The Statesman, Kolkatta 18.01.2015 A Kolkatta student sent his mark sheet to Jodhpur based Jai Narayan Vyas University for verification under RTI and sought to know if this mark sheet had been issued by that university. On receiving few such RTI request, the University now clarified that Mark sheets of B.Ed, with fake seal and signature of Jodhpur based Jai Narayan Vyas University were found at Kolkatta.   4. I am married with my wife on 2008 March. Wife had a conjugal life of hardly 3 months with me, sometime in my native and for 1 month with me, left matrimonial house in 2009. Although my native place is in Raiganj, i live in Kolkata. She and her parents use to abuse me althrough-out. My father expired on April'2012. Earlier father has filed general diary against my wife, her parents on 2010 with local police station and again reported the same on 2011 giving all the details that she does not live with me, not returned bacl and I stay far away from kolkata. Wife filed dVA and maintanance case against me on May'2012. Lower district court send notice to me along with my widow mother and my brother. during june'12. My widow mother accepted her but denied to take notice addressed to me and my brother as a reason that she is not in contact with her children. I have not received/accepted court notice/summons till date although a letter basis court ex-parte judgement on monthly maintanance of 20K and arranging her to stay in my native house was shared to me via protection officer on July 2013. I handed the same to local lawyer. Now court has ordered warrant against me whose executing order is still pending. My wife with help of protection officer brought police along with protection officer, broke lock and keys of my native home last week where nobody stayed. Wife started living along with her mother regularly. Local lawyers told me that there is nothing to worry as because summons/notice were not sent to me through proper channels. Pasting in my residential place, court did not accept the same. No publication in newspaper as well. Although a court record exists that they have sent the same to my kolkata adrress. But I did not acknowldege the same at any stage nor did I recieve. Local Lawyer has done a RTI to get top of it as how the summons were served Particulars of Information to be sought are:- a) To which address the summary of Mr. Suman Ghosh S/O Late Suprabhat Ghosh the O.P No 1 of case no CR 292/2012 of Ld Addl J.M was sent by the protection officer? b) By which process the summons were sent? c) Whether any summon/notice was sent to the address of working place of the O.P No1 Mr. Suman Ghosh of case no C.R.292/12 by the protection officer before 18-12-2012? If so by what mode? d) Whether any summon or notice of case no C.R 292/12 was served upon O.P Suman Ghosh S/O Late Suprabhat Ghosh personally? e) Was there any impediment/objection to serve the summon on him personally? If so what was the reason? Kindly let me know what may be the outcome and how many days does it take to get informations on RTI. I shall be waiting for expert input on the same. Regards Suman

  6. Hi All, Need help to get my road tax paid in kolkata for my i10 car which is registered in bangalore RTO. I got my NOC in Nov 2010 and got my car transfered in Kolkata. In my absense during this period my car was lying in the garage. Now for last 3 months I am in KOL. I want to give the Road Tax and run the car. I do not want to change the registration as there is a changce that I will be back in bangalore in next 1 yr again. Here the RTO people even the agents have different versions and different pricing. I am realy getting confused what to do and how and what amount to pay the road tax and use my car. URGENT HELP required Thanks, Saby
  7. I would like to make an RTI application to find out the list of Hospitals approved by THE CHIEF COMMISSIONER OF INCOME-TAX, in Kolkata Region, UNDER SECTION 17(2)(ii)(b) OF THE INCOME-TAX ACT, 1961. Can somebody suggest to which CPIO I should make the application.
