  6. Dear Sir, I have not received any reply in first appeal as I discussed in earlier threads. I did not file second appeal due to some mistakes in application. Now I want to go for fresh RTI. Kindly guide in the following issues i) Can I repeat RTI for same matter while I have filled first appeal earlier? ii) While I have to file RTI to PIO "secretory, Gram Panchayat Jinapur, Sawai Madhopur, I don't know the name of "Pay to" and "at the post office" that is to be filled in postal order(Rajasthan)". iii) Should I enclose acknowledgement letter with RTI application? iv) Kindly go through the attachment which is the copy of RTI application that I had filled earlier.   8. Dear Sir, The matter is related to the property of panchayat samiti which is appx. 40 crores as per the market value. Which is illigally occupied by the unauthorised persons since last 50 years. The panchayat department has partial records available pertaining to this matter. Only few peoples of my town know the truth of this property. I have obtained the information of these unauthoriesd persons holding the property and defaulters from the concerned department under the RTI act. I want the people should know the reality. That's why I want to disclose the same documents in printed and circulate them in public. I want to disclose the information to the public of my town/ area in the printed/ pamphalet type. Is there any arbitration of law to disclose the corruption in public? If any action can be taken against me to tell the people the truth? Kindly guide me.   11. Our land is registered in 1996 as Punjai land in my fathers name, we just now transfeered the patta to my fathers name. We are planning to build a house there and requested executive officer of my native to approve my building plan. But he checked the patta with the Patta no and Survey no of our land it is mentioned as “Nanjai” there. For getting approval our town panchayat Executive officer needs the land type shouls be “punjai”. But many of my neighbours got approval and their land is also Nanjai, we have a combined patta only. Excecutive officer is not ready to get the building plan application from my father and he is also asking us to come after a week and if we go next time he is saying the same . Please advise me on this issue. How to get approval for my building, i want to get housing loan. Thanks. Note:My total land is 2616 Sqft. We have already constructed a bakery there for nearly 1600 sqft and we built that bakery after getting approval in 2003. We are still paying tax for that too.

So here are some : 1) Is it possible to get the information of my village panchayat funds over the internet or on the RTI site? 2) How I can get the information about the panchayat funds, Here I mean to say what is the procedure to get info? Where do I need to go?(please explain it in brief) 3) Is there any way to register a complaint against the sarpanch, In case if he has done any kind of fraud in panchayat funds. I have approached the Gram panchayat authorities for change of name in Property tax after purchasing a flat ,which comes under the panchayat.They are asking for 8000/- for the procedure and are not ready to give a receipt or bill for the same.Even the official sitting there has openly admitted that the fee for the same will be around 1000/-Rs and the rest is Bribe.The Panchayat is Vichumbe at New Panvel.PLz advice for a further action.
