    Reply from PIO

    A RTI Application has been replied by an officer signing for PIO. To my understanding it is only the PIO who has to reply under his signature and name. My application and reply copy attached

In a specific case, a colleague of mine sought information (under RTI) .... the PIO did not furnish the desired information.. after 28 days he emailed my colleague and mentioned: "I would like to inform you to provide the information in the Application Proforma for the Information Seekers is available at the Institute website and The requirement of Self Attested Photograph and the Proof of Citizenship is a must for the Information Seekers. Please send the above information at the earliest, so that your application can be processed." Can a PIO/CPIO stay away from providing information on the pretext cited above. I welcome your views on this matter - and what can be done against such PIOs/CPIOs? Thank you.
  3. Dear friends I have 2 querie 1) BDA - I have sent an application for infomation to the PIO (Town Planner Member). So far no reponse / reply even after 30 days. Should I approach the Apellate authroity - the commissioner ? 2) The BWSSB is fully karnataka govt organisation. In their website, the details of PIO are not provided. I have sent an application to the PRO of BWSSB as per the RTI. Even after 30 days no repsonse / reply. Should I make an appeal to the chairman of BWSSB. The PIO and Apellate officer details are not available on website Request help / suggestions from some in Bangalore
  4. hi, when was the last time a PIO has been fined for not providing information..i hardly see that n media these days..atleast for the most part or looking at the orders posted in SIC website, I could see the concerned SIC just simply directing the PIO to furnish the information requested, if all the applicant has the time and patience to move it to the second appeal. Does that mean the SIC can decide at its own discretion whether a PIO can be fined or just simply being directed to follow order to provide information to the applicant within the stipulated time.?..or if it totally lies with the integrity of the SIC office to strictly follow the order of imposing penalty for not providing information along with getting the information requested for the applicant..

Hello, A RTI was filed with a town panchayat office in tamilnadu in regards to encroachment of the land by them in the context of some community development purpose when they have no rights vested on it...The rti applicant already have a case pending against the town panchayat for this encroachment. This is in the state of tamilnadu. The RTI reply is in tamil. The PIO replied with a one liner -stating that since there is a court case (stating the case no details) pending on this land, no information can be provided in regards to this land at this time and the applicant can move this to first appeal for further instruction,if needed. Does having a pending legal case has any valid ground with rejecting information on the land.? under what clause? Also ,what is a better option now - 1. move this to first appeal..I am sure first appellate also with go hand in hand with the PIO,as in most cases. or 2 file a RTI directly with the higher revenue authority since the court case is only against the town panchayat and not against the revenue department. Information is time critical here..

Sir, RTI Application filed by a person to PIO, and PIO responds to RTI Applicant stating that Information sought does not come under Public Information as per the Supreme Court of India SLP 27734/2012 decision and rejects the information under section 8 (1)(j). First Appeal of the RTI Applicant considered and directs PIO to dispose application under Section 11. This time, PIO gives a notice to 3rd party seeking any objections. 3rd Party submitted objections to provide requested information including motive of the RTI Applicant. Now, PIO sends a decision letter to 3rd party stating that RTI Applicant requested information does fall under Public Information as per the Supreme Court of India SLP 27734/2012 decision hence decided to provide requested information to RTI applicant without considering submitted objections. Without giving much time to appeal, PIO provides information to RTI Applicant. Now the issue is, is it not PIO contradicting his own decision by considering SLP 27734/2012 on both occasion? How is this contradictory decision is considered in CIC/SIC? What Orders / Penalty if any? Thanks, Manjunatha

    Doesnt know about PIO?

    Hello, i want to get some information from social welfare department dehradun uttarrakhand, but there is no information about PIO and Finanace Officer given on their website. so i want to know in this case how i can file RTI application on this department.
  8. The complainant has submitted a complaint on 6-11-2006 before the commission alleging misbehavior by Addl. Dy. Commissioner, who is PIO. It was alleged that the PIO directed the complainant to get out of his room and refused to accept the copy of the fax and also the fees – Also stated that when complainant take over phone, he spoke rudely to him. The PIO admitted that he was pre-occupied with some work and in an irritable mood. He also admitted hot exchange of words. Tendered apology to the complainant in presence of the Commission and shook hands. Also requested the Commission to accept the apology and assured not to repeat in future. The Commission closed the matter with a strong warning that such conduct should not be repeated. Ref. Decision. [Ali Akbar Mian, Ex MLA v PIO, DC Office Dhubri; 110/2006, ASSAM INFORMATION COMMISSION] The complainant had applied for certain information from The Food and Civil Supplies Department of the Delhi Government, but the staff of the department misbehaved with her and did not provide her with the required information. The Commission in its order held that misbehavior with the applicants approaching public authorities under the RTI is not acceptable, and is violation of section 5(3) of the Act. Further, the Commission held that the Public Authority would pay compensation stipulated under the Act, to the applicant. Ref. Decision.   9. Team, SIC has ordered Municipal Council, Rewari to pay a compensation of Rs. 1000/- and Rs. 1500/- to me for delay in information by 31 Dec 2014. Till date I have not received the money. Please guide what should I do now. Regards Rajender Soni

