While filling First Appeal following Declaration is required as told to me "I also declare that this matter is not previously filled with any information commission nor is pending with any court or tribunal or authority." So my submission is that on 30/10/2017 has filled a RTI to SPIO of New Delhi Municipal Council regarding disbursement of my arrears consequent upon implementation of DTL scales as per my Office Order issued on 02/06/2016,as no payment was recieved by me therefore, RTI was filled me. Since no reply was recieved within stipulated period and in mean time I and other 25 colleague has filled a petition in Central Administration Tribunal vide OA No.3735/2017, and got the orders in our favour. The tribunal bench has directed to New Delhi Municipal Council to release our arrears within 3 months of the orders prounace. So far New Delhi Municipal Council has to comply with by January 2018. Therefore I need advice on following points in such circumstances 1: Can I file First Appeal with out above declaration. 2: Since SPIO have not finished reply within stipulated time frame then should I filled my FA with the stipulated declaration. 3: Any other course of action.   2. Sir, When a RTI applicant asks for certified copy of letter quoting the reference no ( pertaining to 10 Years back) , PIO has replied that in the official gazette published by the department, it is not available. How to proceed further?

Srinagar, July 24: The State Information Commission (SIC) has set aside the order of the General Administration Department (GAD) wherein it had denied to reveal information under RTI Act about the availability of a KAS slot under SC quota for Rural Development Department (RDD) feeding service in 2006. The SIC has directed the GAD to provide the said information under RTI Act to the information seeker.   4. BHOPAL: After a RTI query posed to general administration department (GAD) lay idle for more than a year, state information commission finally passed an order on the pending petition. Chief information commissioner K D Khan passed an order stating that public information officer of the department should provide details within 15 days of receiving the order. Guwahati: Assam government has ordered a probe by an Additional Chief Secretary into the alleged irregularities in recently declared results of civil services examinations. “The state government said that five cases regarding anomalies in the civil services examinations conducted by the Assam Public Service Commission (APSC) have been referred to the one-man inquiry commission, headed by Additional Chief Secretary Subash Chandra Das,” an official release said. The government had received five specific cases regarding anomalies in the results of the civil services examination announced earlier this year and those cases would be probed by the one-man commission, it added. Meanwhile, protests continued for the third consecutive day across the state demanding release of Krishak Mukti Sangram Samiti (KMSS) leader Akhil Gogoi. During the day, sympathisers at many places burnt tyres on roads to block the traffic, but were swiftly cleared by security forces and authorities. In the state capital, a protest meeting was held, where people from various walks of life termed the arrest of the Right To Information (RTI) activist Akhil Gogoi as “undemocratic”. Hello, The original RTI application was submitted on 31/08/2013 in case of no response first appeal was submitted on 23/10/2013 in case of no response from FAA on 13/12/2013 second appeal was submitted to SIC Belapur-Navi Mumbai-Konkan region. on 26/12/2013 i was informed by SIC Konkan thru letter that my case was transferred to Pune region, where i reside. on 30/4/2014 SIC Pune did not call me for the hearing but passed an order directing the PIO and FAA to call me and furnish the info on an urgent basis, also mentioned penalty in case of non-compliance. The concerned PIO or FAA did not budge an inch and not acted at all. I sent new secodn appeal as per the order of SIC Pune for non-compliance of his order along with a letter and all the documents on 18/8/2014. till 10/11/2014 i did not get any reply from them, later i sent an RTI application to Pune SIC, it went unanswered but suddenly on 3/12/2014 i got two letter from Pune SIC telling me that my application is now forwarded to KOnkan and Nashik on the same day. Quite absurd!! Now i got a letter from Nashik SIC on 27/2/2015 that they have transferred my case to Konkan SIC. On my visit to Kinjan SIC 25/3/2015 for second appeal hearing in some other case, I was told that my case has been tagged as 'aniyamit' and kept some where and they were unable to find it and i was asked to call after couple of days, i called up 26th and 27th March 2015 but they were not able to find any clue of the same. This is quite disgusting and disappointing, I am planning to lodge a complaint to SIC Konkan and Pune initiate punitive action against Pune and Konkan SIC staff handling and messing up my case along with PIO and FAA who have failed to act even after an order passed by SIC Pune. I guess this is a classic case of what can happen to an ordinary person like me with governmental machinery decided not to act at all. I am disappointed but not lost, I may not win immediately but definitely. I am not quitting... Please guide.. Thanks and Regards sunil Parab

