Madras High Court today directed two top officials of Southern Railways to send a complete list of abandoned vehicles, particularly two wheelers in parking lots of Railways in Tamil Nadu within two months to Superintendent of Police of Railways here to enable it to dispose them. The first bench, comprising Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam, gave the directin to General Manager, Southern Railways and The Divisional Manager (Commercial), Chennai Division. The bench stated this while disposing of a PIL by lawyer E Jaya Sankar, seeking to direct Railways to create a website under Section 4 of the RTI act, 2005, to support the SP to maintain proper records of such vehicles in the parking lots,also issued notice to Counsel for Railways and Government Pleader S T S Moorthy appearing on behalf of the SP.   2. TRICHY: Flouting town planning norms, commercial establishments in the city are using spaces earmarked for parking for commercial purposes. The violation forces vehicle owners to park haphazardly on pedestrian pathways and roadsides, and eventually causes traffic congestion on busy roads. In Thillai Nagar, many commercial establishments have allegedly rented out their parking space for commercial activities. "A commercial establishment in Thillai Nagar has rented out its whole basement to run a departmental store. A Right To Information (RTI) Act reply revealed that the space was meant to be used for parking," said S Pushpavanam, a consumer activist and secretary of Consumer Protection Council.   4. Hello, I have been parking my bike in perambu and villivakkam stations parking. In perambur they charge 10rs for 12 hrs, but whereas in Villivakkam they charge 20 rs for 12 hours. They speak to bad when we ask about this. Requesting you to help me on this. Thanks.

INDORE: In what can be called as double taxation, Indore Municipal Corporation (IMC) is all set to charge parking fee at 17 dedicated slots across the city despite charging a one-time parking fee from new vehicle purchasers. Tender for parking at select places was issued by civic body recently. Challenging the move of IMC, an RTI complaint charged the civic body with double taxation alleging that vehicle owners are charged parking fees at the point of sale of new vehicles and subsequently at parking lots.     Car Parking

    Hello, I am a owner of a shop in Co-Op Society and I am not staying that society. I am staying in different society. Where I am stay presently there is no space for car Parking. That's why I park my Car in that society where I have a Shop. But society member told me that Shop owner have not permission to park a car in society permission. Please confirm me. That shop owner not a member of society. I can't park my car in Society premises.

    Hello, I have recently bought a flat in Andheri, old nagardas road, the society says that there is no parking space for any new car, if we keep the car outside our gate, the RTO takes it away. Where do we keep our car now. There is also not any traffic on the road that is has been made a NO Parking Space. Please give us some solution on this. Prajakta

    Dear Sir, I have seen in many airports and railways stations that a 90 second time is given for the cabs to drop/ pick up the passengers. But in Coimbatore railway station, the passengers are forced to pay Rs 10 for similar scenarios. Is there a standard parking procedure/rules? can you help? Thanks. Regards, Gerold.

Similarly, the price to pay for parking a two-wheeler is just Rs 5 for for the first two hours, and Rs 3 per subsequent hour. | EPS Ever felt that you were being fleeced at public parking spots due to the exorbitant charges? An RTI query proves that hunch and highlights the blatant violation by those managing the Greater Hyderabad Muncipal Corporation (GHMC) public parking spaces in the city. The response to the query about the allotment of parking spaces in the city has revealed that not more than Rs10 should be charged for four wheelers for the first two hours, and not more than `5 for every extra hour. Similarly, the price to pay for parking a two-wheeler is just `5 for for the first two hours, and `3 per subsequent hour. All Hyderabadis would agree that at various public parking spots in the city, the spots are priced way higher, ranging from `20 for four-wheelers and `10 for two-wheelers. The parking tickets mention in print that the charge is applicable for only one hour and extra charges would be levied after that, without a mention of the amount – a clear violation of GHMC norms. “Not even a single parking place in the city has the tickets printed in accordance to the norms. Those who have licenses are supposed to carry a copy of their license at all times. Hundreds of people use the facility and the additional amount minted due to the misuse is unimaginable,” said RTI activist CJ Karira, who filed the query. GHMC rules also stipulate that the licensee should exhibit the rates in English, Telugu and Urdu at the parking lot Many parking lots were devoid of any sort of information with only a ‘GHMC Parking’ signboard visible. Moreover, even the tickets were unclear about the rates and other information, as some did not even specify the additional charges to be levied after the first two hours of parking. Some tickets in fact did not even have ‘GHMC’ printed on them. “The managements are also supposed to mention the operation time of the parking lots. None of the licensed parking lots mention this. The licensees are cheating people and GHMC seems to have turned a blind eye,” said Karira, slamming the civic authority. When contacted for clarification, GHMC officials said that they would look into the matter, but refused to comment.