  8. Dear RTI COMRADES, I faced many situations where the SPIO do not respond/reply to applicant. But after the FAA is shooted, they wake up only to send a back dated reply, which is sent in ordinary post, STATING they need MORE TIME as the data compilation needs time. The questions that strike my common sense are: 1. No reply from SPIO within 30 days NEVER raise any warning bell that a PROVISION OF LAW IS VIOLATED, which attracts PENALTY. 2. FAA never bother to instruct SPIO to reply on WAR-FOOTING. 3. That, the worst practice of BACK DATING is adopted. FAA is not concerned with these immoral practices. (I can quote, in my experience the WEST BENGAL POLICE DIRECTORATE, states in a letter which is back dated by 45 days that the base record on which my RTI is based is MISSING.) (Another case in this topic is, WEST BENGAL PERSONAL & ADMIN ISTRATIVE REFORMS - WBPAR. Here, the SPIO did not bother to reply and after my FAA, to my surprise, I got a "ORDER" dated Feb 6th 2012, stating that the matter of my application dated Dec2, 2011 was much conneceted with another department (HOME RTI DEPARTMENT, which is also officed in the same building complex), and said that it had transfered my application as per application of secion 6(3). It also stated that the transfer happened on January 25th, 2012 and the same had ALREADY BEEN COMMUNICATED TO ME. THE SHARP CONTRAST is that the FAA's ORDER cannot be termed as an ORDER. It is just a way of DISPOSAL which TRANSFERED the application to SPIO of another department but SHOCKINGLY IT IGNORED THE EMPHASIS OF SECTION 6(3) PARA 2, which states THAT SUCH TRANSFER BE DONE WITHIN 5 DAYS OF RECEIPT OF APPLICATION AND THE SAME BE COMMUNICATED TO THE APPLICATION IMMEDIATELY. THE FUNNIEST PART OF IT IS THAT I RECEIVED THE TRANSFER CONFIRMATION WHICH SAID TO BE DATED JAN 25, 2012 REACHED ME ON FEB 17, 2012, WHEREAS THE FAA'S ORDER DATED FEB 6TH 2012 ALREADY HAD AN ATTACHMENT OF IT. 4. That RTI replies, which is a legal document are being dispatched through NORMAL post. 5. After all these hassles, the reply only contain that the info/data required is tedious and need MUCH time. Here also, the SPIO does not express the 'time required' in measurable terms (days) 6. In these situations can I again write to FAA insisting a hearing wherein I can discuss and solve the above 5 points or can i shoot Second Appeal or Complaint with SCIC...? Please comment....   9. I had sent an important registered post (with AD) from kolkata to bangalore on 14th October, 2009. My registration number was 4846. The post is still to reach bangalore as of 23rd Oct,2009. Can anyone advise me what I need to do as it is critical that the documents in the post receive at the earliest?? Is there anyway to track the post without much delay???
  10. I'm a subscriber of BSNL Dataone since August 2008. Since day 1, I have been facing problems with my phone line. Everytime I log a complain, I'm visited by few people who try some workarounds that dont last over 10 days and my problem comes back. As a result of this faulty phone line, I have not been able to use my broadband service the way I want. I've tried all possible options to reach the customer service desk, but all in vain. Since I'm a service man, I'm at work 9 am to 7 pm on weekdays (Mon through Sat). The only day when I'm free is Sunday and thats a day when no one listens to the customer. How should I take this up to get my connection working the way it should? Regards, B Arvind Kumar
  11. Bureaucrat with two names faces heat as reported by Pranesh Sarkar The Statesman KOLKATA, Nov. 25: The chief executive officer of State Consumers' Cooperative Federation Ltd. (Confed) has been using two names in his official capacity. Mr Sujan Kr Mistry, the CEO, Confed, also uses another name, Mr Sujan Kr Mitra, while signing official documents. Interestingly, the state government recognises both the names of the officer. To steal a line from the BBC comedy Yes Minister, is this a case of yet another top bureaucrat using two names for his two faces, as it were? According to the documents available with The Statesman (see above), the state government has recently issued a transfer order to Mr Mistry. The notification for the transfer of Mr Mistry from the post of CEO, Confed to the Joint Registrar of Cooperative Societies in the co-operation directorate (headquarters), states his name as Mr Sujan Kr Mistry. But while his name was considered for the above-mentioned transfer, he was referred to as Sujan Kr Mitra in the departmental note sheet. While replying to a set of questions submitted under the Right to Information Act, 2005, the deputy secretary and the SPIO, co-operation department, admitted that the CEO, Confed, is using two names in violation of government norms. A highly placed official at Writers' Buildings, explained: "The reason for this norm is that any official using two names