  1. Hello, I am from Kerala. Since there were some errors in the records after the resurvey, I have tried to obtain the field sketch and copies of BTR, TPR registers of my property from our village office through a RTI query. The field sketch needs A3 paper but other details can be given in A4 paper. In response to our RTI query, the information officer is asking me to pay Rs.253 for each copy of BTR, TPR registers and neglected the question for issuing field sketch copy. From the village office I could know that, the field sketch will cost around Rs. 550 and it will not be issued as per the Rs 2/- RTI fee. I had a similar experience from Central Survey Office, Trivandrum, In order to obtain two sketches (prior to resurvey) of our land of A3 paper size, I had to pay around Rs.1200/- !!! So, my questions are, 1. Are they not supposed to give copies of revenue records such as field sketch, copies of BTR, TPR registers at the charges mentioned in RTI act (like Rs.2 for A4)? OR Is revenue records exempted from RTI act?. 2. What is the fees for obtaining copies of documents with A3 size? Please advise. If you have have any links or rulings from the court on this, please share. Thanks for your time and Help, Raju

NAVI MUMBAI: A sub-registrar's office is functioning from the ground floor premises of a residential building in sector 19, although the building has not been given an Occupancy Certificate (OC). This was revealed through an RTI reply by NMMC to Koparkhairane resident, Laxman Jogula. Jogula (42), a senior manager with a chemical firm, had sought information under RTI Act in January this year about the building after he was forced to vacate it due to an alleged dispute between the builder and the plot owner.   6. NEW DELHI: PM Narendra Modi and Delhi CM Arvind Kejriwal are on the same page on this one. Both have declined to make records of their visitors' public though for different reasons. Bihar-based Rohit Kumar had asked Kejriwal's office for details of individuals who made official requests for appointment and those who had been granted an appointment. Kumar also sought to know criteria for granting appointment with the Delhi CM. Responding to the application CMO said that no records or list of appointments were maintained and so could not be revealed. Kumar had earlier sought similar information from PMO. The information was denied on the ground that it may threaten the security and sovereignty of India. ``This is ridiculous. I have challenged the PMO's decision with the central information commission (CIC)," he said.   7. The CBI, which is investigating the murder of RTI activist Satish Shetty, has sought infrastructural facilities from the Maharashtra government to open its camp office in Pune. The Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh has said that the Chief Information Commissioner (CIC) of India will soon have a new office complex in the union capital, the land for which has been allotted at the old JNU Campus and the estimated cost of construction is expected to be Rs 42.53 crore. The added feature of the office complex would be that all the offices related to Central Information Commission will be housed under single roof in the same premises. This was conveyed to the newly appointed Chief Information Commissioner, Shri Vijai Sharma who called on the Minister, here today.   11. ive found many fraudulent registrations at sub-register office.taking into account ive filed rti application seeking the photo copies of such registration documents along with attendance register of sub-registrar where buyer and seller sign in it at the time of registration. -- sub registrar replied that i need to pay fee of 250/- for each photo copy of reg document attestation and he can not give photo copy of the attendance register ,where it can only give if there are orders from court . to what extent above given replies of sub-registrar are true? can i make appeal for these?

Hello sir I wants to say something..I filled RTI application in PWD department Rajasthan before 4 months.but there is no any kind of rply .again I filled application to appealing authority but there is I got letter in which he say that all information should be sent by office and if he will not rply regrading RTI then he will be liable for all action..but the authority not send any answer again ..same communication made two times but there is no any kind of rply... What should I do ....give me suggestions I should filled a RTI to first appealing authority or others. Thanks

The Odisha Information Commission (OIC), the apex transparency body in the State constituted under Right to Information Act, has been functioning with only one Information Commissioner who would also demit office on May 7, thereby exposing the tall claim of Chief Minister Naveen Patnaik about running a transparent Government. As a matter of fact, as of today the Commission seems to have been almost dysfunctional. Hearing of the cases has been almost stopped as the sole Commissioner Pramod Mohanty has stopped hearing and is reportedly busy in preparing his retirement related paper works. The OIC has been headless since February following the resignation of Chief Information Commissioner Tarun Kanti Mishra. Dear All, The undersigned filed a application under RTI Act 2005 before Chief Minister office seeking information about then Hon'ble Chief Minister of Haryana wrote to Hon'ble Prime Minister of India requesting for extension of Mr Maheshwar Dayal, IPS, Tamil Nadu Cadre, at present in Haryana for three years; If yes, then kindly provide me the copy of inputs which led Hon'ble Chief Minister to believe that Mr Maheshwar Dayal has an expertise in these fields. As there was no Public Information Officer & First Appellate Authority under RTI Act 2005 in CM office, PSCM office and as such the information was delayed for long. The undersigned filed second appeal before Hon'ble State Information Commission under Section 19(3) of RTI Act 2005. In a significant decision while disposing of undersigned appeal, the Hon'ble CIC under Section 25(5) of RTI Act 2005, has directed the Chief Secretary to appoint PIO & FAA in each of following offices: 1)Chief Minister Residence, 2) Office of Private Sectary to C M, (PSCM) 3) Additional Private Secretary to CM and (APSCM-I) 4) Additional Private Secretary to CM and (APSCM-I) 5) Chief Minister Complaint Cell, 6) All OSD to Chief Minister This is a big leap for making even highest office of State transparent & accountable. Now any citizen with Rs 50/- can seek information about their working of CM office, CM residence, Office of PS/APS to CM, OSD/s & Grievance Cell of C M. AG office not a public authority under RTI Act: ASG Reported by zeenews.india.com On Nov 2, 2012 AG office not a public authority under RTI Act: ASG New Delhi: The office of the Attorney General of India is not a public authority under the RTI Act but an advisor to the government and hence is not supposed to respond to information seeking pleas, Additional Solicitor General Siddarth Luthra on Thursday argued before the CIC. He said the Attorney General was not an "authority" but an advisor to the government whose work is stand alone and 'sui generis' (unique) in nature. Quoting Article 76 of the Constitution, Luthra said even though Attorney General is appointed by the President, his role is to give advice to the government upon legal matters. Central Information Commission today convened a full bench comprising Chief Information Commissioner Satyananda Mishra and Information Commissioners Annapurna Dixit and M L Sharma to decide whether Attorney General is a public authority or not. The case came before the CIC after the plea of activist Subhash Agrawal and two other applicants was not responded to by the Attorney General's office. Agrawal on the other hand argued that "public authority" means any authority or body or institution of self-government established or constituted by or under the Constitution. He said since Attorney General is appointed under Article 76 of the Constitution, it becomes a public authority. He said since a notification is also issued by the government on the appointment of the Attorney General which brings it under the ambit of the RTI Act. After hearing the arguments for nearly an hour, the bench reserved its decision.

