    In our opinion no. Information which is forbidden by law or information of a nature, if disclosed, would defeat the provisions of any law or disclosure whereof is opposed to public policy, cannot be regarded as lawful and is to be ignored and no disclosure thereof can be made or directed to be made.- HC Once a purposive interpretation is given to Section 8, it will be found that information forbidden to be published [Section 8(1)(b)] and information available in fiduciary relationship [Section 8(1)(e)] is exempt. In our opinion, even though there is no express order of any court of law forbidding publication of marks [as is the want of Section 8(1)(b)] but the effect of bringing the regime of grades in place of marks and of dismissal of challenge thereto, is to forbid publication/disclosure of marks. Similarly, in the evaluation process prescribed by appellant, for guidance of its examiners, marks are only to arrive at a grade, perhaps as aforesaid to acquaint the examiners with the grading system and as a transitory stage in the shift from marks to grades.

  3. I am presently studying in 3rd year with B.Com(Honors) in Calcutta University. I have secured 55% marks in my second year but I have a supply/backlog in a general paper of Economics from my 1st year which I still can't clear even after 3 attempts. Every single time there is a very negligible difference of just 1 or 2 marks in those 3 attempts & just 5 marks less than pass marks. My graduation certificate is being held back for the same reason. A student who secures more than 50% in Honors subjects is not being able to clear a general paper & that is why he can't apply to any post graduate studies or even a job. I feel my life has taken a standstill & I do not know how to go about this situation. Will going for RTI help me get through this situation? Cause I am 100% certain that I have given a pretty good exam every single time. If after an RTI I see my marks being incorrect or some mistake in correction, will it help me get the marks that I should get?

    To The Director Jee mains I am a JEE Mains aspirant with Roll no: 26607750 Application number: 2015086946 Paper Code: B Sir I hereby want to inform you that my score displayed by the board are less that which i calculated according to the answer keys uploaded by JEE Main . My expected score is 120 according to the answer keys but Resultant score is only 12. So please revaluation /recheck my OMR sheet.     Hello, sir i file a rti in rajasthan secondary education board to inspect my answersheets. they reject my application and said that there is no rule for this.then i file second appeal in ric and decision was against rajasthan board. so they give me inspection of my answersheets and i found a lot of mistakes in checked answersheets and i said to board to correct the marks but board says that there is no rule for this.what should i do?

    whom to address the rti??

    I came across a reply from psu recruitment team...i was shocked to see that obc category cutoff is higher than general category cutoff..!! As per clear assumptions they clearly not treated obc candidate clearing general cutoff as general candidate!! I want to get such notification if any of hon'ble supreme court or HRD ministry or obc commission!! Rather first i ask the same to the company pio! Kindly help me to identify the department!!

My relative brother appeared for written examination held by HRD Department for the post of Laboratory Attendant on July 2011 and result declared on 02.02.2013 final result for viva voice is also announced after few days. His name was not there in the list of qualified candidates and he filed a RTI appeal asking for his answer script and question paper along the answer script of other (viva voice)qualified candidates. The department provided only his answer script and question paper and when he inquired about the other candidates answer script they said that its against the RTI act to disclose somebody answer script to other individual person. When we read his answer script we found out that : Total marks was 80 , contains 27 questions (short answer type +fill in the blanks+essay) 1) Out of 25 question (short answer + fill in the blanks carrying 2marks each) he got 6 answer wrong . We did web research and found out that his five answer was correct and one answer had spelling mistake (out of six answer marked wrong by examiner). 2) Last part of question was to write any two essay out of three topics (300 words carrying 15 marks each) He wrote well but they gave him 6 marks and 7 marks each for essay writing. Total he scored 49 out of 80 marks(according to examiner) Now my question is how do we know whether they did a fair judgement or not? How do we draw a conclusion without comparision with other candidates answer script?and also they did not mention marginal marks for qualification? He is suppose to score 54 0ut of 80 More or less I think they didn’t want him to score more than 49 and maybe scoring 50 marks was marginal. If HRD Department does not agree and accept that it was unfair judgment by concerned examiner , Please suggest how do we proceed with further appeal? Can he appeal in court for cancellation or cross-examination with other answer script? And which authority looks in this type of matter? With Regards. Sikkimkochora.

