  2. Hello, I have to get IT refund for AY 98-99 & 99-00. Did not follow up with IT office at that time thinking that they would give the refund. And after some time decided to consider it as "lost", since I did not have the time to go around the IT office. I came to know recently from your site that using RTI , we can get refund. MY question - Can I apply for IT refund for those years. Since I have not followed up at that time, will the ITO cite that as a reason for rejecting it? Is it a per-requisite that we should have send some requests/follow-up before to apply for refund under RTI? Thanks , Rani
  3. Hi, I had submitted an RTI application for my IT Refund to the Bangalore Ward 14(3) IT office. I have addressed my application to the following: Central Public Information Officer (Central Public Information Officer) Under RTI Act 2005 ACIT, ITO Ward 14(3) (Accessing Officer) No 59, HMT Bhavan, Bellary Road, BANGALORE - 560032 I had sent it through speed post on 9th Apr. It was delivered on 11th Apr. I am yet to receive a response on the same. Can you please advise how long I should wait before filing the First appeal? Thank you.
  4. Hi, My son is a NRI. He has a IT refund pending now for the last 5 years. and he is asking me to follow up with IT dept. Despite many letters to the dept i have not had any response. a)Can i invoke RTI by sending the required postal order and requesting for the refund? Or does it have to be my son only who can invoke RTI? . b)He is coming to India on a short vacation. Can he apply for the same when he is in india? Or does he have to necessarily invoke RTI only from overseas? . c) I got a reply saying i could check for cpio address in link Income Tax India but there is none or no record for tamil nadu.   5. Anyone encountered a similar problem of forgetting to encash the IT refund cheque and hence the cheque expired by the time it reached the bank? Help me and many like me to get a handle to the information below, would be highly appreciated. 1. Process to get a new cheque of my IT return refund. 2. Place of filing IT the return Pune. 3. IT cheque expired on 18th Aug 2009 Any other related information passed on this thread would be grand as well!!! Thanks in advance and hope to get useful information that would work, of course. to encash on hard earned money that came back from I.T body?
  6. My consultant uncle's IT refunds of many years had a huge backlog.The accumulated amount became substantial. All his follow-ups and subsequent follow-ups by his authorized personnel, including his Chartered Accountant did not yield any results. This was when he approached me. On my visit, the ITO showed me umpteen (simple) mistakes & discrepancies in the forms submitted by his(my uncle's) Auditor. After rectifying them the refund cheque was (allegedly) issued. On contacting the Post Office we found no trace of the envelope sent in the incoming register. A letter from the Postmaster became necessary saying they hv not recd any letter from the IT Dept. This is where the tale takes a twist. For searching the "lost" cheque I was asked to give a small incentive to trace it out during the holiday. We refused and put the matter in writing to the Commissioner with a copy to CBDT New Delhi. A new cheque was posted to us and this time it came !!! Many times there is fault on both sides, and instead of allowing third parties to intervene, it is better to do it directly.

    Income Tax refund

    Hi, I want to know, is there any process to write directly to Assessing officer for tax refund. Last 2 years, I am continue follow up for my tax refund for the A.Y 2008-2009, but there is no update. Through online tax refund status, every time shows this result : Your assessing officer has not sent this refund to Refund Banker. If this refund has been sent by your Assessing Officer within the last week, you may wait for a week and again check status. Note:- Please contact your Assessing Officer. Please help, how could I refund my money back.

    Need Help on IT Refund

    Hi, Am Sasi Kumar from Chennai. New to RTI. Just having a query in IT Refund. While filing IT returns for 2007-2008, i have paid the excess of Rs.6500. I have checked the Refund status in Online Refund link, and it says the Bank A/c Number is wrong and not able to credit. So i went to Chennai IT office say for 8 to 10 times (Approx) from 2009 to till now and my amount is never get refunded. Each and every time they are saying we will be doing it and you will get the call while updating your account number in the system. But till now i didnt get any call from IT office. Can you pls do the needful and let us know if you need any further information. Regards Sasi

    IT Refund Amount

    Hi All, I haven’t got my IT refund amount of Rs. 30000+ for AY year 2008-09 (FY 2007-08) till date as I had filled IT return form on time. The problem is that my PAN card is issued from Ghaziabad (UP) and I filled return from Delhi. So till now I haven’t got my refund amount. Also I saw one post that for PAN migration the office were you have filled IT return will automatically ask concern PAN office to migrate PAN card. Also in that post it’s mentioned that file RTI to both the offices. Could you please let me know what I need to do and also now a days I am out of India, so in that case how can I file RTI? If not can anyone on behalf of me file it? Thanks, Mahipal Rawat
  12. Hi I filed my tax return in bangalore A.Y. 2005-06 and 2006-07. I am in delhi now and still have not recieved the refunds. I have got the address by looking at some sites is it correct ? Income Tax Officer C.R.BUILDINGS, QUEEN’S ROAD, BANGALORE Now how should I make an application under RTI and there is a draft to be made of Rs 10/- in what name the draft should be made ?     IT Refund Claim

