The CIC has ruled that Vodafone is not a public authority as defined in Sec 2(h) of the RTI Act 2005. http://rti.india.gov.in/cic_decisions/CIC_BS_A_2013_000927_5645_M_136533.pdf Relevant Facts emerging during Hearing on 21/07/2014 The following were present Appellant: Absent Respondent: Mr. Ajit Kumar Singh Advocate The appellant was given an opportunity to participate in the hearing, however, he is absent. It is seen from the records that the appellant has averred that Vodafone Digilink Limited (VDL) is a public authority under Section 2(h)(d)(i) of the RTI Act as it is controlled by the Department of Telecommunications (DoT), which forms part of the Ministry of Communications and IT. He has sought to substantiate this claim by averring that VDL operates only after procuring a license from the DoT and cannot operate its business without the consent of the DoT. Further, the appellant has claimed that VDL acts as per the directions and notifications issued by the DoT, making it clear that VDL is controlled by the DoT, and hence, falls under the category of ‘public authority’. The respondent has countered this claim via written submission with the following contentions: (i) VDL is a public company duly incorporated under the Companies Act, 1956 and has not been established or constituted, nor is owned or controlled by a government agency; (ii) VDL has obtained a license from the DoT to provide unified access services in the Haryana circle. However, VDL operates independently of the DoT; (iii) VDL can in fact, challenge any order/direction of the DoT before the Telecom Regulatory Authority of India or any other appropriate forum and is not bound to follow the directions of the DoT; and (iv) DoT is in charge of formulating policies in the telecom sector and ensure its healthy and orderly growth. It does not control the functioning of any private telecom player like VDL. Decision Notice: The crux of the appellant’s contention rests upon the assertion that VDL is controlled by a government agency. In order to ascertain the import of the word ‘control’ under Section 2(h)(d)(i) of the RTI Act, reliance is placed on the Hon‘ble Supreme Court’s decision dated 7/10/2013 in the matter of Thallapalam Ser. Cooperative Bank Ltd. & Ors. vs. State of Kerala & Ors. (Civil Appeal No. 9017 of 2013) holding as under: “34. We are of the opinion that when we test the meaning of expression controlled which figures in between the words body owned and substantially financed, the control by the appropriate government must be a control of a substantial nature. The mere supervision or regulation as such by a statute or otherwise of a body would not make that body a public authority within the meaning of Section 2(h)(d)(i) of the RTI Act. In other words just like a body owned or body substantially financed by the appropriate government, the control of the body by the appropriate government would also be substantial and not merely supervisory or regulatory […] 35. We are, therefore, of the view that the word controlled used in Section 2(h)(d) (i) of the Act has to be understood in the context in which it has been used vis-à-vis a body owned or substantially financed by the appropriate government, that is the control of the body is of such a degree which amounts to substantial control over the management and affairs of the body.” It is thus clear, that in order for an entity to be considered a “public authority” under Section 2(h) of the RTI Act, the extent of control of a governmental authority in the entity must be substantial and not merely of supervisory or regulatory nature. Obtaining a license to operate from a government agency such as the DoT will not vest the DoT with control over the functioning of VDL. DoT does issue instructions from time to time as a supervisor of the telecom sector, but control over the functioning of a private player such as VDL vests with its management alone. Therefore, the test of establishing deep and pervasive control under Section 2(h) of the RTI Act is not satisfied and hence, VDL will not constitute a public authority under the RTI Act and no information can be sought from it under the same. The appeal thus, lacks merits and is dismissed

    I would like to know from when is the TRAI/service providers implementing the one india resolution which was passed a long time ago, according to which all the roaming charges were supposed to be squashed. Thanks
  5. Sir/ Madam, I am living in New Delhi in D.D.A. Janta flats at ground floor. Originally the building was constructed with one room set for ground and 1st floor only by D.D.A. But the allottee of 1st floor has constructed second floor and partly 3rd floor also. Now he has installed a VODAFONE CELLULAR TOWER at the top of 3rd floor. Our area is totally residential and installing a VODAFONE TOWER is a commercial activity. My concern is that the load on the building has been increased to a dangerous level and radiations released by the tower can be very harmful and even cause cancer and other diseases to residents of the area. The electricity authority i.e. BSES has also installed a 5 kW commercial meter for tower purpose. Kindly advice the procedure for the removal of VODAFONE TOWER from our building. I request to all experts to guide me for preparing a RTI application for the same purpose. Thanks & Regards Sudhir Bhatnagar

