The State Chief Information Commissioner had while hearing one matter involving one such slum society passed an order on December 19, 2017 and declared that provisions of RTI Act shall apply to all the societies under SRA. In a significant interim order, the Bombay high court on Thursday issued a notice to state chief information commissioner and stayed his order which had brought all slum societies under the ambit of Right to Information Act (RTI). The HC was hearing a fresh challenge to an order of the State CIC which in one stroke brought thousands of slum societies under the provisions of RTI making them liable to share information akin to a public body. A slum society in Andheri had moved the HC against a December 2017 order passed by the state CIC and a subsequent order of April 2018 issued by a joint registrar Slum Rehabilitation Authority to it. Andheri Juhu Lane Nav Bharat Cooperative Housing society Limited in its petition questioned the legality and validity of these orders. The SC had in 2013 held that housing societies do not come under RTI and the state info commissioner’s order is contrary to it said, senior counsel Damle before a bench of Justices SS Kemkar and Nitin Sambre. The bench then adjourned the matter for further hearing and stayed the orders. Section 32 of the Maharashtra Cooperative Societies Act, 1960, is parallel to the provision of Sections 3 and 7 of the RTI Act, said the petition as it covers rights of members to inspect and see “free of cost’’ the society’s office, and is entitled to get, for a fee, copies of audited annual balance sheet, profit and loss account, its committee members’ list as well as list of members, minutes of general meetings and records of society’s transactions.

  3. Palande, convicted by the Bombay High Court last year for the double murders of two men in 1998, is currently lodged in Taloja central jail in Navi Mumbai. He is facing trial for three other murders, one allegedly committed in an Andheri flat of Delhi resident Arunkumar Tikku, one of a film producer, Karankumar Kakkad, and another of an unidentified person. While he was lodged in Thane central jail in 2017, Palande had filed an application under RTI on April 20, seeking the “egress and ingress recording of CCTV footage of the Kala Pani yard/main gate’s inside area” between 2 pm and 5 pm of the same day. Palande had claimed in his appeal before the First Appellate Authority, the superintendent of the jail, that an undertrial was given “VVIP facility” by being provided emergency police escort from Thane jail to the Thane civil hospital. He claimed that the undertrial was then taken to JJ hospital by the police escort and was subsequently taken in a private vehicle for a birthday party celebration and returned to the jail only the next day. After Palande’s RTI did not get a response, he filed an appeal before the PIO on May 22, 2017. When he still did not get a response, he filed an appeal before the SIC on September 21, 2017. Palande had written on his application that “I am withdrawing the RTI in duress as told by senior jailors”. The commission said it was not satisfied with the response given by the jail authorities and directed that a penalty be paid in monthly installments.

The RTI application is to be addressed as follows: To, You can either visit the ward and submit it to its Dispatch Section and take an acknowledgment on the photocopy of your RTI application, or You can mail it by Speed Post, track its delivery on Indiapost website on internet and when it shows delivered take a print out of the track report and preserve it as a proof of delivery of your RTI application. In Maharashtra, the best way to pay RTI application fees is to paste a Rs. 10/- court fee stamp on the RTI application itself. You will get court fee stamp from any of the Courts, or vendors (photocopy / xerox shops) near a Municipality or other such Govt. offices. As the court fee stamps are valid forever, you may consider buying extra (say worth Rs. 100/- or more), as you will require them for filing RTI First Appeal and Second Appeals. As per Press Note from ACB Maharashtra, the Desk Officer of Maharashtra SIC Nashik Bench has been caught accepting a bribe of 10,000/- to help a PIO evade a penalty of Rs 25,000/- Just proves my point that the people working in the Information Commissions have not descended from heaven !   11. Hi All, I want to file an appeal u/s 19(3) of RTI Act, 2005 however I am a bit confused regarding postal address where I need to send hard copy of an appeal to SIC. While going through SIC website for Maharashtra I understand that Mumbai is HQ and in addition there are several benches where hearing is possible. I want to know how could I locate exact postal address to send hard copy of an appeal. Is it something like appellant is having a choice to select appropriate bench of SIC as per his geographical convenient or is it need to be as per jurisdiction of SPIO/FAA. Kindly advise. Constructed at a cost of over Rs 8 crore, the Central Effluent Treatment Plant (CETP) in the industrial area of Kurkhumb (Daund taluka of Pune) leaves much to be desired in terms of its performance. While the Maharashtra Industrial Development Corporation (MIDC) claims the CETP is functioning well, reports by the Maharashtra Pollution Control Board (MPCB) shows the discharge from the CETP is failing to adhere to the norms. The CETP, since it was commissioned in 2001-02, has been in controversies. In response to an RTI query filed by The Indian Express, it was revealed that the construction, commissioning and operation had come under scrutiny by various government agencies. While the accountant general had raised questions about its funding, MPCB and Forest Department had pointed out how the discharge from the CETP was polluting the neighbouring regions. Problems regarding its construction were also flagged by the accountant general as a major irregularity during its annual audit. Major issues that came up during the audit was the failure of the MIDC to recover 50 per cent of the construction cost from Industries Association and non-compliance of MPCB norms.   15. The state government has no records of the number of applications it has received through the online Right to Information (RTI) system, reply to an RTI query has revealed. One of the first decisions of the Devendra Fadnavis government in the state was the introduction of an online system for filing RTI applications, on the lines of the central government’s system.     Money lost in Bank of Maharashtra ATMs

    Depositors suffer delays in getting back their wrongly debited amounts from ATMs. This time, it’s a father who lost Rs30,000 he needed for daughter’s college admission On 2nd of June, Pune based Kiran Chaptekar went to the Thergaon (suburb in Pune) ATM of Bank of Maharashtra to withdraw Rs20,000 for his daughter’s college admission. However, no cash came out. So, he immediately went to another ATM, also of BoM to withdraw. This time he wanted to withdraw Rs10,000. He put in his card but again no cash came out. However, he found to his shock that Rs.30,000 has been debited from his account in the Karve Road branch. ........................................................................ ............................................................. ................................. Chaptekar is awaiting the mandatory 7 working days within which a bank is mandated to credit back into the account. If it does not happen, then he would be filing a RTI ................................................ .................... Please remember you can and you must file RTI and ask the following questions: What is the status of my complaint of the wrongly debited amount (please mention amount, account no. date of complaint ) Please supply me name and designation of the officer responsible for the delay in crediting the money back to my account within the stipulated 7 days as prescribed by Reserve Bank of India? What action has been taken against the officer for dereliction in this duty? Reasons why my money was not credited into my account on the very same day? In how many cases in this year (mention from which month to month) was this law violated? What corrective action have you taken from your side, to avoid such delays?
