I want to know if we can form a Housing Society in absense of Buildings Completion Certificate ? Our society has total 6 buildings, out of which 4 are complete and the remaining 2 has even not started yet. Builder has charged us approx Rs. 1.5/- Per SQ Ft from each Flat and that makes it approx 1.5 Crores.The builder promise us that he will return all the money after deductions to our society when the society formation is complete. When we approach the builder, he says that he is yet to recieve the completion certificate of the 4 buildings and this is in progress. We have a coulle of questions on this : Q: Can we form a society in absense of Building Completion Certificate ? Q: If Yes, Do we need to apply for a single society for all the 6 buildings or do we need to apply for only the completed buildings ? Q: If No, How much time it takes to get the completion certificate and then formation of society ? Q: What about the money that builder charged from us as a society maintainance charges ? We all know that the current expensed do not cost more than Rs. 0.50/- Per SQ Ft and he has charges us Rs. 1.50 /- Per Sq. Ft. Q: Though the builder has verbally promised all of us that he will refund the pending money when the society is formed and operational, however we do not have any visibility to the expenses he is doing for society maintainance. He will try to exagerate the expenses, how we can control that or at least get the information on that ? Q: What is include in Society Maintainance Expenses ?   14. Hi, We want to form a co-operative housing society and elect members of committee. 1. Whom to ask for guidance on How to form a housing society and elect members? 2. Will Registrar help? Where to contact them? 3. Our 4 storied apartment has only 16 flats (members), how many of these should be in the committee? Is there any reservation for ladies? 4. How to nominate a member? What form need to be filled by the primary member? Whether a nominated member can participate in the committee election? 5. What are roles of commitee members? Is it ok to have only Chairman and Secretary for our society or Do we need some other role looking at the number of flats (members) in the apartment? 6. What are the responsibilities of Chairman, Secretary and elected memebers of the committee? 7. Can the tenure for the above committee be reduced to 3 years instead of 5 by chaning the Bye-laws appropriate to our society? How to do the same? 8. How much sinking fund should be collected from each member of the society? How it is calculated? 9. How much maintenance charge should be collected from each member of the society? How it is calculated? 10. What are the responsibilities of other members (other than committee) of the society? 11. What documents need to be maintained by the society? 12.   19. I was asking for a signed copy of society by-laws to our society managemet committee. This copy is specific to the society, and some specific values (like the spending amount limit without any need for GBM session) are filled society specific. I was told that this copy can not be given. I was surprised. I would like to know, if I can use RTI to get this copy. atul kumthekar

My name is sadanand, living in vashi navi mumbai.I am living in a big socity having one room-A type,280 sq ft to H type,3BHK 1100 sq ft. we have 31 buildings in our society every type building has 28 flats of same size.Can the society charge equal maintenance amount to every one,according by-laws? is there any law to protect the small flat owner in big society? where we have to complaint about this?

  22. I had 8 months back made a complaint to the Dy. Registrar of Co Societies for which till date he has not initiated action. Can you please let me know the address to which I should make a RTI application.
  23. We did it!! with the help of RTI, we have been able to get the photocopies of the entire documentation exchanged between our builder and the BMC. Till now we felt at the mercy of the builder and BMC ofcourse was a law unto itself - not now. we feel so much more empowered. Earlier applications for the same documents to the BMC in the past years drew a blank, but on the 2nd of April, exactly 2 mths to the date of application under RTI, 2005, we got what we wanted. May the Act live well and long into the future of our country. And all of you too!

    housing society

    Hi Builder has formed the society and already handed over working of the society to the members about 1.5 years ago. But he has not yet submitted us details of bank a/c opened in the society's name. Further we do not have the details of promoter members, no. of shares & value shown against them etc. Can we ask this information from builder or through RTI from registrar. Also there was piece of land which we thought that it is the society's land but he claimed that it was not registered with society or do not belong to society. how we can get info about this..
  25. i would like to know if the bye laws that govern Co-operative housing socieites in Mumbai have any restrictions on the kind of outdoor games allowed in the society. Also, were can I get a copy of the bye laws.
