In a specific case, a colleague of mine sought information (under RTI) .... the PIO did not furnish the desired information.. after 28 days he emailed my colleague and mentioned: "I would like to inform you to provide the information in the Application Proforma for the Information Seekers is available at the Institute website and The requirement of Self Attested Photograph and the Proof of Citizenship is a must for the Information Seekers. Please send the above information at the earliest, so that your application can be processed." Can a PIO/CPIO stay away from providing information on the pretext cited above. I welcome your views on this matter - and what can be done against such PIOs/CPIOs? Thank you.
  2. Advocate H.C.Aroral in a communication has objected to State Public Information Officer of Punjab Agro Foodgrains Corporation Ltd., Chandigarh demanding ID proof for entertaining his RTI plea. In his communication to officer concerned, who declined to provide me requsite information on the ground that has not enclosed ID Proof alongwith my RTI application. Arora said to Information officer that stance is patently illegal. Asking for an ID Proof from an advocate is uncalled for and totally unwarranted. It is in violation of provisions of section 6 of the Right to Information Act, 2005, which envisages that application for getting information is required to be accompanies by such fee as may be prescribed. Section 6 (2) of the Act further requires that application for seeking information need not state any reason, nor any personal details except those which may be necessary for contacting me. He said e-mail ID is sufficient for contacting him, as he has mentioned his e-mail with RTI application.     Respected panel, I am using an airtel prepaid. For my prepaid no. I asked the airtel people to provide me a proof that I am using this number from this day onwards. But they are not providing me and I am having no documentary proof that this phone number is mine. Please guide me how and where can I get a proof that this phone number is mine

  7. RTI application filed online has been transferred to another department that is not online. This deptt has replied by post saying I need to provide citizen ship proof. Should I state online registered citizens are not required to provide proof for each RTI application separately. Earlier I never got asked for such proof. Also, I am asked to send a signed copy whereas m,y original complaint was online on GOI RTI site so I do not need to sign. I believe these are delay tactics. What should I do? Raise first appeal online to original deptt/ministry? Or write back with reasons to transferred deptt? Or send documents needed by transferred deptt?

The CIC has ruled that a PIO cannot go on asking for a proof of citizenship even when the applicant has provided his ID proof: Section 3 of the RTI Act has given the right to information only to the citizens of India, but that does not mean that a Public Authority can go on insisting on the proof of citizenship and use this as a method of denying the information The Commission, therefore, directs the respondent/PIO to give the information sought by the appellant in all his five RTI applications following the relevant provisions of RTI Act, if personal information of third party is involved, within 15 days from the date of receipt of this order and also directs the following officers of the Public Authority to show cause why maximum penalty cannot be imposed in all the five cases, separately in each case, for misusing their authority in denying the information to the appellant and unreasonably demanding the proof of the citizenship of the appellant without any basis The full decision is attached to this thread.     demanding photo identity proof

    Hi All, I have sent an application to Cuttack Municipal Corporation and they have rejected my application mentioning photo identity proof of the applicant is not attached. Are they allowed to do so??? I wish to know that is it necessary to disclose the information of the applicant for filling an RTI application??
  12. Hello, I put an RTI request to get the proof of address provided at the time of taking a land line phone connection by an MTNL employee. However I have got the reply that inspection/ supply of this document will not be possible under RTI section 8(1)(j). Do someone have any judgement made by information commisioner/ any court on similar scenario? Or can help me with some facts to get the information out? Thanks in advance.