    Parking in CHS

    I live in CHS at Prathana Samaj. Parking space in our building compound is limited and is alloted to old allottees, some as old as 40 years. Several new car owning members have to struggle finding a roadside parking. Last new allotment of parking within society compound was done by society after waiting of 26 years ! Could you guide with an solution ? Although, users pay for parking space rent, but the space is being monopolised and many other members of society are being dsicriminated against on the ground of old allotments of parking space. Appreciate guidance.

Most of the times the attendants at DELHI METRO RAIL CORPORATION parking sites fleece the motorists and charge the higher rate of parking fees even if there is a negligible delay of say 5-10 minutes, to extract this additional amount at times they get into arguments or even foul language with the parking users. At times paper coupons(slips) are issued by the parking attendant in place of using the computerized hand held machines to issue parking slips. Apparently this additional amount collected above the value of coupon issued is pocketed by these parking attendants. I had requested that the following information from DMRC, New Delhi under the provisions of Right to Information Act 2005: i. Please provide details of the process of awarding parking contracts at DMRC stations ie. Tender and bidding process etc. ii. Whether these contracts are assigned on one time payment basis to the highest bidder at the time of award of the contract or on the basis of revenue sharing as an ongoing process. Please provide details thereof. iii. Please give specific details of amount/revenue received, for which the contract has been awarded in respect of the 95 DMRC stations as per the list enclosed. Giving the periodicity ie. Annual/Quarterly/Monthly/Revenue Sharing. iv. If the contracts have been awarded on revenue sharing basis what measures are adopted by DMRC to keep a check on the amount of revenue collected by the parking contractors at the respective metro stations. Please provide details thereof. v. Whether any uniform or identity cards have been issued to the attendants manning the DMRC parking sites and whether it is mandatory for them to wear them. vi. Whether it is mandatory for the parking contractor at DMRC parking sites to use computerized hand held machines to issue parking slips. Please provide specific details. vii. Whether it is mandatory for the parking contractor to issue a receipt to the motorist for parking fees collected at the time of exit from the DMRC parking. viii. Please provide details of measures are adopted by the DMRC to ensure that the parking contractors do not park vehicles more than the allowed number at spaces earmarked to them. ix. Please provide details of surprise checks, if any conducted during the last five years at the DMRC parking lots across the city to ensure whether their directions are being implemented by the parking contractors or not. x. Whether the contract details along with the MoU between DMRC and the parking contractors have been provided on the Web site of Delhi Metro under the provisions of Section 4 of Right to Information Act 2005. Please give details thereof. And if not details of persons responsible for willfully not allowing this information in public domain. xi. Please give details of free medical aid, drinking water and toilet facilities being provided at these 95 metro stations. Strange are the ways that these Public Information Officers adopt to hide the wrong doings of their departments. The reply that I got from DMRC in response to my above queries goes as under : Kindly refer to your application seeking information under the RTI Act, 2005 received by PIO 2 cell on 29/08/2011. The information sought by you is voluminous in nature. Therefore, DGM/Civil & Structure who is the deemed PIO as defined under Sections 5(4) & 5(5) of the RTI Act, has informed that you may inspect the available records on 10.10.2011 between 15.00 hrs and 17.00 hrs in Metro Bhawan, New Delhi. May I request the members on this forum to help me in how to proceed further : i. I am not able to make it out that how can simply the information requested for (without copies of documents requested for) be voluminous in nature. ii. Is it mandatory for me to appear before the deemed PIO for a physical look at the information. Simply looking at the information may not help as answer to many questions need to be given by DMRC only. iii. Can I appeal to the Appellant Authority against this requesting for the information to be provided in written form.

Replying to an application filed by Maharashtra Navnirman Sena (MNS) activist Chetan Pedanekar, the traffic department gave figures for the past five years. These show that the department got Rs15,96,77,550 in fines from 2006 to 2010. At the same time, private van owners got Rs23,94,99,550. “There are only 59 towing vans across the city. Won’t it be possible for the traffic authorities to have 59 vans of their own? Why do they need a private contractor for this? If the department has its own vehicles, the money which is going to private contractors could be diverted to the government,” said Pedanekar. He added that the present system only benefits private contractors. According to another reply given by the traffic department, the private workers working on towing vans need to get written permission from the traffic police authority on duty to unlock the car while towing. At the same time, the traffic authority on duty and the workers on the towing van can be held responsible for any loss of goods from the vehicle. A complaint against them can be lodged in the police station concerned. The department has also clarified that putting up and maintaining traffic signs is the responsibility of the BMC. As such, the traffic department cannot be held responsible for a lack of ‘No Parking’ signs.