  11. I think PIO needs to mention the section before denying any information. I have asked for few information about internal complaint committee constructed under sexual harassment act 2013. Every answer is being denied without mentioning section. Here are two question [My question] Please provide me the list of members as prescribed in Section 4(2) of the said Act including the presiding officers , members among non-government organizations or association committed to cause of women or a person familiar with the issue related to sexual harassment nominated to your “internal complaint committee” [PIO answer] : The committee to deal with complaints regarding sexual harassment is internal committee for staff member . Hence no public interest in large appears in declaration the name , telephones , number of member of committee. [My question] Whether your branch /organisation as per Section 19 , duties of employer of the said act in has formulated an internal policy or charter or resolution or declaration for prohibition , prevention and redresal of sexual harassment at work place? If yes , please provide me a copy of that policy. [PIO answer]: Yes . bank has formulated such charter policy , which is meant for staff/employee

Sir, A RTI question on the 1% reservation of jobs for the visually challenged to the PIO of a Government aided Minority Educational Society [which had advertised vacancies of Clerks in their Government aided Primary Schools and carried out the selection process] was replied by the Secretary of the Educational society as follows:- "There is no PIO in the office to reply to the questions". What should be my next step?

  15. ITANAGAR, Feb 26 – The Arunachal Pradesh Information Commission has imposed a penalty of Rs 25,000 on JDEE Public Information Officer (PIO), Monya Nyori under section 20(1) of the RTI Act 2005. The penalty was imposed on Nyori for deliberately defying the orders of the Commission to furnish details to one Toko Sera who in an appeal sought information which, was in public domain, an official release said here today.   19. In my recent RTI application the PIO asked me to deposit Rs. 699/- as photocopy charges which I paid through a bank draft. The PIO then send me the reply of all the questions that I have asked in RTI application. He also mentioned in the letter that he has received the photocopy charges and that the department concerned is being informed to send the photocopies directly to me. When I did not received the photocopies even after one month, I filed my first appeal to FAA. Today when I appeared before the FAA he asked me the proof of my payment for the photocopies. When I told him that I have send a Bank Draft by speed post along with the covering letter (I produced the covering letter) he asked me to prove if that bank draft was actually enclosed with the letter. When I replied that this information can be obtained only from the bank concerned he asked me the counter foil of the Bank Draft !! I was surprised at his question and informed him that a bank draft do not have any counter foil, he told me that I should have deposited the amount at treasury and get a receipt or should prove that the bank draft was actually received by his department. At this point I flashed him the acknowedgement receipt from his own department and he has to agree that his department has received the bank draft. In this case I was fortunate that I had an acknowlegement from the department, but what would have happened had there been no such receipt with me ? How you can prove that you actually sent a bank draft along with your application ? Bank can only prove only if the bank draft has been encashed by the department. What to do if it is not encashed ? A discuss on this matter will help all the mebers.
  20. Hi All, I have few queries , kindly guide me for the same. 1. The website of certain Government departments do not have PIO details and in some cases it shows error message. What is the alternative way to find out the detail of PIO of any particular department. 2. In certain cases , PIO gets transferred or retired and the RTI application is rejected. I have few applications which were not accpeted by the concerned department mentioning that the concerned person has been transferred on my application envelope itself. 3. In few cases my RTI application was not accepted and was returned back without mentioning any reason. How to put someone liable in such case when the application itself was returned back? 4. I have sent a application to Kulti Municipal Corporation and in the response they mentioned that the concerned person has to be personally available at their office on the prescribed date and time to collect the information , are they authorised to do so???

