  1. THRISSUR: In the last five years, the Centre and Kerala government together have spent a whopping Rs 1,347 crore for the development of tribals in the state. Meerut: After his wife met with an accident near Begum Bagh in 2014, professor S K Ghai filed a Right to Information query asking the Nagar Nigam why street lights in some of the city's oldest areas have still not been fixed. Though Ghai filed the application in June 2014 and the RTI Act stipulates that replies must come within 45 days, he received his reply on June 23 - almost a year later. While the Nagar Nigam said all dark spots mentioned in the query have been fixed since then, Ghai claims only one of them has been repaired. "Last year, my wife was riding her scooter at night along the dark Chakbandi Road. A passerby inadvertently spat betel juice at her. In trying to avoid being spattered, she swerved to the side and fell into a drain. After the accident, I filed an RTI query asking the Nagar Nigam why street lights in the area were not working. Even though I should have received a reply within 45 days, I received one after a full year," Ghai, a professor of commerce at NAS Degree College told TOI. Now that I am willing to visit my sister and family members in Malaysia I need a passport for travelling . Hello experts, I am from Tamilnadu, I have given for transfer of patta several months back, every time some one call from office and ask to come in person and then say it is pending in 'X' office or "Y's" office So i filed an RTI applicationto get to know details, .. I pasted 5 nos of 2 Rs Court stamp in the application next to the sender's address along with all the proof of applications for transfer of patta. They responded after 30 days saying the village and survey number is not clearly stated so we cannot reply to your questions Even though its clearly evident in initial application, I responded to their reply stating the survey number and village in words (This time since its a reply, there were no stamps affixed by me) After 30 days of my reply, i have received a response saying that your application is rejected since you did not attach the receipt of RS 10 court fees ! ! Do i have to attach court fees stamp every time ? If the stamp was missing, the PIO should have stated that in his first reply right ? instead he said survey number and village is not clear ! How do i proceed ? Kindly advice
  6. Reply to a query under Right to Information (RTI) Act shows that 82 convicts did not return after being furloughed for various reasons. Another 53 convicts who were paroled chose to stay away well after completion of parole period. The jail administration released 1770 convicts on furlough between 2010 and 2015. Hello,I have filed RTI application to get information from PIO,Dehu road police station.They misplaced or willfully removed and gave another information which is not required by me.Ist appeal was filed,but the same result.IInd appeal filed before SIC, PUNE. attended hearing.ordered to produce the inf.but did not eventhough witness was given,affidavit was filed. After a nearly four-year-long wait to access the missing documents of a residential building in Opera House under Right To Information (RTI), an FIR has been registered by the Agripada Police Station against the administrative officers who worked at the Brihanmumbai Municipal Corporation(BMC) from 1978-2011. Charges against CMD: FACT files go missing KOCHI: Some of the files regarding the cost of renovating the bungalow of Jaiveer Srivastava, the chairman and managing director (CMD) of Fertilizers and Chemicals Travancore Ltd (FACT), are not traceable, states a reply from FACT following an RTI query. The reply assumes significance as Srivastava is currently facing allegations of fund misappropriation. The company secretary's reply to the RTI query states that expenditure details of only Rs 64 lakh is available with the company. Files regarding further expenditure could not be traced, said the company secretary who is also the information officer. Following allegations that the CMD had spent around Rs 1. 5 crore for renovating his official residence, the CBI has been probing the matter. "Some renovation/repair was made on the quarters of CMD recently and the total expenditure incurred is Rs 64.63 lakh. It may please be noted that the details of previous repair and maintenance done to the official quarters of the CMD is not traceable from the records available with the company," the reply by company secretary K V Balakrishnan stated. After receiving the RTI reply, K Premnath, president of VOICE, an NGO based in Kochi, submitted an application to the appellate authority challenging the reply. "Director (finance) of FACT, who is the appellate authority, gave me the same reply. In his reply, he also informed that I can inspect the files. I will inspect the files soon," Premnath said. "Our organization fights corruption. It was following allegations that the CMD had spent a huge amount on renovating his official residence that we filed the RTI application," he said. "Last year, the central information commissioner had ordered that officials concerned should be held responsible if files in his or her custody go missing," he said. When TOI contacted Balakrishnan over phone, he said that he had forwarded the reply received from officials of the concerned departments. "I don't remember the exact reply I gave. Whatever reply I gave, it must have been what I received from the heads of departments concerned," Balakrishnan said. As per the RTI reply, 97 LED bulbs were bought for the living room at a cost of Rs 1.64 lakh. Another 120 LED bulbs were bought for the remaining rooms. For the kitchen furniture alone, Rs 4,68,466 was spent. The amount excluded home appliances. Last week, CBI inspected the offices of various top officials of FACT. They were also questioned. The CBI first raided the office of CMD on December 21 last year while conducting investigations into an alleged misappropriation of funds. It was alleged that the CMD had spent Rs 1.5 crore for renovating his official residence and another Rs 50 lakh for renovating the office. Angry over missing Govt file, Bombay High Court directs FIR