  13. Hi Team, I had applied Gas Connection on 04.01.2012 with Bharat Gas Dealer. When I enquired with the clerk she asked me to deposit the money as I my waitlist was over. When I went to the counter to pay the money, they say that since I did not receive any call I can't pay money for the connection. I had submitted Photocopy of Rent Agreement, Original Affidavit for Gas, Photocopy of Voter Id as Proof. I dont have any written evidence that can proved that I have applied for a Gas Connection. When I demanded the same the Gas Agency said that "We have your documents with us. When your wait list is over you can take the connection. Your wait list is no is 7006 and it can take 2-3 months time" . How can I file an RTI in this case ? Regards, Anand

Ina decision related to the Madras High Court, the CIC has ruled that there is no requirement under the RTI Act for the public authority to call the RTI applicant to verify his signature or produce proof of identity. We*agree*with*the*submissions*of*the*Complainant.*It*was*not*right*on the*part*of*the*CPIO*to*insist*on*the*information*seeker*visiting*her*office*to identify * his * signature * and * to * prove * his * identity. * This * is * certainly * not * a requirement*under*the*law.*We*understand*that*even*the*Madras*High*Court RTI*Rules*do*not*make*such*stipulation.*It*is*good*that*this*practice*has*been abandoned*now. One of the PSUs in Kolkata is asking for attested copies/photogopies of address proof & identity Proof (PAN Card, Electricity Bill, telephone bill, bank pass book, ration card) along with the RTI application, although RTI Act 2005 has not stipulated producing identity & address proof. When an RTI applicant makes a request for informaltion, he mentions his address, telephone no. and the reply is also sent to the indicated address.   17. I have applied for Address proof at Chennai KK Nagar Post office after remitting Rs.240/= on Dec 4th. But still i yet to get my address ID card it looks like they have not even taken my application form because proof of address verification has to come before issuing ID proof. Inspite of so many reminder to PRI(PERSONNEL RELATION INSPECTOR) my efforts go in vein has he says he says so many applicants to varify. What should i do now?
  18. There have been many threads on this forum as to whether the PIO can demand proof of citizenship, from the applicant. The CIC has recently passed an order (related to the Army), where it has ruled that the proof of citizenship is not required as a principle but only in exceptional cases. The full order is attached to this post. NOTE: Some State RTI Rules (for example Orissa) require the applicant to submit a proof of citizenship along with the RTI application.   20. We all speak of registered post and registered A.D. in most RTI discussions. I would like to know which is preferred. As per my understanding, registered post does not provide acknowledgement, but can be tracked, while registered A.D. can be tracked and also provides an acknowledgement of delivery. Everything good so far. The question is , how do we prove that the copy we hold with us is the one we sent to the recipient. The recipient may actually say that the envelope was delivered but there was nothing in it, or claim it was just some text. How do we prove that the envelope contents are exactly what we are holding a copy of? Or should an application / letter be sent open, without an envelope? I am sorry if I am unable to frame the question correctly, but I would request RTIINDIA members to respond.

Dear Sir Please go through below information and advice me. can I get passport at Coimbatore RPO with given proof of documents My New Application No. CBE A02953709 DT.23.10.2009 Old Application No. TRY A04282509 on 18.09.2009 at Trichy transferred to Coimbatore Passport office vide letter No.TRY A04282509 DT.19.10.2009 Fees paid: Rs.1000.00 vide receipt dated 18.09.2009 Penalty paid: Rs.5000.00 vide receipt dated 16.10.2009 Recently received Letter File No. CBEA02953709 Dated 21.12.2009 from Coimbatore RPO asking Ration Card & Voter ID, but I don't have Ration Card & Voter ID. Further to my passport application transferred from Trichy RPO to Coimbatore RPO, I have re-applied for my passport on 23.10.2009 at Coimbatore Passport office and my police verification against this application completed on 11.11.2009 from Avinashi Police station. Recently I have checked my passport status in the online and noticed following status and finally asked for original Ration card / Electoral Identity Card. Online Passport status noticed: 1) on 05.12.2009: Police Report is clear and the passport is expected to be dispatched by 08-12-2009. Subject to all documents being in order. 