    Make MPLAD Funds details public-CIC

    नई दिल्ली. केंद्रीय सूचना आयोग (सीआईसी) ने सरकार को सांसद स्थानीय क्षेत्र विकास योजना (एमपीएलएडीएस-सांसद निधि) के तहत किए गए कामों की जानकारी को सार्वजनिक करने का निर्देश दिया है। ये निर्देश ऐसे समय में आए हैं जब सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्रालय ने सीआईसी को बताया कि वे एमपीएलएडीएस को फंड जारी करता है, लेकिन आंकड़ों के अलावा उसका रिकॉर्ड नहीं रखता। सूचना आयुक्त श्रीधर आचार्युलु ने कहा, "मंत्रालय को उपयोग प्रमाणपत्र जिला प्राधिकरण द्वारा भेजा गया है, लेकिन उसकी जानकारी वेबसाइट पर अपलोड नहीं की गई। अभी इस बात का भी पता नहीं है कि इन प्रमाणपत्रों में वास्तविक कामों की जानकारी है या नहीं।" एमपीएलएडीएस के तहत हर सांसद को उनके संसदीय क्षेत्र में विकास कार्य करने के लिए 5 करोड़ रुपए दिए जाते हैं। अपीलकर्ता को सूचना के अधिकार के तहत नहीं मिली जानकारी इस संबंध में एक शख्स प्रशांत जैन ने ग्वालियर लोकसभा क्षेत्र में किए गए कामों को लेकर मंत्री नरेंद्र सिंह तोमर से जानकारी मांगी थी। जैन ने जानना चाहा था कि जनवरी 2015 से अगस्त 2017 के बीच सांसद ने अपने लोकसभा क्षेत्र में कितना फंड किस संस्थान या फिर व्यक्ति को दिया। अपीलकर्ता ने आयोग को बताया कि उसे सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्रालय और जिला प्रशासन से इस संबंध में कोई जानकारी नहीं दी गई। देश का नागरिक होने के नाते उसे और जनता को सरकारी पैसे के इस्तेमाल के बारे में जानने का पूरा हक है। The detailed campaign for MPLAD funds can be read here https://righttoinformation.wiki/guide/applicant/application/sample/mla-fund

Narendra Modi, the Prime Minister of India and Lok Sabha MP from Varanasi, has not spent a single rupee from his MPLADS funds in all the four villages adopted under Sansad Adarsh Gram Yojana (SAGY). The fact came in a response to an application filed under Right to Information (RTI), the response to which was sent on June 30, 2018. The response addressed to applicant Anuj Verma from Kannauj district of Uttar Pradesh, stated that no development works conducted in the four villages adopted by Narendra Modi have been budgeted from the funds allocated under Members of Parliament Local Area Development Scheme (MPLADS). The Saansad Adarsh Gram Yojana website is here. He first adopted Jayapur on November 7, 2014, then Nagepur on February 16, 2016, Kakarahiya on October 23, 2017, and lastly Domri on April 6, 2018. All of the works in four villages have been done by the private authorities, government banks, state-level institutions, and some central government bodies, locals informed TwoCircles.net. For instance, a Gujarat-based firm has constructed all the bio-toilets in Jayapur, and Vedanta group has constructed one Anganbadi Centre in Nagepur village. The solar street lights have been installed by various public banks. The MPLADS fund, worth Rs 5 Crore per year, can be utilised anywhere in the constituency of an elected MP. But the opposition voices in Varanasi are accusing Modi of not setting an example before other MPs by not spending his own fund for development.