against officers MUMBAI: Observing that information under Right to Information Act (RTI) cannot be denied to a citizen, the Bombay High Court has directed Deputy Secretary of Urban Development Department in Maharashtra to register an FIR against officers responsible for a 'missing' file. A division bench of the HC further directed that after filing the FIR, the investigation must be completed within six months and it should be headed by an officer not below the rank of Deputy Commissioner of Police. Justices Abhay Oka and A S Gadkari imposed costs of Rs 15,000 on the State Government for the lapse on part of officers which led to a UDD file going 'missing' as a result information under RTI Act couldn't be provided to an advocate. "The case in hand is a classic example as to how the Government officers protecting their fellow officers tend to frustrate the basic intention of the legislature behind the enactment of the Right to Information Act, 2005," said the Judges in their order on Friday. The HC was hearing a petition filed by Sangli-based advocate Vivek Vishnupant Kulkarni, who is also an office- bearer of Swatantraya Veer Savarkar Pratishthan, a voluntary group which runs two schools having 1,600 students on rolls. The 58-year-old petitioner filed an application on September 5, 2008, with the Section and Information Officer of UDD seeking information under RTI in respect of a Government Resolution (GR) dated August 21, 1996. The resolution pertained to release of various lands in and around Sangli city in western Maharashtra which were acquired by the Government under the Urban Land (Ceiling and Regulation) Act, 1976. He sought information about the Government notings and other documents on the basis of which the GR was issued. By a communication dated September 22, 2008, the UDD Information Officer told Kulkarni the required information sought by him regarding file ULC/1089/2123//ULC-2 is not available on the Department's record and therefore, the said details cannot be furnished. In the same letter, the petitioner was also informed that some details sought by him is connected with the office of Deputy Collector and his application to that extent had been transferred to the said authority for further action. Being aggrieved by inaction of the Information Officer, the petitioner filed an appeal on November 27, 2008, before the Deputy Secretary of UDD. The Deputy Secretary asked the Information Officer to search the missing file and give the details sought by Kulkarni immediately.   18. The plans of Narendra Modi-led NDA government to bring in a transparent, corruption-free system might take longer than expected, even on paper. In August 2014, all ministries and departments were instructed by the cabinet secretariat to prepare their ‘Corruption Mitigation Action Plans’ or CMAPs. But out of the 73 ministries and departments, only 32 had prepared and submitted these plans by February 1. The mother document - RFD - itself is a mandatory requirement for all ministries. Prepared at the beginning of each fiscal year it comprises of priorities outlined by the concerned ministry, agendas of the ruling government’s manifesto, announcements by government and how these would be achieved. After six months, the list of objectives achieved is analyzed and targets reset. At the end of the financial year, a consolidated report is prepared that lists all achievements of the concerned ministry or department for that year. But, in a response to the RTI, the cabinet secretariat said that less than half the total central government bodies - only 32 ministries and departments - had submitted their plans by November 10, 2014.   21. I applied RTI application on 16.12.2010 to the CPIO of LIC, Bhagalpur Divisional Office for detail information regarding G.S.L.I payment of my father. The CPIO and FAA replied in same manner that ' records pertaining to delay / non payment of G.S.L.I are not found'. The CPIO also did not reply to some information I require in the above matter.     As reported by Express News Service on expressindia.com on 28 April 2008: The missing links IN the city - ExpressIndia.Com The missing links IN the city Ludhiana, April 27 In an attempt to get his 12-year-old missing son traced, local businessman Pawan Kumar stumbled upon the data of the missing persons in the city. Using the Right To Information (RTI) Act, he found that out of 276 persons who were reported missing last year, only 46 were traced by the police. The data further stated that out of the 43 persons who went missing till February 29 this year, only nine were traced. The data reflects that how inefficient the police are in tracing the missing persons. Kumar, who lives in the Purana Bazar locality in the old city, had sought the information from the higher police authorities when his son Gaurav (12) had gone missing on October 28 last year. Since then, Kumar is running from pillar to post to know the whereabouts of his son. His son Gaurav is mentally retarted. "I am trying my best to trace my son but I am not satisfied with the efforts of the police," he added. He said Gaurav is the only brother of two sisters who also are in a state of shock ever since he has gone missing. Kumar said he had paid umpteen visits to the police stations to get the status of his complaint about his missing son but to no avail. "Though the senior police officials constituted a committee to trace my son, police are not taking any pains to find my son," he added. According to the data procured by Kumar, as many as 131 men and 57 women went missing last year out of which 14 men and eight women were traced. As many as 117 men and 49 women are still untraceable. The number of missing children is 72 boys and 16 girls. Of which 20 boys and four girls were traced while 52 boys and 12 girls are still missing. This year till February 29, 19 men and eight women are missing. Of which 13 are boys and three are girls. Out of these, nine persons could be traced by the police. SSP R K Jaiswal said, "Despite our limited resources, we do our best to trace the missing persons. We flash the pictures of the missing persons so that people come forward in helping us to trace the missing persons."

