Kolkata, April 2 (PTI): The full bench of the Central Information Commission will decide whether documents consulted by enquiry panels probing the mysterious disappearance of Netaji Subhas Chandra Bose should be disclosed, Information Commissioner A N Tiwari has said. Tiwari conveyed this recently to Mission Netaji, a Delhi-based organisation campaigning to access information on the disappearance of the icon of the freedom movement, while hearing its appeal in this regard. Giving a "final chance" to the Union home ministry to come clear on the issue, Tiwari asked it to provide an adequate explanation from the ministerial level on why documents sought by Mission Netaji could not be made public. All documents on the basis of which the two inquiry panels led by Shah Nawaz Khan (1956) and G D Khosla (1970-74) made their decisions have been kept secret by the government. Tiwari's directive came close on the heels of Information Commissioner O P Kejriwal directing the external affairs ministry to provide Mission Netaji's Anuj Dhar copies of its correspondence with the Sovet Union and later Russia on Netaji's disappearance. "If adequate explanations are not provided, the Commission will be compelled to direct the disclosure of all documents in question," Kejriwal said. Last year, Home Minister Shivraj Patil announced in Parliament that investigations conducted by Khan and Khosla were more credible than that of Justice M K Mukherjee who headed another panel that probed Netaji's disappearance. Following Patil's announcement, Mission Netaji's Sayantan Dasgupta filed a petition with the home ministry to seek copies of all documents examined by the Khan and Khosla panels. "Our case has been that these enquiries made selective use of evidence to arrive at the conclusion to suit the government's view that Netaji died in Taipei," Dasgupta claimed. In response, the home ministry refused to provide documents, taking recourse to secion 8 1(a) of the RTI Act, which exempts the release of information information which can "prejudicially affect sovereignty and integrity of India", "relations with a foreign state" or "lead to incitement of offence". Dasgupta then filed a complaint with the CIC. In its first hearing in October last year, home ministry officials said they were not aware of the documents examined by the earlier panels as they, unlike the Mukherjee Commission, had not appended any list of exhibits. Tiwari then directed Dasgupta to revise the original application to demand specific documents. Accordingly, Mission Netaji filed a revised petition with a list of 202 documents used as exhibits by the Khosla Commission in its arguments section. At the latest hearing last week, home ministry officials were to appear with the papers but instead came with a secret note from Home Secretary V K Duggal, who has since retired. Irked at the letter that reiterated the same arguments using Section 8 1(a), Tiwari said: "The issue is far too important to be decided in an ad hoc manner at the level of the home secretary. I am not prepared to allow an omnibus recourse to Section 8 1(a)." The CIC assured the appellant that Indians had every right to have full information on their hero. The Hindu News Update Service

Activist deboarding: MHA avoids queries; transfers case to IB New Delhi Refusing to share information on a purported list of people who are not allowed to travel abroad, the Home Ministry has transferred the whole issue to Intelligence Bureau — an exempted organisation under RTI Act — virtually shutting the doors on such queries. The ministry even did not provide information held by it which include the provision under which such people are “off loaded” at the time of boarding the flight and whether any complaints have been received by it. After several instances of people like Priya Pillai of Greenpeace and noted Shia scholar Kalbe Jawwad being deboarded from their flights without being given any prior notice, an RTI applicant had sought to know under what law these citizens are not allowed to travel abroad. He also sought to know if there is a list of Indian nationals who are not allowed to fly abroad, and if so on whose orders the list is prepared, whether the people named in the list are intimated that they cannot fly abroad. The applicant also wanted to know under what law, offloaded is written on the passport of the person being not allowed to fly.After receiving the RTI application, the Home Ministry said the matter is closely related with the working of Intelligence Bureau. The Bureau of Immigration which comes under the Intelligence Bureau had deboarded Pillai from her flight to London where she was to address British MPs. In case of misuse or disrespect to the national flag, who is the PA who is supposed to act on it? 3. In case of misuse or disrespect to the national flag, who is the PA to whom a citizen can approach about such a matter?
  4. Hi! I had applied for PIO (Person of India Origin) card for my kids (US born) with Ministry of Home Affairs Delhi (as I stay in Hyderabad) by sending the required documents and DD via speed post, as specified at the MHA site. It's been almost six months I haven't received any correspondence from them. I don't have any numbers or email contacts or any other contact information to know the status of my application. I want to go the RTI way to get this information. Appreciate help/guidance to get status/expedite on this. Thanks Srini

