  2. TURA, Feb 1 – The Garo Students’ Union (GSU) Rongmil unit has alleged misappropriation to the tune of Rs 1 crore in the distribution of schemes by the local MLA and his workers. The allegation comes after an RTI filed by the GSU unit found distribution being channelled through a few contractors loyal to the MLA resulting in the benefits not reaching the intended beneficiaries. Taking a serious view of 58,000 cases of voter cards with wrong photos admitted by Delhi Government, the Central Information Commission today called for an in-depth inquiry into cards issued on residential proof with MP or MLA recommendation to curb bogus voting. Hearing a case in this regard, Information Commissioner Sridhar Acharyulu said in the context of admission about mistakes and huge bogus votes by Chief Electoral Officer of national capital in a PIL before Delhi High Court, the problem appears to be more serious and complex. "It is shocking to know that there are 58,000 cases of wrong photo image, including that of a film star on a common man's voter card, an in-depth inquiry into residential addresses with MP recommendation criterion might reveal more bogus votes," he said.   4. MLAs’ job: shrouded in deliberate ambiguity Here’s a simple question. What are the responsibilities and duties of the person who will be your member of legislative assembly (MLA)? Frame laws and policies, ensure growth and development, attest documents for citizens, build infrastructure, clean gutters, and so on the list goes. A straw poll that I conducted in the past week in a middle-class housing society, a college class, suburban trains, rickshaw queues and a slum showed what citizens expect of their MLAs. These are expectations. People were not sure what their duties really are. The straw poll was then extended to a few candidates of major parties contesting from Mumbai. And what do we have? Those who seek to be the chosen ones have even vaguer ideas about an elected representative’s duties. We have to work for development, was the one line repeated over and over again by the contestants – some in the fray for the first time, but a few seeking re-election. It’s a bit like striving hard – really hard if you consider the harsh October sun and the occasional storm as a candidate addresses three to six meetings a day – to land a job in which you are not quite sure what to do and what your key result areas are. A well-paying job with ambiguous, or non-existent, parameters of evaluation. A few diligent MLAs happily distribute what they call ‘report cards’, flashy booklets replete with embarrassing self-praise. Advocacy and citizens’ organisations have evolved ways to judge MLAs; questions asked in the Assembly, money spent on projects being some of the criteria. But none of these fall into the ambit of responsibilities and duties of elected representatives. The Constitution of India, an otherwise instructive volume, is silent about this. Aghast at this state of affairs in the world’s largest functioning democracy, a citizen filed an RTI application in 2009. Delhi’s Dev Ashish Bhattacharya began with the Election Commission, was tossed to the Union ministry of parliamentary affairs which, in turn, sent his irreverent questions to the ministry of law and justice. Eventually, two years later, the Lok Sabha secretariat told him there was “no provision either in the Constitution or the rules of procedure and conduct of business in Lok Sabha that define the duties of members of Parliament or through which the accountability can be fixed on non-performing MPs”. The legislative assemblies in Bihar, Assam, Kerala and Haryana affirmed this in their own words. BJP-JDS govt had spent Rs 7 crore on ministers' quarters As reported in Deccan Herald | Bangalore, DHNS The previous JD(S)-led coalition government has spent Rs 7.13 crore to furnish and maintain residential quarters of ministers, including that of the chief minister, according to information furnished by PWD under the Right to Information Act. PWD, which has provided this information to RTA activist Bheemappa Gundappa Gadada on money spent on ministers’ quarters during 20 months, said of Rs 7.13 crore, Rs 4.85 crore was spent on furnishing, Rs 1.98 crore on painting and renovation and Rs 30 lakh on electrical works. As per the information, PWD has spent Rs 69 lakh on the then Chief Minister H D Kumaraswamy’s official residence Anugraha, Rs 33 lakh on the then DyCM B S Yeddyurappa, Rs 38 lakh on the then transport minister N Chaluvarayaswamy. As published by Noor Khan at www.samaylive.com on 21 April 2009 New Delhi, Apr 20 : What are the duties and responsibilities of MPs and MLAs who are elected through secret ballots after spending crores of rupees from the public exchequer? It seems that even after 59 years of becoming a Republic, the world's largest democracy lacks a specific answer to the question as three key government institutions -- Election Commission of India, Union Ministry of Law and Justice, and Ministry of Parliamentary Affairs -- have said they do not have any information on the subject and have been passing the buck among each other. Dev Ashish Bhattacharya, a Delhi based RTI activist, had asked rules or provisions that fix duties and responsibilities on MPs and MLAs. He also asked about their duties with respect to the provision of basic amenities and maintenance of law and order in their respective constituencies. Replying to the application, Election Commission, in its initial response, said it was not concerned with the information sought. Later during an appeal, the Commission accepted that the application should have been transferred to Ministry of Parliamentary Affairs and Ministry of Law also.
