An NGO - Jagriti Welfare Society, wrote to the Governor suggesting that that to facilitate the RTI to every citizen, the UP government should follow Maharastra government where one SIC is posted in every divisional headquarter of the state. The NGO said that presently 10 posts of SIC and one of Chief SIC was sanctioned in UP and out of this, eight SIC and one Chief SIC were presently posted but they sit in Lucknow. The NGO reasoned that since all top officials sit in the state capital so activists and general public seeking RTI replies have to come to Lucknow to pursue appeals against delay with Information Commissioners. The NGO said that if like Maharastra, SICs were posted at divisional headquarters, then making appeal under the RTI would become easier and money and time of government officers could also be saved. Under the present set-up, Information Officers of various departments claim Traveli and Dearness Allowance for coming to Lucknow and attend appeals. Sources said that Governor Ram Naik after going through the request wrote to the state government to look whether the Maharastra model was feasible in Uttar Pradesh or not.

    NGO under RTI

    Continuing the earlier decision, the CIC has confirmed again that minimum 10% of funds should be received by an NGO from the Government, for an NGO to come under RTI. "It would be pertinent to mention here that amount one crore or above or 5% of their portfolio is not worth to be construed as substantially funded or not. But what should be the criteria to be construed as substantially financed, will be such percentage which would not be seen as such but it should be actually substantially financed in a real sense by taking all other financial aspect of a particular NGO that may differ case to case. It is immaterial whether it is 10%, 20% or 30% etc. but definitely not below 10% of total overall financial portfolio of the particular NGO."- CIC The Right to Information Act does not provide any guidance with regard to what is meant by 'substantially financed'. The Oxford English Dictionary defines the word substantial as 'of considerable importance, size or worth'. A determination therefore has to be made of what amount of finance to an organization is 'of considerable importance' for it to come within the ambit of Section 2(h) NGO under RTI In an order wherein the Senior Citizens Welfare Association was the respondent, CIC has set specific figures for the word "substantial" as appearing in Sec 2(h) of the RTI ACT: I propose that if 10% of the revenue of an organization comes from government funding, it should be considered to be ‘substantially financed’. Thus, if a body receives a minimum of Rs. 5 lacs and this amount constitutes over ten percent of its annual income, the body can be considered to be ‘substantially funded’ for the purposes of the Right to Information Act, and would be considered to be a Public authority. While obtaining information regarding details of selected candidates of economically weaker sections (EWS) from Doon Public School the PIO alleged that RTI Applicant has threatened her saying that “My dekhunga, my kuch karunga” and that applicant is not having any public interest behind his RTI applications. The RTI applicant denied all the allegations made by the officer and further stated that he is heading an NGO and all his activities are for public interest. The Commission having heard the submissions and perused the record directed the PIO/Education, West­ B District to provide point wise revised information to the appellant. It was alleged that Student who are given admission under EWS category, are being asked by the school to pay donations He also alleged that lot of stationery and uniform meant for free ­distribution to the EWS students is not being accounted for by the school.   5. In response to a RTI query to the Maharashtra electricityboard, there was a funny reply stating that information I asked for can begiven or provided to an individual only and not to and NGO. Can anyoneenlighten me regarding any such clause stated in the act? If it is so by which clauseor subclause the machinery is, specifically, if it is, government undertaking forconsumers which is answerable to the public at large whether it is anindividual or a NGO.

    RTI to NGO in Mumbai

    I had asked for Information from an NGO registered under BPT Act . I was initially replied that my application is more than 250 words . Then i refiled modified application and they replied we do not come under the purview of the Act Information was sought under RTI Act of 2005 amendment in 2007 stating NGO’s substantially financed directly or indirectly by funds provided by the appropriate Government. I had seeked information as All India Balkanji Bari comes under the RTI act Purview as a. It is located on collectors Land b. It Recieves Government Grants for Running Ashramshala. In the year ended 31 March 2012 they have received a grant of approx Rs 81 lakhs from the project office Dahanu their total expense in Ashramshala is approx 91 lakhs. Can anyone please help