[h=1]White House office to delete its FOIA regulations[/h] WASHINGTON — The White House is removing a federal regulation that subjects its Office of Administration to the Freedom of Information Act, making official a policy under Presidents Bush and Obama to reject requests for records to that office. The White House said the cleanup of FOIA regulations is consistent with court rulings that hold that the office is not subject to the transparency law. The office handles, among other things, White House record-keeping duties like the archiving of e-mails. But the timing of the move raised eyebrows among transparency advocates, coming on National Freedom of Information Day and during a national debate over the preservation of Obama administration records. It's also Sunshine Week, an effort by news organizations and watchdog groups to highlight issues of government transparency. "The irony of this being Sunshine Week is not lost on me," said Anne Weismann of the liberal Citizens for Responsibility and Ethics in Washington, or CREW. "It is completely out of step with the president's supposed commitment to transparency," she said. "That is a critical office, especially if you want to know, for example, how the White House is dealing with e-mail." Unlike other offices within the White House, which were always exempt from the Freedom of Information Act, the Office of Administration responded to FOIA requests for 30 years. Until the Obama administration, watchdog groups on the left and the right used records from the office to shed light on how the White House works. "This is an office that operated under the FOIA for 30 years, and when it became politically inconvenient, they decided they weren't subject to the Freedom of Information Act any more," said Tom Fitton of the conservative Judicial Watch. That happened late in the Bush administration, when CREW sued over e-mails deleted by the White House — as many as 22 million of them, by one accounting. The White House at first began to comply with that request, but then reversed course. "The government made an argument in an effort to throw everything and the kitchen sink into the lawsuit in order to stop the archiving of White House e-mails," said Tom Blanton, the director of the National Security Archive at George Washington University, which has used similar requests to shed light on foreign policy decisions. In 2009, a federal appeals court in Washington ruled that the Office of Administration was not subject to the FOIA, "because it performs only operational and administrative tasks in support of the president and his staff and therefore, under our precedent, lacks substantial independent authority." The appeals court ruled that the White House was required to archive the e-mails, but not release them under the FOIA. Instead, White House e-mails must be released under the Presidential Records Act — but not until at least five years after the end of the administration. In a notice to be published in Tuesday's Federal Register, the White House says it's removing regulations on how the Office of Administration complies with Freedom of Information Act Requests based on "well-settled legal interpretations." The rule change means that there will no longer be a formal process for the public to request that the White House voluntarily disclose records as part of what's known as a "discretionary disclosure." Records released by the Office of Administration voluntarily include White House visitor logs and the recipe for beer brewed at the White House. "You have a president who comes in and says, I'm committed to transparency and agencies should make discretionary disclosures whenever possible, but he's not applying that to his own White House," Weismann said. The White House did not explain why it waited nearly six years to formally acknowledge the court ruling in its regulations. Blanton said the outdated regulation is part of a larger problem of outdated FOIA regulations: Most federal agencies haven't updated their rules to take into account changes in law, many of which benefit requesters. White House spokeswoman Brandi Hoffine said the administration remains committed "to work towards unprecedented openness in government." "Over the past six years, federal agencies have gone to great efforts to make government more transparent and more accessible than ever, including by making more information available to the public via our Open Government initiative and improving the FOIA process," she said. In the notice to be published Tuesday, the White House said it was not allowing a 30-day public comment period, and so the rule will be final. "It's a little tone deaf to do this on Sunshine Week, even if it's an administrative housecleaning," said Rick Blum, coordinator of the Sunshine in Government initiative for the Reporters Committee for Freedom of the Press. The bigger issue, Blum said, is that the Office of Administration is itself responsible for presidential record-keeping. Given the controversy over former secretary of State Hillary Rodham Clinton's use of a personal e-mail account to conduct official business, there ought to be more scrutiny of record-keeping practices, he said. "I think what we've all learned n in the last few weeks is the person who creates a record — whether it's running a program or writing an e-mail — is the one who gets to decide whether it's an official record," Blum said. Sir, A RTI question on the 1% reservation of jobs for the visually challenged to the PIO of a Government aided Minority Educational Society [which had advertised vacancies of Clerks in their Government aided Primary Schools and carried out the selection process] was replied by the Secretary of the Educational society as follows:- "There is no PIO in the office to reply to the questions".
