    Misleading information

    Hello, i had asked for some information from a state university of tamil nadu under rti,i had attached Rs.10 IPO alongwith,but PIO of university returned my application directing me that under rti act section 6(1) payment can only be made through DD in favor of registrar, i am confused kindly guide me
  2. Respected RTI Activists, Experts and Members, Background story I work in a Central Government Organisation in the northern part of India. There are grave irregularities with respect to fresh recruitments and even promotions. For instance few officers in the top hierarchy are being promoted without following the guidelines and the few provisions provided by the government for the most outstanding are being misused for the benefit of them. In this regard, I filed an RTI through my friend and got the reply for the same. Misleading Information They have provided me with an annexure of officers (department wise comprising of 6 pages containing around 70 names) who are promoted in the last few years. However, the few officers for whom the rule was bypassed were not available in the list and seems to be specifically omitted from the list. To make the omission more broad, they have left the entire department (comprising around 10 officers), just to show that it was not an intended omission but a careless mistake if the information seeker reaches till CIC. The department receives less appeal and no case has went to CIC till date. This could be the reason why they could have went for a calculated risk, assuming that the appeal need to somehow come to them. Apart from that few other specific informations were missed. For example, I have asked for the post held by each officer and the duration they stayed in each post; minimum period for each promotion for each officers; and so on. These information are referred to the same annexure containing the name of officers, but no such information was available. Since I work in the same organisation, I know the CPIO. He is a good person, but a person who is afraid to deny anything told by the management. The CPIO has signed in all the papers, except the annexure containing misleading information which is signed by the Assistant Public Information Officer. Can a APIO sign such documents? APIO is reporting the Officer (the one who I referred earlier) who is being promoted without following the rules and the APIO himself was promoted the same way. Finally, I don't have faith in the Appellate Authority to give fair decision. After all it is the Appellate Authority who was behind the promotion of the officers who I am referring to. Now how should I proceed? If I have to proceed to he AA how my complaint should be? Can this be directly taken to the CIC as a complaint. The long post might trouble, but I need your valuable suggestions

