  6. Reported by Timesofindia.indiatimes.com on Nov 28, 2012 No mobile towers near schools, hospitals, directs Rajasthan HC - The Times of India JAIPUR: Holding mobile towers as a health hazard, the Rajasthan high court on Tuesday directed telecom service providers operating in the state to remove within two months their towers falling in the vicinity of schools, hospitals and play grounds. The division bench of Chief Justice Arun Mishra and Justice N K Jain Senior held that radiations emitted from mobile phones and mobile base towers are "hazardous to children and patients", as accepted by the inter-ministerial committee of Central Government, and needs relocation from school, colleges, hospitals and play grounds immediately. The order, running into more than 200 pages, has asked all the mobile companies of the country having towers erected in Rajasthan to relocate them away from schools, hospitals, colleges and playgrounds within two months. It also asked them to relocate the towers from a periphery of 500 meters from prisons, and those falling in 100 meter distance of ancient and archaeological heritage monuments. Earlier on September 7, the Supreme Court had refused to interfere with a Rajasthan high court's interim order to the state government to remove mobile phone towers from near the schools, hospitals and densely populated localities. Today the court said, "We have received a large number of communications from the state and across the country that the mobile tower radiations are harmful and even the inter-ministerial committee of Central Government in its meeting in May this year has held so. "Even the Supreme Court has held that the radiations are hazardous and supported our view while rejecting the appeal filed against our interim order for relocation of towers away from schools." The bench relied upon the inter-ministerial meeting of Central government of May 2012, wherein it was emphasised that the electromagnetic radiations emitted from cellphone as well as towers erected for mobile communication have both thermal and non-thermal effect i.e. these waves cook human tissues just like a microwave oven if the body is exposed to these radiation for long.
  7. I want to have copy of mumbai municipal rule which states, "the permission of every single top floor resident is required before cell towers are installed on the terrace". I am asking this because I am staying on top floor of a building, where a erection of a mobile tower is under consideration; and I have come across enough scientific material stating hazards of mobile towers. Pl help, its urgent.

  9. GLADA acts against illegal mobile towers As reported by Arjun Sharma in Hindustan Times on dated 14th September 2012-09-14 Source : Hindustan Times e-Paper OUT OF 23 ILLEGAL MOBILE TOWERS, SHOW-CAUSE NOTICES HAVE BEEN ISSUED TO 16 BUILDING OWNERS LUDHIANA: Taking action against illegal mobile towers in the city, Greater Ludhiana Area Development Authority (GLADA) has issued showcause notices to several people, who have allowed installing these towers atop their buildings or plots. Out of the total 23 illegal mobile towers installed in different areas under GLADA, show-cause notices have been issued to 16 building owners. Six out of these 16 towers have been installed on shopcum-flats in Dhandari Kalan, Phase 2, four on shop- cumoffices in Dugri, Phase 2, three in Dugri, Phase 1, and three in other areas. Out of these 23 towers, only one tower has been granted permission and five have been resumed. The annual internal and external audit report of GLADA had revealed that the authorities have suffered a loss of over Rs 60 lakh due to installation of unauthorised mobile towers in the city. The audit report said, “23 mobile towers were installed in the city by different telecommunication companies without taking permission and paying the requisite fee.” The first tower was installed in Sector 32-A 10 years ago, followed by two more towers in Durgi, Phase 1. According to the official document, no permission was taken for the installation of these towers. Besides, this has led to a loss of Rs 23 lakh to GLADA and the loss of renewal fee was more than Rs 40 lakh as most of the towers were installed six years ago. “The revised policy for installing communication towers/ antennas by telecom operators provides for permission of communication t o we r s to be installed in the area falling under the purview of the authority,” states an official document. The document further states that the installation “will be permitted on the build-up portion of commercial, industrial and institutional sites outside the prescribed set-backs on receipt of request in the office of the estate officer concerned in form AT-1 along with a bank draft for Rs 1 lakh per tower”. It adds, “Permission so granted shall be valid for a period of one year which can be renewed further on annual basis on a payment of Rs 50,000.” However, during the audit of records maintained by the building and enforcement branch of the office, it was noticed that 23 communication towers had been installed illegally. Twenty-one out of 23 towers belong to private companies, whereas two belong to a public sector undertaking. The matter was first taken u p by the Council of RTI Activists president Rohit Sabharwa land secretary Arvind Sharma, who had filed an RTI regarding the issue of unauthorised mobile towers in the city. Meanwhile, Ravinder Sharma, who is the assistant estate officer of GLADA, said action had been taken against 23 towers. “Showcause notices have been sent to many owners who have installed towers on their buildings or plots,” said Sharma. The authority has resumed five plots under GLADA, as the owners were not able to provide any satisfactory answer. “GLADA will conduct an appeal and thereafter cases will be registered against those who are not able to take action against these towers,” said Sharma.