Dear Member, I wish to File a RTI in Sales Tax Department of Karnataka, seeking some information regarding the registered dealers, but I don't have the proper knowledge for the same and I have a confusion (Given Below) regarding filling of the application also. 1. The sales Tax of Each State is further divided into Ward/Circle etc. So to seek information, Should I file RTI to the Head office or to wards/Circles? Kindly guide me for the same and oblige.   22. Pl. let us know how to proceed in such cases? Have to move to High Court first to get the orders for reconstitution of missing records and then again confront the CIC with High Court"s order to that effect. In short, how should one go about constructing such case to get the requested records claimed 'missing' by the P.I.O of a Public Authority and the FAA and the CIC both condoning the callously casual attitude of the P.I.O in withholding the records and the information claiming them to be missing. As there are so many cases of this type it will help lot of information seekers who have thus been cheated by PIOs who claimed non availability of the requested records with impunity and the CIC condoning their act. I can cite at least four such cases. It will be of much help if the whole procedure is described in detail for our information and taking necessary action, when confronted with such a situation-SANJOG MAHESHWARI
  23. Dear Team 1. I have filed an RTI with the Department of Urban Local Bodies on 19 Sep 2013. 2. The same RTI was transferred under section 5(4)(5) by the PIO of Department of Urban Local Bodies to the PIO of Municipal Council, Rewari. 3. I am reading a previous post of J.P Sir (26 May 2010 at 11.40am) :- Applicants are facing a situation when PIO transfers application to other PIO within the same public authority and advises applicant to collect the same from that PIO. Under these circumstances, while filing first appeal following paragraphs should be quoted. A] As per sub sections 4 and 5 of section 5 of RTI Act PIO to whom application is submitted is duty bound to collect information from any source within the public authority and to supply to the applicant. Transfer of RTI application within public authority is against provisions of RTI Act. B] PIO has also violated directives issued by Government of India Department of Personnel & Training, North Block, New Delhi as contained in its notification No.1/14/2008-IR dated 28-07-08, which deals with transfer of applications. C] CIC has been quoted as under in judgement pronounced on 02.09.2009 by HIGH COURT OF DELHI in W.P. © 288/2009 CPIO, SUPREME COURT OF INDIA, versus SUBHASH CHANDRA AGARWAL & ANR [Judges’ assets case] “23. In view of this, the question of transferring an application under Section 6(3) of the Right to Information Act by the CPIO of the Supreme Court cannot arise. It is the duty of the CPIO to obtain the information that is held by or available with the public authority. Each of the sections or department of a public Authority cannot be treated as a separate or distinct public authority. If any information is available with one section or the department, it shall be deemed to be available with the Public Authority as one single entity CPIO cannot take a view contrary to this.” Note: I will not advise filing of first appeal, if you get proper information even when application is wrongly transferred. Above paragraphs can be highlighted only when filing first/second appeal for non-receipt of reply or incomplete reply. 4. Also please find the attached copy where in it is clearly mentioned that :- 2. According to the Act, it is the responsibility of the officer who is designated as the PIO by the public authority to provide information to the applicant or reject the application for any reasons specified in sections 8 and 9 of the Act. The Act enables the PIO to seek assistanc~ of any other officer to enable him to provide information to the information seeker, but it does not give him authority to designate any other officer as PIO and direct him to send reply to the applicant. The import of sub-section (5) of section 5 is that, if the officer whose assistance is sought by the PIa, does not render necessary help to him, the Information Commission may impose penalty on such officer or recommend disciplinary action against him the same way as the Comm Sir, please refer the attached copy of the circular, As per the act, I understand that the PIO can seek assistance of any other officer to enable him to provide information to the information seeker, but it does not give him authority to designate any other officer as PIO and direct him to send reply to the applicant.   24. Hi all, I am seeking information from Income Tax Deptt. Dehradoon. I have already checked Income Tax Deptt website but I am unable to find the name and designation of CPIO for the same. Please help me finding the CPIO for the Income Tax Deptt. Dehradoon. Also, since Income Tax Deptt. is under Central Ministry, do they have only one PIO or different PIOs for different states?

    Delay Tactics by PIO

    I submitted an RTI application to the PIO along with the fees giving full name and contact details including postal address, e-mail, office and residential phone numbers and mobile number. As I did not receive the information within 30 days I filed the first appeal for deemed refusal with the Appellate Authority. I have not received any communication from the Appellate Authority though more than 30 days have passed. Suddenly I received a letter from the PIO [appears to be a backdated letter] that my application cannot be processed as I had not submitted "Proof of Identity". At no place in the RTI Act 2005 does it say that the applicant has to submit Proof of Identity. Only contact details are required to be mentioned in the application which I have fully given. It appears that the PIO is employing delay tactics and trying to deny me the information. What should I do? Since more than 60 days have passed since receipt of the application by the PIO and the Appellate Authority has not responded for more than 30 days after the first appeal should I file a second appeal with the CIC for deemed refusal? Or should I send "Proof of Identity" to the PIO, set the clock backward and bear further delay? If yes, what Proof of Identity should I send? Is the PIO justified in asking Proof of Identity after so much time or is he just employing delay tactics? Should I make a complaint to the CIC?
