akhilesh yadav posted a topic in RTI in MediaThe State Information Commission (SIC) has directed the MP state general administration department (GAD) to ensure that all the government departments submit report on implementation of Right to Information (RTI) norms to the commission as required under section 25 of the RTI Act. The commission has observed that government departments are failing to submit the annual reports on RTI implementation, which is creating hindrance in the commission’s own compilation of reports. The SIC is expected to come out with annual reports on RTI status which would be tabled in the state assembly. In a recently issued order, information commissioner Heeralal Trivedi observed that during an exercise to compile reports he had found reports from the some departments were missing, which was a violation of provisions of Section 25 of the RTI Act. More than 240 resolutions passed by the civic general body meeting and ward committees are still pending with the Brihanmumbai Municipal Corporation (BMC) for the last 11 years. They have not been implemented due to lack of approval from the municipal commissioner. A right to information (RTI) query by activist Anil Galgali has revealed that as many as 243 resolutions passed in the BMC are waiting to be implemented, as the civic chief has not responded to them so far. The recent directions by Governor N N Vohra to the state bureaucracy on effective implementation of Right to Information Act (RTI) particularly ensuring proactive disclosure through official websites has not only uplifted the morale of RTI activists but the said intervention during the present political scenario would definitely strengthen State Information Commission (SIC) for its effective working. The upright and honest officials in other transparency institutions like State Vigilance Commission (SVC) and Vigilance Organisation too feel elated by Governor’s intervention. The idea of it being with the commission was communicated by none other than Fadnavis in a meeting he had with information commissioners on January 16. In the meeting, the commissioners had sought various measures to strengthen the functioning of the commission. "His response to our demands was positive and said the government too was keen on strengthening the commission because it was looking to give the implementation of theRTS Act to the commission instead of instituting another authority. He said soon a meeting will be held to work on the modalities," said Ratnakar Gaikwad, state chief information commissioner. While Fadnavis was not available for comment, a senior officer present in the meeting gave some reasons. "Most people are filing RTI for information because they need redressal and delivery of services. Information as such does not give them food to eat or home to live. In some cases it does help but in most services are not given to them. That's why we are looking to give the implementation of the RTS to the commission because a lot of it pertains to information and services," said the senior officer. However, the decision (of handing over RTS implementation to the commission) which the government is contemplating lacks sufficient details on how the state will make it possible. "Except for Mumbai, the waiting period for second appeals is over a year. I am not sure that by giving the RTS to the commission it will work effectively. RTI may get worse and this too may become problematic. It may not be a bad idea to have secretaries of each department as second appellate authority of sorts for RTS with time limit fixed on hearing of such appeals," said Shailesh Gandhi, former central information commissioner who has been pushing for an effective implementation of RTS.