    I have filing the IT return since 2006. Every year I have refunds atleast Rs.500 to Rs. 3000. I have never got the refund. Please help me is there any way to find out why i did not get. Best Regards Ramesh

    how to check the status of income tax refund where the return was filed at Bandra Income Tax Office and the refund is not received for past 3 years
  16. For the assessment year 2007-08, when I searched for my refund status, I got this message- "Unable to credit refund as the account number provided by you is incorrect". And for the assessment year 2006-07, I got this message on the page - "1. Your assessing officer has not sent this refund to Refund Banker. 2. If this refund has been sent by your Assessing Officer within the last week, you may wait for a week and again check status." What can I do for both of the above 2 cases? It would be great if someone can advise me on the same? I have checked the other suggested threads, but couldn't get the exact answer to my question, so asking for clarification.     I have sent a postal order to accounts office Mumbai on 19th Feb and am awaiting to hear from Mumbai office.     I t refund

    i have been visiting Myur Bhavan office, Delhi again and again to get my refund for 2007-08 assessment. the refund update of the I T site tells my MICR no is wrong. I have given the correct no and have E mailed the Mumbai SBI as well with no result. What should i do? regards N Dwivedi
  19. I would like to give my sincere thanks to innovators of RTI India for such a wonderful idea. This site is really great. I had submitted my IT return in July 2007 for AY 2007-08. There was a refund claim for Rs. 5000+. But I did not get it till August 08. Then I searched on net for help and found this site. After getting guidance from this website, I had filed RTI application on 10th September, it reached to concerned officer on 15th September and finally, I have got my refund cheque on 12th October. Kudos to RTIIndia.org. I would also like to know that for how much time should I wait to get my IT refund for AY 2008-09. I had filed IT return in July 2008.

  21. I'm working with an organisation on contract. My TDS is deducted & submitted by my company. Last year, i filed IT Return for the year 2007-2008. I have received a mail on 06/03/09 from IT Dept. along with FORM 26AS (Annual Tax Statement under Section 203AA).The Form 26AS shows that the TDS submitted by my Company is in line with the Return i filed. I would like to know, when will the refund come to my account. And do i need to do any formality now to proceed the refund process.
  22. I sought information from ITO regarding my own refunds for the last two assessment years. I followed the process outlined on this website for using RTI to get status of refund. Sad to say, the ITO replied saying the office was exempted from providing the information under section 8(1)(e) unless larger public interest is clarified to solicit information from fiduciary authority. I have to prove public interest and respond within 7 days! Can someone help urgently on how to respond? Thanks in advance!

    IT Refund using RTI

    Hi, This blog is just to share my success story with you all. I did not get my IT refund for the last one year. But when I filed the RTI application with the Hyderabad IT office, I got my refund cheque within 15 days. I was really surprised and very impressed to see that RTI is really a very powerful tool. I encourage everyone to use it effectively to expedite your matters lying pending with govt agencies. I thank the RTI team for their help. Regards, Anupam

    Q & A column in hindu.com on 7 July 2008: The Hindu : Business / Tax Forum : Senior citizens and refund Senior citizens and refund It is well-known that refunds from the IT Department take inordinately long time extending to several months usually after a follow-up and reminder. The Minister of State for Finance had stated in 2007 that ‘there have been instructions to issue refund within four months’. One does not, therefore, understand the inability to comply with these orders. True, belated refunds carry interest in law, subject to such refund being in excess of 10 per cent of tax payable, but this is a poor consolation, even if such interest is received after inordinate delay. Dignity Dialogue, a Mumbai publication, in its October 2007 issue featured an interesting article by a leading chartered accountant on his recourse to the Right to Information Act, 2005 (RTI), whereby he obtained all his refunds pending for six years within a month or so of his application under this Act. The format and the procedure are well described. He ends by stating that “the RTI is the most powerful Act, the like of which has never been witnessed before”. There is a provision under Sec. 195(3) for the assessing officer to prescribe a lower TDS. Rule 29B prescribes Form 15D for such application for authorisation from the assessing officer. But then, the IT Department is not geared for prompt attention for issue of such certification. Further, Instruction No. 8 of 2006 dated October 31, 2006, from the Central Board of Direct Taxes cautions “indiscriminate” issue of such certificates with the further requirement of administrative approval from the Joint Commissioner. All these cumbersome procedures render it difficult for the assessees to get such certificates in time. Having exhibited a soft corner for senior citizens, the Finance Minister should now go a step further and take into consideration the above hurdles and difficulties, abolish TDS for senior citizens altogether or reduce it substantially. Most of them being honest taxpayers, the loss of revenue on its account will be negligible. This letter is received from K. P. Mahalingam of Chennai. It is true that in spite of its sincere attempts, the Income-tax Department has not been able to ensure prompt issue of refunds, while any delay in payment of tax by the assessee is visited with punitive action. Wherever there is a mismatch between the statements furnished by the deductor and the credit claimed by the deductee, sorting out the discrepancy leads to further delay. Some of the charges were that some centres have a separate counter for senior citizens, so as to attend to their refund claims even more promptly, but not followed in other centres. The reader’s suggestion for recourse to Right to Information Act, 2005, is not clear. How this would help an individual to get a refund. But complaints to the Joint Commissioner or Commissioner of Income-tax may help in some cases. A lady refundee of Chennai got back her long standing refunds by staging a dharna in the morning to get the refund on the same day. Such a solution, if it is a solution, may not be necessary after the creation of Ombudsman. But before a complaint is made to the Ombudsman, the assessee should lodge a complaint to the next senior officer and only when there is no response from him also, a valid application can be filed with the Ombudsman. This is likely to be effective because the Ombudsman has powers to inflict pecuniary liability on the persons responsible for the delay, besides placing a possible hurdle in the career prospect of erring officers. The reader’s suggestion for abolishing TDS for all senior citizens is probably too tall, since the affluent senior citizens may far outnumber deserving senior citizens. S. RAJARATNAM