Dear sir/Madam I hereby explaining the difficulty while using the Vodafone.Please consider the complaint and do the needful. 1 .While using Vodafone voice chat IC and chat with different person but I came to realized that their your own person appointed by you ,it vodafone I can through neccessary. 2.I repayed the full amount with full interest only on condition that the same number will be reactivate.After receiving the amount I got the information that the number has been deactivated ,and it is impossible to activate the same number. 3.When I intimated the above issues to your nodal officer Ms Jency ,she replied that issues could not be sorted due the de activation of sim card.After that I submitted the complaint through e mail I got the reply from Ms Jency that it will be activated at the earlist and requested me to contact the nearest Vodafone Store. 4. I didnot get any satisfactory reply from your Nodal officer Ms Jency for my query about Voice chat (I was cheated and have realised that your own female staff had been chatting me by waisting my time and money .The above all you have exploitted the customers innocence and trust with you and I came to know that you have appointed staffs for this pity game for voice chatting.While calling your vodafone number 111 ,tells that you are not engaged such a game. i will submmited to all records to jency the nodel officer of vodophone essar but no reply and no responce to me so please said to me how did solve the problem
  7. Friends, I filed a RTI to TRAI to get my vodafone post paid number call records with tower information for a specific period under section 6(1). Application is also concerns about my life and liberty, attached FIR copy to it. I got a reply from TRAI that "It is informed that the information sought is not held by or under the control of Public Authority viz TRAI and hence does not come under purview of 'Right to Information' in terms of section 2(J) of RTI ACT, 2205." Section 2(j) reads : Right to Information means the right to information accessible under this Act which is held by or under the control of any public authority and includes the right to (i) inspection of work, documents, records; (ii) taking notes, extracts or certified copies of document or records;. In terms of Section 2(i), a record includes a file and in terms of Section 2(j) right to information extends to accessibility to a record . Thus, a combined reading of Sections 2(f), (i)&(j) would indicate that a citizen has the right of access to a file of which the file notings are an integral part. In terms of existing provisions of RTI act i should get the requested details. Now my question is can i go for an Appeal, if i appeal what should be my argument. Regards, Guna.

    I don't why people send unwanted SMSs and call unwanted calls. I have this problem on my Vodafone. You know guys that I registered in DND but it doesn't matter to them. Is there any solution for this or I change to another company? But all my friends who have different sims having same problem. So no choice to which I can switch?

Gaekwad feud resurfaces, this time over construction as reported by Express News Service, Oct 09, 2008, Indian Express Vadodara, October 8 The divide between the scions of the Gaekwad royal family of the erstwhile Baroda State, Ranjitsinh Gaekwad and Sangramsinh Gaekwad, has once again come out in the open. Sangramsinh’s son Pratapsinh has filed an application under the Right to Information (RTI) Act to the Vadodara Municipal Corporation (VMC), inquiring about the Gaekwads carrying out a new construction in the Laxmi Vilas Palace premises recently. C B Patel, VMC Town Development Officer, said: “On September 22, Pratapsinh enquired about the Gaekwads constructing new buildings in the palace premises at Moti Baug area. Following this, we served a notice on the Gaekwads, who replied that there are no new constructions in Moti Baug.” Mahendrasinh Chauhan, Administrator, Gaekwad Baroda Golf Club, said, “We have responded to the queries saying that no such activity is going on in the Palace premises.” Gaekwad feud resurfaces, this time over construction
  10. This may not be good news for Vodafone, the company that acquired Hutch, from the Central Information Commission (CIC). The CIC on Friday got an assurance from the Telecom Regulatory Authority of India (TRAI) seeking an explanation from Hutch for not acting on the complaint of a RTI applicant ML Aggarwal. The CIC’s decision may open floodgates for RTI applications with TRAI against the mobile service providers. Aggarwal, who was being charged for add on services without his consent, filed an RTI application with TRAI seeking eight clarifications. He wanted to know whether Hutch was competent to add arbitrary any amount of charges without any written consent from the customers and number of consumers from whom the money is charged. He also sought information about Hutch officials responsible for collecting the charges. TRAI replied that they have issued direction to Cellular Mobile Access Providers that no chargeable value added service shall be provided to a customer without his explicit consent. TRAI also indicated that any value added service, which was earlier provided free of charge should not be made chargeable without the consent of the consumer. However, on information related to the company TRAI clarified that it does not maintain such details about the companies. During the hearing at CIC, the appellant Aggarwal informed that despite TRAI’s clarification he was still being charged for the service without his consent. The Central Public Information Officer of TRAI informed CIC that Hutch has to carry out the direction issued by TRAI and said they would ‘definitely; take up the appellant’s complaint with the company. "If the case is provide that Hutch has violated, they (TRAI) will take up matter in the court," the CPIO assured CIC, informing that the regulatory body also have a quasi-judicial function.