As reported by Harish V Nair in hindustantimes.com on 26 May 2012: Students not entitled to know marks, says HC - Hindustan Times Students not entitled to know marks, says HC In a significant ruling, the Delhi High Court has said that students appearing under the CBSE, or their parents, do not have the right to know the marks secured by them in each subject even through an RTI application. The directive comes two years after the introduction of grading system. A Bench of Acting Chief Justice AK Sikri and Justice RS Endlaw said this while setting aside the order of a single judge and the Central Information Commission (CIC), which directed CBSE to divulge to a parent the marks his daughter had scored in each subject in her Class 10 exams. The parent, Anil Kathpal, wanted the information to “identify her weak areas” and take remedial action. Allowing an appeal filed by the CBSE, the court said, “We feel that the CIC as well as the learned single judge, by directing disclosure of marks in the regime of grades, have indeed undone what was sought to be done by replacing marks with grades and defeated the very objective thereof.” “We are unable to agree with the reasoning of the CIC and of the learned single judge and allow this appeal. We hold the information, disclosure of which was sought, to be no information and also exempt from disclosure under RTI,” the bench added. The court noted that the purpose of introducing the grade system was to take away the frightening judgmental quality of marks, to lead to a stress-free and joyful learning environment, was intended to minimise mis-classification of students on the basis of marks, to eliminate unhealthy cut-throat competition and to reduce societal pressure. The court said no weightage can be given to Kathpal’s submission that marks, even if disclosed, will not be used for any other purpose. “The possibility of the parent and his ward in securing admission and for other purposes using the said information to secure an advantage over others cannot be ruled out,” the Bench said.
  17. HI, I had given this DEC 2010 attempt of net and pretty sure of clearing it. If not clearing then I expected my marks to be around 80 at least. Shocked to the core I have been given just 33 marks which is just out of my understanding. Please help me frame my questions. Regards. Nikhil kumar
  18. Hello Everybody, I am new to this forum and also to the RTI. I have never used RTI before. So hoping for true help.. Actually, I had recently given an entrance exam of Pune University. It was multiple choice question exam. Its result also got declared. But with my result I'm not satisfied. I mean, I have worked extremely hard for the exam. Worked even full nights on occasions. And I'm fully confident that something has to be wrong. Actually I'm repeater to this exam. So I have many doubts like this could have happened and this is also possible, etc,etc. So, now my question is can I use RTI to view my checked answer-shit ? It was MCQ type list. Also is this possible to access question paper with standard answers ? Maybe experienced people are aware of something more that I'm not asking. I feel there has to be some way to do something.. So guys please help me. This is very very important to me.. Regards.

So am putting up the questions for general and expertized comments, wherein if possible , in case any member or guest have done any such thing where he got personal marks details of other person exmination..he/she may plz come up with the Method I would also request Member-LINARDNI to keep a watch of this thread Thanx

As reported by the Legal Reporter in telegraphindia.com on 6 March 2008: The Telegraph - Calcutta (Kolkata) | Metro | Answer script suit in high court Answer script suit in high court Several students turned up at the high court on Wednesday to attend the hearing of a case filed by a Presidency College student, asking to see his answer script under the Right to Information Act. Pritam Rooz, the third-year mathematics honours student, had requested the Calcutta University authorities to show him his honours paper V answer script. He had appeared for the paper last year during B.Sc Part II. The university authorities had turned down the request. Rooz then moved the high court, stating that the university had violated the Right to Information Act by not allowing him to see his answer script. On Wednesday, Justice Indira Banerjee fixed the matter for hearing on March 7. Rooz had obtained 28 marks out of 100 in his honours paper V. He applied to the university authorities for review of his answer script. Four marks were added following the process. Not satisfied with the increase, Rooz had asked to see his answer script. The university authorities informed him that the norms did not permit handing over of the answer scripts to the examinees. Rooz then wrote to the university authorities that the Right to Information Act empowered him to see his answer script. But the authorities again turned down the request, stating that the university rules did not come under the purview of the act. “I want to know from the court whether students have the right to see their answer scripts. A student should have the right to know whether his answer script was properly evaluated or not,” said Pritam, who filed the case in the high court in January. Viewing of answer scripts is a long-standing demand of students. In 2003, at least 300 Higher Secondary examinees had moved a PIL in the high court, calling for photocopies of answer scripts to be supplied with results. “The court had turned down the plea but said the agencies that conduct examinations should make the result publication process more transparent. The students are now relying on the Right to Information Act,” said advocate Supradip Roy, who had appeared for the examinees.