As reported by Supriya Shelar Govt AIDS helpline only rings on paper: RTI PUNE: The priority of the State government to fight AIDS can be measured by the fact that it’s authorised helpline to provide information about the deadly disease has been closed down for the last seven years. The toll-free helpline 1097 on HIV/AIDS that was launched by the Maharashtra State AIDS Control Society (MSACS) in 1999 has been out of service since last seven years even though advertisements about the facility are regularly being published on various vernacular newspapers, claimed a city-based NGO Muktaa. Making you know and talk about AIDS (Muktaa), a voluntary initiative by city-based non-government organisation Maitri, has been working for the cause of HIV and AIDS awareness since the last three years. It also runs a helpline 25460102. Kishore Dhage, a volunteer of Muktaa helpline, filed an application under RTI Act seeking information about government’s initiative for AIDS control. The reply to the application that was filed in August was received last month. It stated that the 1097 helpline has been closed due to some technical problems. “Considering the need to organise educational and awareness programmes on HIV/ AIDS along with counselling by experts, there should be a government-run helpline also. The MSACS has been established for control of HIV/AIDS. Then why the annual budget has been spent on advertisements of a helpline which does not exist?” Kishore asked. When contacted, the MSACS officials said that the National AIDS Control Organisation (NACO) would soon launch a new service with the same number which would be same countrywide. However, when asked about publishing of advertisements, the project director of MSACS, P R Sabde, pledged ignorance saying that currently he is on election duty at Rajasthan and unaware about status of helpline. Despite being dissatisfied with the shutting down of helpline, the volunteers of Muktaa helpline are firm on following the matter seriously.

As reported by ddnews.gov.in on 18 November 2008: Do not give Govt funds to NGOs without RTI mechanism: CIC The CIC on Tuesday directed the government to release funds to NGOs only after ensuring they have a RTI mechanism in place. In a full-bench hearing chaired by Chief Information Commissioner Wajahat Habibullah the commission said "Government should direct the NGOs to set up the RTI system while sanctioning the funds. Before releasing any funds, it should be ensured that the system is in place." Under the RTI Act, any NGO which gets funding from Government is considered a Public Authority and is supposed to have proper RTI infrastructure in place including a Central Public Information Officer, an appellate authority and complaint redressal system. The three-member commission was hearing a plea filed by Suman Bakshi, an employee of Family Planning Association of India an NGO funded by the Delhi government. Bakshi had filed the plea with the Delhi government and FPAI regarding the alleged discrepancies in payment made to her by the NGO. "The FPAI is funded by the government and we are given payments on government employees scale. The association did not pay me arrears for the fourth pay commission. I wanted to know from Delhi Government and the organisation about that," said Suman Bakshi while speaking to news agency over phone. An ailing Bakshi could not attend the hearing as she recently underwent surgery for a spine ailment. "I had requested the CIC to call both the respondents Delhi government and FPAI to provide me the details but they are calling only Delhi government," she said. "We got information from FPAI and forwarded it to Bakshi. We get funds from the Union Ministry of Health and forward it to NGOs. We do not have any say in their internal administrative matters," said a representative of the Delhi Government before the Commission. When the Commission asked about the RTI infrastructure at FPAI, he could not confirm whether the NGO has a Central Public Information Officer to answer queries directed at it. "Government should be directed to release the funds only after ensuring that an RTI system in place at any NGO," observed the CIC.