may, say, operate bank accounts in two names and/or possess properties in both names. As a result, it would be almost impossible to prove that the official's assets are in conformity with his income, for example. This apart, it would be tough to establish charges of any irregularities because s/he could always claim it was the other chap!" In fact, questions have been raised as to why the the government did not intervene despite knowing that the official was using two names. When The Statesman contacted the CEO, Confed via fax seeking his reaction regarding use of two names, "Mr Mistry" replied last week: "All the particulars relating to change of my surname ~ from Mitra to Mistry ~ for which I have obtained government permission are lying with my advocate who will be filing an affidavit for a change in surname." While replying to questions submitted by The Statesman under the RTI Act, the deputy secretary and the SPIO, cooperation department, however stated that both his names are in official use and thus violative of government norms. Nothing like a long ride in office vehicle... as reported by Pranesh Sarkar | The Statesman | KOLKATA, Oct. 4, 08 State finance minister Mr Asim Dasgupta's effort to control unnecessary expenditure by reiterating an order that was in force since December 2000, was taken for a ride, in no less than an air-conditioned Ambassador, by the State Consumers' Cooperative Federation Ltd. (Confed). Documents available with The Statesman suggest that public money worth lakhs of rupees were grossly misappropriated by the apex cooperative federation violating the finance department's order. Confed bought an air-conditioned Ambassador (WB-02/6328) for official use in April, 2008. Such purchase usually needs prior approval from the appropriate authorities, but Confed did not seek any permission, misappropriating quite a lot of money. An air-conditioned Ambassador costs more than Rs 3 lakh. Replies to a set of questions asked under the Right to Information (RTI) Act, 2005, show that the chief executive officer of Confed, Mr Sujan Kumar Mistry, has used the office car frequently, not conforming to restrictions on daily fuel consumption. He even used the vehicle on holidays without taking prior approval from the department secretary. The vehicle of the CEO, who happens to be a government officer, was also found to be visiting offices of political parties frequently. There are no details or list of the passengers that is usually kept in case of use of official vehicle. The cost cutting order is a standing order since December, 2000, and which was reiterated by the chief secretary, Mr Amit Kiran Deb, on 11 June (Number 454-FB) after the state government decided to provide some relief to common people by reducing the tax on petrol and diesel following the recent fuel price hike. The order clearly states that no new vehicle should be bought by any department until further orders. Having bought the car, Confed violated the order issued to all statutory bodies including local and autonomous bodies, corporations/undertakings (owned or substantially controlled by the state) and institutions that receive grants from the state. Regarding the restriction imposed on government vehicles, the order clearly suggests that non-operational vehicles (which is used by an official exclusively) would be allowed consumption of fuel to the limit of 5 litres everyday. In other words, a government official is allowed to travel 60 km a day in the official car. Further consumption of fuel requires prior approval from the department secretary.     KMC order minus head seal as reported by Statesman News Service in the Statesman KOLKATA, Aug. 12: A notice issued by the chief manager (revenue) of Kolkata Municipal Corporation asking retired employees to apply for job in the right to information (RTI) wing of the Assessment collection department has created a flutter in the civic body. Because, other than the fact that this is for the first time that such an application has been invited, senior civic officials said it is very astonishing that no mention of the municipal commissioner has been made in the notice issued by the chief manager (revenue). The employees who have retired within one year and worked in posts not below the rank of assistant manager are eligible for the job whose duration is for six months. It is for the first time when the civic authorities are inviting applications from retired employees. The usual practice in KMC is that notice and circulars are always issued by the municipal commissioner. “ It is such an important issue and the notice should have been issued by the municipal commissioner,” a senior official said. It was learnt that the civic authorities are yet to fix up the remuneration of those who will be engaged for six months. As a financial matter is involved the notice should have come from KMC's