Can the General Diary of the police station where particulars of "All the details in r/o criminals arrested and entry of arrival/departure of all enrolled police officers on duty with nature of their duties, duty performed and places visited etc." are maintained be inspected and photo copies sought from a particular police station under RTI? Is there any particular clause/section that needs to be quoted for inspection under RTI? Any format available for inspection under RTI?

An RTI was filled by me on 19.11.18 to PIO to finance Department as enclosed herewith, Now PIO has replied that since you have asked certain questions in the disguise of seeking information under RTI act. Asking the question is not covered under definition of "Information" as provided u/s 2(f) of the RTI act. Therefore the Questions asked by me can not replied under RTI Act 2005. Further PIO says Nonetheless I may visit the office of S.O.(Civil Establishment-II) inspect the concerned file on any working day between 03:00 pm to 04:pm and identify the required papers/documents. Same shall be provided the photocopies of required documents after depositing the prescribed fee @ Rs.2/- per page. So please guide me the use of word "Weather" comes under the definition of question? PIO reply after 55 Days and not trying to deemed and denies the information.   3. I have been permitted to inspect files and record in an office under RTI. Video recording of inspection, that is scheduled today at 3 pm, was denied by PIO in the previous meeting unless I provide such order of CIC to him. In my knowledge, there are two orders where video recording was allowed by CIC. (CIC/WB/A/2006/00144 and CIC/AD/A/09/00125). The first order mentioned here is available and attached here. Unfortunately, this order is very ambiguous and does not allow video recording in clear words. The second order is not available in the public domain even on the website of CIC. Please help me in the following issue. 1. Please provide any order of CIC that allows video recording/audio recording of inspection or taking the photo while inspecting documents. 2. Please provide any rules, regulation framed for the purpose video recording/audio recording of inspection or taking the photo while inspecting documents. 3.     How to inspect under rti ?

    I have compiled guidelines to be followed while undertaking inspection of records under RTI. The same is attached herewith. GUIDELINES FOR INSPECTION UNDER RTI 1. Even if you do not desire to carry out an actual inspection of records, invariably request as under in RTI application: This will have deterring effect on PIO against providing false information. 2. If you are not very conversant with the language of record or have any other disability, please also add the following sentence in RTI application: 3. When you get permission for inspection from PIO, FAA or Information Commissioner, send a letter by speed post to PIO stating list of records that you would like to inspect. Please also mention three tentative dates with time which would be convenient to you and also seek an exact name, address, email ID and phone number of PIO. 4. On appointed day, visit the office well before fixed time with your assistant [if permitted] and with copy of relevant decision, photocopy of your photo ID proof [election card, PAN card, passport etc], digital camera, mobile [with recording facility], blank papers, carbon papers, note pad, blank CD, 20-25 paper flaps [ for putting in registers or files to identify papers], pen, pencil, copy of RTI Act and Rules etc. 5. Please make note of your visit and that of your assistant in register maintained at entry point or reception as now most of govt. offices are having such register. This will be proof of your visit at the fixed date and time. 6. Contact the PIO and request for inspection. 7. Ask PIO to prepare inspection slip for noting down date and time etc of commencing inspection and ending inspection and payment of inspection charges. Some offices have register for these details. If he insists that charges be paid in advance before commencing inspection as per tentative hours required for inspection, pay the amount against receipt and then start inspection. 8. Please insist that PIO or any other person from office should be present with you during inspection. 9. In case if sitting arrangement, lighting and air in the room are not conducive to inspection, inform PIO orally and in writing [if need be], with time and date. 10. Start inspection and whatever record you find worth obtaining certified photocopies, use your digital camera and put a paper flap. 11. Go on making notings in your notepad of whatever is necessary from the record with page number and name of register or file etc. 12. In case despite all efforts, you are not in a position to inspect, give in writing to PIO all the reasons and obtain his acknowledgement on copy then and there. Also inform personally or on phone to FAA. 13. If you need data from computers, ask PIO to provide assistance of office staff for accessing computer data. Note down details so that required information can be obtained in a CD. Do not operate office computer yourself. 14. Whenever you talk to PIO keep the audio recorder on in your mobile and ensure that conversation is recorded. 15. At the end of inspection or during it ask PIO that you need certified photocopies of record where flaps are kept and collect the same before leaving the office. 16. Once you end inspection, make entry into inspection slip or register with problems faced by you if any or that you want to continue inspection on next date. Put date and time and pay or seek refund of balance of inspection fees. Pay as per RTI rules applicable for central govt. or state govt. rules for inspection as the case may be. 17. In case certified copies or CDs are not provided before leaving the office, give a written request [against acknowledgement] with page numbers of record etc to PIO for the certified copy. 18. Be cool, collected and courteous during entire visit and inspection. Thank all the staff and PIO if they have cooperated with you for inspection. 19. Do not write anything on govt. record. 20. Next week mail a list of papers you require from PIO which have been identified by you during inspection, as a reminder. Pay the charges if papers are provided within 30 days of submission of RTI application. 21. If you face serious difficulties in inspection, file the detailed written complaint with FAA or Information Commissioner [with copy to PIO in his name] and request for appropriate orders to facilitate proper inspection. 22.   5. Respected members, I had filed an RTI asking for details of MPLAD funds. I received the reply from the PIO that copies run for over 150 pages and have requested me to pay Rs 300. What is the mode of payment of the fees? Can i deposit by postal order only or is there any other way. Kindly help. Thanking You

