  1. RBI issues certain "advisory notes' to Banks, from time to time. In a recent order, CIC has ruled that these advisory notes have to be disclosed by RBI. The matter concerns advisory notes issued to ICICI Bank. Initially, CIC had ordered disclosure but ICICI Bank had approached Bombay High court and obtained a stay order since it was not heard by the CIC, as per Sec 1994) of the RTI Act.   4. It is unfortunate that ICICI bank engages in unethical practices on a recurring basis that go against the norms of standard banking practices anywhere in the world. I have repeatedly brought this matter to the notice of their enthusiastic customer service executives but they have refused/expressed inability to help ('ICICICARE=032-836-455). I do not understand how interest charges applied by the bank can be regarded as a "retail transaction." Their bill is generated on the 5th and the credit limit is exceeded after application of the month's interest. All that is fine. However, the unacceptable part is, an overlimit charge is applied on the 7th (without even giving a chance to the customer to pay!) This has happened several times in the past and is again happening since the last 3/4 months. I wrote to their Nodal Officer Shiva Tadikonda but he has not responded yet though telecallers have reminded me of my payment duty. I have written to Tadikonda that I would like him to invalidate the useless card and that I would be paying my dues in convenient installments.

Can private banks run 'suspense accounts', CIC asks RBI AS appeard in India News section of TwoCirclesNet on 14 July 2009 New Delhi, July 14 (IANS) If a cheque has a spelling mistake in the recipient's name, can the bank put the money in a temporary account? The Central Information Commission (CIC) has asked the Reserve Bank of India (RBI) to clarify on this practice. The decision last week came on a Right to Information application filed by Delhi-based RTI activist Subhash Chandra Agrawal with the finance ministry last year. Agrawal told IANS: "One of my unconfirmed sources had told me that in Delhi alone ICICI Bank has nearly Rs.100 crore lying in suspense accounts. So I feel, the RTI Act should also apply to those private sector establishments where public interest is concerned and such malpractices are taking place." Agrawal had asked the ministry if it was aware that ICICI Bank, India's leading private bank, was following the practice of crediting the proceeds of many clearing instruments like cheques and demand drafts, bearing insufficient details about the account holders to a 'suspense account'. He had also asked if the government was going to take any steps to prevent this practice. Not satisfied with the reply he received from the central bank. Agrawal approached the CIC. "We feel that the RBI must write to the appellant again and give a comprehensive reply stating categorically if the RBI had ever issued any instruction on the subject and if, according to the available information with them, such practice is being followed in other banks including public sector banks," Information Commissioner Satyananda Mishra of CIC observed in his order. Agrawal has indeed brought "a very important matter to the notice of the authorities through his application which deserves to be taken into account by the RBI for appropriate action.   6. We are engaged in a long standing dispute with a Builder ( referred to hereinafter as accused no.1) against whom we have filed 2 criminal cases U/s 156(3) Cr.P.C. This Builder has a relative working in ICICI Bank (hereinafter referred to as accused no.2). Accused no.1 instructed accused no.2 to obtain the Credit Information Reports (CIR) of my wife & son from the Credit Information Bureau of India Ltd (CIBIL). Accused no.2 used (misused) his position in ICICI Bank to access the said information from the CIBIL website and sent back the CIRs as e-mail attachment to accused no.1 through the ICICI Bank server. The accused no.1 then started circulating the said reports to our friends and relatives as well as to Police officials and Govt. Agencies, in order to discredit us. Copies of the e-mail exchanged between accused nos.1 & 2 as well as e-mails circulated by accused no.1 were provided to us by a well wisher. My wife, who is not even a customer of ICICI Bank has registered a complaint before the Police along with all evidence. Under provisions of the RTI Act can we ask ICICI Bank to confirm that the e-mail exchange between accused nos.1 & 2 were made through the ICICI Bank server?   7. I have paid 6 premiums of Rs 10200/- each. This policy is with 3 years lockin period. After monitoring the poor performance of the company and its in-appropriate customer service. I have asked for the exit with refund of money. The complaint is raised to the Ombudsman. They all are ready to close the policy with the refund of Rs 30100/- I need justice with return of 100% principal amount. Also IRDA is not responding. Hi, 3 months back all of sudden I received several threatning calls from ICICI bank (ICICI bank third party vendor) regarding payment of purchases made through credit cards which I have never applied or never received. I had raised my concerns to various department (Customer Care, Head Service Quality, Grievance Cell, etc) in ICICI bank but to no resolution from the bank. I have filled a application in the Banking Ombudsman Offices, Consumer court also . Can anyone guide how can I file a RTI against ICICI bank, to get a resolution to my problem with ICICI bank or also any other possible way where I can get the bank to answer my queries.
  9. Regarding the deniel of accidental insurance by ICICI Home Fiance for a houseing loan applicant (who died in an accident), victim's father (my brother) is having a dispute with ICICI Since 2004. The victim died immediatley after taking first installment of the loan. When his father approached bank to refund the amount, they advised him to submit insurance claim (National Inssurance), telling that the victim is having coverage. After 3 years, they informed that the claim is rekected as per the terms and conditions of the captioned policy. As we do not have the copy of the policy we requested them to give a copy for appreciating the terms and conditions. But they never gave. Meanwhile, the bank filed a complaint on victims father (2nd applicant of loan) in Feb ruary 2008 in LokAdlat that he is defaulter. In the Lok Adlat, the victim's father explained the case and requested the Adalat to get him the policy copy from Bank. Adlat asked the Bank to submit a copy before April end 2008 and settle the case with mutual agreement. But even today they have not given. Victim's father filed a complaint in Banking ombudsman, by stating the hose case, including the Lok Adlat's episode. When ombudsman asked the ICICI Bank to respond, it gave a reply that the case is pending at Lok Adlat. Based on that the Ombudsman rejected the case under clause 9(3)(d) of Banking Ombudsman Schem 2006. Can any body help us what to do now.
  10. Hi, I want to know how can i use RTI to get the status of my case as to why the ttk,ICICI Lombard is taking so much time . I am waiting for medical reimbursement from them since past 3 months whereas they that their normal time is 7 days. Every time i call at their call center they tell me that my case is under review by senior doctors and request me to call after two days. When i call at their office nobody except the receptionist is picking the call saying that she can not transfer call to any other person. Regards, Abhishek