2) on 09.12.2009: It is to regret that due to unavoidable circumstances the dispatch of passport has been delayed and will now be dispatched in a week's time. 3) on 22.12.2009: Original/Attested copy (by a gazetted officer) of S.S.L.C/School Certificate /Birth Certificate. Original/Attested Copy (by a gazetted officer) of Ration Card /Electoral Identity Card/ Voters List. Report to this office on any working day (except Wednesday) between 9.30 A.M. and 12.30 P.M. alongwith the above mentioned documents / this letter. But, I have the Ration card and Electoral Identity Card in my native place address at Nagapattinam and those proofs already submitted with application at Trichy passport office and the relevant police verification already completed on 02.10.2009, later my file was transferred to Coimbatore as my present resident and working location is fall under Coimbatore RPO. So, I have submitted following available proofs at my present address during submission of my passport application at Coimbatore passport office. 1) Certificate from Employer of reputed companies on letter head 2) Statement of running bank account 3) Gas connection Bill 4) PAN card/Income Tax Assessment Order 5) Rental deed Initially I had applied passport at Trichy Passport office vide Application No. TRY A04282509 on 18.09.2009 because I have Ration card and Electoral Identity Card in my below native address which fall under Trichy passport office. 2/62, VELAR STREET PUTHUR, MANJAKOLLAI POST NAGAPATTINAM 611106 My police verification at the above native address completed on 02.10.2009 and later I had met Smt. Gowri Balakrishnan Superintendent at Trichy Passport Office regarding delay of passport. Madam said that the police report says I am presently working in Coimbatore and she asked me to pay penalty of Rs.5000.00 for not mentioning present resident/working address at Coimbatore district. I had explained, by mistake I am not written that because I have the ration card & voter identity at the above native address and hence applied for passport at Trichy RPO, after their explanation I had realised my mistake that I must mention the present address also and the same day I had paid penalty Rs.5000.00 vide receipt dated 16.10.2009. After that madam informed me that my file will be transferred to Coimbatore RPO for the issue of passport because my present address is falling under Coimbatore RPO jurisdiction. Also madam asked me to contact Shri.B. Balamurugan at Passport Officer, Coimbatore and madam assured that I can get the passport with proof of certificate from the present employer, bank account and Gas connection bill at present address. After two days, I received letter from Trichy Passport office informing that my file was transferred to Coimbatore passport office for the issue of passport vide their Letter No. TRYA04282509 dated 19.10.2009 and instructed me contact Coimbatore passport office. After two days I came to Coimbatore passport office and enquired with Assistant Passport Officer Shri.C.G. Rajan and they immediately found my application file transferred from Trichy RPO and asked me to submit fresh application mentioning present. Same day I have submitted new application and my application was accepted vide ref No.CBE A02953709 DT.23.10.2009 with following available address proofs. 1) Certificate from Employer of reputed companies on letter head 2) Statement of running bank account 3) Gas connection Bill 4) PAN card/Income Tax Assessment Order 5) Rental deed Sir, I am not having Ration Card and Electoral Identity Card at my present address. As reported by Shibu Thomas at timesofindia.indiatimes.com on 28 November 2009 MUMBAI: A police officer has allegedly issued an identity card to a Santa Cruz trader, designating him as a "friend of the police'' and an "undercover agent''. The act, obviously, has not gone down well with the Bombay high court. A division bench of Justice J N Patel and Justice Amjad Sayed on Friday directed Mumbai police commissioner D Sivanandan to file a personal affidavit and explain the legal validity of such a I-card. The court was hearing a petition filed by a resident of Lokhandwala in Andheri, Vikas Ganeriwal, who had a dispute with the Santa Cruz trader Sudhir Jhunjhunwala, over s business deal. According to Ganeriwal, Jhunjhunwala has been brandishing the identity card__issued and signed by Saki Naka assistant police inspector Majardekar and stamped with an official seal__and using it to his advantage. In his petition, Ganeriwal said that claiming himself to be a "friend of the police'' and an "undercover agent'', Jhunjhnwala has been threatening him and also putting pressure on his family to settle the dispute and withdraw all court proceedings or he would get him arrested. In fact, Jhunjhunwala did get Ganeriwal arrested by lodging a complaint with the Oshiwara police, a source said. The petition said in the police lock up, Jhunjhunwala assaulted him and "pressured and terrorised'' him to sign blank documents. "He was behaving as if he was the seniormost police officer,'' said the petition. Following his release on bail, Ganeriwal filed a Right To Information query, which revealed some startling facts. In his reply to the RTI plea, assistant commissioner of police Kaiser Ahmed said while the police force and police stations did not officially issue such identity cards, API Majardekar might have given one to Jhunjhunwala as he peronally knew the businessman. According to Majardekar, an "undercover agent'' meant a police informer and in case, Jhunjhunwala misused the