Driver’s fight against no-parking zone fine goes on as purblished in DNA Oct 2, 2010, By Naveeta Singh Two years ago, Manoj Paralkar, a driver by profession, was fined Rs300 for parking his vehicle in a no-parking area in the premises of the domestic airport in Santa Cruz. After paying the fine, when the 44-year-old got a receipt, he realised he had been fined by the Mumbai International Airport Limited (MIAL). Later, Paralkar discovered that the MIAL was not authorised to impose fine. Dahisar resident Paralkar is now trying to find out how the MIAL fined him on the night of October 23, 2008. Various applications filed by him under the Right to Information (RTI) Act had not got him a satisfactory reply. Paralkar, who works for a car rental service, says he is determined to get the answers. “I have filed several RTIs, but neither the traffic police nor the airport police have given me a clear reply.” According to Paralkar, that night, he had gone to drop a guest at the airport. “After dropping the passenger, my friend Nandu Podar, also a driver, and I parked our cars near Balaji Hotel and went in for tea. When we came out after five minutes, we found our vehicles being locked by MIAL security guards. They fined us,” he said. The following day, he filed an RTI with the traffic police as well as the airport police station to know how MIAL, a private body, got the authority to impose fine. “But I have not got a satisfactory response. While the traffic police said they had not bestowed any such rights on the MIAL, the airport police said the private body had been given the right to fine people parking vehicles in the no-parking areas of the airport,” Paralkar said. Vivek Phansalkar, joint commissioner, traffic, said he was not aware of the issue. The spokesperson for MIAL said they did not fine people anymore. “The state information commissioner, Ramanand Tiwari, has dismissed my plea saying the complainant does not want information, but right to adjudication — whether MIAL is authorised to recover fine, which the commission is not expected to do,” he said.   19. Dear All, I'am new to this forum and have been recommended by some of my friends who have been getting very helpful feedback from you all. I have got the following queries : 1. What are the rights of the member relating to car parking in Delhi Co-operative society. 2. My own problem is that i'am residing in a Co-Op Society in Delhi and own 3 cars. I have been paying the parking charges for 2 cars as of now and am willing to pay for the third car too. But the issue is that some members have passed a ruling in AGM that third car can't be allowed in Society premises, despite the fact that there is ample space in the Society. How can any AGM ruling override my fundamental right to own property and movable assets. Also co-operative society law is based on mutual co-operation, if even one member is not satisfied , the principle of Mutual cooperation gets flawed. I would be really greatful, if you all can help me with some inputs.
  20. I recently purchased a new flat in Navi Mumbai, Kharghar and needless to say purchased a covered parking space in the society that is properly demarcated. Now, it so happened that since the last 3 days one of the owners in our society parked his car in my parking space and went out of town, due to which I have to park my car outside our society by the road. MY QUESTION IS - Is there a law to prevent such things? Can someone just park his car in someone else's owned parking space? I am really getting frustrated with this and am thinking of going to the police station, however I would appreciate if someone can throw some light on my predicament.

    Parking Rules

    Hi, My car was towed today on the pretext of it being wrongly parked in 'island parking'. Neither was it parked at a turn or end of the road nor was there any signboard stating 'no parking' or any other sign board warning on parking. I would like to know details on parking rules, firstly to ascertain that what was told to me by the cop was right or was it forced to me due to lack of knowledge & secondly, since i am a regular driver, i would want to be up to date on all the rules prevalent as on date for parking/non parking rules. thank you in advance for your help! regards manisha
  22. I would like to know if there are well defined rules for car parking in delhi. One of the residents in my colony is parking car by the side wall of my flat. My flat is on first floor and he parks car by the side of the support wall of my balcony. We have to be careful all the time that as maid washes utensils there.Logically one should park car by the sidewall of his own apartment. We have requested him many times but its been futile. pls advise...thanks
  23. I have purchase a flat in Thane , Maharashtra. with stilt parking. But the stilt parking is very small and can accommodate small cars. But not big cars. Dyring that time there was no plan for podium parking by the builder and bigger parking slots were not available. Now the builder has taken approval for podium parking. Kindly let me know a) Whether it is legal on part of the builder to take sanction for podium parking when it was not in the earlier plan b) Who will bear the maintenance charge of podium parking as per law ? c) Whethere legally I can ask the builder to give me a new podium parking in excange of the stilt parking. ?   24. Hi, I am seeking information on fine imposed for parking a vehicle in a no parking zone. Wherein the traffic police in Mumbai is charging Rs200 as Rs100 towards fine and Rs100 towards the towing charges for towing your vehicle from the non parking zone to the traffic polie depot. Wherein they are refusing to provide a conrete receipt stating that they have taken Rs200 as a fine for parking a vehicle in a no parking zone. I am seeking information to clarity of this law and the charges levied on to it and if they are charging Rs200 legally or otherwise and if it's otherwise then what action can be taken so that this illegal act is brought to the notice of the law. Further I want any one of you to help me draft an application for seeking information from Municipal authorities on the upcoming shopping complexes in Hyderabad and also the related mandatory rules governing establishment of such complexes. The main problem is that we have severe traffic problems and fire accidents in such complexes and authorities are turning blind eye towards them. Please provide all the questions which can be put in one application under RTI.
