[caption id=attachment_1879" align="aligncenter" width="600] RTI for Ration Card[/caption] On a RTI for Ration card pertaining to third party, the commission has allowed disclosure of information with a legible attested photocopy of the computerized record of the ration card of Shri Jaiveer Singh as requested in the RTI application as after hearing the case it was felt that it is in the larger public interest provide the information. Not only the above disclosure was allowed, the CIC also directed to provide affidavit to the Commission with copy to the appellant that there are no other records held by the public authority pertaining to the matter of the RTI application (regarding issue of ration card to Shri Jaiveer Singh). Those all related posts can be read here: http://www.rtiindia.org/forum/tags/ration-card.html and you can also search of the related help on Ration card from here: http://goo.gl/a0QK0A Case Details of RTI for Ration Card Appellant submitted RTI application dated 9 May 2012 before the CPIO, Department of Food, Supplies and Consumer Affairs (GNCT), New Delhi seeking details regarding the documents submitted by Shri Jaiveer Singh for obtaining his Ration Card. Vide Order dated 14 June 2012, Appellant was informed by the CPIO that documents sought are not available in the office. Appellant preferred first Appeal to the First Appellate Authority. Vide Order dated 31 July 2012, FAA allowed Appellant to inspect the Concerned file(s). Being aggrieved and not being satisfied by the above response of the public authority, the appellant preferred second appeal before the Commission. Decision of CIC on RTI for Ration Card According to the CIC decision uploaded "After hearing both the parties Commission is satisfied that disclosure of information in the present case is in the larger public interest and directs the CPIO to provide the appellant with a legible attested photocopy of the computerized record of the ration card of Shri Jaiveer Singh as requested in the RTI application. Further, CPIO is directed to forward a copy of Commission’s order to the ‘third party’ Shri Jaiveer Singh informing him the outcome of the present case in the light of “Larger Public Interest” The CPIO will also provide affidavit to the Commission with copy to the appellant that there are no other records held by the public authority pertaining to the matter of the RTI application (regarding issue of ration card to Shri Jaiveer Singh). In a well argued order, IC SA has ruled that salary details and official address are disclosable under RTI: Information about salary and official address of public servant is public in nature and shall be disclosed to any person including spouse. Salary details including deductions contained in Salary slip or certificate and residential address of the public servants is personal information, and also third party information. Only after proof of larger public interest such information also can be given…. The spouses do have right to get any information about each other though they are involved in marital disputes/civil, criminal cases filed mutually against them. They can also seek information if in public domain to help them to prove or disprove the charges. But the information about their person unconnected with the discharge of public duties cannot be sought unless they establish a larger public interest. Filing of 50 RTI applications reflects the personal animosity but not public interest. This decision is also important because iot analyses Sec 8(1)(j) threadbare !   4. Several applications are denying U./S. (8) (1) (d) & (j) by PIO for Public Charitable Trust and also denying by FAA of Registered Public Charitable Trust(Religious). They are asking to prove Larger Public Interest. How to prove larger public interest ? Because there is no personal information.Please guide me.

    Dear All I have filled RTI to bank asking the women employees recruited in 2013 with their name, designation & branch in which they are working but I got reply saying info denied under Section 8 (1) (d) (j). can you please help me to get same info? thanks in advance.
  6. PIO's, FAA's and even several IC's have started grossly misusing (by misinterpreting) the decisiorens of CIC and Hon. Supreme Court as well as DOPT OM, all three cited in post no.1 of the following thread- http://www.rtiindia.org/forum/114844-dopt-om-disclosure-personal-information-under-rti-act-2005-a.html#post280637 Due to their rampant misuse by the concerned to deny legitimate information, in current times, it has become necessary for appellants to prove "larger public interest" in many such appeal processes. Hence the questions arise- 1. What constitutes "larger public interest"? 2. what evidences are admissible as "larger public interest"? 3. What citations are available to prove "larger public interest"? Comments, opinions and contributions in form of decisions, are invited from learned members of this forum
  7. today was our hearing in our second case before SIC punjab. this time again commission favors PIO and order us to provide notary attested affidavit that information requested in in public interest. though the argument went for 1 hour. and we agreed to submit affidavit but PIO has to supply information. what to do..?guess commission are also fill with corruption ?