  15. Gram Panchayats should have their own websites. Our lovely Goa is know as tourist destination. Foreign as well as Indian enjoys Goa’s hospitality. Many of them go through interior in villages. But interior villages have made no efforts to give information to tourist. Most of the tourist specifically those who come from big cities are interested in knowing about village life style, nature, village history etc. If a villager itself inform about their village, How it can be done? Village Panchayat can take initiative. All information about their village is made available on a kiosk, just like ATM of a Bank. Information of historic importance places, people, and different resource person from village should be made available on a press of a button. Village panchayat should be like a Information Centre. Tourist visiting village will drop in the village, spend some time on kiosk. If they found contact number and photo of a person from village who can be a guide to them, tourist may call him, know more about village. Few youths may engage themselves as guide. Every village panchayat should have its own website. This website should have information about each and everything about village. Information of recourse persons in different field like sports, music, education etc. will be useful for organizers to organize any event in short time. People from different parts of Goa will know about these resource person and invite them to present their skills. We know about assembly proceedings through news paper reporting however villagers hardly know about what happened in village council meeting or in Gram Sabha. If day to day activities are uploded on village website it will be much help of every villager to know first hand about village council meetings, Gramsabha meetings. How can Village Panchayat have its own website? Goa RTI forum is organizing a workshop at Radhabai Manerikar Hall, Valpoi, Sattari on Sunday Oct.7 2012 at 10am to 1pm.   16. 2 panchayat secretaries penalized for not giving information under RTI Reported by timesofindia.indiatimes.com on August 24, 2012 2 panchayat secretaries penalized for not giving information under RTI - The Times of India PANAJI: Officers not furnishing information on time may land in trouble as the State Information Commission (SIC) has already penalized two panchayat secretaries of Penha da Franca panchayat and Siolim-Marna panchayat. The SIC, hearing the Sachin Kalokhe petition for delay in furnishing information under RTIAct, imposed a penalty of 7,000 on the Penha da Franca panchayat secretary and directed that the amount of penalty should be recovered from the salary in three installments in the months of October, November and December. The order also stated that the office of block development officer, Bardez, must execute the order and recover the penalty from the respondent/PIO and the said amount be paid in the government treasury. 'Public authorities must introspect that non-furnishing of information lands a citizen before FAA and this commission, resulting into unnecessary harassment of a common man which is legally not permissible,' the order stated. 'I feel that imposition of penalty of 7,000 would meet the ends of justice,' stated the order issued by Ajit Panchawadkar, under secretary-cum-registrar, Goa SIC In another order, the SIC has imposed a penalty of 5,000 on the secretary of Siolim-Marna panchayat. The order was issued as the information was not furnished on time and the complainant, Subhash Jetha, approached the commission. The SIC has asked that the money be recovered from the monthly salary of September and October.
  17. Kindly tell me, how many Rs. 10.00 IPO's I need to attach for seeking information about the development work carried out by a Panchayat from Feb 2006 to Nov 2010. I was told by PIO that I need to attach separate IPO for each year I should ask for information year wise.
  18. I have paid my yearly water taxes. I have paid my yearly property taxes. But the panchayat does not release water to me on a regular basis. I have to use my borewell to get water 90% of the time. Everywhere else they are releasing water 3 or 4 times a week. 1. Can I file an RTI on the panchayat asking them to identify the days they release water to people and the frequency. Also can I ask if they release it to some people or all lines. My question is straightforward. 1)How can i seek information from sarpanch regarding what grants he recieved, where has he spent that amount, when has he spent that etc, 2)If i can ask for information from previous sarpanchs.

On the job: Wajahat Habibullah. “There is a need more than ever for the RTI (Right to Information Act) to become a success in rural areas,” said T.R. Raghunandan, joint secretary in the panchayati raj ministry, which oversees local governance. “About 70% of the money spent on Central government schemes routed through panchayats (village councils) are not accounted for properly.” The government has spent at least Rs1.2 trillion in four years, Raghunandan told participants of a seminar that discussed the progress of the legislation here this week. Some 26,500 panchayats spent Rs30-40 lakh each in the last fiscal year to March, he pointed out. Aruna Roy, Magasaysay award winner and a founder of the RTI movement in India, said when it comes to transparency and accountability, villages are neglected by the Centre. “The government has not bothered to even publicize the Act through media campaigns,” she said, adding that the government must set up a governing council to implement the RTI Act on the lines of the supervisory body set up for its flagship welfare programme, National Rural Employment Guarantee Scheme that ensures 100 days of work a year for the rural poor. “There has to be a team of eminent people who will go to the field and ensure that the panchayats and other local bodies at the lower tiers are disseminating information,” she said. “Applications are not maintained in any other office (such as panchayats and block development offices) except for the district collector’s (office) and the people designated to handle these are untrained,” Raghunandan said. The RTI Act requires all government departments to publish information under their purview on their websites. However, none of the panchayats have made any such disclosures, Roy said. Dileep Reddy, a state information commissioner in Andhra Pradesh, stressed on the need to appoint qualified personnel to man the RTI units at panchayats. “Village secretaries are also supposed to assume the role of information officers (in each panchayat) under the RTI Act,” Reddy said. “But in Andhra Pradesh, we have noticed that in many villages, the sarpanchs (village headmen) have usurped the role of information officers, which is against the law.” India’s chief information commissioner Wajahat Habibullah said the commission is planning to work with the information and communications ministries to improve online filing of information by panchayats. “We will definitely work towards full disclosures by all government bodies including panchayats as stipulated by the Act,” he said.

