This is a classic case as to how the Government tries its level best to hide things from its citizens. Applicant applied on 2/09/2006 to the PIO for: "“Entire file containing papers along with notings etc. relating to “the appointment, scope of his brief of special envoy Mr. Virendra Dayal to obtain papers relating to Volcker report and his/her report to the Ministry after meeting the UN officials.” PMO said, we have file notings and details of appointment, but do not have the final report. They transferred the matter to Ministry of External Affairs. MEA said, we don't have the report and transferred it to the Department of Revenue, Ministry of Finance. Dept. of Revenue said that we also do not have the report and transferred the matter back to the MEA. After 3 CIC hearings at the CIC in this matter, CIC could still not figure out who held the report. Finally, in the fourth hearing, Department of Revenue "bashfully" admitted that they might have cause some confusion with their previous statements. They now claimed that they had actually checked with the "Directorate of Enforcement" if the report was lying with them. The Directorate of Enforcement, while niether denying or accepting that the report was with them, nevertheless, claimed exemption under Sec 24 from the RTI Act ! However, the DoE further volunteered that the the matter was exempted under Sec 8(1)(h) since it was under investigation. It should be noted here that Sec 24 exempts certain organisations from the purview of the RTI Act except for those matters which involve Corruption and Human Rights ! This report was prepared to expose corruption and therefore exemption has been wrongfully claimed. Finally, in the fifth hearing held on 15 September 2008, the CIC finally asked the DoE whether the report and full file was available with them or not and to give written submissions as to why the disclosure should not be allowed. Total time taken to reach this stage is 2 years. And still no information ! Readers will be interested to know why the applicant is diligently following up this matter inspite of all obstacles. He claims that the Government did not refer the 3 contracts (M/09/35, M/10/17 and M11/25) pertaining to Reliance Petroleum but only referred the two contracts No. M10/57 of Congress Party and contract No. M09/54 of Natwar Singh to the enquiry authority. This case should be a "case study" at the RTI university, if one is ever established.
