akhilesh yadav posted a topic in RTI in MediaDenial of post retirement benefits Srinagar July 8: As State Forest Corporation (SFC) failed to provide information under RTI Act , about the payment of post retirement benefits which includes 6th pay commission arrears and DA to some of its employees , the State Information Commission (SIC) taking this matter seriously has now issued penalty show cause notices against two officers of the corporation who were held responsible to concealing the said information. Details available with Early Times reveal that one Hafiz Zahoor Jan, a resident of Alamdar colony Rawalpora filed an application under Section 6 of the J&K RTI Act, 2009 before the PIO, J&K, State Forest Corporation (SFC) on 12-11-2014, wherein he sought name and designation of the officers who were paid 6th pay commission arrears. The RTI applicant also sought name and designation of the officers who were paid D.A. arrears. The then PIO, JKSFC, Manzoor Ahmad Ahangar while invoking Section 5(4)(5) of the J&K RTI Act, 2009 sought assistance from Director Finance, J&K State Forest Corporation and Chief General Manager (Adm), J&K State Forest Corporation vide letter dated: 20-11-2014. In response to this communication, Chief General Manager (Adm), SFC vide letter dated: 26-11- 2014 informed the PIO that information so sought does not pertain to Administration Section. I complained(Copy of undersigned Complaint Enclosed): QUOTE " 1) There are no seats to sit for clients/litigants in Gurgaon District Courts and even for advocates which results In thronging the doors of the Court resulting in hampering Court Work; 2) Senior Citizens who are ill and physically challenged have no seating arrangements in District Courts in Gurgaon; 3) There are a couple of toilets in District Gurgaon Courts for a visiting citizens of around 2000 people daily which are so unhygienic that it is difficult to use these toilets: " ' 4) There is no litigant bench at district courts in Gurgaon; 5) There is no Case Status Display in District Courts; 6) The Courts are housed in bathrooms in District Gurgaon Court Complex thus living no space even to stand in these courts; 7) There is no ramp system for physically challenged citizens of Gurgaon in District Gurgaon Courts and no lift for elderly and physically challenged citizen's of Gurgaon to visit second floor Court rooms in Gurgaon District Courts. The above reasons contribute to human rights violations in District Courts in Gurgaon and-as such pray to Hon'bte Commission to pass appropriate orders under relevant section of the said Human Rights Act as deem fit by Hon'ble Commission." UNQUOTE The Hon'ble State Human Commission Haryana took cognizance of undersigned complaint bearing number 1064 of 2014 and on hearing held on 13th Oct 2014 and issued notice to Deputy Commissioner, Gurgaon for submission of reply/report in eight weeks and next date of hearing was fixed for 12th Feb 2015. (Copy of Order Enclosed) On 12th Feb 2015, the double Bench of Hon'ble Human Rights Commission ordered that in view of serious nature of Complaint, the Deputy Commissioner of Gurgaon to file reply/report within four weeks and next date of hearing on 08th May 2015.(Copy of Order Enclosed) The matter is of having larger public interest and is clear cut case of Human Rights Violations as the conditions in District Courts premises in Gurgaon is pathetic and situation there inhuman. The smoke over Mumbai sky and digging of hills in the city, observed by Information Commissioner Sridhar Acharyulu, while on a visit to Mumbai, was treated by him as a complaint under the RTI Act making .. akhilesh yadav posted a topic in RTI in MediaThe MP State Information Commission has taken a very stern view of the failure of the food and drugs administration (FDA) officials to provide information related to adulterated food under the right to information (RTI) Act and issued show-cause notices to three officers. During a hearing on Wednesday, information commissioner Atmadeep directed that show-cause notices should be issued to the chief medical and health officer (CMHO) of Bhind district Rakesh Sharma (who is also ex-officio deputy director, FDA) and food security officers of Ashu Kushwaha of Sagar and Shivraj Pawak of Hoshangabad. I have lodged a criminal complaint FIR U/S 420,467,468,471,120-B. For investigations of my complaint Income Tax Returns Of certain accused are required by the Police authorities. They have issued a notice to the Income Tax Department U/s 91 CrPC for providing the returns. But the Income Tax department has not furnished the returns to the police authorities till date (It has been over 15 Months since the first notice was issued by the Police to the Income Tax Department). An RTI was filed by me in the IT department to know the current status of the 2 Notices issued by the Police to the ITO as to what were the reasons for the delay,why was the IT department not supplying information to the Police, the persons responsible for sending the information to the Police, names of persons who have filed revised or scrutiny orders for their returns and when will the Notices be disposed off (by providing complete information to the Police authorities). I received a reply that the applicant is not entitled for such information which relates to personal information,the disclosure of which has no relationship with any public activity or public interest as in Sec 8(1)(j) of the RTI ACT. Please help me file a First Appeal as soon as possible. Thanks Kumarsaab
I have received 3 notices to attend for hearing from APSIC during the month of April, 2010. Two cases are to be heared by the Chief Information Commissioner, APSIC and in those 2 notices it is mentioned my 2nd appeal date and the respondent's name and address. But in the third notice, the case is to be heared by Sri Dilip Reddy, Information Commissioner in which there is no respondent' name and address but only mentioned my 2nd appeal date and APSIC's case number. As there is no respondent's name and address in the notice, the applicant has to verify the case number by going to Internet Centre and paying some amount. Is it possible to the applicants residing in the villages to go to Internet Centre which is in the nearest towns for this specific purpose. Please suggest how to request the APSIC to furnish the respondent' name and address in the notices issued to the cases to be heared by other 3 Information Commissioners.