Jammu, June 12: On the direction of State Information Commission (SIC), the records of Rural Development Department (RDD) block Ghat in Doda district was inspected second time by an RTI applicant as he was not provided the information sought during his previous inspection of records at Doda. As the matter reached to SIC, the commission directed the BDO as well as Director RDD Jammu to allow inspection of the whole record pertaining to execution of works in Shiva panchayat of Ghat block. Details available with Early Times reveal that one Mohammad Hussain Malik, of Shiva, Doda, moved an application on December 10, 2014 before the PIO/Block Development Officer, Ghat under the Jammu & Kashmir Right to Information Act, 2009 wherein he sought many details about works completed/under completion under various schemes in panchayat Shiva from March 2008 to ending December 2014. From Jayalalithaa To Akhilesh Yadav: Chief Ministers May Love Themselves Too Much To Follow SC Order The Supreme Court, on May 13, decreed that only the prime minister, president and chief justice of India can feature in government advertisements. But taking India’s federal spirit a step ahead, state governments seem to have decided that the top court’s order need not apply to them. Between May 14 and June 7, more than 10 advertisements of state governments with pictures of chief ministers were published in the Delhi editions of major print dailies like The Hindustan Times, The Indian Express, The Hindu and The Times of India. Most of these were advertorials. In case you’re wondering what an advertorial is, it is basically an advertisement “designed” to look like an article – advertisement + editorial = advertorial. A wonderful innovation of the marketing department to perfectly match the image of a newspaper as a source of news. On May 27, the Delhi edition of The Hindustan Times carried a full-page advertorial on page 9 elaborating on the Tamil Nadu government’s achievements under the four-year All India Anna Dravida Munnetra Kazhagam (AIADMK) rule. The advertorial had a total of nine pictures of the state chief minister and AIADMK chief J Jayalalithaa – actually 11 since two of the pictures had her posing in front of and behind her own poster. On May 28, again, the HT carried another advertorial on broadly the same theme, this time stating how “The Return of Iron Lady Augurs Well for TN”. The advertorial carried five pictures of Jayalalithaa. The lengthy ode to the CM accompanied with the pictures stated how compliments were in order for the way in which Jayalalithaa “handled” the court cases against her and that she is “recognised” as the Iron Lady after Margret Thatcher – attracting Japanese investors and maintaining fiscal prudence was all possible because Tamil Nadu had Jayalalithaa. How about Jail-Lalitha as a catchy subhead? Advertorials highlighting the fast progress of Tamil Nadu under Jayalalithaa were printed in the Delhi edition of The Indian Express, too, on May 30, June 2 and June 4. Most of these carried more than one picture of Jayalalithaa. Not 6/6 for sure. Ah, yes, look at those well-placed fenestrations and the almost perfect massing of the piloti. It’s not just the Tamil Nadu government that has used advertorials to talk about the incredible achievements of its CM. Uttar Pradesh Chief Minister Akhilesh Yadav was on the front page of TOI on June 5 pictured inaugurating a cycle track. Is this an ad for World environment day? Or UP? Or an ad for Yadav’s guide to healthy living? The government of UP published another advertisement in the TOI on page 17 on June 6, this time with a picture of Yadav along with Indian Premiere League Chairman Rajiv Shukla. The Madhya Pradesh government published a two-page advertorial on May 16 in The Hindustan Times with at least five pictures of chief minister Shivraj Singh Chouhan. Yup, within three days of the Supreme Court judgement. Advocate Prashant Bhushan, who had filed a public interest litigation on behalf of the Centre For Public Interest Litigation to restrict the misuse of government ads, says these cases amount to contempt of court. But can the state governments take refuge in the technicality that the Supreme Court judgement doesn’t mention the term “advertorial” and restricts the orders to government “advertisement”? “It doesn’t matter whether it is termed an advertisement or an advertorial, so long as the government is paying for it. The Supreme Court judgement is pretty clear and this is a clear violation,” Bhushan says. The judgement does clearly state that “’Government advertising’ means any message, conveyed and paid for by the government for placement in media such as newspapers, television, radio, internet, cinema and such other, media but does not include classified advertisements; and includes both copy (written text/audio) and creatives (visuals/video/multi 6 media) put out in print, electronic, outdoor or digital media.” Right to Information activist Subhash Chandra Agrawal says contempt proceedings should be initiated against erring chief ministers. “The Supreme Court should also make its verdict more stringent by binding the media to it so that media houses have to reject all government-advertisements that go against the judgement.” It was with the aim of thwarting a “personality cult” in politics that the Supreme Court had imposed restrictions on pictures. But a thorough reading of the court order would suggest that the broader aim of the litigants was to ensure that government ads are used only to disseminate information important to the public and not to gain political mileage: “…in the garb of communicating with the people, in many instances, undue political advantage and mileage is sought to be achieved by personifying individuals and crediting such individuals or political leaders (who are either from a political party or government functionaries) as being responsible for various government achievements and progressive plans.” In this context, does a mere restriction on whose picture – whether the PM or the CM — gets published really matter? Take a look at this front-page advertisement that was published in The Hindustan Times on May 26 that talks about the glorious rule of “Amma”, this time without her picture. Clearly, the chief ministers concerned have taken liberty with the SC judgement and have chosen to not follow it in spirit. How long this state of affairs can last will depend on how soon the court takes notice of the blatant manner in which its judgment in being disregarded.

