akhilesh yadav posted a topic in RTI in MediaGURGAON: For over four years now, HUDA has not undertaken the routine cleaning of several overhead and underground drinking water reservoirs in various sectors, an RTI has revealed. The RTI was filed by activist Aseem Takyar. The reply by HUDA's division-II, received on February 12, revealed water tanks in sectors 21, 22, 23 and 23A, have not been cleaned since 2011. They are normally expected to be cleaned once every year. Besides, an overhead tank in Sector 18, underground water storage tanks in sectors 3, 5, 6, 12, 12A, 21, 22, 23, 23A and Electronics City have not been maintained or cleaned since mid-2013. HUDA Officers are not well versed with RTI Act 2005 thus causing lot of hardships to citizens of Gurgaon who access information under RTI Act 2005. The Hon'ble State Information Commission, Haryana has time and again passed orders for training/attend workshop being organized by HIPA (Haryana Government training institute) but in a reply to RTI query it has been found out that none of its (HUDA) official has attended the RTI Workshop or training. Karan Singh Yadav and Dharam Singh Yadav, who are brothers, were allotted these plots in various urban estates of Haryana between 1998 and 2004 (including the time they were serving), documents submitted in the Punjab & Haryana High Court show. The scam is being probed by HUDA on the orders of the court. Over 325 FIRs have been registered against beneficiaries, including 188 defence personnel, who allegedly got more than one plot in their name, or in the name of their spouse or children. harinder dhingra posted a topic in Post your RTI Success hereThe Hon'ble State Information Commission orders HUDA (A Government of Haryana Undertaking) to take action against private company called Kingdom of Dreams, Gurgaon which has taken land on lease from HUDA, if the agreed concessions/benefits (25% of the ticket value) are not passed on to residents of Gurgaon. The Hon'ble SIC derives power under Section 25(5) of RTI Act 2005. This is revolutionery order passed which will be trendsetter. QUOTE................... The RTI Act, 2005 has given the appellant right to know whether.the benefit of the Government policies is being transported to the person for which it was originated, Though the Great India Nautanki Company is not a public authority but the owner of the company is bound to provide the information in view of the settled terms and conditions of the lease agreement. He cannot deny the supply of requisite information on the ground that he is not a public authority as defined under section 2 (h) of the Act. In the light of above stated facts the Commission allows the appeal with the directions to the Estate Officer-Il, HUDA, Gurgaon to look into the matter and provide the information to appellant after obtaining it from the private respondent under section 2 (f) of the Act. In case the private respondent is not ready to furnish the information, the Commission in exercise of the powers vested in Section 25 (5) of 'the Act recommends action against the private respondent as per settled terms & conditions of the lease agreement in order ensure that due benefit of the agreement is received by the resident of Gurgaon Estate. This should be done within two mo.nths of the receipt of this order positively. The outcome should also be communicated to the appellant. In case the appellant does not receive the report, he is at liberty to file a complaint to take further action in this regard. However, penal proceedings initiated under section 20 (1) of the Act against the respondents are hereby dropped. Announced. To be communicated.
