  1. On 14.03.2018 a complaint was filed under RTI Act,2005 with CIC under section 20(1), on the grounds that the CPIO did not provide the information despite the orders of FAA. During the hearing the respondent CPIO of PMO office submitted that information had been provided to complainant vide letter dated 01.03.2018 through speed post. Whereas, the information wasn't received by me and after having hearing submission of both the parties and persuing the records the commission directs the respondent to resend the letter dated 01.03.2018 alongwith the proof of its dispatch including tracking number to the complainant within two weeks. Furthermore my complaint have been disposed of. The CPIO of PMO has coplience the orders of CIC and now I received the information alongwith proof of dispatch on 05.07.2019. Since the copy of reply furnished by CPIO of PMO is unprincipled and immature, & very much fishy. Therefore, expert advice is needed on the following issues 1. Can I still file my appeal against the reply of CPIO of PMO in the event of disposed of my complaint in CIC orders. For your convenience I am enclosing the CIC orders. .CIC Order on PMO CPIO

[h=1]PMO declines information on people meeting Modi[/h] The Prime Minister's Office has refused to reveal to an RTI applicant the information about people who had sought an appointment to meet Prime Minister Narendra Modi, saying this would be prejudicial to the country's security and integrity. Rohit Kumar who had sought the information under the Right to Information Act termed the answer "ridiculous", and said he would appeal. The chief public information officer (CPIO) in the PMO in response to the RTI query by Rohit Kumar - a third-year student of Kalinga Institute of Industrial Technology in Odisha - cited concerns for the sovereignty, integrity, security and the strategic interest to hold back the information sought by him. The prime minister meets people both formally and informally in connection with the functioning of the government and other issues and revealing this information may have "prejudicial effect on the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the state and relations with foreign states, as well as confidential third party information," the PMO said in its reply. Declining the information, it said, "...there may be instances of such meeting being exempt from disclosure of information under Sections 8(1) and 11 of the Right to Information Act." "Sometimes, persons meeting even request the very fact of the meeting having taken place be kept secret," it said in response to Rohit Kumar's query seeking details of individuals whose request for appointment was granted and who had met the prime minister and how many of those were from a business background. A disappointed Rohit Kumar said: "It is ridiculous. How the sovereignty, security, unity and integrity of the country is threatened by the disclosure of information about the people who had met or meet the prime minister upon the grant of the request for the same?" He told IANS in an email that he would file an appeal challenging the refusal of information. "This is indeed an unfortunate era going on for all the activists. All the rights-based laws are being questioned like MGNREGA, RTI Act, Land Acquisition Act etc." "The PMO has become the biggest rejector of RTI applications. So, this type of blatant opaqueness in the governance process is a huge threat to the democratic structure of the nation," he said. He also noted that it was not just the PMO which was declining requests for information sought under the RTI but all the departments under the present government were likewise stonewalling information. It refers to a much-delayed RTI response received from Prime Minister's Office (PMO) wherein PMO, even after intervention of first Appellate Authority, has declined having any file-notings/correspondence on disabling PMO's public email ID pmosb@pmo.nic.in. The Prime Minister's Office has refused to disclose details of correspondence between Narendra Modi as Gujarat Chief Minister and then PM Atal Behari Vajpayee during the 2002 Gujarat riots, saying "concerned third parties" have said the same is of "confidential nature" and will have the effect of impending the ongoing inquiry, investigation and trial in the 2002 riots. The Prime Minister's Office is among the top public authorities to have rejected the maximum number of RTI applications received by them during 2013-14, according to an annual CIC report released on Wednesday. The top slot in the list is taken by Ministry of Corporate Affairs which has rejected 28.85 per cent RTI applications received during 2013-14 followed by the PMO (20.49 per cent) and Ministry of Finance (19.16 per cent). Following them closely are ministries of Power and Home, Cabinet Secretariat, ministries of Personnel and Defence, President's Secretariat, Ministries of Housing and Petroleum and Natural Gas. The data for 2013-14 shows slight change as for the previous three years, Finance Ministry topped the list of public authorities rejecting highest number of RTI applications received by it. Another trend mentioned by the transparency watchdog in its report is that the public authorities are rejecting the RTI applications citing reasons which are other than those listed out in the RTI Act. An RTI application can only be rejected under categories listed out in sections 8, 9, 11, and 24 of the RTI Act which gives various provisions under which information can be denied to an applicant. The analysis by the CIC shows a whopping 44 per cent of RTI applications being rejected by the public authorities in 2013-14 citing reasons as "others" and not giving any of the reasons in the RTI Act for rejecting the requests for information. "This calls for scrutiny and introspection by public authorities to ascertain the reason(s) for rejecting requests for information on the ground instead of judiciously applying provisions of Section 8(1), 9, 11 and 24 of the RTI Act," the report says.

The details of assets and liabilities of the union council of ministers has been available online since 2010. The Prime Minister has no power to declassify secret files relating to the mysterious disappearance of Netaji Subhas Chandra Bose, the Prime Minister’s Office said in an RTI reply. “There are no mentions in Manual of Office Procedure or Public Records Rules, 1997, regarding any discretionary power vested in PM to de-classify records,” the PMO said.   9. Prime Minister Narendra Modi’s foreign visits have been the talk of the town ever since he became the country’s PM in May 2014. While he has managed to win over the hearts of a few, there are many who wonder how much of the common man’s hard-earned money has been used to sponsor these trips. Mumbai resident Mansoor Darvesh filed a Right to Information (RTI) plea on December 24, 2014 demanding to know the number of foreign visits Modi has made from May 2014 to November 30, 2014, the delegates who have accompanied him and the amount spent on these trips.     Hi all, I have been using rti since quite some time and have been sending letters to different departments. Today I Recieved a call who said he is from PMO office and was asking me why I have been sending rti to public distribution department. As per him show cause notice is being issued against me for sending rti queries and was indirectly threatening. I am not disclosing the number here due to obvious reasons. Can anyone throw more light onto it and guide what should be my course of action now.

In April last year, applicant retired Commodore Lokesh Batra was refused disclosure of steps taken by the Prime Minister's Office to proactively part with information as mandated under the RTI Act.