  14. As reported by Nitin Yeshwantrao on 25 April 2011: http://timesofindia.indiatimes.com/city/mumbai/Only-23-of-2k-mobile-towers-in-Thane-district-legal/articleshow/8075898.cms Only 23 of 2k mobile towers in Thane district legal THANE: Only 23 of the total 2,169 towers installed by mobile companies on building terraces and vacant plots across Thane district are legal, according to the information compiled by the district collectorate. The towers were erected without the permission of the municipal bodies or the state revenue department. The district administration has now sent notices to 1,880 such illegal towers. It has also sought Rs 5.69 crore as fine from the plot owners and housing societies which allowed the towers to be set up on their premises. In Thane city alone, all the 1,088 mobile towers have been installed without the permission of the municipal corporation. Notices have been slapped on all the 1,088 housing societies and a fine of Rs 35 lakh has been recovered. "We still need to collect Rs 2.79 crore as fines," said an official. "A plot owner receives anything between Rs 6,000 and Rs 10,000 per month from a mobile company in lieu of the land used to install the tower. However, when two parties enter into such a commercial agreement, they must inform the local revenue officials as the land use changes. However, many choose to ignore this and have been fined,'' a district collectorate official told TOI. RTI activist Nainesh Dolas , who had sought information on illegal cellphone towers in the district, has asked the officials to explain the delay in initiation of action against such towers. "The officials have collected only Rs 1.15 crore as fines. Most of the owners of illegal mobile towers continue to function with impunity.. and an amount of Rs 5.69 core is yet to be recovered from them. The district officials must explain why the delay in recover and acting against those flouting rules'' Officials at the district collectorate, however, said that most of the illegal towers are in the jurisdiction of the municipal corporation or municipal council. "In such cases, action has to be taken by the civic authorities," said the official. The mobile towers has become a contentious issue in most housing societies as majority of members are averse to installing one on the building terraces for fear of radiation. However, one section of the people said their fears of radiation effects are not scientifically proven and that the towers are a big source of revenue for the housing society.
  15. HI. I have applied to the Municipal commissioner, to know the status of the towers in mumbai city through RTI. Whether they are legal or illegal. Just to inform you all, that most of the towers are illegal. The companies dont take the proper permission to erect the tower. However to my RTI query the commissioners office has forwarded the application to all the wards seperately, and the wards are replying to me seperately. My query was - 1. how many towers are there 2. How many of them have permission Now the commissioners office has smartly forwarded this to all the wards telling that the wards will reply. Wach ward (like a, b, c ...) has again forwarded the query to Asesement and collector and also to Building proposal department. Srangely, the BP department tpld that "the information sought by you is voluminous in nature & it would disproportionately divert the recources of the public authority. hence in view of clause 7(9) of chapter II of the RTI act, the information cannot be mande available. My question to RTI experts is a. When I'm asking information from municipal commissioner, can he direct me to various departments? I want a consolidated reply from his office nd not replies from various departments/wards and then I have to fight will all the departments/wards. b. Can the BP dept refuse me information which is of importance to public at large? How to proceed further. IF it is suitable, I can upload all the application and rpies received.