card he could be prosecuted for the relevant criminal offences. Ganeriwal has urged the court to direct the police to clarify the powers and rights granted on the basis of such I-cards. Contending that issuing of such an identity card was unconstitutional, he has sought a ban on the practise. The court has asked the police commissioner to file his affidavit in two weeks. API Majardekar reportedly issued the identity card to Santacruz based trader Sudhir Jhunjhunwala. The I-card proclaims that Jhunjhunwala is a "friend of the police'' and and "undercover agent''. The card further mentions that the fact can be verified from the police station. Jhunjhunwala, the petition claims, used this card to "terrorise'' a Lokhandwala resident with whom he had some disputes pending in court, and have the latter arrested. Police claim there is no official practise of issuing such cards and the API might have issued the card as he personally knew the trader. Police say if the card is misused, the offender can be charged with criminal provisions based on the crime he commits.   23. As reported by Neha Shukla, TNN at timesofindia.indiatimes.com on 06 April 2009 LUCKNOW: An RTI applicant may or may not possess a ration card. The Act has no provision requiring an information seeker to submit any proof of identity. This restricts a public authority from asking an applicant to submit such details unless it has `very strong' reasons to do so. However, National Botanical Research Institute (NBRI) seems to make it a common rule now. It will provide information to the applicants only when they submit a copy of voter card, PAN card or ration card. The response issued by NBRI on March 31 to a query regarding the number of PhD degrees awarded under the guidance of few of its scientists clearly asks an applicant to submit the proof of identity in support of being a citizen of India. The response does not mention the reason behind asking for such a proof. It is also not clear if it was a case-specific response or will it be a common rule. Though the public information officer (PIO) of the institute could not be contacted and the reason behind the move could not be ascertained, sources claimed that this might help the institute to check the number of applications coming from fictitious sources. The response shot off by the PIO informed the applicant that information requested by her was ready. But, it can be provided only after she would submit documents in support of her identity proof of being a citizen of India which could be a copy of PAN card/ration card/voter card. On the receipt of the above, the information will be sent to her. The information commissioners and activists might differ in opinion but they agree unanimously that RTI Act does not mention any such thing. "There is no such provision mentioned in the law but as an exception it might be done and the public authority will have to have a very strong reason behind asking for an identity proof,'' said Shailesh Gandhi, information commissioner, Central Information Commission, New Delhi. The reasons have to be mentioned in the response issued to the applicant which NBRI has not done. In the cases heard by information commissions in other states there have been instances where PIOs have challenged the integrity of the applicants. In such cases a step like this might be taken but it can never be a routine exercise on the part of the public authorities. "It cannot be allowed to become a general practice as public authorities can use it as a tactic to delay information,'' said Gyanendra Sharma, chief information commissioner, UPSIC.   24. Dear Members I want to bring out one thought that I have for long time and I feel it is very very important for the country. In the developed nations such as USA, every citizen is given a national identification number called Social Security Number (As many would know). This number is used almost everywhere and the Government can pretty much track the history of the person in many aspects such as financial, criminal, place of stay and many more. A citizen is pretty much consolidated under on number. Now in India, I think there is no such national identification number for citizens that are used in all required places. With 1.2 billion populations, implementing such number system takes long time. At least 5 years may be required to issue the numbers for all and another 5 years to make people to accustom with the system. If started now we can have such working system around 2020. I know voter’s identification card is given but not sure if this is issued with the purpose of being used everywhere such as school, employment, financial accounts, in property documents and etc. This would give clear control for Government and the advantages are countless. Anyone from this forum know if the Government is already implementing or has any such plans? Otherwise, I would like to use RTI to get this information.
  25. Is it possible to obtain a voters ID card even after the election is over (any working day of the year) or one can only file an application when Election Commission sets dates for counting the Electoral?