  22. Students still can’t access their evaluated answer-sheets but they are getting close. The Central Information Commission (CIC) has ordered the Central Board of Secondary Education to give a Delhi student, question-wise marks awarded to her in the Class X science and technology paper in 2005. The CBSE – that has been strongly opposed to showing students their evaluated answer-sheets – had responded in this case that there were no provisions in the examination byelaws of the board to show the answer-script to candidates. An internal appeal moved on behalf of the student, Aditi Gupta, against this response was also turned down; the CBSE took cover under an exemption clause in the Right to Information clause that bars information available to a person in his fiduciary relationship. Incidentally, the CIC had first cited this exemption clause to turn down an RTI request in February. The order had been severely criticised by RTI activists including Magsaysay award-winner Arvind Kejriwal who argued that the commission had misinterpreted this provision. In subsequent cases, the commission, however, agreed to take a relook and refer this issue to a Full Bench of the Commission to take final call. In a brief order this week, Information Commissioner Dr OP Kejariwal kept the request for inspection of the answer-sheet pending in view of the constitution of the Full Bench but ordered CBSE to "disclose the question-wise marks obtained" by Aditi Gupta in the Class X examination 2005 within a fortnight. The commission had earlier ruled in favour of letting students see the answer-keys, the document that guides evaluators on marks to be awarded for various parts of a question. The CBSE has the option of moving the High Court against the CIC decision; the public examination body, Union Public Service Commission had approached the court in October, 2006 to stay operation of a CIC directive on disclosure of cut-off marks and individual marks of candidates who took the Civil Services examination. The court had granted the stay on the UPSC plea that disclosure of this information would undermine the entire examination procedure. (Hindustan Times, New Delhi, Dec.23,2006)

As reported by Hemali Chappia of TNN in timesofindia.indiatimes.com on 29 December 2008: Now, students can seek exam marks details under RTI-India-The Times of India Now, students can seek exam marks details under RTI MUMBAI: In a landmark judgment that will change how examinations are conducted in the country, the Central Information Commission has ruled that authorities must usher in transparency and reveal questionwise marks awarded to candidates, under the Right To Information Act. The ruling will bring cheer to India's large student population, which has been fighting for access to copies of answer sheets ever since the RTI Act was passed. In March 2006, Treesa Irish from Kerala became the first student to fight tooth and nail to be allowed to see her exam answer scripts. She lost the battle when a full bench of the Central Information Commission ruled that the data she had requested was of a personal nature, and that its disclosure had no relation to any public interest and would therefore be prohibited under section 8(1)(j) of the RTI Act. The CIC also held that the relationship between the exam-conducting authority and the examiner was fiduciary in nature, and therefore information must be kept confidential under section 8(1)(e) of the RTI Act. However, Irish was hardly alone. Students under several education boards across the country have sought copies of their answer booklets under the RTI Act. All failed in their quest, with public information officers conveniently referring to Irish's case as the precedent. That is, until Ajeet Kumar Pathak, a class XII student from Bihar, demanded that the CBSE board provide him details of questionwise marks awarded to him in the chemistry paper. Here too, the CBSE board stated, ``The larger public interest does not warrant disclosure of such information.'' Pathak then filed his first appeal, which was again defeated, with the authority ruling that ``no candidates shall have the right to obtain questionwise marks''. But in a dramatic twist, the CIC overturned those rulings. Information commissioner Shailesh Gandhi, who ruled on December 22 that questionwise marks awarded must be shared with the candidate, said, ``None of the exemption clauses in the RTI Act were applicable in this case.'' Gandhi said that this ruling was now ``in principle'' applicable to all authorities conducting examinations across the country. In Maharashtra too, several students have taken the RTI route to get their hands on copies of their answer sheets. Basanti Roy, divisional secretary of SSC board, said that to date, there has been no provision in the law to part with answer sheets, and that several students had to be turned down. ``But we will wait for orders to flow in from the state government on providing questionwise marks,'' Roy added. Currently, the Maharashtra State Board for Secondary and Higher Secondary Examination lets students demand verification, which allows for marks to be re-calculated by opening the answer booklets. However, NCERT is an advisory body, and it was upto boards to implement NCERT recommendations,'' added Ravindra. Karnataka was the only state in the country that decided to go ahead and hand over answer sheets to students. Educationist and former chairman of the Mumbai board J M Abhayankar said that while the CIC ruling was something to cheer about, boards must be proactive and provide copies of answer booklets. Abhyankar himself had presented a report to the state government on exam reforms in 2002, but it remains on paper. ``I had recommended that the Maharashtra board also give copies of answer booklets to students. But the state did not accept the recommendations under some pressure,'' he said. He added that providing copies of the answer scripts would ensure better evaluation.
  24. Hi everybody, I am a new member,and want help on following lines... I am a psu employee. A prestigious PSU which has 4 main unit and many small units all over India. As per a new promotion policy,wich is being is introduces 1st time,written exam (held by 3rd party) on company level and interviews on unit level were conducted. The results were declaired but no marks have been declaired nor any merit list is being displayed. If we want break up of our marks in written,interveiw ets how we should proceed.We should go through unit level or company level. prdprd

    private scools

    What can i do against a private school if one of my friend has been failed in 11th class though her exams were good. i think there must be partiality in checking the exam coppys ,and she is asked to repeate 11th standard.she has been getting distinction till 10th standard.she has also not been shown her test copys.