[h=1]CIC reprimands MoEF for giving 'misleading' info on radiations[/h] The Environment Ministry got a rap on its knuckles from the CIC for furnishing "false and misleading" information that there was no study by it on the harmful effects of mobile radiations. The Central Information Commission was hearing a case related to an RTI applicant seeking information in respect of a press release from WHO, which termed the electromagnetic waves from mobiles as possible carcinogens for a kind of brain cancer. The applicant sought to know whether Environment Ministry has declared these radio-waves as air-pollutants, details on steps taken by the ministry to reduce their impact, and was there any study to measure the harmful biological effects of the waves emanating from cell phone towers on human health. The ministry said it has not undertaken or sponsored any such study. However, during the hearing it came to light that there was an inter-ministerial group which studied the matter and submitted a report in 2010. The CIC yesterday expressed "surprise" that the Environment Ministry claimed that there is no study when an inter-ministerial group in 2010 and the WHO had said that there is an adverse impact of radiations on human health and made several suggestions on the "crucial issue". "The Commission found that the answer of the CPIO in response to this RTI request is false and misleading. The ministry said there is no report when they knew or presumed to have known the content of both the reports -- by WHO and the inter-ministerial group," Information Commissioner Sridhar Acharyulu said. "The Commission is surprised that the respondent authority knew that the report was submitted by the inter-ministerial group, but officers neither cared to submit the copy of the report nor read it. The Commission could trace the report from the websites of Department of Telecommunication and DDA," noted Acharyulu who issued show a cause notice to the ministry. The report of the inter-ministerial group highlighted the adverse effects of the EMFs on human health and made very specific recommendations of not permitting cell towers near schools, residential colonies, and hospitals, he said. "It is astonishing and pathetic that the Ministry of Environment and Forests is inclined to discuss whether this falls under the definition of air pollution or not. It has not only ignored the WHO report cautioning the ill-effects on humans but did not care to read the report of its own group on radiation," he said. Acharyulu also came down heavily on the Delhi Development Authority asking them to explain why they are propagating false information that there are no adverse effects of radiations on human beings and carrying on with the installation of mobile towers. He directed the Environment Ministry to give reasons for not imposing any restrictions on installations of mobile towers and instead permitting the DDA to go ahead with "unrestricted installation" of mobile towers, in spite of recommendations against it. PATNA: The irony could not have been more pronounced: When this newspaper asked Bihar State Milk Cooperative Federation Ltd (Comfed) MD Harjot Kaur why milk was being sold @ Rs 33 to 43/litre in Bihar and Rs 25/litre to a private dairy at Joya in Moradabad, she banged the phone. When the report got into print on May 29, the MD of Vaishal-Pataliputra Milk Union (VPMU) - one of the milk unions under the cooperative - presumably took it upon himself to deny the report, of which VPMU is only a small part. 'Presumably' because the denial is on plain paper, not on letter head, and the signature is also illegible. It does not have even a letter number. The gist of the three-page denial, which has used terms like 'baseless', 'misleading' and their synonyms at least 36 times, is that the TOI report is bunkum. Kaur, on her part, held a press conference to trash the TOI story. This newspaper was not invited to the presser. We exercised our RTI (right to information) to know who is misleading whom. And according to documents procured under the RTI Act, the state animal husbandry and fisheries department received complaints earlier this year, alleging milk unions under Comfed were sending lakhs of litres of milk to private dairies in Delhi and Moradabad for processing the same as powder. Thus, the milk powder plants, opened by the Bihar government investing crores from the state exchequer, are not being utilized. This causes losses worth crores to the state every month, the complaints alleged and added one private party was selected in violation of tender rules.   5. Hi, I filed an RTI in July 2013 asking the PIO, Govt. College, asking whether the lecturer in the MBA department are working on contract or as guest faculty. He replied that they are working on contract (and this is the correct answer). Now in my RTI, dated 26th November, 2013, i asked for the duration of the contract, he said they are not working on contract, but are working as guest faculty. I had filed first appeal, but don't know what to expect. Any suggestions?
  6. In a recent order, CIC has imposed the maximum penalty and also recommended disciplinary action on the PIO for misleading the commission. Full order is attached to this post. Further, Commission notes that Shri Rajinder Prasad Dagar was present for the hearing on 21 May 2013 and made false and misleading statements before the Commission which are recorded in order of even number dated 21 May 2013 in para 6 of the order. Shri RP Dagar falsely stated that he is in no way connected with the case whereas in fact it is Shri RP Dagar who has signed the original note dated 18 October 2012 which was forwarded to the appellant by the CPIO as noted above. It is also observed that Shri Rajinder Prasad Dagar signed his name as Rajinder (the word Prasad is not clearly written) even on the attendance sheet of the Commission on 21 May 2013 with a view to concealing his true identity and to mislead the Commission as his name could not be properly noted in the Commission’s order of that date.     State Spins A Long Yarn

Tel.:43504770 Dear Sir, I lived in different rooms for over four years from 9th April, 1992 in P.G.K.Mansion,78, L.B.Road, Adyar, Madras, 600020. 5th Sep., 1996 I left for New Delhi to attend an interview at Miranda House for the post of lecturer in physics. In my absence the drunken landlords Mr.Ramesh Menon and Mr.Suresh Menon broke open the lock and took away ALL my possessions. The writ petition(W.P.1170, 27th Jan., 1997) I filed was dismissed as the Home department misled the court saying that an inquiry was conducted at Adyar police station in the presence of the petitioner on the very SAME DAY WHEN I WAS AT DELHI AT MIRANDA HOUSE. Had the landlords alone been guilty of misrepresentation of facts I would have filed an appeal as Miranda House also issued a letter stating I was at Delhi when the inquiry was purported to have been conducted. Earlier befor September 1996 during MsJ.Jayalalitha's regime when the landlords locked me out, the then D.G.P. Mr.W.Dawaram got the room opened for me. The landlords waited for Mr.M.Karunanidhi to take over and broke open my room. The then Home Secretary Mr.Ashoke Joshi told me "I am sorry. I know your case." My father a retired Headmaster who worked at Tiruvarur also said "Shall I write to Karunanaidhi? He is my student." I said "Let me see how far an honest, educated common man like me can get seeking justice." Needless to say I am diappointed with the judiciary and the country. My well wishers have warned me that my detractors have enough man power and money power and ......power to get me implicated in false cases!!!
