  1. Dear All, I have been behind authorities in NOIDA for some time now. They have tried not to answer my RTI on this subject twice. Earlier this was because of information not pertaining to our department (i used section 6(3) this time). This time they seems to have found new way. I fail to understand what they actually mean here. Could someone please help me understand this and suggest steps ahead. Here is the reply: Background: We filed a complaint and few reminders to CEO, NOIDA Authority. They did not reply to complaint for 6 months. So we filed following RTI: Questions asked: 1.Date of receipt by my complaint (Appendix A & B) in the office of NOIDA Authority and inward number. 2.Daily progress on my complaint from date of receipt till date of this RTI application. 3.Names, designations, and office addresses of officials with whom my representations were lying during this period and date wise period with each official and details of action taken by him/her. 4. Evidence of receipt and dispatch of my application in the offices of each of these officials. 5.Number of days within which matter of representation should have been resolved according to rules or citizens charter or any other order or public service enactment. Please also provide a copy thereof. 6. Details of action taken by the controlling authority against erring employees, if employees have not adhered to time limit mentioned in rules. 7.If no action has been initiated as above, reasons on record be made known to me, with name, designation and contact details of controlling authority of these employees. [Ref: section 4.1.d of RTI Act]. 8. Present status and date by which this matter will be completely resolved. 9. File notings, if any held on my said representations. 10. Number of complaints received by NOIDA in last one year against the builder/ developer on similar subject. 11.Name, designation and address of Nodal Officer designated to receive and decide on notices under section 80 of CPC relating to your office. 12. Name, designation of head of vigilance department, his address, email Id and phone/mobile number to whom complaint can be lodged by me against your office. 13. Please permit me inspection of relevant records with assistant of my choice. 14.Incase I am not satisfied with your reply then the contact details of the first appellate authority who can be approached for filing the first appeal. regards!

    Hello All Actually I own a flat in a group housing project located in noida. Builder has delayed the project and also refusing to pay delay penalty stating that due to Natonal green tribunal order that no construction activity shall be allowed in 10 KM radius of Okhla Bird Sanctuary it is dealyed. I qm sure builder is lying. For that Noida authority had submitted a list of all projects falling in this range to national green tribunal. I need to know wheteher my project was part of that list or not? Please suggest how shall i frame a question. Can I directly ask whether this project flls in that list or not?? Or should I ask them to provide that complete list but I doubt it may be reject as it may cause harm to so many thid paties(builders)
  4. Dear All, I am putting forward a general query. With hundreds of builders duping home buyers in Noida, Uttar Pradesh, a lot them have resorted to filing RTIs. However, the authority is bring adventures and not providing information properly. Here are some of the examples : 1. Delaying the response. 2. Giving half or incomplete information. 3. Not replying to crucial RTIs. 4. Saving builder by hiding information quoting third party information. 5. Delaying by saying information belong to other departments despite mentioning section 6(3) in application. The list doesn't end. I know we always have options to go higher up but that takes time. We are not talking about individual RTIs but an authority being notorious and mocking rti Act all together. What are the options we as a group have to handle the authority once in for all.   5. Hello, We filed our first RTI to NOIDA Authority seeking information regarding one of the housing project. We were seeking copies of layout plans approved by authority for a private builder. Now authority replied after 30 days (Aug 8th, 2013) stating that this is third party information and a letter is being sent to third party for appeal/NOC. Additionally authority did not reply to 3 of RTI applications out of 6 that we had filed. We are o the edge of unearthing a major scam in Noida and we know they are deliberately trying not to provide us information. Attached is the RTI reply in image : My question to all experts here are: 1) Do you think layout plans approved by authority for a private builder is third party information? 2) How much time can they really take replying to our application? 3) As NOIDA has not replied to 3 of our applications, what should be our action plan? Please suggest if this query should have been posted in another thread as i am a novice here and in RTI world too.