administrative head. The civic authorities have opened a RTI wing for the assessment and collection department. Earlier, the RTI was handled by the deputy municipal commissioner (personnel). But the state Information Commission had pulled up civic authorities as many queries related to assessment and collection department remained unanswered as the department did not give replies on time. As reported by ENS in expressindia.com on 28 July 2008: Commission not keen to punish, RTI stumbles in state - ExpressIndia.Com Commission not keen to punish, RTI stumbles in state Kolkata, July 27 Almost two years since the inception of the state Information Commission, the Right to Information Act in the state is yet to make inroads. First, nearly 1, 500 applications that reach the state’s commission are too few compared to other states. Plus, the commission has imposed only three penalties and awarded one compensation so far, as its directives have been restricted to issue show-cause notices to state public information officers (SPIOs). In comparison, Tamil Nadu’s information commission has slapped nearly 250 penalties in the three years of its existence, even as it receives 400 applications everyday. The Punjab Information Commission has imposed 46 penalties in 5687 applications, it has received till date. Penalty case 1 An applicant Ratikanta Pal had sought some information from the Mugkalyan Benapur panchayat office. When he did not get any reply, he approached the commission, which asked secretary of the gram panchyat to furnish an action report within 15 days. Two months later, Pal informed the commission that he had not yet received any information. The commission then slapped a show-cause notice on the SPIO. Yet, the secretary did not send any reply to the commission nor furnished any information to the applicant. The SPIO also did not turn up at the two hearings held by the commission. Subsequently, the commission imposed a penalty of Rs 25,000 -the maximum penalty amount- on the secretary and the state public information officer of the gram panchayat. Penalty case 2 Raghunath Chakraborty, a resident of Jangipara in Hooghly, had requested the Chief Medical Officer for certain information. When he did not furnish it, the case was referred to the information commission. When the commission issued a show-cause notice to the CMO, he furnished false information. When the applicant proved that the information was wrong, the commission imposed a penalty of Rs 15,500 on the CMO and the state assistant public information officer of Hooghly. Penalty case 3 An applicant Indranil Ballav of South 24 Parganas submitted an RTI application seeking some information, which was ultimately furnished by the district registrar. Ballav complained to the commission that the information was incomplete and contradictory. The commission observed that not only there was considerable delay in providing the information, it was also contradictory. The commission then imposed a penalty of Rs 1750 on the district registrar of South 24 Parganas in an order dated March 25, 2008. Compensation case Saroj Kumar Khettry requested the SPIO of the cooperation department to furnish certain documents. When he did not get any response, he approached the commission, which ordered the SPIO to submit the information. The SPIO, however, provided the wrong documents. When issued a show-cause notice in this regard, the SPIO admitted to supplying the erroneous information due to an inadvertent error by department clerks. The commission ordered the cooperation department to compensate the applicant with an amount of Rs 1000 for the ‘harassment’ caused to him. Leniency galore There are, however, several cases, when the commission did not take any action. The case of Swati Banerjee, for instance. Banerjee, a part time lecturer with the Lady Brabourne College, was shown the door after being with the institute for 20 years. She requested the higher education department to provide the government orders by which the post of lecturer was created and subsequently abolished. But the department admitted that it could not find the requisite documents. The commission observed, “When the government has issued orders for the creation of some posts, there should also be some orders for abolishing the posts.” The commission said, “Neither any order of abolishing the posts nor any order terminating the service of Banerjee was actually issued.” Notably, while the commission pointed at the grave administrative failure in the case, it did not take any stern action. All the commission did was to ask the public authorities to gear up its machinery. Chief Information Commissioner, Arun Bhattacharya could not be reached to comment on why the commission did not take proper action in the case. A senior official, however, admitted that the government had ‘requested’ the commission to show leniency.
