    Hello,My father had passed away and He gave me his car before his death.Now my elder brother is asking for all the details documents of that name transfer of that car from RTO Office.SO will he get those forms from RTO or not? Again I have read some where that this is my personal information so it should not be get publically exposed. I will be thankful to our esteemed and learned forum members if they provide me any direction/order passed by Supreme Court in this regard.

[h=1]Research paper is not personal information: CIC[/h] New Delhi: The thesis submitted by a research student is not a personal or third party information and cannot be withheld by an Institution under the Right to Information Act, the Central Information Commission has said. Information Commissioner Sridhar Acharyulu said,"It is not third party information. Moreover, there is a public interest in knowing the originality of the thesis, especially when a serious allegation of appropriating the research work is made by the co-researcher, it is the duty of the academic institution to clear the allegation after due verification." The matter related to an RTI applicant who had demanded from Rajasthan-based Arid Forest Research Institute the copy of pre-thesis submission seminar details of a researcher, copy of her thesis, all correspondence related to research work, rules and regulation of research work and related records. The applicant alleged that the researcher had stolen theme of her research paper, hence she requires all these details to establish her claims. Acharyulu said the thesis submitted to a University is not private or personal information of the candidate who submitted it, but the property of the University, which has to discuss and decide whether it deserves the award of Ph.D or not. Justice T S Sivagnanam on a petition filed by the ex-professor I Elangovan has granted interim injunction against the college restraining it from parting with any personal information in response to applications filed under RTI Act.   13. RTI, a weapon for personal use in Himachal ? The Right to Information (RTI) Act is fast turning into a weapon for government employees to settle professional scores in Himachal Pradesh. Though the maintainability of the pleas filed by one government employee against another for information pertaining to professional conduct is debatable, the filing of such "frivolous" or "personal-in-nature" applications is on the rise despite a state information commission directive in this regard. "On an average, more than 60 percent of the total applications are those relating to the issues of government employees," a senior functionary in the information commission told IANS, requesting anonymity as he is not authorised to speak to the media. He said that a major number of queries are from those who want to know not only professional but also personal information about their colleagues - subordinates or seniors. Several applications have been filed seeking information on the income tax returns of officers, names of their spouses and even their marital status. Issues regarding promotion, elevation from state administrative or police services to the IAS (Indian Administrative Service) or the IPS (Indian Police Service), transfers, drawing and disbursing powers and bills raised by a fellow colleague as travel expenses constitute the major chunk of RTI queries. "Such queries certainly do not constitute public interest. In fact, they (the applicants) are empowering themselves. But we cannot stop anyone from filing applications," the official said. Last year an RTI activist asked how much the government spent on sending boxes of apples as Diwali gifts and a list of the recipients. One RTI application sought a list of journalists accredited with the state public relations department, their qualification, salary and the like. Later, the journalists gave a written declaration that the qualifications and salary were personal to them and should not be shared with the public. Interestingly, the RTI activists have not even spared the state information commission authorities. Only recently, a senior officer in the information commission found himself at the receiving end after an 'activist' questioned his absence from the office on a day when certain RTI applications were to be decided. Questions were raised on the reason for his absence from the office. As a result, the very next day, the officer found himself completing all necessary formalities relating to his leave. The issue of minimising the misuse of the RTI came up while hearing a plea of Shimla's Himachal Pradesh University professor Shekhar Sharma, who sought official details about the university. "The appellant himself is a senior functionary of the university and the rules and regulations of the university are accessible to him. Interpretation of rules can be discussed at administrative level. This can't form the basis of information under the RTI Act," observed information commissioner K.D. Batish. "Officials of the public authority, themselves being the custodians of the information, are not expected to access information under the RTI Act," he noted, while turning down Sharma's appeal. "If this practice is encouraged, it will adversely affect efficiency and good governance." Warning the government functionaries against using the RTI as a tool to settle personal scores, the order said: "It's also noticed that some functionaries working under the public authority unnecessarily ask voluminous information in order to settle personal scores with their colleagues." "Stringent penal provisions of the RTI Act should not be invoked for ulterior motives. This practice has to be discouraged and stopped," Batish added. The state information commission has one chief information commissioner and one information commissioner. As per the commission's records, 61,202 applications were received by 110 public authorities in 2012-13. In 2006-07, the number was just 2,654. The commission in 2013-14 received 670 appeals and 43 complaints. From 2006 to 2014, Rs.444,242 was awarded as compensation to the appellants and complainants by the commission.   14. Hello, A few of my First Appeals in a department have been disposed because I wasn't present during the appeal proceedings. The appealate authority said appellant not present and is not interested to persue the matter, so appeal is disposed in accordance to General Administration Department's circular. On persuing the matter I found that the state General Administration Department, nodal department for RTI related matter has issued. Guideline type circular for In which it is stated that appellant should be compulsarily called for first appeal hearing and provided legal help if necessary. I would be filing a second appeal with the State Information Commission but I don't think it would set aside the PIO's order easily given its past track record? Beside section 19(5) what should I add to my grounds of appeal? Is there any court judgement in the matter? Requesting learned members help in the matter.