Noida activists demand green clearance for mobile towers NOIDA: Though the Noida Authority has announced specific guidelines for telecom towers, city-based environmental activists said the most crucial step in setting up of a mobile tower - seeking clearances from the Pollution Control Board - is missing. "According to an RTI response, none of the towers in Noida or Greater Noida have environmental clearances. We demand that all the towers in the city be checked for valid pollution and environmental clearances," environmental activist, Vikrant Tongad, Social Action for Forests And Environment, said. In a public notice issued on Saturday, the Noida Authority has warned that if not removed within a stipulated period, the mobile phone towers would be forcefully knocked down, and the properties on which they are installed would also face cancellation of allotment. According to officials, all mobile towers in the city are to be installed as per a Noida Authority policy framed in November 2013. The policy states that cell phone towers can be installed in community centres, green belts and shopping centres, but not on roofs of hospitals, schools and nursing homes. They can, however, be set up on the roofs of institutional, industrial and commercial buildings, said officials. In January 2012, the Allahabad High Court had banned the installation of new towers in residential areas, following which, the Noida Authority in November 2013, had formulated the policy and thereafter undertook the relocation of all existing towers from residential areas of the city. "We have been sustaining an awareness campaign against the installation of mobile towers within the proximity of schools, residences, hospitals and more. While these cities are already choc-a-bloc with towers, there are over 200 applications still pending with the authorities who want to set up these towers. We appeal to the citizens as well as the authorities to exercise caution in adding any more towers to these cities," Tongad added.   8. Hi, I had got my son admitted to Amity International School, Noida in Oct-11 for Nursery. But due to various reasons, I got his admission cancelled and requested for fees refund in the first week of Feb-12. Despite numerous calls and emails to the school authorities (accounts, principal and her secretary, chairperson and her secretary), nothing has moved. Every time the answer is "wait for 10-15 days". Can you pls guide if filing an RTI can help? Where can I file an RTI and what is the process? This is my last hope before I think of taking any legal action. Thanks & regards
  9. I would like to know whether Prateek Stylome project located in Sector-45, NOIDA UP approved legally. Can NOIDA authority provided approval status of this project? I would like to know that this project followed all NOIDA authority guidelines and aligned with NOIDA 2021 plan. Is this project acquired all goverment approvals before launch.

    Noida land prices up 200 times in 20 yrs

    As reported at financialexpress.com on 16 June 2009 New Delhi: Property prices in Noida have skyrocketed about 200 times in the past two decades, reveals an RTI reply. Residential plots in all sectors of Noida, which were available at a price of Rs 175 per square metre in 1980, have now spiralled to Rs 39,600 per square metre in some sectors of the township, said the reply. The highest surge has come in sectors 14, 14A, 15A, 17 and 44, the reply said. As per official records, residential land in other sectors is available in the range of Rs 14,400 per square metre and Rs 27,600 per square metre. Exercising his right to information, an RTI activist, Lokesh Batra, has filed an application with the New Okhla Industrial Development Authority (Noida), asking it to furnish information on categories for which the authority is selling or allotting land and regarding the prices of plots as per the record. The authority is selling land under five categories -- residential land, residential group housing, industrial land, commercial land and institutional land. There is a definite procedure for fixing and revising land allotment rates for various sectors. "For industrial and other institutional activities, land cost is subsidised. For commercial land, prices are fixed on ad hoc basis keeping in view the market rates," the reply said. Industrial allotment rates of Noida have risen over 350 times to Rs 14,400 per square metre from Rs 40 per square metre since 1976. Land in first, second and third phase of Noida was available at Rs 40 per square metre in 1976, which has now touched Rs 14,400 per square metre for phase I, Rs 5,550 for phase II and Rs 5,750 in phase III, the reply said.     Case boomerangs on dowry givers

