JAMMU, Apr 17: Despite misuse of the Right to Information Act to pursue hidden agenda, the State Government has adopted contemptuous approach towards High Court’s directions for revisiting of existing Rules of the Act during the past nearly eight months. Now, feeling handicapped in taking action on frivolous applications, the State Information Commission has made a fervent appeal to the State Government to have a serious look on the issue so that legislation doesn’t become a tool for putting unwarranted pressure on the public authorities.The Division Bench of State High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal, in a Public Interest Litigation titled B R Manhas Versus State of J&K and Others, had directed the State Government to repeal the existing RTI Rules and frame fresh ones to make various provisions of the Act workable and achieve the very purpose envisaged in enacting of the legislation.Read at: Govt adopts contemptuous attitude towards HC’s directions for revisiting RTI Rules

  4. Jammu, Apr 11 : Concerned over the denial of information to an RTI activist by CAPD, State Information Commission (SIC) has directed the department to furnish the information within two weeks. Rashu Kanna, a resident of satellite township for KP Migrants, filed an RTI application before Tehsil Supply Officer (TSO), but the CAPD Public Information Officer (PIO) did not provide the information. "After the PIO refused to provide the information, I approached the first appellant authority, ie Director CAPD but when no response came, I took up the matter with SIC," he said. JAMMU: RTI activist Balvinder Singh, who is also the Convener of Sangarsh RTI Movement met Chief Vigilance Commissioner Shri Kuldeep Khoda, and apprised him with the most important issues relating to mismanagement and corrupt practice in various departments on the basis of information received under RTI by the activist. Jammu, Apr 4: In a sheer exploitation of the state exchequer, the Executive Engineer (planning & marketing) wing of Horticulture department continues to spend lakhs of rupees as fare for a hired vehicle, thus providing undue benefits to a private travel agency. In response to an RTI, it was exposed that instead of purchasing a vehicle, the executive engineer (P&M) of the Horticulture department had hired an Innova vehicle to allegedly benefit a travel operator, who is believed to be close aide of the concerned officer.   7. Srinagar, Mar 28: Army has refused to reply an RTI application relating to the Court Martial in Machil fake encounter case and Court of Inquiry in Pathribal case. An RTI was filed by Venkatesh Nayak, Programme Coordinator in Access to Information Programme Commonwealth Human Rights Initiative to get documents relating to Court Martial in Machil fake encounter case and the Court of Inquiry into the Pathribal case. Srinagar: Six years since the landmark legislation Right to Information Act was implemented in the state, the government itself has failed to adhere to the guidelines of law on voluntary disclosure of information. Ironically, when one would at least expect the institutions of justice and legislation to comply with the law, both the legislatures – Assembly and Council, and the High Court have also failed to make voluntary disclosure under various sub-sections of Section 4 (1) of the Act. Srinagar, Feb 17: The State Information Commission (SIC) has directed Hindustan Petroleum Corporation Limited (HPCL) to allow inspection of its LPG dumping sites in Srinagar and Budgam by an information seeker under the provisions of State RTI Act. The direction came after an RTI application filed by Dr. Raja Muzzafar Bhat who in his appeal had highlighted that most of the dumping sites of oil marketing companies in J&K are located in populated areas. JAMMU, Feb 11: “Though J&K Right to Information Act is in operation during the last five years yet users and implementers are by and large showing their reluctance and ignorance to know how to use and pursue the right to information”. Jammu, Feb 3: While hearing a second appeal related to information about the alleged Jagti township construction scam being investigated by State Vigilance Organisation (SVO), the State Information Commission (SIC) has directed the investigating agency to reveal all the information under RTI once the final investigation report is submitted before the competent court. Srinagar, Jan 18 (KNS): In yet another discrepancy in central sponsored scheme Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA), the RTI (Right to Information) details have revealed huge sums have been released for different works in the block which allegedly does not exist on ground in Sultapora area of Wagoora in north Kashmir’s Baramulla district. According to the RTI details which are in possession of KNS, the applicant Ashiq Hussain Bhat of Sultanpora sought information regarding work done in the area and funds released for the same which according to him have discrepancies. Srinagar, Jan 29: Taking serious note of the failure of various departments to voluntarily disclose information under the Right to Information Act, the Government led by Governor NN Vohra on Thursday directed the administrative secretaries to implement provisions of the Act in “letter and spirit” to ensure transparency and accountability. “It has been observed that the provisions of Section 4 of the J&K Right to Information Act, 2009, are not being followed strictly and despite repeated instructions, many departments have not hosted the requisite information, as required under the Act. The other measures for introducing transparency like electronic mode of payments also need further impetus and attention,” MA Bukhari, Secretary to the Government, General Administration Department (GAD), states in his order. As this transparency law is enforced in J&K from last so many years, the Public Authorities (Government / Semi Govt organizations) continue to abnegate the responsibilities which have been conferred upon them under the provisions of State RTI Act. The recent directions by Governor N N Vohra to the state bureaucracy on effective implementation of Right to Information Act (RTI) particularly ensuring proactive disclosure through official websites has not only uplifted the morale of RTI activists but the said intervention during the present political scenario would definitely strengthen State Information Commission (SIC) for its effective working. The upright and honest officials in other transparency institutions like State Vigilance Commission (SVC) and Vigilance Organisation too feel elated by Governor’s intervention. Unnecessary delay in furnishing Information Jammu, Jan 17: As the Services Selection Recruitment Board (SSRB) made un necessary delay in dispatching the information sought under RTI Act by an information seeker from Poonch , the State Information Commission (SIC) taking cognizance of the case has shot penalty notice against the administrative officer of the SSRB who is also the designated Public Information Officer (PIO).
