INDORE: A fresh trouble is brewing in Indore Municipal Corporation (IMC), already dented after conviction of mayor-in-council (MiC) member and BJP corporator Suraj Kero in a decade-old corruption case, with irregularities surfacing in revenue collections in collusion with civic officials. An RTI query has exposed a scam in revenue collection by certain zonal offices of IMC which caused a loss of around Rs 50 crore to the exchequer in last few years. Documents procured through RTI filed by Rajendra K Gupta exposed irregularities in revenue collection at four zonal offices of IMC including Vijay Nagar (zone-8), Pancham Ki Phel (zone-9), Saket zone (zone-10) and Stadium zone (zone-11).   2. Hello, Dear All, I am residing at Pune,off Pune Sinhgad Road, Near Damodar Nagar. I am paying Pune Numicipal Corporation tax for last 5 years and more for my residential property. I have applied for the revaluation of the property tax to Pune Municipal Corporation around 4 year back based on the tax assessment of my fellow flat holders assessment. Till today my application has not been considered. How can I get myself satisfied that the tax I am paying is as per the standard practices and am ot paying extra tax.
  3. Sheikh Saleem Srinagar, April 15: Illegal appointments and irregularities in GP Fund distribution have come to fore in municipal committees of Kokernag and Doru Shahabad in an RTI reply. The officers of these municipal committees have been paying salary to the illegal appointees from the GP fund of regular employees. In a written reply to few questions by a student under RTI, (copy of which is with Rising Kashmir) it has come to fore that dozens of class IV employees have been illegally appointed by the officials despite ban by the Department of Urban Local Bodies. The officials have been paying their salaries from the provident fund of the permanent employees as the officials have not deposited the GP fund of more than one million rupees in the treasury. The Orders of the PSIC are as follows : Appeal Case no. 174/2015 I would like to make couple of more specific suggestions ( read as directions) which would arm your PIOs with soft skills to dispose of the RTI applications. I understand that there are in all nearly two dozen PIOs and nearly the same number of APIOs in the MC, Ludhiana and number of others who are assigned duties related to RTI Act. Instead of deputing any officials on such a job, I strongly recommend that these officers are properly trained first. To begin with, I would advise that all of the PIOs and APIOs should undergo 15 days’ on-line certificate course from Centre for Good Governance, Hyderabad, (Andhra Pradesh) which would be possible without disturbing the routine functioning of the public authority or officials. This training would change their mind set with respect to RTI or RTI activist which I have discovered is very negative as information seekers are perceived by officials as trouble makers, mischief mongers, black mailers and necessary evil. Also, it would help them in better and systematically responding to the RTI applications as per the provisions of the RTI Act. Besides, a number of public authorities have adopted certain practices in the country that have resulted in greater transparency and accountability and the DoPT, Government of India has already published a a compendium of “Best Practices on implementation of RTI Act”. I would like to specially mention of SARTHI (System of Assisting Residents and Tourists through Helpline Information” adopted by Pimpri Chinchwad Municipal Corporation, Maharashtra and of “RTI Library” an initiative introduced by Pune Municipal Corporation , Maharashtra. Pimpri Chinchwad is spread over 177 sq. km while its population is 17.30 lakh (as per Census 2011) which is close to Ludhiana with an area of 157 sq km and a population of 16 lakh. Pune Municipal Corporation is far bigger as it covers much more area, having more population and far more and more complex demographic composition. Besides, the citizenry in Pune is certainly far more active and demanding than that of Ludhiana . Therefore, Ludhiana can learn a lot from these two cities. A sketchy detail is available in this compendium which can be easily downloaded and studied. Moreover, implementation of Delhi Municipal Corporation, trifurcated some years ago, should be studied as to how these urban bodies have responded to the gigantic task of responding to the information needs of the their citizens. I am not proposing to replicate DMC or PMC models by any stretch of imagination but only focusing on the fact that Ludhiana too can evolve its own model suiting its own challenges. These success stories of Pimpri Chinchwad, Pune or Delhi could of immense value while evolving a system to answer the information needs of the biggest city of Punjab State. The undersigned Commissioner would also like to issue couple of specific directions which must be immediately implemented without fail and the head of the public authority i.e. Municipal Commissioner must ensure that these are complied with immediately. 1) In its notice of hearing, the undersigned commissioner has introduced para 3(b) along with 3(a). In reply to the notice of hearing, PIOs must comply with this direction. 2) Though there is no format prescribed for responding to the RTI request yet all such responses should have the following ingredients: i) Name, designation, official telephone number and email address of the PIO. ii) In case the information is denied, then detailed reasons for quoting the relevant sections of RTI Act should be mentioned besides a speaking order of denial. iii) In case, the information pertains to another public authority and the RTI request is transferred u/s 6(3), then details of the public authority including his official telephone and address be clearly mentioned. iv) In the concluding para, of the reply, there should be clearly mentioned that the First Appeal, if any, against the reply of PIO be made to the First Appellate Authority should be mentioned. v) Name, designation, address official phone number and email address of the First Appellate authority should be mentioned. vi) Whenever the appellant has requested for certified copies of documents/ records, then the documents should carry the signature of the public authority above the seal containing name of the officer, PIO ( instead of designation) and name of the public authority. These directions should be strictly adhered to as these are in consonance with the instructions issued on March 17, 2015 by DoPT (Department of Personnel and Training), Ministry of Personnel and Grievances ,Pensions. Hello, I want to apply an RTI for the municipal solid waste management regarding its regular inspection, system of disposal-collection, budget allocated etc in my city(shahdol, m.p) as my area's condition in terms of pollution and solid waste is getting worse. Several health problems and environmental issues are left unsupervised here. There is no regular solid waste management system in the area. Can you help for getting a draft sample for it, under which ministry and department I have to apply ?