  5. We must know our Hon'ble Member of Parliament daily routine. But unfortunately, you may not get that information from MP Office. They do not come under Right to Information Act. But yes, you can get the details of the work Member of Parliament has undertaken by various means. Here are few: 1. Request General Administrative Department of the State Government to give you all the correspondence an MP has written to State Government for his constituency related work. You can get the reply and analyse his focus. 2. File another RTI (actually if you dig deep, it's already there in public domain) to get the information on number of days Hon'ble MP has attended the Lok Sabha/ Rajya Sabha. You can also find out what questions is the MP asking in the parliament. You can also file in the Loksabha/ Rajya Sabha and know under which Parliamentary committee the Hon'ble MP is part off and how many meeting has he/she attended. 3. Then file an RTI in the nodal district which is the District having powers to disburse money under MPLAD funds (Hon'ble MP gets 5 crore per year under MPLAD, which is non lapsable). Get all the letters written by Hon'ble MP for recommending work under MPLAD. Once you have the information, analyse if at all any work is recommended by him/her, what is the nature of the work recommended e.t.c. MPLAD Fund Guidelines are available here! 4. Find out from the District, how may meeting has he/she attended under Vigilance Monitoring Committee and get the minutes of the meetings. Generally, Hon'ble MP does not have many powers in the State Government especially if the District Administration is non-cooperative. A district collector only listens to Chief Minister, therefore, if MP does not have a very good repo with CM, the District Collector will rarely listen to him /her. Do let me know if you find my observations helpful and you decide to go ahead and ask for information. I know its a difficult route, but we all must know and stand to make our representative accountable to us. Right!!
  6. I have filed an RTI with Ministry of Rural Development. Below is the whole word document copy pasted. It got rejected and reason is this. Previously also my application got rejected with same reason. Here is the response from them. The funds allotted for MPs to use for providing drinking water, public health, education, sanitation, sports and roads are either unused or misused The Member of Parliament (MP) Local Area Development Scheme (LADS) funds, which were instituted in 1993 at Rs50 lakh per year have grown to Rs5 crore per year in 2011. However, the usage of MPLADS funds from all MPs of Lok Sabha as well as Rajya Sabha, remain in controversy, thanks to the opaqueness in their expenditure. As per the Annual report for 2010-2011 by the Ministry of Statistics and ProgrammeImplementation, which disburses these funds, at least 45% to 60% of MPLADS funds in most of the states have been spent on roads. Looks like most of our Parliamentarians, believe that creating roads means development! As per the guidelines of MP LAD funds, preference of works under this scheme is to be given to works relating to national priorities such as provision of drinking water, public health, education, sanitation, sports and roads. However, as per the Annual Reportfindings, in most of the States, only 1% to 7% money has been spent on public sanitation, drinking water, electricity, health and family welfare. Except for Odisha, Kerala, Punjab, Sikkim, Tamil Nadu, West Bengal, Uttarakhand and Tripura, which have spent between 20% to 50% money for education, other progressive states have not spent beyond 3%-7%. Lakshadweep has been an exception, spending 100% of the funds on education. Sports too is very low on the priority list of most states that have spent not more than 3% of the funds except for North-East states like Manipur and Mizoram who spent more than 20% of it.     Sir, In which department one should file a RTI to know how much money MP has spent from his funds. Is MP having any right to get sanctioned work / money from any department of any muncipal/state/central department. What are the other discritionery power of MP which he/she can use. What are the other quota's of any type which MP has his/her right like houses he can allot ? etc. Please provide help at earliest.

Also, citizens will get an opportunity to decide what kind of projects they want from the funds received by their MPs. A booklet containing details of all works taken up during 2009-10 and 2010-11 under the LADS by each MLA would be printed by the Delhi government soon. Information Commissioner Shailesh Gandhi had earlier directed that suo moto declarations about works taken up under MLA LADS be made under Section 4 of the RTI Act. So the government has now decided to bring out this booklet .“The booklet will cost R10 and will be available at Delhi secretariat, offices of all deputy commissioners and SDMs across the city,” said a senior official. “We would also bring out booklets for LADS for each MP and councillor,” he added. Meanwhile, the government will also set up — before March-end — a monitoring cell for stringent monitoring of implementation of various works taken under the MPLADS. “Also, MPs will be regularly invited for review meetings on the work undertaken through their LADS,” said a source. A national review meeting had decided last month that “preparation of shelf life of projects based on the needs of the people” was important. And as per the minutes of the meeting, accessed by HT, it was also decided that this information should be provided to the MPs.