    As reported by Case boomerangs on dowry givers- Hindustan Times This may act as a reminder that “giving” dowry is also an offence. In perhaps the first of its kind case, a Noida court has ordered the registration of a criminal case against a woman, her parents and brother for allegedly giving dowry. The Noida chief judicial magistrate ordered the registration of an FIR against Sarita (name changed) and her family members after her husband Hari (name changed) filed a complaint alleging that they were trying to extort money by filing a dowry demand case against him. Hari is an engineer. Hari, who spent a week in jail after the allegation, said the police did not verify the financial background of his in-laws who claimed they had given Rs 12 lakh and a Maruti Alto as dowry to him. Hari also contended that, in any case, dowry-givers are considered accomplices under the Dowry Prohibition Act. Hari used the Right to Information (RTI) Act to challenge his wife’s claim and the police’s refusal to register a case on his complaint. The RTI reply showed that the police registered the case against Hari on the verbal complaint of Sarita and that the charges against him were never verified, his counsel Pradeep Nawari said. The Delhi High Court had recently said women or their parents who go ahead with marriage despite dowry demands from the bridegroom’s side would have to be seen as “accomplices to the crime” and “will face prosecution” under the Dowry Prohibition Act.

Authority has little to say Greater NOIDA, August 10 The farmers of Greater Noida’s Bisrakh village have received fresh ammunition in their movement against the Greater Noida Authority’s decision to acquire their ancestral land. The new lead has come from the Right To Information Act: an application has revealed that the planners do not know of what is to come up on the farmers’ land. Applicant Rampal Bhati, a resident of Bisrakh, had filed the RTI on April 16, asking the Authority about its plans for his land which it had wanted to acquire. “The Authority has notified the land as illegal without knowing that this is our ancestral land. My father is literate and he used the RTI Act. We tilled our fields and this is all we had,” said Karan Singh Bhati, his son. But much to the surprise of Rampal, the reply he received was as vague as the Authority’s claim on his land. It read: “For the RTI you have filed about the land, we have to inform you that we do not have any ‘exact superimposition’ map and thus cannot make available the information you require.” According to Karan Singh, the Greater Noida Authority had wanted the land for development. “But we know they did not have any plan for opening hospitals and schools. They will sell our ancestral land to builders,” he said. Chairman, Greater Noida Authority, Lalit Srivastava, said they do have a Masterplan for the land. “Notices for land acquisition are sent only when the Masterplan is ready. There are times when the applicant does not ask for the right information,” he said. But his reply was a direct contradiction of the Authority’s reply — which clearly mentioned that it does not have the superimposition map, which is the basis for preparing a planned map. “A superimposition map is an actual revenue map of a village, which is compared to the planned map. When the boundaries of revenue and planned map do not match, we reframe the planned map for the area,” Srivastava said. With the RTI response to the Bhatis, suspicions are rife about the Authority’s decision to acquire the village land, which, according to the farmers, is their ancestral property.

As reported by Sapna Verma of TNN in timesofindia.indiatimes.com on 03 June 2008: '46 Gzb, Noida kids go missing in 60 days'-Delhi-Cities-The Times of India '46 Gzb, Noida kids go missing in 60 days' NEW DELHI: More than 46 children have gone missing in Ghaziabad and Noida in the last two months. This is claimed by an NGO, Naujawan Bharat Sabha, which has alleged a huge trafficking racket, in a report. The report is based on the figures obtained under the RTI Act. The maximum cases are reported from Nandgram, Harsh Vihar, Vijaynagar, Pratap Vihar, Sanjay Nagar, Raeespur, Mirzapur, Rahul Vihar, Khoda Tigri, Khadda, Arthala, Viklang colony, Ghukna, Deendayal Puri, Salarputi, Karheda, Shyam Park Extn, Budh Vihar, Navada, Pyarelal colony in Ghaziabad and Bhangel, Bishanpura, Mamura, Chotpur, Chhijarsi areas of Noida. The report says that most of these children are from poor families, and when they complained to cops, it was alleged, they were turned away both in Noida and Ghaziabad. Nithari in Noida had witnessed a similar disappearance of children till the story of Surendra Koli and Moninder Singh Pandher emerged. The CBI is now investigating the matter. President of the NGO Tapish Maindola said," We have urged the Ghaziabad DM to take immediate action, but the attitude of the police remains negligent despite cases like Nithari. We demand that CBI take strict action against the police." The report says India is a target for criminals engaged in human trafficking for organs, child pornography and paedophiles. Gangs that abduct children for begging or selling them off are also active in NCR. Ghaziabad SSP Deepak Rattan said, "Till now, the cases registered have not pointed towards human trafficking and the like. After the Nithari case, we are cautious."