But the panchayat of Meghraj village in Sabarkantha district, it seems, is seeing the other side of the Act. The panchayat has passed a resolution to initiate action against an ex-serviceman, Anil Kumar Pandya, who has been keeping it on its toes through petitions filed under the Act. Not only that, the panchayat has also forwarded a copy of its resolution to the Sabarkantha District Collector and DDO, with a request to take action against Pandya. Ahmed Chadi, village sarpanch, said: “Pandya had been asking for some land on a subsidised price, which we had agreed to at the panchayat. Later, the State Revenue Department altered the rates, and since then, Pandya has been trying to harass us through numerous RTI applications.” He added: “We cannot refuse to provide information to any one who seeks it under the RTI Act. But we have passed a resolution to request the authorities to look into the matter and take action against this man.” Pandya, meanwhile, said that while he had filed only two petitions — one in January 2007 and another in August 2007 — a third petition was filed by his father, who is a former Talati of the village, in March this year. “All these applications were in connection with various land allocations by the panchayat. While I got partial response to some, I had to go for appeal later,” Pandya said, adding that the responses he finally got from the panchayat revealed many errors in the land allocation process. “Now, they are uncomfortable and want to hush me up. These steps are being taken to achieve that end,” Pandya added. Deputy District Development Officer B N Chaudhury said this is a “strange” situation. “Seeking information is not a crime. One cannot do anything about someone who is seeking information under the RTI Act,” he said. He added that being an elected body, a panchayat has the right to pass a resolution, but it is difficult for the department to act on the same. Panchayat, officer caught in RTI row Alipurduar, Dec. 4: The Information Commission has severely reprimanded members of a village panchayat for violating norms under the Right to Information (RTI) Act, 2005. The incident took place in the Chaporerpar-II village panchayat area under Alipurduar Block-II. Manik Sinha, a resident of Salsalabari in the panchayat area, had written to the secretary of the panchayat asking for the minutes of the meetings held in the panchayat between March 1, 2003, and March 15, 2006, the master plan of the panchayat for the same period and a report on the projects undertaken, an estimate of the income and expenditure of the rural body (including the bill vouchers) and details of the funds released for the financial year 2005-06. The secretary reportedly did not even receive the application. Sinha then wrote to the block development officer (BDO) of the area but still there was no progress. He then took up the matter with R.K. Maity, the joint secretary of the Bengal panchayat and rural development department. On February 1 this year, Maity wrote to the BDO, instructing him to provide the details to Sinha. The BDO, however, failed to comply. Then, on May 26, Sinha wrote to the secretary of the Information Commission. The commission secretary on July 12 wrote to the secretary of the panchayat stating that the body had taken serious exception to the blatant violation of the RTI provisions. He had added that the rural body faced the risk of being penalised by the commission if the information was not provided within seven days. When the panchayat secretary failed to meet the deadline, the commission convened a hearing on October 11 at Bhavani Bhavan in Calcutta and summoned the pradhan and secretary of the panchayat, the BDO, the district panchayat officer and Sinha to it. “It was decided that Sinha will inspect the official papers of the panchayat and take what he needs in the presence of an officer from the BDO’s office,” Nandan Roy, the secretary of the commission told The Telegraph over phone from Calcutta. “Once he gets the information, we will showcause the authorities for the delay.” Publication | Indian Publication News | Indian Publication Aggregator | Regional Publication News | Leading Publications India