Amid the general flow of ideas, I had the chance to put forth a point as well. India has about 250,000 electoral constituencies at the parliamentary, assembly and panchayat levels, I said, and more than three million elected representatives. Under the Right to Information (RTI) Act, 2005, they are all supposed to provide all kinds of constituency-related information to voters. Yet, hardly anyone has an official website. The minister replied: “It is more a matter of adoption of technology or media rather than that of policy. For example, I have my own website and others could also develop theirs and their constituency’s websites.” I googled the minister’s name; the website he said he has does not show up on the first few search pages. There is, however, an up-to-date Wikipedia page on him, which carries a link to his website kapilsibalmp.com. I clicked on the link and came up with an error message. I similarly searched for the two junior IT and communication ministers—Sachin Pilot and Gurudas Kamat. Pilot, too, has a Wikipedia page, while his personal website, sachinpilot.com, shows it is under maintenance. Googling Kamat gave me his personal website, gurudaskamat.com, as the first link, but the site is still in 2009 election mode—appealing people to vote for him. Several other elected representatives, particularly young parliamentarians, also have websites, but they almost invariably have the dot-com extension, which is typically meant for commercial activities. I wonder why elected representatives will use such an extension. It indicates the websites are just personal initiatives, not the official websites of the constituencies or the representatives. It also shows why it is important to have a policy that obliges elected representatives to put online all official information that can be of use to their constituency members. Such websites can serve as online gateways to these constituencies, allowing representatives to showcase the work they are doing and interact with their voters without meeting them physically. Several years ago, I had said the same thing to Pilot. He agreed, but told me the member of Parliament local area development (MPLAD) fund—given to every MP for development work in their constituencies—does not have provisions for such expenditure. I offered to do it through the Digital Empowerment Foundation if he could help us get all the information. Pilot invited me to accompany him to his constituency, to collect information and witness the ground realities, so they could be reflected in the website. We built the parliamentary constituency website as an example for others. IT has changed the world over the past two decades and helped India come on a par with the developed world in a number of ways. But for the country to reap the benefits of IT optimally, it is imperative for the government to adapt to the information revolution and for elected representatives to make information easily available to people online. Experience shows this will only happen through changes in policy.

As reported by D N Divakar on expressindia.com on 16 February 2008: College accused of embezzling Rs 9L from MPLAD grant College accused of embezzling Rs 9L from MPLAD grant Ambala, February 15 The Block Development Officer, Barara, reported an embezzlement of Rs nine lakh under the MPLAD grant, by the management of MPN College, Mullana, to the Deputy Commissioner (DC), Ambala, today. According to DC Mohammad Shayin, a grant of Rs 12 lakh was given to M P N College in the year 2006-07, for purchase of 20 computers, books for the library and equipment for the gymnasium. In the inquiry report submitted to him, it was stated that only 12 computers, costing about Rs three lakh, were purchased. The books and gymnasium equipment were not bought and only cheques were delivered to the firms. The irregularities came to light after a resident of Mullana, Sat Pal, sought the information under the RTI Act. The District Administration then ordered an inquiry on his complaint, which was conducted by the Barara BDPO. Meanwhile, the library incharge of the college, Mohinder Pal Singh, said he had no knowledge of the grant and neither was any equipment purchased for the gymnasium. He said the utilisation of the grant was the responsibilty of the disbursing officer, for which the principal, Ashima Joshi, was ultimately accountable. He added that the president of the college, Major Swaraj Paul, was also not discharging his duties properly towards the functioning of the college. Complaining about the faulty management, he said the college may be taken over by the district administration in order to save the career of the students. He added that a criminal case was being framed against the principal on the basis of the contents of the report.