I've filed several RTI's on an encroachment in the name of religion.The encroachment(temple on municipal land) exists for last 4 yrs.However corporation PIO replied that encroachment existed for last 15 yrs.He also stated corporation never received any complaint for last 15 yrs and I was the first complainant in year 2015.He is giving false information in RTI reply.I'd like to shoot questions in RTI that would make the PIO speak the truth. Please suggest possible questions I could ask to make the PIO reply that the encroachment existed for last 4 yrs only.The encroachment has got a power supply connection(EB) and water supply connection from corporation. I'd like to get the above information without going for 1 st appeal. Please help

  9. Hello, Around 2 years ago, I have demolished my english tiled and tin shed house measuring 109 sq yards and constructed a G+1 cement building non commercial no rental income. The tax has been raised from 700 rs to 3000 rs per year. The steep increase the tax collector says because i had applied for municipal permission for house construction. There are houses adjacent to me which are atleast 300 sq yards G + 2 who are paying the tax at 500 rs per year, and have not taken permission at the time for construction. It looks i am being punished for following rules and regulations and being a responsible citizen. Please advise how should i resolve the issue Thanks for reading and helping. Regards Moin

  12. Hi All, I have a query and would require your guidance for the same. Is RTI Act applicable on all the states and Goverment offices in the same manner. Ex:- I have asked certain information from Mumbai Municipal corporation , kolkata municipal corporation and Delhi municipal corporation. Mumbai municipal corporation provided me the desired information after paying the fees asked by them however the same information was denied by the other two. Now first query is that are they allowed to deny me information when one municipal corporation has already furnished the desired information. Secondly does it make my case stronger during first appeal as I have recieved information from one municipal corporation but denied by other two.

    Hi All, I have sent an application to Cuttack Municipal Corporation and they have rejected my application mentioning photo identity proof of the applicant is not attached. Are they allowed to do so??? I wish to know that is it necessary to disclose the information of the applicant for filling an RTI application??
  14. My RTI query revealed in 2006 that not a single cattle owner has taken license for a cattle shed from the MCC or Mysore City Corporation. I'd filed a specific RTI query w.r.t. one of the stray cattle owners who is harassing me since 2004 by bringing his cattle 1.5 Kms away from our corner site residence and letting them lose from dawn to dusk at the vacant corner site that is opposite to us. After I filed a first appeal with the Karnataka Information Commission / Commissioner or KIC I got a reply from the then Municipal / Corporation Commissioner that this particular nuisancer had not obtained any licence / license. The office superintendent of the health section confirmed telephonically that no one in the entire city of Mysore has taken a license to own a cattle-shed or cattleshed. I think this is the case in the most or almost all the municipalities in the entire state / country which is the root cause of the stray cattle menace in the Indian cities or urban India. High pendency killing RTI Act, says activist by Viju B ,TNN, 13 Oct 2008, Times of India MUMBAI: In the three years of its existence, the Right to Information (RTI) Act has been effectively used by lakhs of citizens to bring about changes in their everyday lives. In Maharashtra, the Act has been a runaway success with around 3.7 lakh citizens filing RTI queries in the last three years. "The RTI Act has made a positive impact on the lives of people like no other Act has done before. More and more people are filing RTI queries to procure information , which was earlier denied by government officials,'' said Shailesh Gandhi, information commissioner with the Central Information Commission, from Delhi. RTI activists and citizens, however , say the rising pendency of second appeals is a cause for concern. An applicant is forced to file a second appeal after both the public information officer (PIO) and the first appellate authority deny the information on flimsy grounds. "The high pendency of appeals is slowly killing the act. Applicants have to wait for more than a year for a hearing of their second appeals ,'' said Bhaskar Prabhu of Mahiti Adhikar Manch, an NGO dealing with RTI-related issues. The six information commissions in Maharashtra had 16,866 appeals pending till the end of June this year, with Mumbai alone having 4,818 such pleas. Activists say the problem of pendency can be dealt with effectively if the information commissioners dispose of 150 appeals on an average every month. "The current disposal rate is way below the mark and this is the reason behind the rising number of appeals,'' said Prabhu. Gandhi, who looks after appeals pertaining to the Municipal Corporation of Delhi (MCD), has disposed of 50 pleas in three-and-a-half days. "I am doing it even though I have been given just two staff members to assist me,'' says Gandhi. The CIC has around 8,500 second appeals pending for disposal. A senior SIC official said a number of first appeals were rejected in blatant violation of the RTI Act. "Recently , a municipal ward officer was hauled up after he did not even bother to hear 67 RTI appeals. We hope the first appellate authority provides accurate information so that the applicant does not have to file a second appeal,'' the official added.