    Hi All, Just joined to this Forum. Have some questions - and of course answers. Q1. Whatever we post here - does it go to the PIO and get an answer ? Q2. What is the objective of this site ? I guess, online RTI - if not can we make our aim like that ? Can we also not bring the PIO logged in as a user to this site and make everything online to the extent possible ? It should be offline only where the user does not want / know / does not have access to INternet. Q3. The information present in this site is growing at high speed - searching will soon get an issue. Do you need help from software developer ? Q4.I belive NGOs are associated with RTI - a citizen should be able to identify an NGO and communicate using this site ? Wish a good day to everyone. By KPM Basheer in The Hindu - Online The Hindu : Kerala / Kochi News : NGOs liable to answer RTI queries NGOs liable to answer RTI queries Even partial State aid makes them accountable to the public SIC says when an NGO is given aid for specific projects, RTI applies to only that project NGOs should designate information officers to answer public queries KOCHI: Non-Government organisations (NGO) receiving government grants or aid for specific projects come under the Right to Information (RTI) Act and are required to provide information to the public under the Act. They also need to designate information officers to answer the public’s queries, the State Information Commission (SIC) has ruled. In a recent precedent-setting order, the SIC held that any NGO receiving government aid — even if the aid is for a specific project— was liable to provide information sought by the members of the public. The order, issued by the State Chief Information Commissioner and all the three State Information Commissioners, was on a petition against two NGOs who had refused to provide information on their spending of the government aid sought by S. Krishna Kumar of Vellanad. The NGOs, Mithranikethan and The Dale View, argued that since they had received government aid only for specific projects they were not liable to provide information to the public. The commission shot down the argument and ordered them to provide the information sought by the person and also to designate assistant public information officer, public information officer and appellate authority to deal with the public request for information. Inalienable right “The Commission found that access to information regarding public money cannot be denied to the members of the public under any circumstances,” the commissioners stated in the order. “The public have an inalienable right to know how the government money is spent and whether it is spent for the purposes for which it is provided and, if it is spent, also, the manner in which it is meant to be spent. Since these institutions have been receiving public funds and since they both have been working as implementing agencies of the government’s schemes and programmes, although for specific projects, they have to be deemed to be Public Authorities under section 2 (h) (ii) RTI Act to that extent.” ‘Public authority’ According to section 2 (h) (ii), ‘Public Authority’ means any authority or body or institution of self-government including “non-government organisation substantially financed directly or indirectly by funds provided by the appropriate government.” However, State Chief Information Commissioner Palat Mohandas clarified that when an NGO is given aid for specific projects, the RTI applies to only that project. Many NGOs get funding from variety of sources, including from overseas. The NGO could be deemed a public authority to the extent of government funding or to the specific project for which funding is provided. Aided colleges Aided colleges, run by the Christian Church and other community organisations, also come under the definition of ‘public authority’ and are hence required to provide information to the public. Aided colleges receive hundreds of crores of State government money every year. However, an earlier order issued by the commission on the application of RTI to aided private colleges has been challenged in the High Court. A single judge’s verdict that upheld the commission’s stand has now been challenged before a larger Bench.
  18. Nawanshehar NGO tries RTI Act on Punjab MLA's performance NAWANSHEHAR: Elected Repersentatives! Sit up and work as your own performance as MLA, MP or minister is now open to public scrutiny, thanks to the Right to Information Act, 2005 which has empowered the common man to the hilt. The Nawanshahr-based Human Empowerment League of Punjab (HELP) has shown this by getting information about the performance of all the three MLAs-Jatinder Singh Kariha, Mohan Lal Behram and Chaudhary Nand Lal, all Akalis- representing the district, under the Act. The organisation had sought from the Punjab Vidhan Sabha Secretariat as to what were the questions posed by these MLAs during the previous two sessions of the Sabha and how much time they had spent in Vidhan Sabha during the sessions. According to information received from the Secretariat, Nawanshahr MLA Jatinder Singh Kariha had given notices for 21 questions out of which eight were orally answered on the floor of the house while three were replied separately. Four notices of questions were not put, five were disallowed and reply of one question was not received, says the information provided by PIO, Punjab Vidhan Sabha, Chandigarh. As to the questions, Kariha had sought information about the total area of land belonging to historical Baradari constructed by Maharaja Ranjit Singh along with the area of its land under unauthorised occupation at present. Kariha had also asked whether there was any proposal under the consideration of the government to set up a museum in the name of the Maharaja in the Baradari complex. Kariha had also asked questions related to Desilting of Bist Doab Canal, steps being taken by the government to check accidents caused by dead trees along the main roads in the district, creation of posts at the district headquarters after the elevation of the town as district, availability of artificial semen in veterinary dispensaries in the state, details of the steps to improve the breed of milch cattle, upgradation of civil hospital in Nawanshahr, reinstatement of Panchayat Secretaries during the period 2002-06 and whether there was any proposal to run a separate institute of higher education in the field of IT in the premises of local ITI. Except for the last day of session in March, Kariha remained present in the house during the sessions. The list of questions asked by Balachaur MLA Chaudhary Nand Lal included information about the installation of new tubewells and release of power questions to the tubewells for irrigation in his constituency, whether there was any proposal to open a government college in Balachaur and whether there were any plans to lay a sewerage system in the town. Lal who remained present throughout both the sessions, had also sought to know whether the state government was aware of the damaging of crops by stray animals in his constituency. Lal who is a Chief Parliamentary Secretary in the Badal government, had asked six questions during the first session out of which four were orally answered on the floor of the house, one was disallowed and one lapsed. Lal too was present on all the days during both the sessions. Banga MLA Chaudhary Mohal Lal, served notices for a total of sixteen questions out of which eight were answered orally on the floor of the house. Three were answered separately, four were disallowed and notice of question was not put for one. The questions put up by this MLA included whether there was any proposal to upgrade Banga as sub-division, any plans to repair some roads in his constituency and any plans to accord Nagar Panchayat status to Apra and Behram towns. Mohal Lal too attended all the sessions of the Vidhan Sabha. According to HELP activists Gurvir Singh, Charanjit Singh Bheen and Parvinder Singh Kittna while some people considered the performance of their MLAs as satisfactory, others considered them a "waste of time". Some social activists however, rued that no questions were asked related to social issues like female foeticide, drugs and problems like increasing traffic congestion in the district. But I would like all of you to know that a NGO in India has enacted, on the basis of RTI Act an Ordinance in its Constitution and that too inspired by our RTIindia.org, members and team discussions etc. It is a great achievement for us indeed that an Non Government Organization has enacted the soul and body of RTI Act 2005, in its constitution..And in constitution in particular becasue any NGO Is answerable to the Government and Public when it comes to its rules and regulations, by-laws etc in Constitution...So by enacting the same in the constitution the NGO would also be answerable as far as RTI ordinance as enacted by them is concerned The ngo is Sweearindia....link Sweear India Cheers for all of us..rtiindia.org team and the NGO Abhinav