  8. The Full Bench Orders of the CIC are as below : 56. The respondent’s counsel has tenaciously argued that the appellant’s request for information is not in public interest and that he is seeking this information for extraneous considerations. The question is whether information is disclosable under the RTI Act only in public interest and not otherwise. Suffice to say that RTI Act does not draw a distinction between demand for information in public interest and private interest. The Act provides for disclosure of information to the citizens of India subject to the provisions of section 8, 9, 10 & 11 of the RTI Act. In other words, appellant is not required to establish any larger public interest in his search for all classes of information. He is required to establish public interest only in particular clauses of section 8(1) of the RTI Act.   9. I have asked for a copy of an inspection report under RTI written by the director of women and child. The inspection was at the request of the chief sec as we are currently appealing the decision of the non-renewal of our licence to operate as a children's home. The reply stated "The Competent Authority is satisfied that the information should not be disclosed in larger public interest" On asking more details they said "the information was declined under Section 8 (e) of the RTI Act" As Section 8 (e) states (e) information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrents the disclosure of such information; Questions 1. Does Secton 8 (e) 'fiduciary' relate to the Director and Chief Sectretary's relationship in this context? 2. Any suggestions? Thanks
  10. There have been many threads on this forum about PIO's not disclosing information by taking the stand that "there is no larger public interest". I have been consistently saying that there is absolutely nothing in the RTI Act which allows the PIo to deny information under such a reason. Finally, it seems we have a CIC order, explicitly sorting out this point once and for all: http://cic.gov.in/CIC-Orders/WB-19032009-01.pdf In this case the plea taken by respondents in the written submissions of learned counsel Shri Naresh Kaushik is that the disclosure does not justify “larger public interest”. However, respondents have been unable to cite the clause u/s 8 (1) (j) in which the larger public interest has been cited as a permissible ground for refusing information, whereas in most sub sections of 8 (1) which allows exemption from disclosure of information, public interest is repeatedly cited as a reason for disclosing information otherwise considered exempt except in the case of information falling u/s 8 (1) sub section (j), but even in that case only if it has “no relationship” to any public interest, which in this case is nobody’s argument. In the same order (matter concerning UPSC Civil Services exams), CIC has also allowed the disclosure of: a) Summary Sheet concerning the interview b) Regarding Cut-off marks, CIC has decided to wait till the Dehi HC passes a judgement.

As posted by Jasneet Bindra at indianexpress.com on Feb 03, 2010 Chandigarh : Punjab Chief Information Commissioner R I Singh has asked the police to provide an RTI applicant a copy of the inquiry report into a land deal, in which a woman allegedly sold part of a public street through a registered deed. Dismissing the police plea that this was third party information as the complainant was not a party to the case, Singh said, “The information is of public interest, as it has been alleged that an individual has fraudulently sold public land. Police have conducted an inquiry and papers related to it are public documents.” Ludhiana resident Mehar Chand had sought copies of the report of the inquiry conducted by the Economic Offences Wing of the police. The appellant alleged that Sawaranjit Kaur had fraudulently transferred a part of the public street by a registered deed in favour of Harvinder Singh. Ludhiana SSP (the PIO) and IGP, Zonal-II, Jalandhar (the first appellate authority) were respondents in the case. Kaur had earlier entered into an agreement with Jaswant Singh for sale of the property, but when he realised that she did not own the land, he withdrew. Alleging fraud, Jaswant submitted an application to the SSP, Ludhiana, and an inquiry was conducted by the EO Wing. Mehar Chand said public interest was involved in this case and police inquiry has established fraud in the deal. The respondent, on the other hand, took the plea that Mehar Chand was a third party as he was neither the complainant before the police nor the disputed property’s owner. The CIC said Section 11 of the RTI Act requires a PIO to give a written notice to the third party and invite submission asking whether information should be disclosed. “If public interest is involved, which outweighs the interest of third party, information must be disclosed. The criterion is of public interest,” Singh said. “There is nothing confidential about either the complainant made by Jaswant Singh or the conduct of Sawaranjit Kaur for which information should be withheld,” the CIC said Source: Information under RTI Act can be provided to third party, CIC tells police
  12. Sir, Firstly, I would like to express my deep appreciation on this great social intiative. We have not received the IT refund for the past 3 years (Ass. yr. 2005 - 2008). After going through the RTI portal, I followed the instructions and submitted a form along with Rs 10 PO for the 3 years separately. The response from the Asst Commissioner of Income Tax, Bangalore - Ward 14(1) refers to section 8(1)(e) of RTI Act 2005, and says that, "there is no obligation to provide information, available to the undersigned in a fiduciary capacity unless it is clarified as to a larger public interest, which warrants to the disclosure of the information. Hence, you are requested to clarify the larger public interest." I have to respond to this within 1 week from the receipt of this letter (ie before the 13th of March). I request you to kindly help me by pointing the way forward....Please respond soon Thank you
