Sir? A convict prisoner asks for copies of certain records including judgment under Rti to prefer appeal. the application is received through the prison where he is serving his sentence. Out of the records requested a copy of judgment has already been furnished to him on the date of judgment. My question is whether copy charges should be collected from the applicant in this case or should he be treated as BPL and what about the judgement ? Interestingly applicant has affixed court fee of 10 on the application.
Atul Patankar posted a topic in RTI in MediaAs reported at timesofindia.indiatimes.com on 23 October 2009 AHMEDABAD: Suspended deputy superintendent of police NK Amin and sub-inspector NV Chauhan accused in the Sohrabuddin Sheikh fake encounter and Kauserbi killing cases had filed an application under Right to Information (RTI) Act against Sabarmati Central Jail authorities to know who exactly is authorised to take decisions in case of a medical emergency and what facilities were required to be provided to prisoners. Prison authorities replied to all questions and said that the application was a fallout of a power struggle between IPS and non-IPS officials lodged in the prison. According to officials, the duo wanted to investigate favouritism by the prison staff. Central jail officials said the duo had filed an application last month seeking answers to questions like who takes the final decision whether a patient should be transferred to Civil Hospital or any other competent hospital in the city and who has the right to refuse it. V Chandrasekhar, superintendent of Sabarmati Central Jail told TOI that they had received an application from the duo pertaining to medical facilities in the prison. "We have tried to give them elaborate answers," he said. However, he refused to divulge details. Jail officials added that health facilities are constantly upgraded in the prison. Recently, prison inaugurated the country's first telemedicine centre inside the premises in a tie up with a private health major. Who takes the decision on how to go about it? - It is a set procedure that form number 32 is to be filled up by the inmates going out. Who is the competent authority looking at the forms? What if the inmate is taken out without filling in the form? - What are the provisions available with the jail to evacuate a prisoner/prisoners in case of medical emergency such as heart attack or asthama attack? What if a doctor is not available at that time? - Who goes with the prisoners/undertrials when they are escorted out? Who sends them or chooses them for the job? - How many inmates/undertrials were taken out of the prison on the medical grounds between January and July 2009? - If an undertrial is recommended for outside treatment, who can decline the visit and on what grounds? Are there any laws addressing the issue? - What is the procedure to check physical fitness of the undertrials?