Asked to show files, CBI claims they are missing as reported in Times of India, 20 Dec 2008, TNN MUMBAI: Just when the CBI was ordered to produce three files pertaining to a seven-year-old corruption case under the Right to Information Act, the premier investigating agency said the files were missing. The files pertain to investigations in a corruption case against three junior officials of the Narcotics Control Bureau (NCB). The case dates back to July 19, 2001, when the CBI laid a trap at the Mumbai NCB office on a complaint by Navin Dubey, a suspect in a narcotics case. Dubey was sent with a recording device to the NCB office, while CBI officers waited outside. The trap fell through after one of the officers detected the recording device. After failing to hear from Dubey, the CBI team went to the NCB office to ensure his well-being. The CBI conducted a search at the NCB office. The CBI prepared a draft panchnama on the sequence of events, which they subsequently tore and replaced with another one. In the second panchnama, the CBI mentioned that NCB chief Ajay Ubale obstructed the search, which was not in the draft copy. The next day, Ubale complained to then joint director of CBI, D Sivanandhan, about dragging his name. As a fallout, Sivanandhan wrote to Ubale's seniors seeking his transfer. Ubale challenged it in the Central Administrative Tribunal (CAT), which held that the transfer was malafide. The Bombay high court also upheld the order. Ubale sought sanction from the central government to prosecute CBI officials__D Sivanandan, then DIG K L Prasad, superintendent of police (SP), N S Saravde and his deputy Manoj Pangarkar among others for falsifying the records. Ubale moved the high court when the government denied permission for prosecution, which is pending. Meanwhile, Ubale also sought information under RTI and obtained details which revealed that the witness in Dubey's complaint was called on July 17, 2001, a day prior to the receipt of his complaint. The government justified the action in the court saying it was part of operational exigency. Ubale filed a complaint before Chief Information Commission (CIC) that in spite of its order, CBI was withholding certain records. CIC directed the CBI to allow Ubale access to the records but the agency did not comply with it. Following this, CIC conducted an inquiry which revealed that the concerned records-file pertaining to the investigating officer calling the witness on July 17, 2001, the case diary and a complaint dated July 16 from Dubey were not available. CBI officials have denied any wrongdoing in the case. The CBI, in its reply dated December 14, 2008 to the CIC, stated that all efforts were made by the concerned officers to find out about the status of the case files. "All concerned officers have reported that no such files are available in their office,'' said SP Sujeet Pandey. This contradicts the government claim that there was an operational exigency. This is claimed by an NGO, Naujawan Bharat Sabha, which has alleged a huge trafficking racket, in a report. The report is based on the figures obtained under the RTI Act. The maximum cases are reported from Nandgram, Harsh Vihar, Vijaynagar, Pratap Vihar, Sanjay Nagar, Raeespur, Mirzapur, Rahul Vihar, Khoda Tigri, Khadda, Arthala, Viklang colony, Ghukna, Deendayal Puri, Salarputi, Karheda, Shyam Park Extn, Budh Vihar, Navada, Pyarelal colony in Ghaziabad and Bhangel, Bishanpura, Mamura, Chotpur, Chhijarsi areas of Noida. The report says that most of these children are from poor families, and when they complained to cops, it was alleged, they were turned away both in Noida and Ghaziabad. Nithari in Noida had witnessed a similar disappearance of children till the story of Surendra Koli and Moninder Singh Pandher emerged. The CBI is now investigating the matter. President of the NGO Tapish Maindola said," We have urged the Ghaziabad DM to take immediate action, but the attitude of the police remains negligent despite cases like Nithari. We demand that CBI take strict action against the police." The report says India is a target for criminals engaged in human trafficking for organs, child pornography and paedophiles. Gangs that abduct children for begging or selling them off are also active in NCR. Ghaziabad SSP Deepak Rattan said, "Till now, the cases registered have not pointed towards human trafficking and the like. After the Nithari case, we are cautious."

    File not Traceable

    Hello Forum Members, I have been bowled over by most stubborn CAPIO/CPIO/AA of one of the leading Telecom Utility. Every time I am asking for a file inspection I am being told that the particular file is "Not available" or "not readily traceable" carefully avoiding the words Missing or Lost. See these Replies: "From your letter under reference it is revealed that you were not satisfied by the above inspection due to the fact that the relevant information regarding the contents that appeared in website of BSNL, Cuttack during March-05 to Oct-05 were not shown to you as those were not available. The undersigned has deeply felt the gravity of your sentiments and has therefore taken due care of that in true sense of spirit. In this respect it is to intimate that sincere efforts are being made to collect the information from Adsoft Technologies, the website designer and Ex-SDE ( Computor), O/o GMTD, Cuttack. You will be intimated in due course of time if any information as to your queries are received by this office from the above sources." After two months this reply: "While referring to this office letter as above on the captioned subject it is to intimate that inspite of sincere efforts made from different angles for collecting the information relating to the contents that appeared in the website of BSNL, Cuttack on Broad Band Service during March-05 lo Oct-05 . no fruitful results were obtained. This is for your kind information please." Here's another reply to another RTI Query: "A-3. The information is not readily traceable, will be supplied if found subsequently. A- 4 (A)&(B). No file is missed, lost or destroyed. The allegation is self made." Please see the Contradictory Statements above. My previous Complaint / Appeals are pending with the CIC. No sign of early disposal. I am at my wits end. Fellow members please guide me.