    No relief for prisoners of apathy

    As reported by Chitleen K Sethi at tribuneindia.com on March 3, 2010 Hundreds of foreign nationals wait to be deported to their countries In gross violation of international conventions, hundreds of foreign nationals are languishing in jails across India, even years after the completion of their sentence. They are waiting to be deported to their countries. For a few inmates this “punishment” has continued for over a decade. For others the wait has extended from four to six years. The prisoners who were arrested with their families have been separated from their children for years with the younger members lodged in observation homes. Information gathered under the Right to Information Act by city-based advocate and RTI activist HC Arora has revealed that these prisoners are caught between no clearances from the Union Ministry of Home Affairs and the alleged apathy of their native countries. Most of these persons are from Pakistan, Bangladesh and Myanmar while some are from Russia, Jordan Switzerland, Austria, Singapore, Poland, Taiwan, Uganda, Nigeria etc. Abdul Sharif, from Pakistan, completed his sentence on August 29, 1997 and has been ever since a “guest” at Central Jail Amritsar. In the same jail is lodged Shukla Ghosh who completed his sentence in October 2000. Haran Rashid, another Pakistani, is waiting to go back home since February 2004. The jail, declared as “transit camp” for foreign nationals has 77 foreign internees, all of whom have completed their sentence of imprisonment but have not been deported to their respective countries. These include as many as 58 Pakistanis, 10 persons from Myanmar, five Bangladeshis and a Jordanian. Karnataka has 56 foreigners in its jails, including two dozen Bangladeshis, a dozen Nepalis, three are from Sri Lanka, two Pakistanis, two Nigerians and a prisoner each from Taiwan, Vietnam, Tanzania, Singapore, Nigeria, Kenya, Uganda, Poland, Switzerland, Austria. Here, a Sri Lankan Mira Sahib Shamshudin, has been languishing in jail since May 17, 2004 and another Pakistani Mohammad Ali Hussain since December 8, 2007. The Andaman and Nicobar jail has 248 foreigners awaiting deportation since “no confirmation has been received from MHA so far”. These include 156 Bangladeshis, 51 Sri Lankans and 41 from Myanmar. Similarly, in the district Jail, Goalpara, Assam, there are 38 foreign nationals who have been detained under orders of Foreigners Tribunal Court, but the permission from MHA for their deportation is awaited. Following an RTI query, Ashim Khurana, joint secretary, Ministry of Home Affairs stated that the policy relating to detention of foreigners and their deportation was a “classified document” and could be provided under the RTI Act since “disclosure of the policy could prejudiciously affect the security of the State and relations with foreign states.” He, however, added that many of the foreign nationals who had completed their sentence did not have valid travel documents. “These foreigners would have to be issued travel documents by the concerned foreign mission, which normally takes considerable time,” stated the MHA reply. “There is a general apathy in dealing with these persons. It seems no one, either here or in their parent state is bothered that these persons rotting in jails in India, waiting to taste freedom and go back to their homelands,” said Arora.   6. Rare government records pertaining to events leading to abolition of privileges of erstwhile rulers of Indian states appear to be missing from the National Archives here. Senior BJP leader Jaswant Singh came to know about this through an RTI application in which he had sought information on these records. The National Archives said that the documents could not be traced and they were looking for it. Singh, represented through his Secretary Raghvendra Singh, moved his request before Home Ministry on January 17 this year. He sought an inspection of documents, including cabinet papers and notings that preceded the abolition of "privileges and privy purses" of rulers of then Indian states. What followed thereafter was a eight-month-long hiatus wherein the records were searched in the Ministry's record office, which finally took a stand that documents and files have been transferred to the National Archives. The Archives, after its efforts to trace out the records, could only manage to find only two amongst a total of 10 files sought by Singh, who required those documents for research and study. NAI, however, said its efforts were on to trace out the remaining documents. A complaint was thereafter preferred before the Central Information Commission seeking appropriate directions. While the Ministry did not approach its Appellate Authority in relation to his RTI plea, Chief Information Commissioner Wajahat Habibullah allowed his appeal on grounds that despite Singh's repeated requests, no documents could be provided to him. Habibullah has directed the National Archives to make "renewed efforts" to look out for the files that have by far remained untraced.