  15. In a case before the supreme court,a petitioner has produced an rti reply from one central govt Public sector undertaking,as an evidence. In the counter affidavit filed by the opposite respondent PSU,has disowned the said rti reply,as the personal view of the concerned CPIO. the petitioner has to submit his reply shortly. any ruling by CIC or any courts on the above. opinion from experts are requested.

Govt staff leave info personal, can’t be disclosed: Punjab panel The Punjab State Information Commission has rejected a plea seeking details on ex-India leave of more than 30 days by government employees during the past 10 years of service. The rationale is that such leave, as per norms, constituted a personal matter and had no bearing on the state exchequer. The Right to Information (RTI) applicant from Sangrur, Prem Kumar Rattan — who had sought the employees’ applications for leave, the sanction, and copies of their passports and visa — also faces legal action as the commission has asked the senior superintendent of police (SSP) of Sangrur to register a case against him for furnishing a false undertaking after he had been refused information of the same nature earlier by the SIC. Information commissioner Surinder Awasthi pointed out that the applicant was aware of the case having been disposed of earlier by him, and had thus requested that the case now not be assigned to him this time. The latest decision refers to a 2012 judgment of the Supreme Court, which says that salary details, including deductions, copies of memos, show-cause notices, inquiry proceedings and income tax returns, fall in the category of personal information, because disclosure of these would amount to invasion of privacy. “The information sought qualifies to be far more personal than those mentioned in the case decided by the Supreme Court,” says Awasthi’s decision, reiterating that the public information officer (PIO) concerned was not expected to provide information exempted under section 8(1) of the RTI Act. While it must be mentioned here that the state vigilance bureau is investigating alleged misuse of ex-India leave by government employees, the SIC order says that if information related to ex-India leave were to be furnished, someone could even ask for leave availed within India, and the period thereof could be reduced or increased in the RTI pleas; resulting in no end to such requests and little time for the government departments to perform their core duties. Explaining its express rationale, the judgment says the employees had taken leave for personal visits and there was no resultant burden on the state exchequer. The availing of leave, whichever kind, due to an employee is governed by service rules which fall under the expression “personal information”, disclosure of which has no relationship with public activity or public interest, it says. The RTI Act, the apex court verdict says, should not be allowed to be misused or abused, nor be converted into a tool of oppression or intimidation of honest officers. SIC no to making service books of 164 officers public The Madhya Pradesh State Information Commission has quashed the order of first appellate officer in which it was directed topublic information officer to provide free of charge information of service books of 164 officers and employees. Generally, the citizens make second (final) appeal to the Commission against appellate officer and public information officer. In a rare case, a public information officer lodges second appeal against the appellate officer.The Commission in its hearing by its commissioner Atmadeep accepted the appeal and rejected the order of the first appellate officer. The rejection of the order will lead to a stop on making personal information public of more than 150 officers and employees along with principal of Govt.