    ICICI Bank under MRTPC scanner

    As reported by Souvik Sanyal of TNN in timesofindia.indiatiems.com on 25 May 2008: ICICI Bank under MRTPC scanner- Banking-Banking/ Finance -News By Industry-News-The Economic Times ICICI Bank under MRTPC scanner NEW DELHI: Monopolies and Restrictive Trade Practices Commission (MRTPC) has called for an investigation against ICICI Bank for clearing cheques with discrepancies, but not crediting the money to the accounts of depositors. According to official sources, the Commission has asked its investigating arm DGIR (director general of investigation and registration) to inquire into the matter and submit a report within 60 days. Relying on media reports highlighting an incident in Noida where an ICICI bank account-holder’s cheque carrying some discrepancies was cleared without the money being credited to his account, the Commission took suo-motu cognisance and called for a probe to see if the practice was unfair. Media reports said the cheque which had some discrepancy in the name written on it was cleared by the bank and the money deposited with its suspense account. It was claimed that the depositor had to face a lot of difficulties before realising his money. “The practice of clearing cheques with discrepancies and not crediting it to the concerned accounts, prima facie, appears to be an unfair trade practice,” a source in the Commission said. Apparently not convinced with ICICI bank’s approach on the matter, the official added in cases of discrepancies in the cheques, banks usually return them to the depositors without clearing them on its own. When contacted, an ICICI spokesperson said they have not received the notice yet. The RBI is in knowledge of the ICICI bank maintaining an account styled ‘current cheques with insufficient details’ reflecting amounts collected against instruments deposited where the depositors fail to give proper account details. The RBI, in response to a right to information application, had noted that while one of the discrepancies could be a mismatch in the name and account number of the depositors, “these entries could be reversed at the branch after receipt of appropriate information”. The ICICI bank which has been at the receiving end of the courts over several aspects of its functioning, with the Supreme Court disapproving its coercive methods to recover loans from defaulters.

Question-1) What are the rights of the Loan Recovery officer of a Co-operative bank in regards to recover a loan from a Garentor? Question-2) Can a Loan Recovery officer of a Cooperative bank give orders to Nationalised banks to seize the accounts of Loan Garentor without the seal or order of Special Magistrate? Question-3) Can a Nationalised Bank like ICICI have rights to accept the orders of Cooperative Bank's Loan recovery officer to seize the accouts of Loan Garentor? Question-4) For how many days, months or years can a Bank account be siezed? Question-5) Can a Nationalised Bank seize the accounts without intimating / informing its consumers in time?
  14. ICICI agents rough up Goa man for not paying loan Margao (Goa): Jowett D'souza's had financed his dream car from the ICICI bank in March 2002. But his dream ride abruptly came to a halt on August 6, 2004. "They gave me two blows, they pushed me and grabbed the keys from me,” says D'souza. The reason- after making 26 on-time installments, D'souza had failed to pay two because he had run into financial trouble, according to RBI guidelines. ICICI Bank should have done the following things: First sent default notices to D'souza. Then given him reasonable time to make up for the defaulted payments. And under no condition should it have used muscle power to recover the loan. But ICICI bank chose to do otherwise. D'souza was accosted and beaten up in front of the Colva post office. The recovery agents of ICICI BANK snatched his car in broad daylight and that is when D’souza ‘s struggle for justice began. Police Control Room file notings, applied for by D’souza under the RTI act clearly show that the ruffians were sent by none other than ICICI bank in direct contravention of a Supreme court order. But D’souza’s ordeal didn't stop there. "In the month of October 2004, I have written a letter to the Director of Transport saying that the vehicle is in dispute between me and ICICI bank and you are not authorised to sell the vehicle and you have to inform me,” says D’souza. But the recovery agents got round this as well. On March 3, 2005, they simply forged D’souza's, signature on the letter, terminating the hypothecation on the car. On March 4, someone posing as D’souza filed a complaint at the Colva police station on a ready-made template stating that the car papers have been lost. While driving the irony is that D’souza wasn't even in possession of the car at that time. The next day someone again forged a letter posing as D’souza asking the RTO to withdraw the freeze on the sale of his car. On May 21 the Crime Branch surprisingly issued a No Objection Certificate, giving the green signal to transfer the car. On May 25 D’souza’s signatures were forged on all the sale papers of the car. And on May 30, the RTO cleared transfer of the Car to Mallapuram in Kerala. "The banks nowadays seem to be engaging gangsters to sieze the car from the defaulters and this is done in collusion with the police" says D’souza’s lawyer, Radha Rao Gracious It was only after D’souza went to court that the police filed the FIR. So what is the progress of the case three months later in August 2005 so what's the progress of the case? "We have registered a case here and the investigations are going on soon we all are going to file a chargesheet soon," says SP, South Goa, Shekhar Prabhudesai.