    Money order to get a fillip

    The good old ‘money order’ service of the India Post has been saved from meeting the same fate as the telegram service, which was closed forever in 2013. Instead, the department of posts under the Ministry of IT and Communication has decided to adopt state-of-the-art printing technology to come up with new postal orders of Rs 10, Rs 20, Rs 50 and Rs 100 denominations. In response to a query filed by RTI activist Subhash Chandra Agrawal, the department recently revealed that a new Indian Postal Order design in these denominations has been approved and an order has been placed with the Security Printing Press, Hyderabad.     About IPO. 1. IPOs are available in denominations of Re. 0.50, 1, Rs. 2, 5, 7, 10, 20, 50 and 100/-. 2. Commission per IPO is Re1 to Rs.3 depending upon denomination. For Rs.10 IPO commission is Re.1/-. 3. Value of IPO can be increased by maximum Rs.3/- by affixing unused postal stamps not exceeding 4 on its face. Each stamp should not exceed Re1. Hence, say if you want to pay Rs.12 [and post office does not have denominations below Rs.10, you can buy IPO of Rs.10 and affix two postal stamps of Re.1 [ or 4 stamps of 50 paisa] each on its face. This way IPO will be for Rs.12. This facility of value addition is not applicable to IPO of Rs.100/-. 4. IPO is valid for 24 months from the last date of the month in which IPO is purchased from post office. 5. IPO older than 24 months as above can be revalidated for next 12 months by paying prescribed commission for that denomination of IPO in the form of postal stamps to be affixed on the reverse of IPO. 6. IPO older than 36 months from last day of the month of issue will be forfeited if presented for payment. 7. Purchaser can get refund of IPO within 6 months from last day of month of issue by surrendering original IPO and counterfoil. Purchaser can also get refund after expiry of 6 months from last day of month of issue but before 12 months from last day of month of issue of IPO provided he pays commission for renewal at prescribed rate by affixing stamps on the reverse of IPO to be refunded. 8. In case of loss of IPO, refund can be claimed by submitting counterfoil to Superintendent of Post Offices under whose jurisdiction issuing post office operates. However, refund of lost IPO will not be made before expiry of 36 months from last day of the month of issue of IPO. Claim for lost IPO should be made within 24 months from last day of month of issue. If counterfoil is not available, then number, date and post office of issue should be mentioned in the application for refund.

Often information is denied by the PIO by cryptic statement(s) quoting some provisions under section8(1) or 9 of the RTI act, 2005 or even some other extraneous factors not provided in the RTI act, 2005 , thereby denying the information without any cogent reasons for the same. The applicant files first appeal and the first appellate authority most often (!) justifies the denial of the PIO by providing some reasons. However, the appellate order containing reasons, justifying the original order of the PIO in which no reasons were given for the denial, is not valid in law. The above proposition was highlighted by the honorable supreme court in ORYX Fisheries Private Limited- Versus - Union of India and others The copy of the judgment of the supreme court is attached with this post. In paras.42,43, the court held - Absence of reasons in the original order cannot be compensated by disclosure of reason in the appellate order. 43. In Institute of Chartered Accountants of India v. L.K. Ratna and others,(1986) 4 SCC 537, it has been held: “……after the blow suffered by the initial decision, it is difficult to contemplate complete restitution through an appellate decision. Such a case is unlike an action for money or recovery of property, where the execution of the trial decree may be stayed pending appeal, or a successful appeal may result in refund of the money or restitution of the property, with appropriate compensation by way of interest or mesne profits for the period of deprivation. And, therefore, it seems to us, there is manifest need to ensure that there is no breach of fundamental procedure in the original proceeding, and to avoid treating an appeal as an overall substitute for the original proceeding.” Hence, relying on the aforementioned judgment, whenever, an RTI applicant receives a reply from PIO denying the information without cogent reasons supporting such denial, and the order by the First appellate authority contains reasons justifying the denial, then a second appeal can be filed against the order of the FAA justifying the denial containing the reasons which were not present in the original order of the PIO. Hence, in such case, the Information commission has two options - (a) It may remand the application back to the PIO to decide the issue of providing information and justifying the denial by cogent reasons. (b) Or it may order the PIO to provide the information subject to other provisions of the RTI act, 2005. The judgment of the apex court can also be effectively used to prevent the information commission acting as the mouth piece of the public authority.     Hello, The RTI application is recording government quarters detal. Actually the quarters is for medical staff but those quarters occupied by clerical staff. PIO replayed after 2 months, FAA did not give any information after first appeal. After second appeal information commissioner has passed order of the PIO should provide RTI Applicant requested information within 15 days. Then I requested government order of constructed government quarters type B or any other record wemployee quarters. Are any order which shows you are the controlling authority of this quarters for so and so employee. But the PIO sometime said we do not have any order or proof and sometime he said you are not right person to ask this information. 1. Is it true I am not right person to seek those information, 2. Is it possible without any order or proof of any public authority may can hold government 3. Building or government quarters and distribute those quarters to /any employee?. 4. I asked 8 quarters detail who all are staying in the quarters and order details. They provide me 5 names and details 3 other details no information but some employees are staying in the quarters. Again to whom should I complaint regarding this matter?.

  25. Hello, I haven't seen the text of the PM's executive order that ministries publish RTIs processed post Nov 2014. But the UIDAI certainly isn't following it, they haven't posted any RTIs received in 2014 (and the ones they have published are a small subset of what they get. They certainly are putting up the ones they want to.) What does that executive order cover, and is the UIDAI bound by it?