The National Board of Examinations, which regulates almost 7,000 post-graduate medical seats, mostly in private hospitals, has refused to share inspection reports of hospitals on the basis of which seats were granted. In its response to RTI applications, the NBEstated that it had asked the hospitals if information pertaining to them could be given to a third party but the hospitals had refused. The Medical Council of India (MCI), which regulates roughly 28,000 PG seats, in contrastputs all inspection reports on its website. Since post graduateseats regulated by NBE are equivalent to those regulated by MCI and both bodies essentially perform the same function, it is not clear why NBE cannot also put this information in the public domain. Asked why they had refused to part with this information, NBEofficials told TOI that its assessment reports also included employment contracts of hospitals with faculty members and income tax details of the faculty along with pan number, which areconfidential and could not be shared. Asked why such information alone could not be kept confidential while revealing the assessment reports, they claimed the relevant assessment documents, list of assessors and other details would be put up on the new website once it becomes operational by June end. Yet, the NBErefused this information to RTI applicants.

    An Applicant during inspection of the concerned records can be accompanied by his counsel or an authorized representative. If the petitioner, for some reasons, felt inhibited due to his not being fluent in English, denial of appropriate assistance in fact would have resulted in withholding access to information. Surely, that is not the object of the Act or even the order. In these circumstances, the respondents should grant the petitioner's request. Accordingly, the respondent No.1 is directed to permit inspection of the concerned records by the petitioner, who can be accompanied by his counsel or an authorized representative.

As I have file RTI and demanded inspection but I have not written in my RTI Application what documents I need on this base PIO rejected my application. How to demand before inspection.   11. Hi, I wish to know the rules related to Inspection. For example, can I ask some responsible officer for a certain road to inspect the road surface? Or ask an officer from Municpal Corporation to come and expect a walkover bridge? Also about road or walk over bridge, do roads have a inspection schedule by default by some officer? How do they know that road has damaged and needs repair? Can we ask for a schedule of inspection by the inspector? Can I ask to be accompanied by him? or read his notes? I have some idea of inspecting documents but not much about inspecting work. Thanks, Vikas
  12. Every time I seek information, I add the following line at the bottom. During the Inspection I am intending to take photographs of Records, Documents, Objects that I am allowed to Inspect. Invariably the PIOs [CPIO/SPIO] deny the same saying that taking photographs is not allowed in the Act. So what is position? Any members of this forum ever used camera to take photographs during file inspection? Any feedback/suggestion/decisions which may help me? Sidharth

Central Information Commission, after giving one of the important judgement "No provisions to deny information on grounds that it disproportionately divert the resources", citing case law from Kerala High Court now has issued show cause notice to Public Information Officer (PIO), as to why instead of giving the file under RTI Application, he has offered applicant to inspect the record. In a similar citation posted at out law segment here: Can PIO direct inspection of records under RTI without knowing where the information is?, Central Information Commission (CIC) has decided that Considering such response of asking appellate to do the inspection, where the PIO himself does not know where the information is, the Commission, considered such response as ‘Denial of Information” and directed the Public Authority to provide information An RTI was filed for seeking copy of file in which govt. is planning to approach SC for grant of 50000 additional auto rickshaw along with the file noting and released 15000 permits for SC/ST/OBC category. CPIO asked the complainant for inspection. The applicant made the complaint before commission for imposition of penalty for obstructing in providing information. Asking for inspection of record instead of giving file record CIC in it's decision here stated that "the then Motor Licensing Officer, Auto Rickshaw Unit, Burari (as on 7.2.14) to show cause as to why he offered inspection when the Complainant had sought the entire file. He is directed to submit his response so as to reach the Commission within three weeks of receipt of this order." You can discuss this decision at our forum here!   14. I have filed application for inspection of records. But unfortunately PIO didn't invited for. 30day time limit has been passed. What to do? Will they provide information free of cost now?
  15. Commission directed the respondent CPIO to provide copy of the agreement between the contractor and Delhi Jal Board about the execution of work along with the drawing. It appears from the decision that inspection of record was not demanded by the appellant, yet, Commission directed the CPIO to facilitate inspection of record to the appellant.     Fee for inspection

    Though no fee is chargeable for first hour for inspection, someone has interpretted that any application to the PIO seeking any information, including inspection the prescribed fee of Rs.10 has to be paid. I could not locate any order that stipulate requirement or non-requirement of payment Rs.10/- along with application seeking inspection, I request for help.

    Hello, Kisi bhi larger records ka inspinspection karte samay kis tarah se inspection karna chahiye. AgarAgar muze students attendence register ka inspection karne ki permision mili to wo inspection karte samay agar wo students ka verification muze dakhal khariz register se karna ho to kya muze pahle hi batana hoga sic ko. Aur ininspection k samay muze gadbadi najar aai to uski copy dene se mana kiya to.

Central Information Commission (CIC) in its recent order ruled that offer of inspection cannot be claimed as denial of information and it indicates the willingness of the Public Information officer (PIO) to disclose information. Commission noted that "It would be easier for the Respondent to supply those documents identified by the Appellant after inspection thereby curbing unnecessary wastage of paper." However, the Commission advises the PIO to supply those documents that can be supplied instantly and to offer inspection if it is scattered over several files. The RTI Act 2005 prescribes that applicant can inspect the document, there is no provision to state that PIO has discretion to direct applicant to do the inspection. The Provision of RTI Act states that; A citizen has a right to inspect the records of a public authority. For inspection of records, the public authority shall charge no fee for the first hour.   23. During the course of inspection or before and after inspection, an applicant has every right to take notes and extracts from the documents or records. He can further ask for certified copies of any such documents or record (which includes manuscripts, file, microfilm, microfiche or facsimile copy of a document, any reproduction of image embodied in such microfilm, or any other material produced by a computer or any other device as per Section 2(i). Copies of unsigned documents shall be provided duly certified that these are unsigned documents. Ref decision – (Surya Prakash v Land and Building Deptt. DDA, CIC/WB/ (A)/2006/270 DT. 29.5.2006)

If an applicant wishes to make copies of records/samples given to him for inspection at his own expenses, it is not for the Public Authority to object to the copies are being made, provided it is restricted to the information permissible under the Act. There is no provision in the act disallowing Videography, and therefore, cannot be excluded unless it violates the parameters of any information sought and agreed to be provided. Ref.   25. I have recently applied an RTI and the PIO had asked me to come for inspection even for queries in yes or no format. This kind of PIO approch is to block the information. Futher, i do not want to meet the PIO. What should i do. Hon'ble members value suggestion is solicited. RTI-PPCL-1.doc
